Attachment "A", paragraphs 7(d) and secfiion 11 Development regularions include, vnthout
lmutation, the County Zomng Code, the State Environmental Pohcy Act (SEPA) and the
County's Local Envuonmental Orduiance (chapter 11 10 of Spokane Counfiy Code)
The County Zomng Code references change of conditions apphcations, but does not

amend.ments to the Code based on any one of six (6) grounds, vinthout difterenhating between
amendments to the zomng text of the code and amendments to the official zonuig map Zonung
Code 14 402 020(1) authonzes the Code to be amended if rt is " consistent wnth the
Comprehensive Plan and is not detrlmental to the pubhc welfare " Zoiung Code

Zoiung Code 14100 104 states that Code provisions sha11 be interpreted to carry out and
unplenment the purpose and intent of the Comprehensive Plan, and the general plans for physical
development adopted by the Board of Counfiy Comnaissioners Zonung Code 14100106 states
that when the Zoning Code conflicts wrth the Comprehensive Plan or other adopted plans and
regulations of the County or other regulatory agencies, the more restnchve provisions shall
govem to the extent legally pernussible and the Zonuig Code provisions will be met as a
nunumum The Comprehensive Plan itself indicates that it should be used as a reference source
and guide for maiang land use decisions See Comprehensrve Plan, p 2 The "decision
guidelines" set forth in the respechve sections of the Plan are to be used as a guide to deteanine
whether or not a pazticular proposal should be approved, condztioned or deued
In considenrig a rezone apphcation, Washvagton case law generally pmvides tha.t (1) there
is no presumption in favor of the rezone, (2) the apphcant for the rezone must prove that
condztions have substantiaUy changed in the area suice the last zoiung of the properiy, and (3) the
rezone proposal must bear a substanrial relahonship to the pubhc health, safety or welfare
Parkndge v Seattle, 98 Wn 2d 454, 462 (1978), and Bjarnson v Kttsap County, 78 Wn App
840 (1995)
General conformance wlth a comprehensive plan is usually reqwred before a rezone can be
approved. Citizens for Mount Yernon v City of Mount Vernon, 133 Wn 2d 861, 873 (1997),
Cathcart v Snohomi.sh County, 96 Wn 2d 201, 211-12 (198 1) Some cases have dispensed vcnth
the changed cn-cumstances requirement where the rezone closely unplemented the pohcies of the
comprehensive plan Bjarnson v Kitsap County, supra , Save Our Rural Environment v
Snohorntsh County, 99 Wn 2d 363, 370-371(1983), and Tugwell v Ktthtas County, 90 Wn App

Washington case law indicates that where a comprehensive plan confltcts vcnth zonuig
regulahons, the provisions of the zozung code vnll usually prevail See Weyerhaeuser v Fierce
County, 124 Wn.2d 26, 43 (1994), and Cougar Mt Assocs v Krng County, I11 Wn 2d 742, 755-
57 (1988), and Nagatani Bros v Commzssioners,108 Wn 2d 477,480 (1987)
A change of condirions is not a rezone, because it does not change the actual zone of the
property However, a change of condihons apphcafaon may significantly affect condihons of
approval, as well as the permitted uses, locahon of bwlduigs, landscaping, condztons of approval
and other features in a site development plan, approved in conjuncrion with a pnor rezone The
changed candition apphcation should be justified by the same changes that supported the onginal
rezone, as modified by any more recent changes in the area.

A change of conditcons is reqwred for the project, since the project seeks to change some of
the condztions of approval for the 1980 rezone of the site See Zomng Code 14 504 040, and
Hearing Examiner Committee decision dated 8-8-80 in Ffle No ZE-101-80
The site Ls designated in the Urban category of the Comprehensive Plan. The Urban
category is intended to provide for the opportunrty for development of a"city like" envuonment
It is pnmanly a residential category of single-family, two-fanuly, multifamily and condominium
builclvags, along Rnth neighborhood commercial, hght industnal, pubhc and recreational
facihries The more intensrve land uses in the Urban category, such as hght industrial and
neighborhood commercial uses, will be located near the heavily traveled streets, wlule the least
intensive single-family uses will be isolated from the noise and heavy traffic The Urban
category is charactenzed by a hiigh level of pubhc services and famlities, and modern u1thty
systems See Comprehensive Plan, Section 1
The Urban category encourages urban development in areas havuig adequate power
supphes, water, sarutary and storm sewers, and school and fire services, provided that other
relevarit pohcies of the Comprehensive Plan are met Decision Guzdeluies 111 and 13 3
Pubhc sewering is strongly encouraged Decision Guidehne 13 3 Decision Guxdehne 1 61
recommends that land use pmposals conform to County sewer and transportation plans, poucies
and regulations, and take steps to resolve sigiuficant adverse unpacts on pubhc utiIifiy systems
and roads
The Urban category indicates that new development should be buffered from existing
adj acent land uses where adverse effects may develop, using buffenng and/or laadscaping to
nutigate the difference between proposed development and existmg uses See Decision
Guideluie 15 1 Residenhal areas are discouraged in lugh noise areas, such as in the vlcuuty of
freeways
The Transportation sechon of the Comprehensive P1an contazns the County Artenal Road
Plan and transportation pohcies for the County road network. The Transportation section
vndicates that retail, wholesale and mdustnal land uses requinng fi-equent truck dehvenes should
be situated to have due,ct access to officially designated truck routes Local Access roads are to
designed to provide access to abutting property and to dehver traffc to artenals
The Light Industnal(I-2) zone is intended to meet the needs for industnal land identified in
the Industrial category of the Comprehensive Plan, of a hght industnal nature It is not intended
to unplement the Urban category The existing use on the site is a pubhc sewer Iift station This
appears to meet the definihon of a"pubhc utthty transmission facffity", as defined by Zomng
Code 14 300100 Such use is a permitted use m the I-2 zone, subject to the special development
standanis of the I-2 zone hsted in Se,ction 14 632 210 (1) of the Zomng Code, and the general
development standards of the Zomng Code Such use is pernutted under the same condihons in
the UR 3 5 zone See Zomng Code 14 616 210 (2)

The change in use for the sewer pump stahon use on the site was apparently allowed on the
rezone site since rt would have less unpacts and intensity than the previous warehouse use
approved m 1980 See Zomng Code 14 504 040 (2)(5) To assure pre.servation of nearby
residential areas, County Enguieeruig condition #6 of the 1980 rezone prolubited access to Ella
Road Zomng Admmistrator con(zhon #8 of the 1980 rezone specifically limited access to Park
Road
County Uhhhes currently has to access through the adjoining warehouse property to get to
and from the site The Ella Road access would a11ow such agency an alternative access, and also
facihtate access for a large "vactor truck" through the site The environmental checklist
submrtted for the project indzcates that the current use on the site is lunited to one dazly tnp by a
County pick-up, and one large County "vactor" truck wluch would visit the srte 3-4 times a year
The checklist also indlcates that Ella Road will receive a new asphalt and base matenal m the
new future The project will accordvagly have a minimal unpact on Ella Road
The site plan of record bnngs the existing use into comphance vnth the reqwirements of the
I-2 zone for the existing use on the ute This repre.sents an unprovement over the status quo, and
makes the site more consistent wnth the Urban category of the Comprehensive Plan. Residential
use of the srte is discouraged, considenng rts proxuYUty to Intersta.te-90 The site has converuent
access to the maJor aztenal systems in the area, and to I-90
Some neighboring property owners tesrified at the pubhc heanng in opposition to the
project, based on concerns that the industnal user to the west would try to access via Ella Road
The warehouse use on the remauung 7 acres of the ongmal rezone would not be aUowed to use
the Ella Road access, wluch would be controlled by a locking gate Access should be restncted
to Ella Road for any industnal or commercial use of the site, not includuig the cuzrent use The
Exanuner has shghtly modified the Buildmg and Planiung and Counfiy Engineeruig condztions to
ensure that rt restncts commercial as well as industnal access to Ella Road from the srte
No deficiencies wrth regard to the abihty of the project to comply wrth development
regularions have been estabhshed in the record The proJect has been conditioned for comphance
vvith the development standards of the I-2 zone and other apphcable provisions of the County
Zomng Code, and the recommendations of the comtnenting pubhc agencies The project
generaily conforms vnth the Comprehensive Plan
No pubhc agencies objected to the DNS issued for the proposal by the County Division of
Building and Pla.nning The proposal will not have more than a moderate effect on the quality of
the envuonment, and the Examiner concurs vcnth issuance of the DNS The procedural
requirements of chapter 43 21 C RCW and chapter 11 10 of the Spokane County Code have been
met

In applyuig the changed cucumstances test, courts have looked at a vanety of factors,
including changed pubhc opuuon, changes m land use patterns in the area of the rezone proposal,
and changes on the property itself The Zomng Code references changes in "economic,

technological or land ttse conditions" as factors that will support a rezone Spokane County
Zoning Code Section 14 402 020 (2) Washuigton courts have not requued a"strong" showing
of change The rule is flexlble, and each case is to be judged on its own facts Bassant v County
Commustoners, 70 Wn App 389,394 (1993)
As stated previously, recent cases have held that changed circumstauces are not requlred if
the proposed rezone unplements pohcies of a comprehensive plan The Examiner concluded
above that the project generally conforms with the Comprehensive Plan
The current apphcation is jushfied under the changed conditions that supported the onginal
rezone, as modzfied by changes in the area that have taken place since such rezone was granted in
June,1987 Such changes include the changes on the site itselt wluch have substituted a pubhc
utihty tarransmission facihty for the previous industnal use
TV DECISION
Based on the above Fmduigs of Fact and Conclusions, the apphcation for a change of
conchtions to the srte development plan and certain conchtions of approval attached to the 1980
rezone of the site is hereby approved, subject to the conditions of approval of pubhc agencies
stated below Any conchtions of such agencies which have been added or sigzuficaatly revised
by the Heartng Examiner aze italicized
Failure to comply anth the conchtions of this approval may result in revocation of this
approval by the Hearmg Exammer This approval does not wazve the apphcant's obhgation to

SPOKANE COUNTY DIVISION OF BIJII,DING AND PLANNING
1 The proposal shall comply anth Sechon 14 632 210 (1) of the Light Industnal (I-2) zone,
and other apphcable provinons of the I-2 zone and the Spokane County Zoxung Code as amended.
2 The apphcant shall develop the subject property m accord wnth the site plan of record
subnutted on February 7,1997 Vanahons, when approved by the Division Duector/designee, may
only be pernutted under Section 14 504 040 of the Spokane County Zorung Code, and to comply
wrth apphcable development regulations and conchtions of approval The onginal intent of the
development plans shall be mawtanaed
3 The Divislon of Builduig and Plannulg shall prepare and record with the Spokane Counfiy
Auditor a Title Notice notuig that the property in question is subject to a vanety of special
condihons unposed as a result of approval of a land use action This Trtle Nohce shall serve as
pubuc nohce of the conchtions of approval affecting the property in queshon. The Title Nobce
should be recorded withun the same time frame as allowed for an appeal and shall only be
released, m full or m part, by the Spokane County Division of Biulduig Plazuung The Trtle

Study The method of sewage disposal is subject to approval of
the Director of Utilities pursuant to County Resolution 80-0418
adopted March 24, 1980 The topography and soils in the area
are generalfy suitable for use af individual on-site sewage
systems The lot is of the proper dimensions to permit use of
both an individual wetl and sewage system a public water well
(WWP) is located adjacent to the west end of the project
2 Recommendations
a) The use of individuai wells js not authot^ized
b) Subject to speciftc applicatron approval and issuance of permits
by the Nealth Officer, the use of indivtdual on-site sewage

action of the Responstble Administrative Body and be completed before
any site improvements are made

plan for the appraved area prior to installation of such Iighting
(Such plan shall attempt to confine illumination to the area with full
consideratton to adjacent 13roperties)
2 No free-standing sign on the premises shali exceed forty (40) square
feet in area or thirty-five (35) feet in height All signs may be
illuminated provrded that they shall not be animated nor flashing and
shall be of low intensity, not exceeding the equrvalent of four hundred
twenty-five (425) milliamperes flourescent tubing behind plexiface,
spaced on seven (7) inch or more centers, or of exposed neon not
exceeding thirty (30) milliamperes

the proposed vacation of BOONE AVENUE, proceedings for which were initiated by Lyle L
Johnson and others, and it appearing to the Board on proof duly made that notice of the
hearing was published and posted in the manner and for the time required by law, and the
Baard after examining al1 claims and all maps and papers on file and after hearing the
evidence adduced at the hearing and it appearing that the hereinafter described road
