review vf the zone reclassification application and the entue record, hereby makes the following
findings of fact, conclusions of law and decision
I FINDANGS OF ]FACT
1 The application requests a rezone of approximately 27,060 square feet from the Urban
Residen#ial-3 5(UR-3 5) zone to the Light Industnal (I-2) zone, for those uses permitted in the
I-2 zone
2 The site is generally located west of and adjacent to Ella Road, approxunately 150 feet
north of the intersection of Ella Road and Boone Avenue, and south of and adjacent to Interstate
94, in the NW '/4 of Section 18, Township 25 North, Range 44 EWM, Spokane County,
Wash.ington
3 The site is currently referenced as a portion of County Assessor's tax parcei no
45182 9002 The subject property is legally descnbed in File No ZE-04-02
4 The applicant for the proposal and the site owner is Leslie Penn 1303 Narth Ella Road,
Spokane, WA 99212
5 The Heanng Exa.nvner heard the application pursuant to the County Hearm.g Exarnlner

on May 7, 2002
9 The Hearing Examiner takes notice of the GMA Comprehensive Plan and Capital Facilities
Plan, Phase I Development Regulations, County Resolution Nos 1-1033 and 2-0037, County
Artenal Road Plan maps, County official zoning maps, County Zorung Code, County Code, other
applicable development regulations, and pnor land use decisions in the viciruty

11 The site is approximately 62 acre in size, irregular in shape, relatively flat in topography
The site is improved with a single-family dwelling, which fronts along Ella Road The site is
vegetated with grasses and small trees and shrubs The subject property represents a portion of a
2 63-acre parcel of land owned by the applicant, the remauider of which abuts the site on the
west
12 Effective January 1, 1991, the zorung of the site was reclassified from the Agncultural
Suburban zone of the now expired County Zoning Ordinance to the Urban Residential-3 5
(UR-3 5) zone, under the Program to Implement the Spokane County Zoiung Code The site is
also located in the Aquifer Sensihve Overlay zone and the Public Transit Benefit Area designated
by the Zorung Code
13 The current rezone application and other documents necessary to make the application
complete were submitted on March 15, 2002
14 The site plan of record submitted on March 15, 2002 does not propose a specific site
development plan or uses The site illustrates access through the current site for the existing
industnal shop located on adjacent land to the west, wluch is owned by the current applicant
Approval of the rezone will allow legal access to Ella Road for such industnal use
15 Effective January 15, 2002, the County implemented a new Comprehensive Plan ( GMA
Comprehensive Plan"), County Urban Growth Area (UGA) boundanes, and Phase I
Development Regulations, all in implementation of the State Growth Management Act The
County also repealed the intenm development regulations previously adopted by the County
under the State Growth Management Act See County Resolution No 2-0037
16 The site and nearby land to the south and west are designated in the Light Industnal
category of the GMA Comprehensive Plan The only implementing zone for such category under
the Phase I Development Regulations is the I-2 zone The land 1}ring east and southeast of the

site is designated in the Low Densrty Residential category The site and area are designated in
the UGA
17 The land l}nng east and southeast of the site across Ella Road consists of a smgle-family
residentiai dwelling area zoned UR-3 5 The remainder of the parcel that includes the current
site abuts the srte on the west, is zoned I-2 and is developed with an industnal-type workshop
bullding The parcel of Iand 1}nng directly south of the site is undeveloped and zoned UR-3 5
The remaining land located near the site to the west and southwest is zoned I-2 and is
undeveloped Further to the south is found Centennial Mddle School, on land zoned UR-3 5
18 Neighbonng property owners did not comment on the proposal No opposition to the
project was expressed by public agencies
19 The Staff Report sets forth applicable policles of the GMA Camprehenslve Plan, and finds
the proposal to be consistent with such policies and the purpose and intent of the 12 zone The
Examiner agrees wrth such analysis and hereby adopts and incorporates such analysis by
reference as findings of fact herem
24 Sigiuficant changes have occurred in the area since the site was zoned UR-3 5 in 1991
This includes the availabihty of public sewer to the subaect property, adoptian of the GMA
Comprehensive Plan and Phase I Development Regulatians, and designation of the slte in the
County UGA
21 The project has been conditivned for compliance with the development standards of the I-2
zone and other applicable provisions of the County Zoning Code, and the recommendations of
the commenting public agencies
Based on the above findings vf fact the Heanng Exanuner enters the following
II CONCg.,USIONS OF LAW
1 The proposed rezone, as conditioned, generally conforms to the Comprehensive PIan
2 The proposed rezone bears a substantral relationship and w111 not be detrimental, to the
public health, safety or welfare
3 A change in economlc, technological, or land use eonditions has occurred to warrant the
prvposed rezone, and a substan.tial change of cucumstances has oceurred in the area since the site
was last zoned
4 The procedural reyuuements of the State Environmental Policy Act and the Cvunty s Local
Envu-onmental Qrdinance have been met The proposal, as condltioned, will not have a
slgnificant, probable adverse impact on the environment
5 The proposed rezone meets the cntena established by Washington case Iaw for approving a
rezone, and the cntena established in paragraphs 14 402 020 (I)(2) of the County Zoning Cvde
for amending the County official zorung map

6 Approval of the land use application is appropnate under Section 11 of the County Heanng
Examiner Ordinance, adopted by County Resolution No 96-0171
III DECISION
Based on the above Findings of Fact and Conclusions of Law, the application for a rezone
from the Urban Residential-3 5(UR-3 5) zone to the Light Industnal (I-2) zone, for those uses
developed in the I-2 zone, is hereby approved, subJect to the conditions of approval of the public
agencies stated below
Any conditions of such agencies that have been added or sigruficantly revised by the
Heanng Examiner are atalicized
Faulure to comply with the conditions of this approval may result in revocation of this
approval by the Heanng Examiner This approval does not waive the apphcant's obligation to
comply with all other requirements of other agencies with junsdiction
SPOKANE COUNTY I)IVISION OF PLANNING
1 All conditions imposed by tbe Hearing Examiner shall be binding on the Applicant
which term shall include the owners and developers of the property, and their heirs, assigns and
successors
2 The proposal shall comply with the Light Industnal (I-2) zone, the Aquifer Sensitive
Overlay zone, and all other applicable provisions of the Spokane County Zorung Code, as
amended
3 A detalled site development plan shall be submitted to the County Division of Planrung for
review and approval pnor to issuance of any building pernut on the property Any site
plan/development proposal sball be reviewed for compliance with the Conditions of Approval
imposed by the Heanng Examiner All vanations must confornz to regulations set forth in the
Spokane County Zorung Code and the condrtions of approval
4 Approval is required from the Director of the Division of Planning/designee of a specific
illumination and signage plan for the descnbed property pnor to the release of any building
permit
5 The Division of Planning shall file with the Spokane County Auditor, within the same time
frame as allowed for an appeal from the final disposition, including lapsing of appeal penod, a
Title Notice, which shall generally provide as follows
"Pnor to the issuance of any building permit for any building or any use on the property
descnbed herein, the applicant shall be responsible for complying with the provisions of the
Zorung Code for Spokane County, Sectlon 14 706 (Aquifer Sensitive Area Overlay Zone) The

3 A Professional Engineer (P E), Iicensed in the State of Washington, shall submit road and
storm drainage constructlon plans and a drainage report fhat confonn to tlae verslons of the
Spokane County Standards for Road and Sewer Constructlon, the Guidelines for Stormwater
Management, and all applicable federat, state, and local regulations and laws that are in effect at
the tirne of the plan submittal or at the tune of the development permlt application{s} The final
road and storm drainage plans and drainage report shall receive the County Eng7neer's acceptance
pnor to release of any Grading, Buildzng, or Right-of-Way Permits

4 A parking plan and traffic circulation plan shall be submitted and approved by the Spokane
County Engineer The design, locahon and arrangement of parkuzg stalls shall be in accordance
with standard engineenng practices Paving or surfacing as approved by the County Engineer will
be required for any portion of the project which is to be occupied or traveled by vehicles
5 The construction of the roadway improvements stated herein shall be accomplished as
approved by the Spokane County Engineer
6 The County Engineer has designated a Local Access Roadway Section for the improvement
of Ella Road wluch is adjacent to the proposed development Tlus will require varying amounts
of asphalt to construct a cul-de-sac at the terminus of Ella Road Curbing and sidewalk must also
be constructed
7 All required improvements shall conform to the current State of Waslungton Standard
Specifications for Road and Bndge construction and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer
8 Roadway standards, typical roadway sections and drainage plan reyuirements are found in
Spokane County Resolution No 1-0298 as amended and are applicable to this proposal
9 No construction work is to be performed within the existulg or proposed nght of way until ~
a permit has been issued by the County Englneer All work within the public road nght of way is
subject to inspection and approval by the County Engineer
10 All required construction witrun the existing or proposed public nght of way is to be
completed pnor to the release of a building permit or a bond in an amount estimated by the
County Engineer to cover the cost of construction or improvements shall be filed with the County
Engineer
11 The applicant is advised that there may exist utilities either underground or overhead
affecting the applicant's property, including property to be dedicated or set aside future
acquisition Spokane County will assume no financial obligation for adjustments or relocation
regarding tbese utilities The applicant should contact the applicable utilities regarding
responsibihty for adjustment or relocation costs and to make arrangements for any necessary
work
12 The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards
13 Tlus proposed zone change is not being requested for a specific development proposal or
site plan at thls time At such time a site plan is submitted for review, the applicant shall submit
detailed traffic information for review by the County Engmeer to deternune what traffic impacts,
if any, that the development would have on surrounding infrastructure The applicant is advised
that rrutigation maybe required for off-site improvements

certificate shall be issued in accordance with the Phase 1 Development Regulations adopted by

use and/or expansion, additional faeilities may also need to be connected Commercial

2 The applicant shall submlt expressly to Spokane County Division of Utilities, under
separate cover", only those plan sheets showing sewer plans and specifications for the public

3 Sewer plans acceptable to the Division of Utilities shall be submitted pnor to the issuance

consistency with the new Comprehensive Plan The proposai is located in the Light Industrial Category
The Light Industry category is intended for mdustrial areas that have a special emphasis and attention given
to aesthetics landscaping and internal and community compatibility Light Industry areas are comprised of
predommantly industnai uses but may incorporate office and commercial uses that support and compliment
the industrial area The Light Industry category may serve as a transitional category between heavy
industnal areas and other less intensive land use categones The category may also serve as a visual
buffer for heavy mdustnal areas adJacent to aesthetic corridors The proposal as conditioned is consistent
with the purpose of the Light Industrial category The conditions of approval require all development comply
with the standards of the Spokane County Zoning Code to include such land uses mitigation requirements

police and fire protection services and in consideration of existing adjacent industrial zoning and land uses,

reclassification is generally c,onsistent with the purpose and intent of the Light Industrial (I-2) zone
The applicant is asking for zone reclassification that allows for the development of any use permitted in the
I-2 Zone Therefore this analysis does not address consistency of the proposal with the specific standards
of the I-2 Zone Consistency will be determined by the Division of Planning when buiiding permit
applications are submitted
Changeci Conditions Section 14 402 020(2) of the Spokane County Zoning Code states that
amendments to the zoning map may occur when it is found that changes in economic technological or
land use conditions has occurred to warrant modifications Conditions have changed in the area of the
proposal Spokane County adopted a new Comprehenswe Plan effective January 15 2002 that changed
the designation of the subject site and adjacent property south and west of the proposal from Urban to Light
Industrial This section also contemplates that sennce infrastructure enhancement has occurred in the
vicinity supporting more intensive uses and further that a trend in the development of more mtensive land
uses has begun justifying additional zone reclassifications Property southwest of the subject site has been
developed into a combination contractor's yard and spec storage building complex between 1992 an d 2001
The proposal is consistent with the intent and spint of said Section 14 402 020(2)

6 The County Engineer has designated a Local Access Roadway Section for the improvement of
Ella Road which is adjacent to the proposed development This will require varying amounts of
asphalt to construct a cul-de-sac at the terminus of Ella Road Curbing and sidewalk must also
be constructed
7 All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bridge construction and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer
8 Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane Board of County Commissioners resolution 'i -0298 as amended and are applicable to
this proposal
9 No constructson work is to be performed within the existing or proposed right of way until a
permit has been issued by the County Engineer All work within the public road right of way is
