A. INTRODUCTION ~
This matter having come before the Zoning Hearrng Examiner Committee on
July 1, 1981, and the members of the Committee present being Phillip D. Harri s, Chai rman, and Gary Anderberg and John S~. Skadan.
B. PROPOSAL
The sponsor, Dr. Greg Doering, is requesting approval of a zone
reclassification, File No. ZE-29-81, from Agricultural Suburban to Urban
Residential-22 (UR-22} Zone, for the purpose of developing a retirement
cente r and professional offices.
C. FINDINGS OF FACT
1. That the existing land use in the area is single family residences,
new construction, offices, parking, hospital, and open area.
2. That the Comprehensive Plan designates this area as appropriate for Urban development.
3. That the existing zoning of the property described in the application ~

Act} have been complied with, and the Committee concurs with the

STANDARD:
1. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Commi ttee. Vari ations when approved by the Zoni ng Admi ni strator
wi 11 be permi tted, i ncl udi ng, but not 1 imi ted to the fol l owi ng
changes: 6uilding location, landscape plans, and general
allowable uses of the permitted zone. All variations. must
conform to regulations set forth in the ZONING CODE FOR SPOKANE COUNTY. The original intent of the development plans shall be
maintained.
2. The specific development plan will be submitted fo r Planning
Department review and approval prior to i ssuance of bui i di ng
permits.
3. All current standards of the Urban Residential-22 (UR-22) Zone,
as amended, shall be complied with in the development of th~s
si te.
4. Applicant shall comply with 'ZOS' reco~unendations concerning
stormwater runoff and provide necessary landscaping for runoff.
5. Any division of land fo r the purpose of sale, lease o r transfer,
shall comply with RCW 58-11 and the Spokane County Platting
Ordi nances pri o r to i ssuance of bu i 1 di ng pe rmi ts.
SPECIAL:
6. That, pursuant to Section B.Ofi.040~2)(a) of the Spokane County Zoning Code, at least a 20 foot wide landscape strip consisting
of Type III landscape plantings is requjred along the Ve rcle r
road f rontage.

1. Access permi ts for approaches to the County Road System shal l be
obtained from the Spokane County Engineer.
2. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or any portion thereof, if the
development ~s to be phased. .
3. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design,
location, and arrangement of parking stalls shall be in
accordance wi th standard traffi c engi neeri ng practices. Pavi ng
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
4. The construction of the road improvements stated herein shall be
accompl ished as approved by the Spokane County Engineer.

Washington Standard Specifications for Road and Bridge
Construct~on, and other applicable County standa rds and/or
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless

4. Specific location of hydrants shall be determined by the fire
district.
5. Commerci al dumpsters and contai ners wi th an i ndi vi dual capaci ty
of 1.5 cubic yards or greater shall not be stored or placed
within five feet of combustible walls, openings or combustible
roof eave lines.
b. Depending on the extent of existing water mains and hydrant
locations, fire hydrants which meet the minimum fire flow requirements as enumerated in Chapter 6, Title 3 of the Spokane
County Code, may be required to be installed prior to any

1. The applicant shall provide verification from the Fire District

1. Water Purveyor is Modern Electric Water Company, and they will
supply the site with adequate water for domestic, fire and
irrigation uses once specific arrangements are made with the
district.
g~ COUNTY AIR POLLUTION CONTROL AUTNORITY
STANDARD:
1. Air poilution regulations require that dust emissions during
demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or
suspension of activity during ce rtain weather conditions. Naul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud , from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.

Proposal:
A request to rezone an approximate 2.3 acre site fron~ Agricultural
Suburban to Urban Residential-22 (UR-22~ Zone for the purpose of a
retirement center and professional offices.
Location:
The site is generally located east of and adjacent to Vercler Road,
approximateiy 650 feet south of Mission Avenue, and approximately 300
~ feet north of Boone Avenue. in Section 15-25-44, Tax parcel numbers:
15542-1013; and 1014.

The Urban category is basica~ly a land use designation suitable for
residential uses, at various densities, and certain non-residential uses.
Criteria for type and density of a particular development is dependent
upon site specif ic considerations; included are land use and zoning
pattern, location, proximity to arterials, and development trends.

The Comprehensive Plan suggests that measures be considered and required
to insure compatibility between proposed developments and existing or ~
f uture developments. This is especially true in regards to high density
residential or non-residential uses adjacent to low density residential

The Zoning pattern being established in the immediate area,
espec i a l ly to the north and west of the s i te, i s to zones su i tab 1 e
for office and high density residential development. Specific
developments, and therefore the land use pattern, has not progressed
as rapidly as rezones have oc~urred in the area. Mos~ health care,
office, and other medical services are concentrated northwest of this proposal along both sides of Mission Avenue. However, some newer
office construction projects are beginning along the east side of
Yercler Road south of Mission Avenue. The area to the east and
northeast of the proposal is an established single f amily residential
neighborhood. ~
The most recent land use approval in the area is for a 2.3 acre
prelimi~ary plat, Planned Unit Development, and rezone to be known as ~
Vercler Medical Center (File PE-1537-86 and ZE-53-86) located immediately north of~the present proposal. When finalized the
project will consist of six individual lots and buildings, perimeter

' circulation/parking as common area, perimeter landscape strips, and
extensive site aesthetics. Predominant use is expected to be medical
offices. Zoning, when the plat is f i ied, wi 11 be Urban

The current proposed rezone site has had approval for a preliminary
plat and reZOne, known as Yercler Road Professional Park, since 1919

Site Plan Considerations: The applicant proposes development of the
retirement center on the southern 1 acre of the site. The northerly •
portion of the rezone site is not detailed on the s~te plan, however,
it is proposed for future professional off ice development. Pending
development of that northerly portion of the site, a temporary
cul-de~sac would occupy a portion of that undeveloped property to
serve as a turn-around for the retirement center's parking lot.
The proposed retirement center will contain approximately 20
retirement units, a dining area, and a partial second story for an
administrative office and apartment. Parking areas wouid be oriented
westerly of the building towards Vercler Road and northerly of the
building towards the undeveloped portion of the property.
Landscaping is proposed around the building, along Vercler Road, the

Proposed Buffering Techniques: The proposed site development plan

~ 8ufferin~: The proposed design concept, that is offices on the northern
portion of the site with retirement center on the south, is consistent
with the development trend along Vercler Road and is an appropriate ~ buffer design. The higher intensity office and medical services are
found in close proximity to Mission Avenue with a transition, south
along Vercler Road, to lower intensity office uses, and, eventually,
residential uses.
The intent to provide buffering to properties south and east of the

landscaping appears to be in compliance with Spokane County Zoning Code
standards with two exceptions. The site plan indicates a 10 foot wide landscaping strip along the~Vercler Road frontage. However, the Spokane
County Zoning Code requires landscaping along a street in the Urban
Res i dent i a 1-22 ( UR-22 ~ Zone to a depth of 20 feet f rom the f ront
property line. The provision of that landscaping may require that the
park i ng and bu i 1 d i ng de s i gn be ad justed approximate 1y 5 to 10 f eet to
- the east. There appears to be adequate room to accomplish this
modification.
- The second landscape problem is within the parking area along the
northerly side of the retirement center. Some planting will need to be
added to this area to bring it into compliance with the landscaping
standards for parking areas from the Spokane County Zoning Code.
Si~nacle: The site plan indicates a detached sign for the retirement
center located in the planting strip along Vercler Road. Detached signs are allowed in the Urban Residential-22 (UR-22) Zone at a maximum of 15
square feet per side. An attached sign, at a maximum 20 square feet,
would also be allowed.
Circulation/Access: The Spokane County Engineer requires dediCation of
10 feet along Vercler Road with improvements to consist of approximately

An Environmental Checklist was subrnitted by the sponsor and was -
reviewed by the County Planning Department. The review considered
the specif ics of the proposal, other avai lable information, County
ordinances, other regulations and laws, possible standard Conditions -
of Approval, the Generalized Comprehensive Plan, and other County
pol icies and guidel ines. The Zoning Administrator has determined
that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of
Non-Signif icance ( "DNS"
The "DNS" was circulated to ~ine other agencies of jurisdiction and
other agencies/departments affected by the future development for
review and comment. The "ONS" comment period ends June 30~ 1987, and
was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 f eet of the proposal,
and by notice on a sign posted on the proposal site. The Nearing
Examiner Committee may consider additional environmental related

The State Envlronmentel Pallcy Act (SEPA) chapter 43.21C RCW~ requires all governmental agencies to consider the environmencal impacts of a proposal
before making decisions. An Environmental Impact Statemen[ (EIS) must be prepared for all proposals With probable significent adverse impacts on the quelity of the environment. The purpose of thls checklist ie to provide information to help you and the agency identify impacts from your
