Tlus matter conung on for pubhc heanng on September 25, 2002, the Hearuig Examiner,
after review of the zone reclassification apphcation and the entire record, and findmg good cause
therefore, hereby makes the following findings of fact, conclusions of law and decision
I FINDINGS OF FACT
1 The apphcation requests a rezone of 12 acres of land from the Urban Residenhal-3 5(LTR-
3 5) zone and the Urban Residential-22 (UR-22) zone to the Commuruty Busvaess (B-2) zone, for
a pnvate parkulg lot and those uses allowed m the B-2 zone
2 The site is located west of and adjacent to Argonne Road, approximately 310 feet south of
Alki Avenue, in the SE '/a Sechon 18, Townslup 25 N, Range 44 EWM, Spokane County,
Wastungton The site address is 417 N Argonne Rd
3 The srte is currently referenced as County Assessor's tax parcel no 45184 0810 The
subject property is legally descnbed as the South 67 feet of the North Half of Lots 8 and 9, and
the South 67 feet of the North Half of Lot 10, Less Hwy, all m Block 23, Hutchuisons Addition,
as per plat recorded in Book Q, Page 4 of Plats, records of Spokane County Auditor, in Spokane
County, Washington

east half of the site and a proposed parlung lot m the west half of the site The parking lot is
mtended to provide overflow parlang for the office use on the site and the site ovvner's adjacent
developments located to the north
13 Effechve January 1, 1991, the zomng of the east third of the srte and the westerly two-thirds
of the site was reclassified from the zonuig of the site under the now expired County Zorung
Ordinance to the UR-22 zone and UR-3 5 zone, respectively, pursuant to the Program to
Implement the Spokane County Zonuig Code
14 Effechve January 15, 2002, the County unplemented a new comprehensive plan ("GMA
Comprehensive Plan"), Capital Faciuties Plan, County Urban Growth Area (UGA) boundanes,
and Phase I Development Regulations, all pursuant to the State Growth Management Act
(GMA) The County also repealed the intenm development regulahons previously adopted by
the County under the State Grrowth Management Act See County Resoluhon No 2-0037
Minor revisions were made to the Phase I Development Regulations on May 7, 2002 See
County Resolution No 2-0470
15 The Phase I Development Regulations designate the site, the site owner's adjouung land
located to the north, and other land 1}nng adjacent to or near Argonne Road and Mullan Road m
the area, in the Mixed Use category of the Comprehensive Plan Such regulations retauied the
existmg zorung of the site and neighboring properhes The site and neighboring land are
designated in the County UGA The Argonne/Mullan comdor is developed with a mixture of
office and other commercial uses, along with some remaming residenhal uses

16 The Phase I Development Regulahons designate the land lymg west of Mullan Road, west
of the land designated in the Mixed Use category of the GMA Comprehensive Plan, in the Low
Density Residenhal category of the GMA Comprehensive Plan, and retained the UR-3 5 zorung
of such land Such land is dominated by single-family homes This includes the land lymg west
of the srte
17 In 1997, the east half of the parcel of land lying duectly north of the site was rezoned from
the UR-22 zone to the B-2 zone See decision in File No ZE-12-97 Such parcel is currently
zoned entirely B-2, and is under the ownerslup of the current site owner Commercial buzlduigs
are found on the north half of such parcel, and parlang is found on the north half
18 The parcel of land 1}nng immed.iately north of the parcel that abuts tbe site is under the
ownerslup of the current site owner, and is currently zoned UR 3 5 and B-2 The apphcant is
currently seeking to rezone such pazcel entirely to the B-2 zone, to develop a 2-story office building
Parlang for such use would be provided on the south half of the parcel located directly north of the
current site, through a reciprocal parking agreement See File No ZE-14-02/VE-14-02
19 In 1996, the land lymg north of the land uivolved in File No ZE-14-02/VE-1402 was
rezoned from the UR-3 5 zone to the Urban Residential-22 (UR-22) zone See decision in File
No ZE-16-96 Professional offices have been developed on such land In 1998, a 17,000 square
foot parcel of land located chrectly north of such land, across Alla Avenue, was rezoned from the
UR.-3 5 zone to the Urban Residennal-22 (LTR-22) zone, for the development of
medicaUprofessional offices See decision in File No ZE-1-98
20 In 1991, the land lymg south of the easterly two-thirds of the site was rezoned to the
Regional Business (B-3) zone The land lymg south of the westerly third of the site is zoned UR-
3 5 The land 1}nng south of the site includes a parking lot for a nearby school and office uses
21 The Exarruner consolidated the land use apphcahons in the cturent file and File No ZE- 14-
02/VE14-02 for public heanng, considenng the common ownership and locanon of the sites, the
sunilanty of the land use issues presented, and the lack of public opposihon to the proposals
22 Argonne and Mullan Roads form a one-way couplet, compete with curb and sidewalks, in
the area, between Sprague Avenue and Interstate 90 The GMA Comprehensive Plan designates
such roads as Urban Pnricipal Artenals
23 The srte plan erroneously mdicates that only 5 feet of Type III landscaping is reqiured along
the south boundary of the site, mstead of the 20-foot width reqtured by the Zoriulg Code The
County Division of Plazuung is wnlling to allow the reduced width of landscaping, pursuant to the
alternahve method of compliance provisions of Zomng Code 14 810 200, by installing 15 feet of
Type I landscapmg along the south boundary of the srte, 20 feet of Type I landscaping along the
west boundary of the srte, and augmentuig tlie 20 feet of Type I landscaping requued along the
west boundary

24 The proposal fails to meet the mimmum frontage reqiurements of the B-2 zone The
apphcant is vvilling to aggregate the site owner's ownerships to the north to provide adequate
frontage for the current proposal and the rezone proposal in File No ZE- 14-02/VE- 14-02
25 The Sta,ff' Report analyzes the consistency of the proposed rezone wnth the GMA
Comprehensive Plan and the approval cntena for rezones The Examiner concurs wnth such
analysis and hereby adopts the same by reference as findings of fact herein
26 Neighbonng property owners did not comment on the proposal As condrtioned, the
proposal will comply with the B-2 zone and other applicable development regulahons, vvill not
have any sigruficant adverse unpact on the envuonment, and will be reasonably compahble with
neighbonng land uses
27 Condihons have changed in the area since the zonuig of the site was reclassified in 1991, to
support the proposed rezone This mcludes the commercial rezoiung and development of land
lyuig near or adjacent to the site dunng the 1990s, mcreased commercial development along the
west side of Argonne Road in the vicuuty, adoption of the GMA Comprehensive Plan and Phase
I Development Regulations, and extension of public sewer to the area.
Based on the above finduigs of fact, the Heanng Examiner enters the following
II CONCLUSIONS OF LAW
1 The proposed rezone, as condihoned, conforms to the GMA Comprehensive Plan
2 The proposed rezone, as condinoned, bears a substantial relahonslup, and will not be
detnmental, to the public health, safety or welfare
3 A change in economic, technological, or land use condihons has occurred to warrant the
proposed rezone, as modified and condihoned A substantial change of circumstances has
occurred in the area smce the site was last zoned
4 The procedural reqiurements of the State Environmental Pohcy Act and the County's Local
Environmental Ordmance have been met The proposal, as condihoned, will not have a
sigruficant, probable adverse unpact on the envuonment
5 The proposed rezone, as condltioned, comphes with the B-2 zone, the County Zorung Code
and other applicable development regulations
6 The proposed rezone, as conditioned, meets the cntena established by Washuigton case law
for approving a rezone, and the cntena established in paragraphs 14 402 020 (1)(2) of the County
ZoYUng Code for amending the County official zoiung map

III DECISION
Based on the above Findings of Fact and Conclusions of Law, the apphcation for a rezone
to the Commuruty Busmess (B-2) zone, for the development of a pnvate parkmg lot, is hereby
approved, subject to the condihons of approval of the public agencies stated below
Any condztions of such agencies that have been added or sigmficantly revised by the
Hearing Exammer are atalicized
Fallure to comply with the conditions of this approval may result w revocation of this
approval by the Heanng Exammer Tlus approval does not waive the applicant's obhgahon to
comply vvith all other requirements of other agencies wnth junsdiction
SPOKANE COUNTY DIVISION OF PLANNING
1 All condihons unposed by the Heanng Exammer shall be binding on the "Apphcant,"
wluch tenn shall include the owner and developer of the property, and theu heus, assigns and
successors
2 The zone change apphes to the real property legally descnbed as "The South 67 feet of the
North Half of Lots 8 and 9, and the South 67 feet of the North Half of Lot 10, Less Hwy, all m
Block 23, Hutchinsons Addihon, as per plat recorded in Book Q, Page 4 of Plats, records of
Spokane County Auditor, m Spokane County, Washington"
3 The proposal shall comply with the Commuruty Busmess (B-2) zone, the Aqu.ifer Sensihve
Overlay zone, and all appucable provisions of the Spokane County Zonuig Code, as amended
4 The srte shall be developed in substanhal conformance with the site plan of record
subrrutted on July 25, 2002, subject to comphance with development regulations and condrtions
of approval The County Division of Planrung may approve minor alterations and add.ihons to
the site plan of record, pursuant to Secnon 14 504 040 of the County Zorung Code, as amended,
subj ect to comphance with all conditions of approval and regulahon standards All other
changes must be subnutted to the Heanng Exammer for approval at a public hearmg, through a
change of conditions apphcanon
5 The site plan of record does not illustrate compliance wtth required landscaping along the
north and west boundaries The County Davaston of Planntng may approve an alternate method
of compliance for the landscapang illustrated along the north property ltne, f the applicant

7 Approval is requzred from the Duector of the Division of Plammng/designee of a specific
lighting and sigrung plan for the descnbed property pnor to the release of any building pernut
8 Direct hght from any extenor area lighting fixture shall not extend over the property

9 A specific laridscape plan, plantulg schedule and provisions for the mauitenance acceptable
to the Duector of the Division of Planrung/designee shall be submitted with a performance bond

1 The applicant should contact the Division of Building and Code Enforcement at the earllest
possible stage m order to be informed of code reqwrements admuustered/enforced as authonzed
by the state Builduig Code Act Design/development concerns include addressing, fire apparatus
access roads, fire hydrant flow, approved water systems, builduig accessibihty, construction type,
occupancy classificahon, existuig exterior wall protechon and energy code reqwrements

for the subject land use acton on August 15, 2002
The exisbng zoning of the site is Urban Residenbal-3 5(UR-3 5) established in 1991 previousty classified
as Agncultural m 1947 (ZE-299-47) and Urban Residenbal-22 (UR-22) established in 1991, previously
ciassfied as Muitiple Family Suburban (MFS) m 1970 (ZE-21-70) Adoption of the Phase I Development
Regulations to Implement the Comprehensrve Plan by the Board of County Commissioners on January 15
2002 (Resolution #2-0037) did not change the exisbng zornng of the subJect site
Section IV Concurrency of the Phase I Development Regulabons reqwres applrcabons for Zone
Reclassifications vnthm the Urban Growth Area (UGA) to be evaluated for transportation water and sewer
concurrency The Spokane County Division of Engmeenng and Roads has issued a Certificate of

busmess offices, recreaton facilities, higher-density residences and other high-intensity uses to serve the
needs of surroundmg residenbal areas Mixed-use areas are mtended to enhance travel opbons, encourage
development of locally servmg commercial uses, medium-density apartments and offices along
transportation corridors identified on the Land Use Plan Map Mixed-use areas discourage low-intensity,
auto-dependent uses and focus on a pedestnan orientation with an emphasis on aesthetics and design

Policies UL 12 2 UL 12 3 and UL 12 4 state that Mixed-use areas will include a variety of high densdy
housmg and employment to support transit service, a full range of retail goods and services with a with an
~ emphasis on community-serving rather than regional serving commercial uses, and wdl prohibd commercial
uses that require large land areas wnth low empioyment densites such as warehouses, auto dealerships,
etc Policy UL 12 5 states that implementation of Mixed-use areas should only occur after the adopbon of a
subarea plan that involves design professionals, govemment service providers business people and
commurnty residents
As stated above the policies of the Mixed-use Category of the Vrban Land Use Chapter generally supports
the development of additional overtlow parking for the established uses Secbon II Zone Reclassificabon
Applications of the Phase I Development Regulabons states that applicabons for amendments to the
Spokane County Zornng Map irnbated under Section 14 402100(1) of the Spokane County Zornng Code
shall be limded to reclassificabons that are consistent wrth the Comprehenswe Plan category and
associated implemenbng zone as provided in the table attached to the Regulations The table idenbfles the
implemenbng zones for the Mixed-use Category to mclude Urban Resrdenbal-12 (UR-12) Urban
Residenhal-22 (UR-22), Neighborhood Business (B-1) Industnal Park (I-1) and the proposed Commurnty

Goals CF 3 CF 6 and CF 7 Capital Facdities, Chapter 7 are to ensure that public facilities and services
support proposed development at established Levels of Sernce and is consistent with public water and
