A. INTRODUCTION

This matter having come before the Zoning Hearing Examiner Committee on
September 3, 1981, and the members of the Committee present being Phillip
D. Harris, Chairman, and Gary N. Anderberg and John W. Skadan.
B. PROPOSAL ~
The sponsor, Diagnostic Radiology of Spokane and Inland Imaging Ltd.
Partnership, is requesting approval of a zone reclassification, File No.
ZE-32-87, for the purpose of developing a medical office bui lding. Also a
var~ance request, File No. VE-10-81, for off-street parking.
C. FINDINGS OF FACT
1. That the existing land use in the area is single fami ly residential,
church, school, medical office, hospital and open area.
2. That the Comprehensive Plan designates this area as appropriate for
URBAN development.
3. That the existing zoning of the property described in the application
is Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
~ Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
I tem have been f u 1 f i 11 ed.
b. That the land in this area is suitable for the proposed use, or
uses within the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified.
8. That the proposed use is compatible with existing uses in the
area.
9. That the owners of adjacent lands and/or their representatives expressed concern over possible shortfall in available parking and
clogging of adjacent streets with parked cars should the variance be
approved. The Hearing Examiner Committee notes that Planning
Department Condition #7 should adequately avoid such a situation.

If parking demand on this site exceeds available on-site parking,
then the owner will be compelled to provide additional parking to sat i sfy the demand . Other remed i es may a 1 so be ava i 1 ab 1 e through the
County Engineer in conjunction with the Sheriff's Department.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a) The Urban category of the Comprehensive Plan would support an
aesthetically pleasing development consistent with other similar
type land uses and compatible with adjoining residential uses.
b) Buffering techniques necessary to screen parking areas and
provide separation between this use and adjacent residential
uses has been indicated.
c) The proposal has direct access to an arterial as suggested by
the Cor~prehensive Plan for non-residential uses.
d) The grant i ng of the of f-street park i ng vari ance does not
authorize a use otherwise prohibited in the Urban Residential-22
(UR-22) Zone.
e~ The off-street parking standards for medical offices are
generally geared to the worst case situation of a normal doctors
office which generates high parking demand. In the instance of
the proposed specialized medical facility, the proposed site does accomodate the building, the building landscaping, the
required parking lot screening, adequate buffering to adjacent
residential uses, required landscaping, stormwater drainage
areas, and adequate parking for actual need. Nowever, the size
of the property is not sufficient to provide the required
park i ng f or the worst ca se s i tuat i on of a typ i ca 1 doctors of f i ce operat i on .
f) The granting of the variance will not be detrimental to the area
or adjacent properties provided conditions are imposed to remedy
park i ng shortages i f they occur.
g) A broader public need and interest will be served by granting
the variance insomuch as new medical technology wi 11 be located in a growing medical service oriented neighborhood.

D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL

of the property, heirs, assigns, and successors.)
a) HEARING EXAMINER COMMITTEE
1. Amend Planning Department Condition #1 to read as follows:
That should parking demand exceed parking provided on-site, then
the shortfall must be corrected by developing additional
of f-street park i ng area s, or enter i ng i nto a rec i proca 1 park i ng
agreement on sites consistent with provisions of the Spokane
County Zoning Code, Expansions to the building, changes in the
facility's operation, or employment of additional personnel may
all result in the need for additional parking and therefore the requ i rement that add i t i ona 1 park i ng be prov i ded. The park i ng of
employee and patient cars on any of the streets in the area will
not be allowed and will not be counted to satisfy parking
demands or requirements.
b) COUNTY PLANNING DEPaRTMENT
STANDARD:
1. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning administrator
wi 11 be permi tted, i nc 1 ud i ng , but not 1 i mi ted to the f o 11 ow i ng
changes: Building location, landscape plans, and general allowable uses of the permitted zone. All variations must
conform to regulations set forth in the ZONING CODE F~R SPOKANE
COUNTY. The original intent of the development plans shall be
maintained.
2. All current standards of the Urban Residential-22 (UR-22) Zone
(for Mission View Addition, Lot 2, Block 1), as amended, shal l
be comp 1 i ed wi th i n the deve 1 opment of th i s s i te.
3. That the project is subject to Section 1.06, the Aquifer
Sensitive Area Overlay Zone of the ZONING CODE FOR SPOKANE
COUNTY, which sets forth yarious measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.

b) COUNTY PLANNING DEPARTMENT
4. Any division of land for the purpose of sale, lease or transfer, shall comply with RCW 58-11 and the Spokane County Platting
Ordinances prior to issuance of bui lding permits.
SPECIAL:
5. That at the building permit review stage, the plans be reviewed
and approved so that no more than 15~ of the total site is committed to landscaping as intended by the landscaping
provisions of the Spokane County Zoning Code. In approving the
detailed site plan adequate provisions must be provided to
screen parking areas from view of adjacent property and streets ~
and that adequate buffering be provided along the west property
1 ine ~general ly consisting of a 5 foot landscape strip with a
mi n i mum 6 f oot ta 11 barr i er
6. That the off-street parking variance as described in the
application and Planning Department report, is approved to allow
46 park i ng sta 11 s to serve the 11, 000 square foot bu i 1 d i ng
specialized medical faci 1 ity.
1. That should parking demand exceed parking provided on-site, then
the shortfall must be corrected by developing additional off-street parking areas, or entering into a reciprocal parking
agreement on sites consistent with provisions of the Spokane
County Zon~ng Code. Expans~ons to the building, changes in the
f ac i 1 i ty' s operat i on, or emp 1 oyment of add i t i ona 1 personne 1 may
all result in the need for additional parking and therefore the
requirement that additional parking be provided. The parking of
employee and patient cars on any of the streets in the area shall be prohibited.
c~ COUNTY ENGINEERING DEPAR~IENT
Prior To The Issuance Of A Building Permit Or Use Of The Property As
ProQosed:
STANDARD:
1. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or any portion thereof, if the
development is to be phased.
2. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
location, and arrangement of parking stalls shall be in
accordance wi th standard ,traf f i c eng i neer i ng pract i ces. Pav i ng
or surfacing as approved by the County Engineer, wiil be
required for any portion of the project which is to be occupied
or traveled by vehicles.

c) COUNTY ENGINEERING DEPARTMENT
3. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer.
4. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and~other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless otherwise approved by the County Engineer.
5. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners' ~
Resolution No. 80-1592 as amended and are applicable to this
proposal.
6. The appl icant should be advised that individual driveway access
permits are required prior to the issuance of a building permit.
1. No construction work is to be performed within the existing or
proposed public right of way until a permit has been issued by
the County Eng i neer. Al l work wi th i n the pub 1 i c road ri ght of
way is subject to inspection and approval by the County Engineer.
8. Al 1 required construction within the existing or proposed publ ic
right of way is to be completed prior to the release of a
building permit or a bond in the amount estimated by the County
Engineer to cover the cost of construction of improvements shall
be filed with the County Engineer.

10. The County Engineer has designated Typical Roadway Section
Number One, Access Street standard for the improvement of
Maxwell Avenue which is adjacent to the proposed development.

sidewalk along the frontage of the development.
11. That the applicant shall provide a 5 foot wide easement along
Maxwell Avenue for utilities, signs and road maintenance. This
easement shall be located outside of the County Road Right of
Way and shall run paralle,l to the right of way along the south
property line. The easement shall extend from the west property
line to the Houk-Maxwell intersection.

SPECIAL:

e) C~UNTY HEALTN DISTRICT
STANQARD:
1. Sewage disposal method shall be as authorized by the Director of
Uti 1 ities, Spokane County.
2. Water service shall be coordinated through the Director of
Utilities, Spokane County.
3. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Nealth Services. .
4. Use of private wells and water systems is prohibited.
SPECIAI:
5.~ A public sewer system will be made available for the project and
~ndividual service will be provided. Use of individual on-site
sewage disposal systems shall not be authorized.
f} COUNTY BUILDING AND SAFETY DEPARTMENT
STANDARD:
1. The site is located in Fire District
2. Specific location of hydrants shall be determined by the fire ' district.
3. Commercial dumpsters and containers with an indiv~dual capacity
E of 1.5 cubic yards or greater sha11 not be stored or placed
wi th i n f i ve f eet of combu st i b 1 e wa 11 s, open i ng s or combu st i b 1 e
roof eave 1 i nes.
4. The appl icant shal l provide verif ication from the Fire District
to the Department of Building and Safety that provisions have
been made for adequate fire protection prior to the release of
bui ]drng permits.
g) WATER PURVEYOR

h~ COUNTY AIR POLLUTION CONTROL AUTHORITY
All air pollution regulations must be met. This includes but is not 1 imited to the fol lowing:
STANDARD:
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects.be controlled.
Th i s may requ ire use of water sprays, tarps, spr~ nk 1 ers, or suspension of activity during certain weather conditions. Haul
roads should be treated and emi ssions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities. ,
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or spi 11 s occur on paved surf aces, measures must be taken ~
immediately to clean these surfaces.
3. All traveiled surfaces (ingress, egress, parking areas, access
roads~ must be paved and kept clean.
4. Some ob jectionable odors wi 11 1 ikely result durrng the construction phase of the project and from motor vehicles using
the site following completion of the project and from occupants
of the proposed project.
5. Demol ition and renovation pro jects must comply with the
requirements of CFR 40 Part bl, Subpart M, Intent to Demol ish ~
and Renovate forms are available at the SCAPCA office.

The Urban category of the Comprehensive Plan is a land use
designation suitable for a wide variety of residential and
non-residential uses. Type of land use appropriate for a specific area is dependent upon development trends, site specific
considerations, and location. The siting of non-residential uses
should be adjacent to or have direct access to the arterial road
system. Buffering techniques ~including landscaping, screening, and
setbacks) are encouraged along those boundaries between
non-residential and less intense land uses.

Both the land use and zoning pattern in this area has been heavily
influenced by the location and expansions of the Valley General
Hospital complex. That facility has spawned the development of associated medical offices and services north and south of Mission
Avenue. The notable exception to this trend is found in four or five
residential uses immediately west of the proposal toward Pines Road.
The lot immediately east of the proposal, up to Houk Street, is part -
of this rezone applicant's ownership. That lot was zoned Residential ~
Office in 1918 for the purpose of a small medical office building and
associated parking. ~

It is part of the development concept proposed for this rezone
request, however, the lot itself is not proposed for rezone. That
Residential Office Zone has development standards similar to those
found in the new Urban Residential-22 (UR-22) Zone. However,
retention of that Residential Office Zone will allow the owners more
flexibility in the siting of this building than would be allowed
under the Urban Residential-22 (UR-22) standards.

Land Use Plan, Mission Avenue is designated as a minor arterial. ~

arterial improvements. Plaxwell Avenue is not specially designated in the Comprehensive Plan and would therefore remain a local access
street.

Site Plan Considerations: Viewed as a total concept, the proposal .
ca 11 s f or deve 1 opment of the med i ca 1 of f i ce bu i 1 d i ng, 1 andscap i ng, and associated parking on two (2) contiguous lots under two somewhat
different zone classifications; the old existing Residential Office
Zone on Parcel Noo 15542-0101 and the new proposed Urban
Residential-22 ~UR-22) Zone on Parcel No. 15542-0702. The intent and
standards of both zones, however, are very similar and compatible
with each other.
The building is positioned on the property so that it straddles lot
and zoning boundaries. Placement of the building is critical due to
the special ized medical equipment contained in the bui lding which
must n~a i nta i n a 25 f oot cl ear zone f rom certa i n meta 1 ob jects. The
less stringent yard setback requirements, provided by the o1d
Res i dent i a 1 Of f i ce Zone, a 11 ows the f 1 ex i b i 1 i ty to ma i nta i n the

Landscaping proposed on the site plan is extensive and covers at
least 15~ of the total site. The Spokane County Zoning Code provides
that no more than 15~ of the site is re uired to be in landscaping.
The proposed site plan demonstrates comp iance with that 15~ rule

Examiner Committee is general in nature. Detailed review to
determine compliance with all Ordinance regulations and
conditions of approvai is recommended to be administrative and
~ to occur at the Building Permit stage.
IIIo SITE DEVELOPh1ENT RECOMMENDATI4NS .
De~si~n: The proposed site plan indicates compliance with both the
Residential Office and the Urban Residential ~UR-22) Zone standards. It
is recommended that the site plan be adopted as the development concept
for both lots and zones.
Buff.ering/Landscapinq: Landscaping and buffering shown on the site plan indicates comp~iance with the 15~ rule of the new Spokane County Zoning
Code. Review of the specific development plan at the building permit
stage will ensure that the intent of the standard is maintained while at
the same time providing the best and most effective buffering
technique. This will require installation of the 5 foot landscape strip
and 6 foot tall screen along the west property line. Additionally, the
parking area will be screened along the roads to comply with the intent . of both the Residential Office and the Urban Residential-22 (UR-22}
standards.
Circulation/Access: The County Engineers will require that sidewalks be ~
install ed a~ong ~ouk Street and along Maxwell Avenue as already
conditioned in the Residential Office Zone approved in 1918.
Continuation of that sidewalk along Maxwell Avenue will be required in -
the proposed Urban Residential-22 ~UR-22) Zone. Along the entire Maxwell Avenue frontage, the Engineers will require that the applicant
~ provide a 5 foot wide utility and maintenance easement on the
property. That area wi 11 rema i n i n the app 1 i cant' s ownersh i p and may
. be used for landscaping as needed.
Stormwater Oraina~e: The applicant will be required to provide
stormwater drainage onesite consistent with the '208' Drainage Design Standards of Spokane County.
Sewage Disposal: The site is located within Sewer Utility Local
Improvement District #85-1. The building will be required to hook to
the public sewer system available in the area.

II. SITE DEVELOPMENT RECOMMENDATIONS ~continued~
Critical Materials/Use Activit : Development of the property is subject
to the Aqu~~er ~ensitive ~rea verlay Zone which requires that projects be reviewed for use of critical materials. If critical materials are
used in conjunction with this operation appropriate measures will be
required for spi 11 containment and aquifer protection.
Yariance: Based upon the arguments set forth by the applicant it
appears that the criteria for granting a variance have been met and the
off-street parking variance may be approved if the rezone action is approved. Granting of the variance should be conditioned so that if
operational changes or actual parking demand results in parking problems
then the faci 1 ity wi i 1 be required to provide the additional off-street

IV. SEPA ENVIRONMENTAI. REVIEW
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered ~
the spec i f i cs of the proposa 1, other ava i 1 ab 1 e i nf ormat ion, County
ordinances, other regulations and laws, possible standard Conditions
of Approval, the Generalized Comprehensive Plan, and other County
po 1 i c i es and gu i de 1 i nes . The Zon i ng Admi n i strator ha s determi ned
. that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of Non-Significance ("DNS").
The "DNS" was circulated to eight other agencies of jurisdiction and
other agencies/departments affected by the future development for
review and comment. The "ONS" comnent period ends September 2, 1981,
~ and was advertised 15 calendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site.
The Hearing Examiner Committee may consider additional environmental
related testimony and the "DNS" at the public hearing.

V. PLANNING SUMMARY
Approval of the Urban Residential-22 ~UR-22} tone and the total site
development concept is appropriate for the following reasons:
a7 The Urban category of the Comprehensive Plan would support an
aesthetically pleasing deveiopment consistent with other similar
type land uses and compatible with adjoining residential uses.
b) Buffering techniques necessary to screen parking areas and provide separation between this use and adjacent residential
uses has been indicated.
c} The proposal has direct access to an arterial as suggested by
the Comprehensive Plan for non-residential uses.
Approval of the requested off-street parking variance should be approved subject to conditions that will require provision of more
parking should actual parking needs exceed the 46 parking stalls

authorize a use otherwise prohibited in the Urban Residential-22

required parking lot screening, adequate buffering to adjacent - res i dent i a 1 u ses, requ i red 1 andscap i ng, stormwater dra inage
areas, and adequate parking for actual need. However, the size
of the property is not sufficient to provide the required
park i ng f or the worst ca se s i tuat i on of a typ i ca 1 doctors of f i ce
operation.
c~ The granting of the variance will not be detrimental to the area or adjacent properties provided conditions are imposed to remedy
parking shortages if they occur.
d} A broader public need and interest will be served by granting
the variance insomuch as new medical technology will be located
in a growing medical service oriented neighborhood.
e} The case for granti~g the variance is supported by an existing ~ and s imi 1 ar f ac i 1 i ty operat i ng i n the C i ty of Spokane near St.

were applied to the entire property, this ratio ~s very close to the 1:200 proposed in the new
law. The sma11 difference in ratio can be easily expla~ined by the unusually high space
