ZE-59-90 x ~l No :91 0939 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF SPOKANE COUNTY, WA IN THE MATTER OF ZONE RECLASSIFICATION ) ZE-059-90, URBAN RESIDENTIAL-22 TO ) D E C I S I O N REGIONAL BUSINESS AND VARIANCE FOR ) REAR YARD SETBACK, APPLICANT, SPOKANE ) STRUCTURES, INC ) Mr Chairman This evening is the date which the Board of County Commissioners has set to render its decision on ZE-059-90, Rezone Request, Urban Residential-22 to Regional Business and variance for rear yard setback, applicant Spokane Structures, Inc The application consists of a rezone request and a variance in conjunction therewith The variance would allow a structure to be placed on the property within two to three f eet of the rear yard setback The standard setback required for such structure is f i f teen f eet The proposal was heard on two (2) occasions by the Hearing Examiner Committee A second hearing was required as a result of inappropriate notice of the first hearing At the second hearing, the Hearing Examiner Committee approved the rezone request and additionally, a variance request for a two-foot rear yard setback An adjoining property owner to the south, Associated Restaurants, Inc , appealed the Hearing Examiner Committee action to the Board of County Commissioners They did not appeal the rezone approval, only the variance approval At the public hearing, a representative, on behalf of Associated Restaurants, Inc , asserted that the variance did not mEet the requirements of the County Code He further indicated that the granting of the variance would place an unsightly wall in close proximity to the appellant's property After considering all testimony with regard to the variance request, I hereby move that the appeal filed by Associated Page - 1 ~ t Restaurants, Inc , be denied In denying the appeal, I am, in effect, approving the variance request for a two-foot rear yard setback, or the location of a presently constructed wall on the rear yard setback, whichever setback is greater In making this motion, I have considered the requirements of state law and the County Code, as they govern the granting of variances I specifically f ind that the granting of this variance will not grant a special privilege to the applicant's piece of property, inasmuch as information supplied at the public hearing suggested that ten (10) variances had been granted to other properties in the vicinity Additionally, and as noted by the Planning Department analysis, the topography of the site does support the variance request Lastly, the granting of the variance will not be materially detrimental to the public health, safety and welfare To the contrary, the variance will afford the property owner the ability to access his site more easily, thus eliminating potential traffic congestion on Sprague Avenue Moreover, the unsightliness of the present site, to include fencing, will be removed, thus creating a more aesthetically pleasing land use to ad3oining property owners, to include the appellants The variance, I believe, will not adversely affect the appellant's property in its present use or potential uses I would request that Planning Department staff prepare Findings of Fact and Decision reflecting this motion and other issues raised at the public hearing for execution by the Board at a subsequent public meeting Such Findings should address the fact that such variance does not contradict the provisions in Section 14 404 082(3) of the Spokane County Zoninq Ordinance Page - 2 . ~ . Q BOCC FINDINGS Page 2 counsel for Associated Restaurants, Inc , asserted that the requuements of the Spokane Counry Zoning Code concerning granang of vanances were not met 11 The proposal was heard on two occasions by the Hearmg Exanuner Committee A second hearmg was reyuired as a result of inappropnate notice of the first hearmg 12 The Hearmg Examiner Committee approved the zone reclassification roquest and additionally granted a 2 foot rear yard setback at the second heanng on May 24,1991 13 The Board finds that gtanting of a vanance in this uistance will not be matenally detnmental to the pubhc health safety and welfare The vanance will afford the property the ability to remove and relocate the structure(s) as shown on the site plan This will provide for direct access from Sprague Avenue to the loading docks This wnll eluninate the existing traffic congestion on Sprague Avenue caused by dehvery to the site The unsighthness of the onginal site shall be improved, especially along the south property line which included a fence with razor wue and junk storage The onguial site use along the south praperty lule will be removed. This will create a more aesthetically pleasing land use and design to adjoining pmperty owners, including the appellant 14 Vananves for rear yard setback have been granted along Sprague Avenue in the viciruty of the proposal and are contained in the County Planmng Department's records Informanon supphed by applicant indicates that several rear yard vanances have been granted on commercially zoned property along Sprague Avenue in this vicinity The granting of the vanance will not grant a special pnvilege t+o the apphcants property nor be invonsLstent wnth the lumtanon of other properti.es in the vicimty and similar zone reclassifications as tlus prvperty 15 The vanance approval is for a 2 foot rear yard setback or on the location of the presendy constructed wall, whichever is greater The vanance is not granted for a zero setback as requested 16 The granang of the vanance will not adversely affect the appellants property in its present use or rts potential use 17 The approval of a rear yard vanance is not based on precedent estabhshed by illegal or nonconfornung circumstances The approval of a rear yani setback wdl not adversely effect the zoning concept for this area 18 The site plan layout results m a more effective and efficient movement of truck mff'ic to and from the site and is not based on the site beuig too small or economic haniships 19 The vanance approval will not result in de-facto zone reclassification nor will it cu+cumvent density or coverage requuements of the zomng 20 The zone reclassification and vanance is generally in comphance wnth the Comprehensive Plan 21 The proposed use is compatible vnth exisang uses in the area 22 The apphcant has demonstrated that conditions have substantially changed since the onguial zorung of ttus area and accordingly, the proposed zone reclassification is jusafiei 23 Special circumstances apphcable to the site including exisang traffic cuculaaon problems, practical diff'iculaes wnth stonn drainage disposal and existing site development configurations are gnounds for granting a vanance DECISION Based on the above Findings of Fact, the Board approves a vanance for a two foot vanance or on the locauon of the presendy vonsavcted wall m the rear yard setback, wluchever setback is greater The zone raclassificaaon of the subject property to Regional Busmess (B-3) by ttie Heanng Examiner Committee was not appealed to the Board of County . ! aisle, a 40 foot wnde building is necessary The applicant has identiff'ied special cucumstances includuig topography, safety concerns and pracncal diffitculaes as a basis for grannng the vanance The Planning Department recognizes these special circumstances However, it appears that the site is sunply too small for the use being proposed Purchase of adjoirung property may be an opnon It should also be noted that construction of a warehouse on the rear property lme may have a negative unpact if the adjacent multiple fanuly zoning is developed However, apartment development may reduce unpacts
