This evening is the date which the Board of County
Commissioners has set to render its decision on ZE-059-90, Rezone
Request, Urban Residential-22 to Regional Business and variance for
rear yard setback, applicant Spokane Structures, Inc
The application consists of a rezone request and a variance in
conjunction therewith The variance would allow a structure to be
placed on the property within two to three f eet of the rear yard
setback The standard setback required for such structure is
f i f teen f eet
The proposal was heard on two (2) occasions by the Hearing
Examiner Committee A second hearing was required as a result of
inappropriate notice of the first hearing At the second hearing,
the Hearing Examiner Committee approved the rezone request and
additionally, a variance request for a two-foot rear yard setback
An adjoining property owner to the south, Associated Restaurants,
Inc , appealed the Hearing Examiner Committee action to the Board
of County Commissioners They did not appeal the rezone approval,
only the variance approval
At the public hearing, a representative, on behalf of
Associated Restaurants, Inc , asserted that the variance did not
mEet the requirements of the County Code He further indicated
that the granting of the variance would place an unsightly wall in
close proximity to the appellant's property
After considering all testimony with regard to the variance
request, I hereby move that the appeal filed by Associated

Restaurants, Inc , be denied In denying the appeal, I am, in
effect, approving the variance request for a two-foot rear yard
setback, or the location of a presently constructed wall on the
rear yard setback, whichever setback is greater
In making this motion, I have considered the requirements of
state law and the County Code, as they govern the granting of
variances I specifically f ind that the granting of this variance
will not grant a special privilege to the applicant's piece of
property, inasmuch as information supplied at the public hearing
suggested that ten (10) variances had been granted to other
properties in the vicinity
Additionally, and as noted by the Planning Department
analysis, the topography of the site does support the variance
request
Lastly, the granting of the variance will not be materially
detrimental to the public health, safety and welfare To the
contrary, the variance will afford the property owner the ability
to access his site more easily, thus eliminating potential traffic
congestion on Sprague Avenue Moreover, the unsightliness of the
present site, to include fencing, will be removed, thus creating a
more aesthetically pleasing land use to ad3oining property owners,
to include the appellants The variance, I believe, will not
adversely affect the appellant's property in its present use or
potential uses
I would request that Planning Department staff prepare
Findings of Fact and Decision reflecting this motion and other
issues raised at the public hearing for execution by the Board at
a subsequent public meeting Such Findings should address the fact
that such variance does not contradict the provisions in Section
14 404 082(3) of the Spokane County Zoninq Ordinance

THIS MATTER, being considered by the Board of Counry Commissioners of
Spokane County, hereulafter referned to as the "Board", of an appeal of the Spokane
County Heanng Exanuner Committee decision of May 24, 1991, whereui said committee
approved said proposal with condiaons of approval
The Board received an appeal apphcation on May 24,1991 by Associated
Restaurants, Inc Associated Restaurants appealed the vanance only and not the zone
reclassification pornon of the Heanng Examiner Committee's decision
The Board held a de novo public heanrig on July 2,1991, and having fully
considered all testimony pr+esented, and havmg nndividually acquainted themselves with the
vicuuty and the site in question, did reach a decision on July 16,1991, to deny the appeal
and in doing so approved the vanance for rear yazd setback wnth specific condhtions and u1
doing so dsd enter the following
FINDINGS OF FACT
1 The property is generally located ui the Spokane Yalley south of and adjacent to
Sprague Avenue and 1/4 nule east of Park Road in Section 19, Township 25 North,
Range 44 EWM, Spokane County, Washmgton
2 The Board considered the Planning Department Report as a part of this record along
with the uiformation presented at the pubhc hearmg and informaaon contained in
Counry File No ZE-59-90 and VE-86-90
3 The existing land uses ui the area include warehouses, retail sales offices and
residences
4 The Comprehensive Plan designates tlus site as Commercial and Urban categones
The narth 300 feet of the site is vvithui the Commercial category The remauung
south pornon of the site is categonzed as Urban
5 The Artenal Road Plan designates Sprague Avenue as a Principal Artenal wnth a
recommended nght of way wndth of 130 feet
6 The existing zorung of the property descnbed in the apphcation is Regional Business
(B-3) Only the south 46 feet of the site is zoned Urban Residennal-22 (UR-22) The
request is to rezone the south 46 feet to Regional Busmess (B-3) to be consistent wrth
the remainder of the site
7 The provisions of RCW 43 21C (The State Environnaental Policy Act) have been
comphed with and a Deterannation of Nonsigruficance was issued.
8 The legal reqwrements for pubhc notice have been fulfilled
9 The proposal was appealed by Associated Restaurants, Inc on May 24, 1991 The
appealletter luruted the appeal to the consideratton of the vanance request Associated
Restaumnts, Inc did not appeal the zone reclassification request to Regional Business
(B-3), which was approved by the Heanng Exammer Comnuttee
10 The owners of adjacent property to the south (Repps) expressed opposiuon to the
vanance request and requested that no vanance be granted and the 15 foot setback
reqwrement of the Regional Business (B-3) zone be requred Wntten reasons for denial
of the vanance were submitted by Associated Restaurants, Inc At the pubhc hearmg

counsel for Associated Restaurants, Inc , asserted that the requuements of the Spokane
Counry Zoning Code concerning granang of vanances were not met
11 The proposal was heard on two occasions by the Hearmg Exanuner Committee A
second hearmg was reyuired as a result of inappropnate notice of the first hearmg
12 The Hearmg Examiner Committee approved the zone reclassification roquest and
additionally granted a 2 foot rear yard setback at the second heanng on May 24,1991
13 The Board finds that gtanting of a vanance in this uistance will not be matenally
detnmental to the pubhc health safety and welfare
The vanance will afford the property the ability to remove and relocate the structure(s) as
shown on the site plan This will provide for direct access from Sprague Avenue to the
loading docks This wnll eluninate the existing traffic congestion on Sprague Avenue
caused by dehvery to the site
The unsighthness of the onginal site shall be improved, especially along the south
property line which included a fence with razor wue and junk storage The onguial site
use along the south praperty lule will be removed. This will create a more aesthetically
pleasing land use and design to adjoining pmperty owners, including the appellant

15 The vanance approval is for a 2 foot rear yard setback or on the location of the presendy
constructed wall, whichever is greater The vanance is not granted for a zero setback as
requested
16 The granang of the vanance will not adversely affect the appellants property in its present
use or rts potential use
17 The approval of a rear yard vanance is not based on precedent estabhshed by illegal or
nonconfornung circumstances The approval of a rear yani setback wdl not adversely
effect the zoning concept for this area
18 The site plan layout results m a more effective and efficient movement of truck mff'ic to
and from the site and is not based on the site beuig too small or economic haniships
19 The vanance approval will not result in de-facto zone reclassification nor will it
cu+cumvent density or coverage requuements of the zomng
20 The zone reclassification and vanance is generally in comphance wnth the Comprehensive
Plan
21 The proposed use is compatible vnth exisang uses in the area
22 The apphcant has demonstrated that conditions have substantially changed since the
onguial zorung of ttus area and accordingly, the proposed zone reclassification is
jusafiei
23 Special circumstances apphcable to the site including exisang traffic cuculaaon problems,
practical diff'iculaes wnth stonn drainage disposal and existing site development
configurations are gnounds for granting a vanance
DECISION
Based on the above Findings of Fact, the Board approves a vanance for a two foot
vanance or on the locauon of the presendy vonsavcted wall m the rear yard setback,
wluchever setback is greater
The zone raclassificaaon of the subject property to Regional Busmess (B-3) by ttie
Heanng Examiner Committee was not appealed to the Board of County

In addiaon to the condiaons of approval for the vanance, the Board of County
Commissioner's has reiterated, hereui, for ease of reference only, the condiaons of
approval unposed by the Heanng Examiner Comimttee for the zone reclassif'ication

The following "Conditions of Approval" for the above referenced zone
change are submitted to the Spokane County Hearing Examiner Committee
for inclusion in the "Planning Report" and "Findings and Order" of
the public hearing scheduled January 24, 1991
Prior to the release of a building permit or use of the property as
proposed
E43 Applicant shall submit for approval by the Spokane County
Engineer drainaqe plans
E44 The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof if the
development is phased
E45 A parking plan and tzaffic circulation plan shall be submitted
and approved by the Spokane County Engineer The design,
location and azrangement of parking stalls shall be in
accordance with standard engineering practices Paving or
surfacing as approved by the County Engineer will be required
for any portion of the project which is to be occupied or
traveled by vehicles
E48 The construction of the roadway improvements stated herein shall
be accomplished as approved by the Spokane County Engineer
E50 The County Engineer has designated Typical Roadway Section
Number One, Ma)or Arterral standard for the improvement of
S~raque which is ad)acent to the proposed development

E51 All required improvements shall conform to the current Statz of
Washington Standard Specitications for Road and Bridge
construction and other applicable county standards and/or
adopted resolutions pertaining pertaining to Road Standards and
StormWater Management in effect at the date of construction,
unless otherwise approved by the County Engineer
E55 Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 80-1592 as amended and are applicable to this
proposal
E56 This plat or development proposai is located within a drainage
basin which has been identified by the Spokane County Engineer"s
Office as having stormwater runoff problems Since this plat or
development proposal is affected by or is a contributor to
stormwater flows, propeZty owners should participate in the
planning and implementation of a future basinwide stormwater
management system The following "Condition of Approval" shall
be required
That the owner(s) or successor(s) in interest agree to join
in any county approved Stormwater Management Program and to pay
such rates and charges as may be fixed through public hearings
for service or benefit obtained by the planning, design,
construction, maintaining or operation of stormwater control
facilities
E58 IVo construction work is to be performed within the existing or
proposed right of way until a permit has been issued by the
County Engineer All work within the public road right of way is
subject to inspection and approval by the County Engineer
E90 There may exist utilities, either underground or overhead,
affecting the subject property, including property to be
dedicated or set aside for future acquisition Spokane County
assumes no financial obligation for adjustments or relocation
regarding these utilities Applicant should check with the
applicable utility purveyor and the Spokane County Engineer to
determine whether applicant or the utility is responsible for
adjustment or relocation costs and to make arrangements for any
necessary work

FINDINGS OF FACT AND CONCLUSION
1 The proposal is to divide approximately 2 4 acres into 2 lots for

2 The proposal ls located adjacent to and south of Sprague Avenue and
approximately 630 ft east of the intersection of Park Road and Sprague
Avenue in the Spokane Valley in Section 19, Township 25N, Range 44,
E W M, Spokane County, Washington
3 The current zoning of the property is Commercial The proposed lot sizes,
frontage and established uses are allowed within this zone.
4 7he Spokane County Comprehensive Plan designates this area as Major
Commercial The established uses are in accord with this planning
category
5 The required public notice was provided for this proposal and agencies
having a potential lnterest in the project were notified and asked for
recornnendations
6 That a number of people in the area commented on the proposal. The chief
concerns expressed were if any new development was proposed through the
division No written comments or addresses of those concerned have been
received.
7 That in consideration of the recommended conditions and Spokane County
development standards, the proposal is not detrimental to the public
health, safety and general welfare
8 That the project is exempt from environmental review under the State
Environmental Po1icy Act
9 That the present uses and any future uses are regulated by the terms of

Officer, the use of indivldual on-site sewage systems may be authorized "
3 Water service shall be by an existing public water supply when approved
by the Regional Engineer (Spokane), State Department of Social & Health

4 Prior to filing the final plat, the sponsor shall present evidence that
the plat lies wtthin the recorded service area of the water system
proposed to serve the plat The dedicatory language on the plat shall

The site under consideration is located wnthin both the Commercial and Urban
categones of the Comprehensive Plan The proposed rezone to Regional Business
(B-3) and warehouse construcnon is consistent wnth the Commercial category Since
most of the site is vvittun the Commercial category and developed for Commercial
' use, the proposed zomng and land use are logical
The proposal is consistent vvith the design standards of the Regional Business (B-3)
Zone except for the rear yard buildmg setback requuement The Regional Business
(B-3) zone requires a 15 foot rear yard setback whereas a zero rear yard is proposed
by the vanance request
The Zoning Code Secnon 14 040 082 gives conditions and requuements for grantmg
vanances from the dunensional requuements of the Code The following are directly
apphcable and must apply to the cucumstance in order to grant the vanance

hazard on Sprague Avenue xs the result Trucks must back approxunately 200 feet to
the existing loacimg dock along a narrow dnveway
The apphcant proposes to demolish two existuig biuld.uigs located on the back pornon
of the property and construct a new build.ing along the rear property luie This will
create an open maneuvering area that will allow trucks to pull direcdy uito the site and
maneuver into the new loading dock area

rear poraon of the site slopes to the southeast The southeast corner of the site is the
logical area for locating drmnage facihties The lower elevation of the property at rts
south boundary also facihtates at grade loading dock which can be drained to the 208
swale and which contnbutes to a maximum area for maneuvenng trucks
The applicant has considered the alternauve of malang the buiiding nazrower as a
means of achievulg the requued 15 foot setback However, the need is for storage of
garage doors that are commonly 16 feet in width In order to store two rows of doors
m the building vcnth a center access aisle, a 40 foot wnde building is necessary
The applicant has identiff'ied special cucumstances includuig topography, safety
concerns and pracncal diffitculaes as a basis for grannng the vanance
The Planning Department recognizes these special circumstances However, it
appears that the site is sunply too small for the use being proposed Purchase of
adjoirung property may be an opnon
It should also be noted that construction of a warehouse on the rear property lme may
have a negative unpact if the adjacent multiple fanuly zoning is developed However,
apartment development may reduce unpacts if appropnately designed Addiaonally,
should that pmperty, in the future, be developed for commercial uses these unpacts

The Plannmg Deparnnent recommends the approval of the rezone but has not
identified sufficient grounds for supporting the vanance from the rear yard setback
requuements The apphcant will expand upon the need and reasoning for a vanance

The Zomng Code Secaon 14 040 082 gives condiaons and requirements for granang
varianves from the dunensional reqwrements of the Code The followuig are duwdy
apphcable and must apply to the cucumstance m order to grant the vananoe

hazard on Spragae Avenue is the result Trucks must back approxunately 200 feet to
the existing loading dock along a nazrow dnveway
The apphcant proposes to demolish two existing builduigs located on the rear pomon
of the property and construct a new btulduig along the back property luie Ttus will
create an open maneweruig area that will allow trucks to pull duwdy into the site and
maneuver mto the new loading dock area.
The -opography of the site also provides some support far the vanance request. The
rear poraon of the site slopes to the southeast, The southeast corner of the site is the '
logical area for locating drainage faciliaes The lower elevation of the property of its
south boundary also facilitaties at grade loading dock which can be drained to the 208
swale and wluch contnbutes to a maximum area for maneuvenng trucks
The apphcant has considered the alcernative of mulang the builchng narnower as a
means of achievuig the reqmred 15 foot setback. However, the need is for starage of
garage doors that are cominonly 16 feet m width In order to store two rnws of doors
in the building with a center acoess aisle, a 40 foot wide bwlding is necessary
The apphcant has identif'ied special cinvmstances including topography, safety
concerns and practical ddficulaes as a basis for granang the vanance
The Plarming Department rocogmzes these spemal cmcumstances However, it
appem that the siZe is sunply too small for the use being proposed Purchase of
