SP~KANE COUNTY HEARING EXAMINER COMMITTEE ~,F' E~„ ~QN~LUSIONS AND INTRODUCTION This matter having come before the Hearing Examiner Committee on September 21, 1989, and the members of the Committee present being Venona Southern, Cha~rperson, Phil Harris and Ron Odell. PROPOSAL The sponsor, C. Don Miller, Phillip Woolf and Robin L. Mitchell, request approval of a zone reclassification from Agricultural Suburban (AS) to Urban Residential-22 {UR-22), File No. ZE-30-89, ~or the purpose of developing medi~al offices. FINDINGS OF FACT AND CONCLUSI4NS 1. The property is generally located at the southeast corner of Mission Avenue and McDonald Road in the NE 1/4 of Secrion 15, Township 25 N., Range 44, EWM, Spokane County, Washington. 2. The committee adopts the Planning Department Report as a part of this record. 3. The existinng land use~s) in the area are single family residential, vacant lots and undeveloped and major powe~ Iines within 150' wide easement (Bonneville Power A ' 'strarion). _ r 4. The Comprehensive Plan des~gnates this site as U~ban. ~°he Urban category is suitable for residenrial uses a~ various densi~es ~d ce~tain nonresidenrial uses. S. The Arterial Road Plan designates Mission A.~e~ue and Mc~onald Road as Minor Arterials, with a recommendc~ right a~ way wi~th of 84' feet. 6. The existing zoning of the p~perty described in ~he application is Agricultural Suburban, previously establisfied in 1955. 7. The provisions of RCW 43.21~ (The State Environmental Policy Act) have be.en complied with and a Deter~min,aaon of Nonsignificance was issued, 8. The proper legal requirements for advertisement and notice have been fulfilled. 9. One adjoining property expressed disapproval of the p~oposed use if said use were to include high density residenriai use. However~ ~he adjacent owner did speak in favor of proposed medical of~ ces. 10. The proposed use is comparible with existing us~s in ~e area. 11. The proposed zoning does irnpiement and confa~ to the Camprehensive Plan. 12. The applicant hasdemons~rated that canditions have substantially changed since the original zoning of this area an~ accordingly, the proposed zone reclassification is justified. CONDITIONS OR CONTIN~ENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant", which term shal~ include the owner or owners of the property, heirs, assigns, and successors-~n-m~eres~ HEARING EXAMINER COMM~VIIITTEE 1. That portion of subject propeny without a specific site plan shall be developed for medical offices only, as consisxent with the concept plan presented to the Hearing Examiner Committee on September 21,1989. Building height is limited to maximum height allowed in the Urban I~esidenrial-3.5 (UR-3.5) Zone. COUNTY PLANNING DEPA~TMENT 1. Legal description: Starting at the N.VV. corner of the N.E.1/4 of Secrion 15, Township 25 North, Range 44 Easterly on Mis~ion 325' then southerly 675' then westerly 325' then northerly 675' to point of beginning. 2. Approval is required by the ~ Ianning Director/designee of a s~~ecific lightinng and s~gn~ng plan for the descr~~ property pnor to the re~ease of any bu~dl.ng permlts. A speci~c Iandscape plan, ~~antinng schedule and provision for maintenance acxeptable to the Planning I~r~ector/designee s~all be s~zbm~tted wi~ a perfarmance bond for the project priar ~o release of building permits. The applicant shall develop subject property general~y ~ acco~~ance withui the concept presented to the Hearing Examiner Committee. ~ariati~ns, when approved by the Planning Dinector/de~ignee, will be pennitted, including, but not limited to the following changes: builc~ng location, Iandscape plans, ar~d general allowable uses of the permitted zone. ~11 variarions must conform to regulations set forth in the ZONIlVG CODE FOR SFOKANE CaUNTY. The future acquisition area, ~nt~ acquired by Spokane County, shall be private property and may be used as allowed in the zone except any improvements (such as landscaping, parking, surfaoe. drainage, drainfields, signs, or ot~ers) shall be considered "interim" uses. . e. The Spokane County Plann~ng Department shall prepare and record with the Spokane County Aud~tor a MTitle Notice" noting that the property in quesrion is subject to a variety of special condirions imposed as a result of approval of a land use ac~on. This "Title No~.ce" shall serve as official public nonce regarding conditions of approval aff~eting the property in question. The "Title Norice" sh~ll be recorded within fifteen (IS) days of final disposirion of the approved land use action and shall only be ex~nguished by the Spokane Counry Planning Department. The "Title Norice" shall generally provide as follows: The parcel of property legally described as (legal description and tax parcel number~ is the subject af a land use action, imposing a variety of special development co~ditions, by a Spokane County Hearing Body or Administrative Offic~al on {date} and as maybe amended, altered or supplemented by officia~ action or as already changed. File No. (Planning Department File Number} is available for inspection and copying in the Spokane County ~lanning Department. COUNTY ENGINEERING D~PARTMENT Prior To The Issuance ~f A~uildin~ Permit ~r Use Of The Propertv As Proposed: 1. Applicant shall dedicate 2 feet on McDonald Road and Mission Avenue and a 20 foot radius at the McDonald - Mission intersecrion for right of way. 2. Access penmits far approach~s to the County Road System shall be ob~ained fro~n the S-~+~kane Co~nty Engin~. ~ 3. Applicant ~ai~ submit for a~proval by the Spokane County Engineer road, dra,i~age, a~d access g~ans. 4. The app~cant shall submit fvr approval by the Spokane County Engineer and t~e Spokane Co~~y Hea~th Dis~ri~t a detailed combined on-site sewage system plan a~d s~uface wat~er disposal p~an for the entirre project or any portion t~~reof, if the developm~~t is to be phase~. 5. ~~g plan an~ traffic ci~culation plan shall be submitted and approved by t~e Spokane Caunty Engineer. The design, Iocarion, and arrangement of parlang stalls shall be in accordance with standand traffic engineering pracrices. Paving or surfaci.ng as ap~oved by thc County Engineer, will be nequired for any portion of the project which is to be ooc~pied or traveled by vehicles. 6. , The Cou~ty Engineer has designated Typical Roadway Secrion Number ane, Secondary Arterial Standa1d for t~e improvements of Mission Avenue and McDonald Roa~d, which at~e adjacent to the p~posed development. This will require the addition of app~ximately 12 to 14 fe~t of asphalt along the frontage of the development. Curbing a~,d sidewalk must also be cons~ucted. 7. All required 'unpr~ovements s~all conform to the current State of VVashington Standar~ Specifeations for Road and Bridge Cons~ucrion, and other applicable County standards and/or adopted ~solutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Eng~~eer. i f.~ ~ 9-89 HEC Order for ZE-30-89 Page 5 8. Roadway standands, typicaP roadway sections and drainage plan requirements are found ln Spokane Board of County Commissioners' Resolution No. 80-1592 as amended and are applicable to this proposal. 9. No cons~uction work is to be performed within the e~sting or proposed public nght-of way until a pernut has been lssued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 10. All requined cons~ucction wtthin the existing or p~posed public right of way is to be completed prior to the re~ease of a building pernlit or a bond in the amount estimated by the County Eagineer to cover the cost of construction of improvements shall be filed with the County Engineer. 11. The county Arterial Road plan identifies Mission Avenue and McDonald Road as Minor Arterials. The existinng right of way width of 60 ft. is not consistent with that speci~ed in the Plan. In o~er to implement the Arterial Road Plan it is recommended that in add.irion to the required right of way dedicarion, a s~ ip of property 8 ft, in width along the Mission and McDonald fnontages be set aside in ~serve. This property may be acquired by Spokane County at the rime when Arterial Improvements are ~na~de to Mission or McDonald COUNTY UTILITIES DEPARTMENT 1. Puisuant to the Board of Cd~nty Commissioners Resolurion No. 80-Q418, the use of on-site sewer d~sposal sy~tems is hereby authorized. This authorization is condirioned on com~liance r~ith all rules and regulations of the Spokane County Health Dist~ict ~d is furtha conditioned and subjeet to specific application ap~roval a~d iss~nce of permits by the Health Distric~. 2. The dedication sh~ .state: '9Tfie owner(s) or successor{s} in interest agree to authorize t~e County ta p~ace t~eir name{s) on a petition for the formarion of ULID by peti~ion met~od p~rsuant ro RCW 36.94, which the petition includes the owner(s)' prope~.y; a~d further not ~o object by the signing of a p~test perition agalnst the fo~na~or~ of a U~..ID by resolu~on method pursuant to RCVV Chapter 36.94 which ~nctudes ~he ov~~er(s)' property. Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane County. 3. Water service shall be coordinated through the Director of Ubliries, Spokane County. 4. Water service shall be by an exisring public water supply when approved by the Regional Engineer (Spokane), State Department of Social & Health Services. S. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 6. Subject to specific application approval and issuance of perniits by the health officer, the use of an ind.ividual on-site sewage dis~sal system(s) may be authorized.. 7. Use of private wells and water systems is prohibited. COUNTY BUILDING AND SAFETY DEPARTMENT 1. The applicant shall contact the Department of Building and Safety at the earliest possible stage of design/development m order to be informed of Code requinements administered/enforced by the department, e.g., State Building Code Act regularions such as requirements for fine hydrant~flow, fire apparatus access roads, street address assignment, bamer-free regulations, energy code regulaaons, and general coordination with o~rer aspects of project implementation. 2. Haul noads should be treated and emissians from the transfer of e~~rthen material must be controlled as well as emissions from all other cons~uction related acrivities. 3. Measures must be taken ~a avo~d the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If ~racking or s~ills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 4.
