The sponsor, VMG Parmership, requests approval of a Zone Reclassification, Flle
No ZE-b I-90, to rezone a 4 9 acre site from Urban Resldentxal-22 (UR-22) and
Urban Residentlal-3 5(UR-3 5) to Regional Business (B-3) to allow develapment of
a miru-storage facility
FINDINGS OF FACT AND CONCLUSIO►NS
1 The property is generally located south of and adjacent to Sprague Avenue and
approximately 1/3 rrule east of Park Raad in Sectlon 19, Townshlp 25 N, Range 44

(B-3), Urban Residential-22 (UR-22) and Urban Residenhal-3 5(UR-3 5) The
request is to change the Urban Residential-22 (LJR-22) and Urban Residennal-3 5
(UR-3 5) Zomng to Regional Business (B-3) so that the entue site will be zoned
Reglonal Business (B-3)
8 The provisions of RCW 43 21C (The State Envuonxnental Pohcy Act) have been
comphed with and a Detei-minanon of Nonsignif'icance was issued
9 The legal requuements for public nonce have been fulfilled
10 Elberta Walker, owner of adjacent land, expressed concern regarding the plans to
construct storage units adjacent to her fence and the possibility of damage to the fence
as well as the possibility to snow falling from the new buildings onto her property
11 The apphcant stated that the storage units will be designed to preclude snow from
falling onto adjacent property and that the fence will not be disturbed dunng
construction without pernussion of the owner
12 The proposed use is compatible with exisnng uses in the area
13 The proposed zoning does implement and confoml to the intent of the Comprehensive

Pnncipal Artenal standard for the improvement of Sprague Avenue, which is
adjacent to the proposed development
7 All requued unprovements shall conform to the current State of Washington
Standard Specif"icanons for Road and Bndge Construction and other applicable
County standards and/or adopted resoluaons pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer
8 Applicant shall construct a paved and delineated approach(es) to meet the existung
pavement on Sprague Avenue
9 Access to South Valley Artenal shall be prohibited until such tune as specifically
authonzed by the Spokane County Engineer
10 Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Comnussioners Resolution No 80-1592 as
amendecl and are apphcable to ttus proposal
11 This subdivision or development proposal is located within a drainage basin which
has been idenhf'ied by the Spokane County Engineer's office as having stormwater
runoff problems Since this plat or development proposal is affected by or is a
contnbutor to stormwater flows, property owners should particlpate in the planning
and implementation of a future basinwide stormwater management system The
following statement shall be placed in the plat dedication
"The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be fixed

theu name(s) on a petition for the fonnanon of UI,ID by pention method pursuant
to RCW 36 94, which pention includes the owner(s)' property, and further not to

The Planning Deparmaent will propose a"Plan" amendment to Major Commercial
- category for this Urban area when it can be included ui the work program. The site is
uiside the Pnority Sewer Service Area.
- Arterial Road Plan: Access to the site is from Sprague Avenue. Sprague Avenue
is designated as a principal artenal uz the Artenal Road Plan The existing nght of
way width is 100 feet. No roadway dedicanon on Sprague Avenue is requested.
Along the southern boundary of the srte a luYUted access pruicipal artenal is planned.
The future artenal is known as the South Valley Artenal. The recommended nght of
way width for the future arterial is 160 feet The existing nght of way is 100 feet.
The County Engineer has requested that an additiona130 foot strip of property be set
aside in reserve for future road unprovement. No access to thus future artenal will be
pernntted finm the site.
Zoning: The existing zoiung on the site is Regional Business (B-3), Urban
Residential-22 (UR-22) and Urban Residential-3 5(UR-3 5). The north 300 feet of
the site is zoned Regional Business (B-3). The muddle 230 feet is zoned Urban
Residential-22 and the southerly remamder of the site is zoned Urban Residential-3.5
(UR-3.5)
Surrounding Zoning:
To the NORTH: Regional Business (B-3), (Crossover Zone), 1991

III. SITE DEVELOPMENT RECOMMENDATIONS
Circulation/Access: Two driveways wnll provide access to the site from Sprague
Avenue. No access from the future artenal fronting on the south boundary of the site
will be pernutted. Paved driveways will provide cuculation on the site. The
minimum width for a driveway is 20 feet For dnveways with access to storage units
on both sides, the minimum dnveway width is 24 feeL
- Stormwater Drainage. The proposal is located in the Aquifer Sensitive Area
Overlay Zone. A storm drainage plan is requued by the County Engineer. Ihsposal
of stonn water in grassed swales according to "208" standards is requimd
Sewage Disposal. SepUc tank and drainfield may be allowed subject to Health
Distnct approval. The managers umt and retail building will be double plumbed for
connection to future area wide collection system
Water Supply: Water will be supphed by the Dishman Water Company

IV. SEPA ENVIRONMENTAL REVIEW
An Envimnmental Checkhst was subnutted by the sponsor and was reviewed by the
County Planning Department The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Conci.idons of Approval, the Generalized Comprehensive Plan, and other
County poucies and guidelules. The Plamung Department has determined that "No
probable significant adverse unpacts" would result firom the proposal beuig developed
_ and has issued a pkAprming&n of NqnWnificance ("DNS").
~ The "DNS" was cuculated to 7 other agencies of junsdtction and other
agencies,/departments affected by the future development for review and comment.
The "DNS" comment penod ends February 19, 1991 and was advertised 15 calendar

days before said date in the newspaper, by letter to adjacent property owners within
400 feet of the proposal, and by notice on a sign posted on the proposal s1te. The
Hearmg Examiner may consider additional environmental related testimony at the _

V . PLANNING DEPARTMENT SUMMARY
The site under consideration is located in both the Commercial and Urban categones
of the Comprehensive Plan. Although the proposal is not in stnct confonmance with
the Comprehensive Plan at ttus trme, the Plannmg Deparmnent recommends approval
of the rezone subject to the conditions of approval, based on surrounding land use
and future Arterial Road Plans.
V I. CONDITIONS OF APPROVAL
i. All Conditions imposed by the Hearing Examiner Committee shall
be binding on the "Applicant," which term shall include the owner
or owners of the property, heirs, assigns, and successors.

landscaping, parlang, surface drainage, drainfield, signs or others) shall be
considered interim uses
4. The Planning Department shall file with the Spokane County Auditor, within the
same time frame as allowed for an appeal from the final disposirion, includulg
lapsing of appeal penod, a Title Notice, which shall generally provide as follows:
"Pnor to the issuance of any bwldulg pernut for any building or any use on the
property described herein, the applicant shall be responsible for complying with the
provisions of the Zoning Code for Spokane County, Secaon 14.706 (Aquifer
Sensiave Area Overlay Zone). The properry which is the subject of this notice ls

5. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Ihrector/designee shall be submitted with a performance
bond for the project pnar to release of builchng peimits. Landscaping shall be
_ mstalled and maintamed so that sight distance at access points is not obscured or
unpaired
. 6. A specific development plan shall be subnutted for Planiung Department review and
approval pnor to issuance of buildmg pemuts. Construction must be judged as

Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineenng practices. Pavuig or -
surfacxng as approved by the County Engineer, will be required for any pornon of
the project which is to be occupied or traveled by vehicles
5. The construcaon of the road unprovements stated herein shall be accomphshed as
approved by the Spokane County Engineer
6. The County Engmeer has designated Typical Roadway Secaon Number One,
Pnncipal Arterial standard for the improvement of Sprague Avenue, which is
adjacent to the proposed development.
7. All requued unprovements shall conform to the current State of Washulgton
Standard Specifications for Road and Bndge Construcaon and other apphcable
County standards and/or adopted resolutions pertauung to Road Standards and
Stozmwater Management in effect at the date of construcnon, unless otherwnse
approved by the County Engineer.
8. Apphcant shall construct a paved and deluieated approach(es) to meet the existing
pavement on Sprague Avenue.
9 Access to South Valley Artenal shall be prohibited until such time as specif'ically .
authorized by the Spokane County Engineer.
10 Roadway standards, typical roadway sections and drainage plan requirements are .

runoff problems. Since dus plat or development proposal is affected by or is a
contnbutor to stormwater flows, property owners should participate in the planning
. and implementalaon of a future basinwide stormwater management system. The

SPOKANE COUNTY UTILITIES DEPARTMENT

The following "Conditions of Appzoval" for the above referenced zone
change are submitted to the Spokane County Hearing Examiner Committee
for inclusion in the "Planning Report" and "Findings and Order" of
the public hearing scheduled February 21, 1991.
Prior to release of a building permit or use of the property as
proposed:
E40 Access permits for approaches to the County Road System shall be
obtained from the County Engineer.
E43 Applicant shall submit foz approval by the Spokane County
Engineer road, drainage and access plans.
E44 The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof if the
development is phased.
E45 A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
location and arrangement of parking stalls shall be in
accordance with standard engineering practices. Paving or
surfacing as approved by the County Engineer wYll be required
for any portion of the project which is to be occupied or
traveled by vehicles
E98 The construction of the roadway improvements stated herein shall
be accomplished as appzoved by the Spokane County Engineer.

E50 The Cuunty Engineer has designated Typical Roadway SeGtion
Number One, Principal Arterial standard for the improvement of
Spraque Avenue which is adjacent to the proposed development.
E51 Al1 required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
construction and other applicable county standards and/or
adopted resolutions pertaining pertaining to Road Standards and
Stormwater Management in effect at the date of construction,
unless otherWise approved by the County Engineer.
E53 The applicant shall construct a paved and delineated approach(s)
to meet the existing pavement on Spraque Avenue.
E54 Access to South Valley Arterial shall be prohibited until such
time as specifically authorized•by the Spokane County Engineer.
E55 Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 80-1592 as amended and are applicable to this
proposal.
E56 This plat or development pzoposal is located within a drainage
basin which has been identified by the Spokane County Engineer"s
Office as having stormwater runoff problems. Since this plat or
development proposal is affected by or is a contributor to
stormwater flows, property owners should participate in the
planning and implementation of a future basinwide stormwater
management system. The following "Condition of Approval" shall
be required:
That the owner(s) or successor(s) in interest agree to join
in any county approved Stormwater Management Program and to pay
such rates and charges as may be fixed through public hearings
for service or benefit obtained by the planning, design,
construction, maintaining or operation of stormwater contzol
facilities
E58 No construction Work is to be performed within the existing or
proposed right of way until a permit has been issued by the
County Engineer. All work within the public road right of way is
subject to inspection and approval by the County Engineer.
E61 The County Arterial Road plan identifies South Vallev Arterial
as a Principal Arterial. The existing right of way width of 100
ft. is not consistent with that specified in The Plan. In order
to implement the Arterial Road Plan it is recommended that in

addition to the required right of way dedication, a strip of
property 30 ft. in width along the South Valley Arterial
frontage be set aside in reserve. This property may be acquired
by Spokane County at the time when Arterial Improvements are
made to South Valley Arterial.
E90 There may exist utilities, either underground or overhead,
affecting the subject property, including property to be
dedicated or set aside for future acquisition. Spokane County
assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant should check with the
applicable utility purveyor and the Spokane County Engineer to
determine whether applicant or the utility is responsible for
adjustment or relocation costs and to make arrangements for any
necessary work.
