This mat~er coming on for public hearing on June 19, 2002, the Hearing Examiner,
after review of the change of conditions application and the entire record, and finding good cause
therefore, ~ereby makes the following findings o~ fact, conclusions of law and decision:
I. FINDINGS OF FACT
1. The application requests changes to cer~ain conditions imposed in the 1982 zone
reclassification (File No. ZE-33-82) of .5 acres of land i~ the Neighbor~ood Business (B-1) zone,
to allow the development of offices under a specific site plan.
2. The site is located south of and adjacent to Mission Avenue, approxirrlately 300 ~'eet west
of State Route I~~o. 27 (Pines Road), in the NE ll4 of Section 16, Township 25 Nor~h, Range 44
E~VM, Spokane County, Washington,
3. The site is current~y referenced as County Assessor's tax parcel no. 45161.4415. The site is
legally described in the subj ect change of conditions application.
4. Th.e applicant for the proposal and the site owner is James A. Wolff,12209 E. Mission
Avenue, Spokane, V~A 99206.
5. The Hearing Examiner heard the applicatio~~ pursua~t to the County Hearing EXaminer
Ordinance {County Resolution No. 96-0171) and the County Hearing Examin.e~ Rules of
Procedure (Coun.ty Resolution No. 96-0294).
6. The Hearing Examiner visited the site on June 18, 2002 and conducted a public hearing on
the proposal on June 19, 2002. The legal requirements for notice of public hearing were met.

8. The ~iearing Examiner takes notice of the County Genera~ized Comprehens~ve Plan, the
GMA Comprehensive Plan and Capital Facilities Plan, Phase I Development Regulations,
County Reso~ution Nos.1-1033, County Resolution Nos. 2-0037 and 2-0470, County Zoning

Code, County Code, other applicable development regulations, and prior land use decisions in
the vicinity.
9. The record includes the documents in File Nos. ZE-33-82 and ZE-33A-82 at the time of the
public hearing; the docur~ents submitted at the public hea~ing; the Examiner's letter of oral
approval dated 6-19•02; and the items taken notice of by the Examiner.
10. A Determination of Non.significance (DNS) was issued for the proposal on June 18, 2002.
1 l. On October 14,1982, the zoning of ,95 acres of land was reclassified from the Agricultural
Suburban zone to the Local Business. Tk~e cu~rent site comprises the east hal~ of such land. The
rezone was approved for the development of a carpet cleaning business on tla.e west half of the
rezoned parce~, and no specific use on the east half of the parcel. The rezone decision r.equ~red
the west ha~f of the site to be developed for the cleaning business, and zequized the submittal of a
specific site plan for development of the current site, for review and approval at a publ~c hearing.

12. On January l, ~991, the rezone site was reclassified to the Neighborhood Business (B-1}
zone, pursuant to the Program to I~nplement the Spokane County Zoning Code. The Program to
~nplement preserved the conditions of approval imposed by the 1982 zezo~.e, to the extent that
such conda.tions were more restrictive or specific on development of the s~te than the
development standar. ds of the B-1 zone.
13. The site is approximately .49 acres in size, relatively flat topography and improved with
a zesidence and detached garage. Such improvements existed on the site when it was rezoned in
1982, The site is ~enced on the east, west and south with var.ious ~encing materials. The ~982
rezone required the installa~ion of a 6-foot high, sight-obscuring fence along the west and south
property boundaries of the original rezone parcel.
14. A complete application was submitted for the subject property on April.l7, 2002. The
application requests deletion of the condition of the 1982 rezone that required the submittal of a
specific detailed site plan for review an.d approval at a public hearing before development of the
site.
15. ~`he s~te plan of record dated April 12, 2002 illustrates the development of a single story,
6,47f~-square foot office building on the subject property. The site plan illustrates 20 parking
spaces on the site,l5 feet of Type I landscaping along the south boundary, 5 feet of Type III
landscaping adj ace~t to N~ission Avenue, and a 6-foot high, sight-obscuring fence alon~ the south
border.
16. The Staff Repor~ contemplates that the conditions ~of approval of the 1982 rezone of the site
would be replaced by new conditions recommended by commenting public agencies.
17. Effective Ja~luary 1 S, 2002, the County adopted County Resolut~on No. 2-003 7. Such
resolution implem.ented a new Comprehensive Plan ("GMA Comprehensive Plan"), a Capital
Facilities Plan, County Urban Growth Area (UGA) boundaries, and Phase I Development

Regulations; all pursuant to the State Growth Management Act. Such resolution also repealed
the interim development regulations previously adopted by the County under the State Growth
Management Act.
~ 8. On May 7, 2002, the County adopted County Resolution No. 2-0470, which made m.~nor
text rev~sions to the Phase I Development Regulations. The Phase I Development Regulations
designate th~e area inside the County UGA. Prior to January 15, 2002, the area was designated in
the County's IUGA boundaries.
19. The Phase I Development Regulation.s designate the site, the adjacen.t parcel to the west,
and the land lying east and southeast of the site in the Mixed Use category of the GN~A
Comprehensive Plan. Such regulations designate the land lying nor~herly of the site in the
Reg~,ona~ Commercial category of the GMA Comprehensive Plan, and the ~and ~yin.g south and
southwest of the site in the Low Den.sity Residential category of the GMA Com.prehensive Plan.
20. '~he Phase I Development Regulations retained the B-1 zol~ing of the site and adjacent land
to the west; the B-3 zon~ng of the land lying east, southeast and no~th of the subject property; and
the UR-3.5 zoning of the land l~.ng to the south. The land lying east, west and north of the site is
developed for commercial uses; while the land located to the south is developed for single-family
homes. A carpet busi~ess is found on the parcel Iocated directly west of the si~e.
21. The County Arterial Road Plan in the GMA Compreh.ensive Plan designates Mission
Avenue as an Urban Minor Arterial. SR-27 comprises a 5-lane state laighway in the area, with a
free~vay interchange at Interstate 901ocated a short distance northeast of the site.
22. The Staff Report sets forth applicable policies of the GMA Comprehensive Plan. The
County has not adopted necessary imp~ementing regulat~ons for most polices of the Mixed Use
category. The B-1 zone is an implementing zone for such category.
23. The Staff Report found the proposal, as conditioned, to be consistent with the GMA
Comprehensive Plan a~d the B-1 zone. The Examiner a~rees with such analysis, and adopts and
incorporates the same by reference as findings of fact herein.
24. Neighboring property owners did not comment on the proposal, and no publ,ic agencies
opposed the proposal. The proposed landscaping and sight-obscuring fence alon~ the south
proper~y line sufficiently buffers the single-family homes located to the south. As conditioned,
th.e proposal will not have a signifi.cant adverse impact on neighboring properties or the quality of
the environment, and will not adversely impact neighbori~g properties.
25. Ch.anged cxrcumstances have occurred in the area since the site was zoned B-1 in 1982. ~
This includes the installation of public sewer, the rezoning and development of land in the
vic~nity o~ the site for commercial development, increased population and traffic in the area,
adoption of the GMA Compzehensive Plan and Phase I Development Regulations, inclusion of
the site in the County IUGA and UGA, and road improvements in the vicinity.
Based on the abo~~e findi.ngs of fact, the Hearing Examiner enters the following:

II. CONCLUSIONS OF LAW
The proposed change of conditions, as conditioned, generally confonns to the GMA
Comprehensive Plan.
2. The applicant has established that ~he proposal bears a substantial relatzonship to, and/or
will not be detrimental to, the public heal~h, safety or welfare.
3. Conditions in the area have si~nificantly changed since the site was last zoned.
4. The procedural requirements of the State Environmental Policy Act and the County's Local
Environmental Ordinance have been met.
5. The pzoposa~, as condit~oned, complies with the B-1 zone, the County Zoning Code, and
other applicable development regulations.
6. The proposed change of conditions meets the criteria established in Section.14.504.040 of
the County Zonin.g Code for a change of conditions application.
7. Approval of the land use application is appropriate under the criteri.a established for the
approval of land use appl~cations in Section 11 of the Coun.ty Hearing Examiner Ordinance,
adopted by County Resolution No. 96-0171.
IXI. DECISION
Based on the Findings of Fact and Conclusions of Law above, the application for a change
of condi.tions, to allow the development of offices in the B-1 zone, is hereby approved, subject to
the condit~ons of the various public agencies specified below.
Any changes to pubic agen.cy conditions added or significantly altered by the Examiner axe
italicized.
Failure to comply with the conditions of this approval may result in. revocation of this
approval by the Hearing Examiner. This approval does not waive the applicant's obligation to
comply with all other requirements of other agencies with jurisdiction over land development.
SPOKANE COUNTY DIVISION ~F PLANNING
All conditions imposed by the Hearing Examiner shall be binding on the "App~icant," ~
which term shall include the owner(s} and developer~s} of the property, and their heirs, assigns
and successors.
2. The change of con.ditions approval applies to the real property currently referenced as
Cou~lty Assessor's tax pazcel no. 45161.0415, and legally described in the subject change of
conditio~ls application.

3. ~'he proposal sh.all comply with the Neighborhood Business (B-1) zone, the Aqu~fer
Sensitive Area Overlay zone, and oth.er applicable provisions of the County Zoning Code, as
amended.
4. The proposal shall comply with the Spokane County Subdivision Ordinance, as am.ended.
5. The applicant sha~l develop the subj ect property in substa.ntial conformance with the site
plan of record dated Apri.l 12, 2002, subject to compliance with conditions of approval and
development regulations. The Director/desig.~ee of the Coun.ty Division of Planning Director
may admin~stratively approve minor revisions to the site plan, as provided in Section 14.504.040
of the County Zoning Code, as amended. All other changes require the subm~ttal of a change of
conditions application and its approval by the Hearin~ Examiner after a public hearing. All
~ariations shall conform to regulation standards, and the original intent of the development plans
shall be maintained.
6. The applicant shall install and maintain a six (6)-~oot high, sight-obscuring feilce alo~g the
southerly edge of the Type I landscaping installed along the south property line of t~e subj ect
proper~y.
7. Approval is required from the Director of the Division of Plann.ing/designee of a specific
lighting and sign.ing plan for the described property prior to the release of any bui~ding perm.it.
. S. Direct light from any exterior area lighting fixture shall not extend over the proper~y
boundary.
9. A specific la~ldscape plan and screening plan, planfiing schedule and provisio~s for the
maintenance acceptable to the Director of the Division of Plannin~ldesignee shall be submitted
with a perfonnance bond or other suitable guarantee for the proj ect prior to release of any
building permits. Landscaping shall be installed and maintained as required in Chapter 14.806 of
the County Zoning Code, as amended.
10. The conditions of approval of this decision replace all the conditions of approval imposed
by the 1982 rezone decision in File No. ZE-33-82, applicable to the site.
11. The Division of P~anning shall promptly file wi~h the Spokane County Auditor a Title
Notice, after the appeal period has passed for the proposal, which title notice shall generally
pzovide as follows:
"Prior to the issuance of any buildin~ permit for a~y building or an.y use on the property
described herein, the applicanfi shall be respons~ble for,corn~plying with the pro~~sions of the ~
Zoning Code for Spokane County, Section 14.706 (Aquifer Sens~tive Area Overlay Zone). The
property which is the subject of this notice is more particularly described as follows: ; insert
legal description~."
12. The Divis~on of Planning shall prepare and. record with the Spokane County Auditor a Title
Notice, not~ng t~lat the proper~y in question is subject to a variety of special conditions imposed

as a result of approval of a land use action. This Title Notice shall serve as publ~c notice of the
conditions of approval affecting the property in question. The Title Notice should be recorded
within the same time £ram.e as allowed for an appeal and shall only be released, in full or in part,
by the Division of Planning, The Title Notice shall generally provide as follows:
"The parcel of property legally described as ;inseYt legal description~ is the subject of a
decis~on by the Spokane County Hearing Examiner on September 17, 2002, approving a change
of condition application a~d imposing a variety of special development conditions, File No. ZE-
33A-82 is available for inspection and copying in the Spokane County Division of Planning."
SPOKANE COUNTY BUILDING AND C~DE EN~'ORCEMENT
1. The app~i,cant should contacfi the D~vision of Building and Code Enforcem.ent at the earliest
possib~e stage in ozder to be informed of code xequirements admi~istered/enfo~ced as authorized
by the state Bu~lding Code Act. Design/development concerns include addressing, fire apparatus
access roads, f~~e hydrant fl.ow, approved water systems, buildin~ accessibility, cons~ruction type,
occupancy classification, existing exterior wall protection and energy code requirements.
SPOKANE COUNTY DIVISI~N OF ENGINEERING AND ROADS
. Prior to the release of a building permit or use of property as proposed:
1. Access perm~ts for approaches to the County Road System shall be obtained from ~he
County Engineer.
2. The applicant shall subm~t road, dra~nage and access plans to the Spokane County Eng~neer ~
for approval.
3. A Professional Engineer (P.E.), licensed in the State of VVashil~gton, sha~l subm.it final
road and storm drainage construction plans and a drainage report that conform to the versions of
the Spokane County Standards for Road and Sewer Construction., the Guidelines for Storr~water
Management, and all appl.icable federal, state, and local regulations and laws that are in. effect at
the t~me of the plan submittal or at the time of t~le development permit applicat~on(s). The final
road and drainage plans a~d a drainage report shall receive the County Engineer's acceptance
pri.or to release o#' any associated Grading, Building or Right-of Way Permit.
4. A par.king plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking s~alls shall be in
accoxdance with standazd engineering practices. Paving or surfacing as approved by the County
Eng~neer will be required for any portion of the proj ect which is to be occupied or traveled by ~
vehicles.
5. The construction of the roadway improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
6. The County Engineer has designated a 3-Lane Minor Arterial Roadway Section for the

improvemen.t of Mission Avenue which is adj acent to the proposed development. This will
require the installation of various amounts of asphalt along the frontage of the development.
Curbing an.d sidewalk must also be constructed,
7. All required improver~en.ts shall co~lform to the cur~ent State of Washington Standard
Specifications for Road and Bridge construction and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer.
8. Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane County Resolution No. l-0298 as amended and are applicable to this proposal.
9. No construction work is to be performed within the existing or proposed right of way
until a permit has been issued by the County Engineer. Al~ work with.in the public road right of
way is subject to inspection an.d approval by the County Engineer.
10. All required construction within the existing or proposed public right of way is to be
completed prior to the release of a building permit or a bond in an amount estimated by the
Count~ Engineer to cover the cost of construction or improvem.ents shall be filed with the County
Engineer.
11, The applicant is advised that theze may exist utilities either under~round or overhead
affecting the applicant's property, including proper~y to be ded~cated or set aside future
acquisition. Spokan.e County will assume no financial obligation for adjustments ox relocat~on
regarding these utilities. The applicant should contact the applicable utilities regarding
zespons~bility for adjustment or relocation costs and to make arrangements for any n.ecessary
work.
12. The applicant shall grant applicable border easements adj acent to Spokane County Right
of Way per Spokane County Standards.
13. The Spokane County Engineer will issue a Concurrency Certificate under the Spokane
County Comprehensive Plan at tl~e time of building permit.
14. The proposed change of conditions has been reviewed according to the site plan of record.
Any modifications to this site p~an of record shall require additional review by the County
Engineer. At such time as a revised site plan is submitted for review, the applicant shall submxt
detailed traffic information for review by the County Eng~neer to determine what traffic impacts,
if any, that the development would have on surrounding infrastructure. The applicant is advised
that mitigation maybe required for off site improvements. ~
SP4KANE COUNTY DIVISION OF UTILITIES
l. Pursuant to the Phase I Development Regulations adopted by the Cou~lty as part of the
County Zoning Code, a wet (live) sewer connection to the area-wide Public Sewer System shall
be constructed. A sewer connection permit is required. Commercia~ deve~opments shall subm.it

estab~ish sev~er fees.
2. ~.,he applicant shall submit expressly to Spokane County Division of Ut~lit~es, "under
sepaxate cover", only those plan sheets showing sewer plans and specifications fo~ the public
sewer connections and facilit~es for review and approval. Cor~mercial developments shall
submit historical and/or estimated water usage as part of the sewer plan submittal.
3. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the ~ssuance
of the sewer connection permit.
4. Arrangements for payment of applicable sewer charges must be made prior to issuance of
sewer. connection permit. Sev~er charges may include special connection charges and general
facilities charges. Charges may be substantial dependi~.g upon the nature of the development.
S. As1y water service for. th~s project shall be provided ~n accordance with the Coordinated
Water System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. The sewage d~sposa~ method shall be as authorized by tlle Director of ~Jtilities, Spokane
County.
2. Water service shall be coordinated throug~~ the Director of Utilit~es, Spokane County.
3. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the project. The use of on-site sewage
disposal system shall not be authorized.
5. The use o~ private wells and water systems is prohibited.
SPOI~ANE COUNTY AYR POLLUTION CONTROL AUTHORITY
1. Al~ applicable air pollution control regulations shal~ be met.

1. All conditions imposed by the Hearing Examiner shall be binding on the "applicant", which
term shall include the developer, owner(s) ofthe property, heirs, assigns and successors.
2. The Change of Condition applies to the following real property:

Beginning at a point 169.7 feet East of the Northwest corner of said Tract 5; thence

3. The proposal shall comply with the Neighborhood Business ~6-1} zone and all other

4. The proposal shall comply with the Spokane County Subdivision Ordinance, as amended.
5. The applicant shall develop the subject property in conformance with the site plan of
record presented to the Hearing Examiner on June 19, 2002, subject to compliance with
the conditional of approval and development regulations. All aspects of the concept and proposal shall be binding on the development, including proposed uses. Variations, to be
approved by the Director of the Division of Planning/designee, shall only be allowed to
meet regulation standards and conditions of approval.
fi. Approval is required by the Director of the Division of Planningldesignee of a specific
lighting and signing plan for the described property prior to the release of any building permits.
l. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
8. A specific landscape plan, planting schedule and provisions for maintenance acceptable
to the Director of the Division of Planningldesignee shall be submitted with a performance
bond or other suitable guarantee forthe project priorto release of building permits.
Landscaping shall be installed and maintained so that sight distance at access points is
not obscured or impaired.

9. A six (6)-foot high sight-obscuring f~nce srall be constructed on the southern edge of the ~
Type I landscaping strip located along the south property line.
10. The Division of Planning shall prepare and record with the Spokane County Auditor a Title
Notice noting that the property in question is subject to a variety of special conditions
imposed as a result of approval of a land use action. This Title Notice shall serve public
notice of the conditions of approval affecting the property in question. The Title Notice
should be recorded within the sarne time frame as allowed for an appeal and shall only be
released, in full or in part, by the Division of Planning. The Title Notice shall generally
provide as follows:
"The parcel of property legally described as ~ ] is the subject of a land use action by
a Spokane County Hearing Examiner on June 19, 2002, imposing a variety of special
developrnent conditions. File No. ZE-33A-82 is available for inspection and copying in the
Spokane County Division of Planning."
12. All remaining conditions of approval for ZE-33-82 shall remain in effect.
13. The Division of Planning shall file with the Spokane County Auditor, within the same time
frame as allowed for an appeal from the final disposition, including lapsing of appeal
period, a Title Notice, which shall generally provide as follows:

described herein, the applicant shall be responsible for complying with the provisions of

The Spokane County Division of Engineering and Roads has reviewed the above referenced
~ application. The following "Conditions of Approval" are submitted to the Spokane County Division of
Planning for inclusion in the "Findings of Fact, Conclusions and OrderlDecision" should the request be
approved.
Prior to release of a building permit or use of property as proposed:
The Spokane County Engineer has no objection to the Change of Condition Application for deletion
of Spokane County Planning Department Condition D~a}(6) - requiring a public hearing for site plan
review. Since the approval of the Application for Zone Change on October 14, 1982, development
conditions have changed in th~e surrounding area, which include but are not limited to, adoption of
new Spokane County Road Standards and the re-construction of Mission Avenue - CRP #2809. The
following Engineering Conditions of Approval replace previous Engineering Conditions of Approval
for ZE - 33-82 for the portion of property described in this proposal.
1. Access permits for approaches to the County Road System shall be obtained from the County
Engineer.
2. Applicant shall submit for approval by the Spokane County Engineer road, drainage and access
p ans.
3. A Professional Engineer ~P.E,}, licensed in the State of Washington, shall submit road and
storm drainage construction p ans and a drainage report that conform to the versions of the
Spokane County Standards for Road and Sewer Construction, the Guidelines for Stormwater
Management, and a app icable federa, state, and ocal regulations and laws that are in effect
at the time of the plan submittal or at the time of the development permit application~s). The

4. A parking plan and traffic circulation plan sha I be submitted and approved by the Spokane
County Engineer. The design, location and arrangement of parking stalls shall be in
accordance with standard engineering practices. Paving or surfacing as approved by the County
Engineer will be required for any portion of the project which is to be ~occupied or traveled by
vehicles.
5. The construction of the roadway improvernents stated herein shall be accomplished as
approved by the Spokane County Engineer.
6. The County Engineer has designated a 3-Lane Minor Arterial Roadway Section for the
improvement of Mission Avenue which is adjacent to the proposed development. This will
require the addition of various amounts of asphalt along the frontage to match existing
improvements to the east of the development. Curbing and sidewalk must also be constructed.
7. All required improvements shall conform to the current State of V1lashington Standard
Specifications for Road and Bridge construction and other applicable county standards andlor
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the
, date of construction, unless otherwise approved by the County Engineer.
8. Roadwa.y standards, typical roadway sections and drainage plan requirements are found in
Spokane Board of County Commissioners resolution 1-0298 as amended and are applicable to
this proposal.
9. No construction work is to be performed within the existing or proposed right of way until a
permit has been issued by the County Engineer. All work within the public road right of way is
subject to inspection and approval by the County Engineer.
10. All required construction within the existing or proposed public right of way is to be completed
prior to the release of a building permit or a bond in an amount estimated by the County
Engineer to cover the cost of construction or improvements shall be filed with the County
Engineer.
11. "The applicant is advised that there may exist utilities either underground or overhead effect~ng
the applicant's property, including property to be dedicated or set aside future acquisition.
Spokane County will assume no financia obligation for adjustments or relocation regarding
these utilities." "The applicant should contact the applicable utilities regarding responsibi ity for
adjustment or relocation costs and to make arrangements for any necessary work."
12. The app icant shal grant applicab e border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
13. f the requested zone change is granted, the Spokane County Engineer wi issue a

14. This proposed zone change has been reviewed according to the site plan of record. Any
modifications to this site plan of record shall require additional review by the County Engineer.
At such time a revised site plan is submitted for review, the applicant shall submit detailed traffic
information for review by the County Engineer to determine what traffic impacts, if any, that the
~ development would have on surrounding infrastructure. The applicant is advised that mitigation
maybe required for off-site improvements.

Prior to release of a building permit or use of property as proposed:
The Spokane County Engineer has no objection to the Change of Condition Application for deletion
of Spokane County Planning Department Condition D(a}(6) - requiring a public hearing for site plan
review. Since the approval of the Application for Zone Change on 4ctober 14, 1982, development
conditions have changed in the surrounding area, which include but are not limited to, adoption of
new Spokane County Road Standards and the re-construction of Mission Avenue - CRP #2809. The
following Engineering Conditions of Approval replace previous Engineering Conditions of Approval
forZE - 33-82 forthe portion of property described in this proposal.
1. Access permits for approaches to the County Road System shall be obtained fro~n the County
Engineer.
2. Applicant shall submit for approval by the Spokane County Engineer road, drainage and access
plans.
3. A Professional Engineer ~P.E.), licensed in the State of Washington, shall submit road and
storm drainage construction plans and a drainage report that conform to the versions of the
Spokane County Standards for Road and Sewer Construction, the Guidelines for Stormwater
Management, and all applicable federal, state, and local regulations and laws that are in effect
at the time of the plan submittal or at the time of the development permit application(s}. The
final road and storm drainage plans and drainage report shall receive the County Engineer's

acceptance prior to release of any Grading, Building, or Right-of-Way Permit.
4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane
County Engineer. The design, location and arrangement of parking stalls shall be in
accordance with standard engineering practices. Paving or surfacing as approved by the County
Engineer will be required for any portion of the project which is to be occupied or traveled by
vehicles.
5. The construction of the roadway improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
6. The County Engineer has designated a 3-Lane Minor Arterial Roadway Section for the
improvement of Mission Avenue which is adjacent to the proposed development. This will
require the addition of various amounts of asphalt along the frontage to match existing
improvements to the east of the development. Curbing and sidewalk must also be constructed.
7. All required improvements shall conform to the current State of UVashington Standard
Specifications for Road and Bridge construction and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer.
8. Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane Board of County Commissioners resolution 1-0298 as amended and are applicable to
this proposal.
9. No construction work is to be performed within the existing or proposed right of way unti) a
permit has been issued by the County Engineer. All work within the public road right of way is
subject to inspection and approval by the County Engineer.
10. All required construction within the existing or proposed public right of way is to be completed
prior to the release of a building permit or a bond in an amount estimated by the County
Engineer to cover the cost of construction or improvements shall be filed with the County
Engineer.
11. "The applicant is advised that there may exist utilities either underground or overhead effecting
the applicant's property, including property to be dedicated or set aside future acquisition.
Spokane County will assume no financial obligation for adjustments or relocation regarding
these utilities." "The applicant should contact the applicable utilities regarding responsibility for
adjustment or relocation costs and to make arrangements for any necessary work."
12. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
13. If the requested zone change is granted, the Spokane County Engineer will issue a
Concurrency Certificate under the Spokane County Comprehensive Plan for Ten ~10} PM peak
hourtrips for a 6500 square foot office building.

14. This proposed zone change has been reviewed according to the site plan of record. Any
modifications to this site plan of record shall require additional revievu by the County Engineer.
At such time a revised site plan is submitted for review, the applicant shall submit detailed traffic
information for review by the County Engineer to determine what traffic impacts, if any, that the
development would have on surrounding infrastructure. The applicant is advised that mitigation
maybe required for off-site improvements.

various materials. The applicant has proposed sight-obscuring fencing in addition to the required

The application for the proposed Change of Conditions was submitted on April 17, 2002. A Technical
Review meeting was held on Nlay 9, 2002, and the Notice of Application was issued on May 2, 2002, with a comment period ending on May 16, 2002.
A Zone Reclassifcation, ZE-33-82, from Agricultural Suburban (AS) to Local Business (LB) on .78 acre for
the purpose of developing Shur Kleen Carpet Cleaners and no specific use for Parcel "B", was approved by
the Hearing Examiner Committee on October 14,1982 with specific conditions of approval limiting
development of the site. The subject site identified in this Change of Conditions application is Parcel "B" of the original Zone Reclassification request. Condition D~a)(6) requires uThat Parcel "B" shall submit a
specific development plan for review by the Hearing Examiner Committee at a pubtic hearing".

The existong zoning of the site is Neighborhood Business ~6-~~ established in 1991, and previously classified
as LocaO Business (L~) in 1982 ~ZE-33-82). Pursuant to the Phase I Developrnent Regulations, and in
recognition of only par~ial implementation of the Comprehensive plan as adopted on August 24, 2001, 4he purpose and 'on4ent of the Neighborhood ~usiness (6-1) zone is to allow for limited, small scal~
neighborhood ser~ing retai0 and office uses as a means of implementing the iVlixed Use, Urban Activity
Center, Communit~ Center, Neighborhood Commercial, Neighborhood Center and Commercial/industrial
Limited Development Area categories of the Comprehensive Pl~n. Previously, the Neighborhood Business
(~•1) category was used as a means to impler~ent the Niajor Commercial, Urban and Suburban categaries
of the Comprehensive Plan.
The Neighborhood Business (~-1~ zone is intended to provide land use transition befi~een intense and less
intense land use categories of the Comprehensive Plan. TP~e uses allowed in the Neighborhood Business
(B-1) zone are usually oess intense than those of other business zones and the development standards,
associated uvith compatibility and aesthetocs, provide appropriate land use transition. Site access should be

3. The proposal shall comply with the Neighborhaod Business ~B-1) zone and all other
applicable chapters of the Spokane County Zoning Code, as amended.
4. The proposal shall comply with the Spokane County Subdivision Ordinance, as amended.
5. The applicant shall develop the subject property in conformance with the site plan of
record presented to the Hearing Examiner on June 19, 2002, subject to compliance with
the conditional of approval and development regulations. All aspec~s af the concept and
proposal shall be binding on the developrnent, including proposed uses. Varia4ions, to be
appraved by the Director of the Division of Planningldesignee, shall only be allowed to meet regulation standards and conditions of approval.
6. Approval is required by the Director of the Division of Planning/designee of a specific
lighting and signing plan for the described property prior to the release of any building
permits.
7. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
8. A specific landscape plan, planting schedule and provisions for maintenance acceptable
to the Director of the Division of Planning/designee shall be submitted with a performance
bond or other suitable guarantee for the praject prior to release of building permits.
Landscaping shall be installed and maintained so that sight distance at access points is
not obscured or impaired.

10. The Division of Planning shall prepare and record ~ith the Spok~ne County Auditor a Ti~le
Notice noting that the proper~y in ques4ion is subject to a variety of special conditions
imposed as a result of approval of a land use ac~ion. This ~itle Notice shall serve public notice of the conditions of approval affecting the property in question. The Title Notice
should be recorded within the sarne time frame as allowed for an appeal and shall only be
released, in full or in par~, by the Division of Planning. The Title Notice shall generaely
provide as ~ollows:
"The parcel of proper~y legally described as ~ ~ is the subject of a land use action by
a Spokane County Hearing Examiner on June 19, 2002, imposing a variety of special
development conditions. File No. ZE-33A-~2 is available for inspection and capying in the Spokane County Division of Planning."
12. All remaining conditions of approval for ZE-33-82 shall remain in effect.
13. The Division of Planning shall f le with the Spokane County Auditor, uvithin the same time
frame as allowed for an appeal from the final disposition, incOuding lapsang of appeal
period, a Title Notice, which shall generally provide as follows:
"Prior to the issuance of any building permit for any building or any use on the proper~y
described herein, the applicant shall be responsible for compiying with the provisions of

Planning for inclusion in the °'Findings of Fact, Conclusions and OrderlDecision°'should the request be
approved.

The Spokane County Engineer has no objection to the Change of Condition Application for deletion
o~ Spokane County Planning Depar~~nent Condition D(a}~~~ - requiring a public hearing for site plan
review. Since the approval of the App~ication for Zone Change on October 14, 1982, development
conditions have changed in the surrounding area, ~hich inc ude but are not limited to, adoption of
new Spakane Coun~ Road Standards and ~he re-construction of Mission Avenue - CRP #28Q9. The
following Engineering Conditions of Approval replace previous Engineering Conditions of Approva0
for ZE - 33-82 for the portion of proper~y described in this proposal.
Access permits for approaches to the Counfy Road System shall be obtained fror~ the Coun~y
Engineer.
2. Applicant shall submit for approval by the Spokane County Engineer road, drainage and access
plans.
3. A Professional Engineer ~P.E.~, licensed in the S~ate of UVashington, shall submit road and
storm drainage construction plans and a drainage repor~ that conform to the versions of the
Spokane County Standards for Road and Sewer Construction, the Guidelines for Storm~vater~~
Nianagement, and al app icab e federa , state, and oca' regulations and laws that are in ef~ect t
a~ the time of the p an submittal or at the time of t~e deve~opment permit applica~ion~s}. The

4. A parking plan and tra~fc circulation plan sha.0 be submitted and approved by the Spokane
County Engi~eer. The design, location and arrangement of parking stalls shall be in
accordance with standard engineering practices. Paving or sur~aci~ng as approved by the Coun$y
Engineer will be req~ired for any porfion of the project ~rhich is to be ~occupied or traveled by
vehicles.
5. The construction of the road~vay improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
fi. The County Engineer has designated a 3~Lane N9inor Ar~erial Roadway Section for the
io~provement of Mission Avenue vuhich is adjacent to the proposed development. This will
require the addi~ion of various amounts of asphalt alo~g $he frontage to match existing
imp~ovements to the east of the development. Curbing ~nd sodewalk must aiso be constructed.
l. All required improvements shall coc~f~rm to the current State ~f UVashington Standard
S~ecifcations for Road and ~radge const~uction and other applacabl~ county s$andards andlor
adopted resolutions pertaining to Road Standards and Stormwater Management i~ effect at the
date of construction, unless othe~rrise approved by the Coun~y Engineer.
8. Roadway standards, ~pical road~ray sections and drainage plan requirements are found in
Spokane ~oard of County Cornmissioners resolution 1-0298 as amended and are applicable ~o
this proposal.
9. IVo construction work is to be performed ~rothin the existing or proposed right of ~ray until a
permit has been issued by the Counry Engoneer. All uvork within the public road right of ~ay is
