ZE-056-94 ~ . ~ SPOKANE COUNTY HEARING EXA►MINER COMMITTEE FINDINGS OF FACT, CONCLUSIONS AND ORDER INTRODUCTION Tlus matter has come before the Hearmg Examiner Committee on January 26, 1995 The members of the Comm~ttee present are Harry Cnbbons, Chair, Verana Southern and Jane Myers PROPOSAL ~ The sponsor, Park Place General Partwrship, % Dee McGonigle, reqaests approval of a Zone Reclassif'ication, ZE-56-94, from General Agncultural(GA) and Urban Residennal3 5(UR 3 5) to Urban Residenual-22 (UR-22) for an asnsted care fachty and those uses allowed in the Urban Residennal-22 (UR 22) zone Sixty (60) assisted hvuig uruts and a thuty (30) bed special care facility n proposed. FINDINGS OF FACT AND CONCLUSIONS 1 The property is generally Iocated east of and adjacent to Park Road, north of 8th Avenue and approxunately 2,000 feet south of Sprague Avenue m the NW 1/4 of Secaon 19, Township 25 North, Range 44 EWM, Spokane County, Wastungton 2 The Comrmttee adopts the Plannuig Department Report as a part of this recond. 3 The existing land uses in the area include vacant undeveloped land, Dishman Hdls Natural Area, single family readenves, a retiremeat facility and Edge Qff Park. 4 The pmposed use is compatible vrrith existing uses in the area. 5 The pmperty is located withm the Urban (4 47 acres) and Rural ( IZ acreJ5,000 square feex) categanes of the Comprehensive Plan with the majonty of the site situated in the Pnonty Sewer Service Area (PSSA) The Urban categary is intended to provide the opportumty for development of a "citylike" envuonment which includes vanous Iand uses, intensive resulential development and pubhc facilitles and servLCes Multi family structures should be located with duwt or near direct acvess to the major artenal road systems rather than on intenor neighborhood streets Access to pubhc tianspxution should also be considered. The "Rural Category" is intended to provide the opportunity for development of agricultural, timber or open envYronments in a"countrylike" setang Most urban, major commercial and uidustnal activiaes would be incompatible ui the Rural Category Urban, suburban, and some senu-rnral intensity residenual subdivisions not related to agnculture would also be out of place The aesthetic semng of the Rurdl Category will L be open space Large culavated fields, pastures and timber and natural areas will consume most of the land. 6 The proposed zonuig dces unplement and conform to the Comprehensive Plan 7 The Spokane County Artenal Road Plan identifies Pazk Road as a Principal Artenal wrth an exisang nght-of-way width of 60 feet and a recommended nght-of-way wndth of 100 feet In order to unplement the Aroenal Road Plan, the Spokane County Engineer is requesting two (2) feet of dedication and that a stnp of prvperty eighteen (18) feet in width along Park Road be designated as Future Avqmsition Area (FAA) Structure setbacks should be established from the eighteen (18) foot Futur+e Acquisltion Area (FAA) as recammended by the Comprehensive Plan Buddwg/structure setbacks are recommenby the Comprehensive Plan to be 35 feet from the Futum Acquisition Area. Improvements to Park Road will be - determined and specified by the Spokane County Enguieer 8 The existing zonulg of the property descnbed in the apphcaaon is Urban Residential,-3 5(iJR 3 5) previously estabhshed as Agncultural (A) (File no 16-59) zoning ia 1959 and redesignated to Urban Resideatial-3 5(UR-3 5) on 3anuary 1, 1991 pursuant to the Program to Implement the Spokane County Zorung Code The proposal dces conform to the reqairements of the proposed zone 9 The provisions of RCW 43 21C (The State Envuenmental Pohcy Act) have been comphed vvith and a Detertnmation of Nonsignificance (DNS) was issued. The Commttee, after uidependent review, hereby adopts the DNS 10 The legal reqwrements for pubhc aotioe have been fulfilled. 11 The owners of adjacent lands expressed neither approval nor disapproval of the ProPosed use 12 The apphcant has demonstrated that vonditions have substantrally changed since the angiaal zonuig of dus area, and accardmgly, the pmposed zone reclassifieanon is justified.
