INTRODUCTION
This matter has come be~ore the Hearing Exam~ner Committee on December 20,
1990, The members of the Committee present are Verona Southern, Chairperson,
Harry Gibbons and Phil H~rris.
PROPOSAL '
The sponsors, Kevin & Kris Rudeen, request approval of a Zone Reclassification, File No. ZE-48-90, for the purpose of developing 110 multiple family dwelling units
on approximately 5.10 acres.
FINDINGS OF FACT AND CONCLUSIONS
1. The p~operty is generally located approximately 250 feet west of Pines Road, and south of and adjacent to Maxwell Avenue, in the NE 1/4 of Secrion l6, Township 25
N., Range 44 EWM, Spokane County, Washington..
2. The committee adopts the Planning Department Report as a patt of this neco~.
3. The existinng land use{s) in the area are single family residential, retail, office and
undeveloped. ~
4. The Comprehensive Plan desibnates this site as Urban. The Urban category
encourages a variety of residential types and densiries with net densities of 1 to 17
units per acre. The Urban category recognizes that multi-family transirion use can be
urilized between single family residential and the more intensive development along
Pines Road.
5. The e~sting zoning of the property described in the application is Agricultural
Suburban (AS), Residential Office (RO) and Local Business (LB), previously
established in 1955,1977, and 1978. ~
6. The pr~ovisions of RCW 43.21C (The State Environmental Policy Act) have been
. complied with and a Determination of Nonsignificance was issued.
7. The legal requirements for public notice have been fulfilled.
8. The owners of adjacent lands expressed both approval and disapprnval of the
proposed use. Concerns expressed included objecrions to building height along the
northerly property line, and additional traaffic volume on Maxwell Avenue. ~
9. The proposed use is compdtible with exisring uses in the area.
10. The p~oposed zoning does implen~ent and conform to the Comprehensive Plan.

COUNTY PLANNING DEPARTMENT
1. All curnent standards of the Urban Residential-22 (UR-22) Zone as amended or applicable shall be complied with in development of the site and the following
condirions adopted by the He~ring Examiner Committee shall be complied with any
development of the site. The applicant shall develop subject pnoperty generally in
accondance within the concept presented to the Hear'~ng Body as arnended by the ~
above cond.itions.
a. That the west 151 feet of the subject property be limited to a maximum of 10 dwelling units.
b. That all s~uctures wlth proposed dev~lopment shall not exceed a maximum
height of 35 feet, with t~~~ exception t~l~~t the northwesterly dwelling unit shall

not exceed a maximum height of 25 feet for the northerly 2 dwelling units within said structure.
c. That the northwest dwelling unit sh~ll be setback a minimum of 15 feet from
the northerly property line.
d. That all construcrion equipment shall only access the subject propcrt}► thnough the 40 foot access easement to Pines Road.
Variarions, when app~oved by the Planning Director/designee, may be pcrnutt~ed,
including, but not limited to building location, landscape plans and general
allowable uses of the permitted zone. All variations must conform to ~gulations set
forth in the Zoning Code for Spokane County and the condirions as amended above ~
by the Hearing Examiner Committee. The original intent of the development plans shall be maintained.
2. Approval is r1equired by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.
3. A speci~c landscape p1an, planting schedule and provisions for maint~enance
acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired.
4. Direct light from any exterior area lighting fixrure shall not extend over the property ~
boundary. ~
5. The Planning Department shall prepare and record with the Spokane County
Auditor a Title Norice noring that the property in quesrion is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title
Notice shall serve as public notice of the conditions of approval affecring the
property in quesrion. The Title Notice should be recorded within the sa~rrie time
frar~ae as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The ~'itle Notice sh~l generally provide as follows:

3. Access permits and improvements to Fines Road (S.R. 27) must be app~ved by the Washington State Department of Transportation (WSDO'I~.
4. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
5. The applicant shall submit for app~val by the Spokane County Engineer and the
Spokane County Health Dismct a detailed combined on-site sewage system plan and surface water disposal plan for the entirre p~jec~ or portion thereof, if the
development is to be pha.sed.
6. A par~ang plan and tr~affic circulation plan shall be submitt~ed and approved by the
Spokane County Engineer. The design, locadon and arrangement of par~ang stalls
shall be in aa;o~ance with standand tr~faffic engineering practices. Paving or surfacing as appraved by the County Engineer, will be ~quired for any portion of
the project which is to be occupied ar ~aveled by vehicles.
7. The cons~ucrion of the road impr~vements stat~ed herein shall be accomplishe~ as
approved by the Spokane County Engineer.
8. The County Engineer has designated Typical Roadway Section Number One, Local Access standand for the improvement of Maxwell Avenue, which is adjacent to the
p~posed development. This will require the addirion of approximately b-8 feet of
asphalt along the fnontage of the development. The cons~uction of curbing and
sidewalk is also required.
9. All required imp~vements shall conform ~o the current State of Washington
Standard Speci~carions for Road and Bridge Constivction and other applicable County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of cons~ucrion, unless otherwise
approved by the County Engineer.
10. Applicant shall construct a paved and delineated app~ach to meet the existinng
pavement on Maxwell Avenue.
11. Roadway standands, typical roadway secrions and drainage plan nequirements are
found u~ Spokane Board of County Comr~ussloners Resolu~on No. 80-1592 as
amended and are applicable to this progc~sal.
12. This plat or development proposal is located within a drainage basin which has been
identi~ed by the Spokane County Engineer's office as having stormwater runoff problems. Since this plat or development p~posal is affect~ed by or is a con~ibutor
to stormwater flows, property owners should participate in the planning and
implementation of a future basinwide stormwater management system. The
following statement shall be placed in the plat deci~ication: ~
"The owner(s) or successor(s) in inter~st agree to join in any County-approved ~
stormwater management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design, constructing, maintai~ning or operaaon of stormwater con~ol faciliries."

13. No construction work shall be perfornied within the existing ar proposed public right-of way until a permit has been issued by the County Enginoer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
14. All requir~ed cons~uction within the exis~ing or p~posed public right-of-way is to
be complet~d prior to the release of a building permit, or a bond in an amount
esrimated by the County Engineer to cover the cost of construcrion of improvements shall be filed with the County Engineer.

~ Special Condirion:
15. A secondary ingress and egress shall be provided to Pines Road (S.R. 27), as shown on the rezone site plan.
COUNTY UTILITIES DEPARTMENT
1. Applicant shall make connection to Public Sewer System. Sewer connoction perniit
is required.
COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Uriliaes, Spokane
County. ~
2. Water service shall be coordinated through the D►inector of Urilities, Spokane ~ County.
3. Water service shall be by an e~sring public water supply when approved by the
Reg~onal Engineer (Spokane), State Deparnnent of Healih.
4. A public sewer system will be made available for the project, and individual service
will be provided to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be authorized.
5. Use of private wells and water systems is prohibited.
COUNTY BUILDING AND SAFETY DEPARTMENT
1. The applicant shall contact the Department of Building and Safety at the earliest
possible stage of design/development in o~der to be informed of code requirements
ac~minis~eredJenfo~ed by the department, e.g., State Building Code Act
regulaaons, such as r~equirements for f~re hydrantlflow, fire apparatus access roads, ~
smeet address assignment, barrier-free regularions, energy code regularions and
general coordination with ot~er aspects of project implementation.
2. The issuance of a building permit by the Department of Building and Safety is required.

1. Air pollurion regularions nequin that dust emissions during demolition, cons~uction
and excavation p~jects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of acrivity during certain weather cond.itions. Haul roads
should be created, and emissions from the traansfer of earthen material must be
controlled, as well as ~missions from all other constn~ction-relat~ed activiries.
2. All ~avelled surfa~ces need to be paved and kept clean. If ~cacking or spills occur on
paved surfaces, m~easures must be taken immediately to clean these surfaces.
3. Debris generated as a~sult of this p~ject must be ' of by means other than
. urning.
4. Solid fuel heatinng devices shall meet provisions of SCAPCA Regulation I, Article .
VIII.

The following "Conditions of Approval" for the above referenced 2one
change are submitted to the Spokane County Hearing Examiner Committee
for inclusion in the "Planning Report" and '~Findings and Order" of
the public hearing scheduled December 20, 1990. .
Prior to the release of a building permit or use of the property as proposed:
E36 Applicant shall dedicate 5 feet on Maxwell Avenue for ~ight of
way.
E40 Access permits for approaches to the County Road System shall be obtained from the County Engineer.~
E41 Access permits and improvements to Pines Road (S.R. 271 must be
approved by the Washington State Depar~ment of Transportation
(W.S.D.O.T.).
E43 Applicant shall submit for approval by the Spokane County
Engineer road, drainage and access plans.
E44 The applicant shall submit for approval by the Spokane County . Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof if the
development is phased.
E45 A parking plan and traffic circulation plan shall be submitted and a~~roved by the Spokane County Engineer. The design,
location and arrangernent of parking stalls shall be in
accordance with standard engineering practices. Paving or
surfacing as approved by the County Engineer will be required

traveled by vehicles
E48 The construction of ~he roadway improvements sta'ted herein shall be accomplished as approved by the Spokane County Engineer.
E50 The County Engineer has designated Typical Roadway Section
Number One, Local Access standard for the improWement of
Maxwell Avenue which is adjacent to,the proposed development.
This will require the addition of approximately 6-S ft. of
asphalt along the frontage of the development. Curbing and
sidewalk must also be constructed.
E51. All requi.red improvements shall conform to the current State of
Washington Standard Specifica~ions for Road and Bridge
construction and other applicable county standards and/or
adopted resolutions pertaining pertaining to Road Standards and Stormwater Management in effect at the date of construction,
unless otherwise approved by the County Engineer. .
E53 The applicant shall construct a paved and delineated approach to
meet the existing pavement on Maxwell Avenue.
E55 Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 80-1592 as amended and are applicable to this
proposal.
E56 This plat or development proposal is located within a drainage
basin which has been identified by the Spokane County Engineer"s
Office as ha~ing stormwater runoff problems. Since this plat or
developmen~ proposal is affected by or is a contributor to
stormwater flows, property owners should participate in the
planning and implementation of a future basinwide stormwater management system. The following "Condition of Approval" shall
be required:
That the owner(s~ or successor(s~ in i.nterest agree to join
in any county approved Stormwater Management Program and to pay
such rates and charges as may be fixed through public hearings
for service or benefit ob~ained by the planning, design,
construction, maintaining or operation of stormwater control facilities

proposed right of way until a permit has been issued by the

II. SITE ANALYSIS
Comprehensive Pian: Category is Urban and the site is inside the Priority Sewer
Service Area (PSSA) Boundary. The Urban category encourages a variety of
residential types and densi~ies to reflect a city like environment. Criteria for type and
density of a development is dependent upon site specific considerations such as
adjacent land use and zoning pattern, locarion, pro~mity to arterials, and
development ~ends. The goals, objectives and decision guidelines of the Urban
category recognize that mula-family development will usually be a transi~onal use between single family residenrial and more intensive development, that multi-family
development should be located with direct or near direct access to designated arterials,
and that careful considerarion must be given to the density and design of multiple
family development to ensure protection of amenities of single family areas.
ComFatibility between multiple family and single family development may require use
of landscaping, physical separation, height limitation, access restrictions, screening or modlficat~on ~n ~ntensity of proposed land use.
Arterial Road Ptan: Pines Road (S. R.-27) to the east of the site is a State
highway and not within the Spokane County Arterial Road Plan. The Department of
Transportation has jurisdiction on access to State right-of ways such as Pines.

Zoning and Iand use trends of the area reflect a change from residential uses to retail,
office, and multiple family developments. Parcels adjacent to Pines Road have been subject to numerous zone changes to the Local Business, Residential Off ce, and
Commercial since the adoption in 1981 of the Spokane County Comprehensive Plan.
These zones are within the Major Commercial Comprehensive Plan category which
extends approximately 250 feet west of Pines Road. Multiple Family Suburban and
Res~dennal Office Zon~ng has been used as a buffer between business zones and
residential development within Urban Comprehensive Plan category.
Existing Multiple Family Suburban and Residential Office Zones in the area are
generally found within b50 feet of Pines Road. The proposed zone reclassification
~ would extend multiple family development approximately 150 feet further into the
Urban category and an existing single family residenaal area. _
Two previous zone change requests from Agricultural Suburban to Residential Office and Locai Business were app~ved for the subject property (see ZE-125-77A, _
ZE-170A-78) and provided for future development of office, business, and limited
retail uses. The proposed zone change would eliminate previous zoning approvals
and prov~de for mul~ple family development at densiry of 21.56 dweUing units per
acre. According to the Program to Implement the Spokane County Zoning Code, on
January 1,1991 existing zoning classi~cations in the area will crossover to the new
Zoning Code as follows; Agricultural Suburban (AS) to Urban Residential -3.5 (UR-3.5)

wide easement extend~ng easterly from the s~te to P~nes Road (SR-27)

The site plan submitted for review by the Hearing Examiner Committee is general in natune. Detailed review to deternune compliance with all Ordinanee
regulations and condirions of approval is recommended to be administrative and
to occur at the Building Permit stage.
III. STTE DEVELOPMENT RECOMMENDATIONS
Density: The proposed density of 21.Sb dwelling units per acre is excessive given
the pr~~ect's loca~on to adjacent s~ngle fanuly development without providing a
"density transition" to those existing single family uses. Reduction in density alang
west property line is recommend to provide an adequate tr~nansition from high density
multiple fam~ly to s~ngle fam~ly development. Denslty ~cansition could be provided
by excluding the westerly 145 feet from the rezone proposal, or use of Urban ,
Resideneal-12 (UR-12} or Urban Residential-7 (UR-7) Zoning as a buffer within said 145 feet.
Design: Proposed design concept with multiple family structures, off s~eet parking
at slte penmeter and between structures, and nurumal landscaping can satisfy
minimum standards of pr~posed Urban Residential-22 (UR•22) Zone. The site plan
does not provide a good dens~ty transition form ma~or commercial uses to the east and
s~ngle fam~ly deveiopment to west. Site also does not have dlrect, or near direct access to a major arterial, and does not provide adequate landscape buffers to
adjoining residential use. -
Buffering/i.andscaping: Site plan modifica~on would be required to illus~ate 20
feet of Type III landscaping adjacent Maxwell Avenue and provision of b foot
decorative wall, solid landscaping, or sight obscunng fence where Urban Residential- -
22 (UR-22) Zone abuts the Urban Residential-3.5 (UR-3.5) Zone (along west, north and portion of south property lines) as per Zoning Code requirements. Site plan
rev~sion w~ll also be re,quu~ed to show a 3b inch decorative wall, s~ght obscuring
fence, 3 feet Type I landscaping, or 3 feet berm with Type IV landscaping where off

IV, SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal,
other available information, County ordinances, other regularions and laws, possible
standard Condirions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has deterinined that "No
probable signi~cant adverse impacts" would result from the proposal being developed
and has issued a D~rmin~i n Qf NQn~ignificance ("DNS").
The "DNS" was circulated to 9 other agencies of jurisdiction and other
, agencies/departments affected by the future development for review and comment.
The "DNS" comment period ends December 18th,1990 and was advertised 15
calendar days before said date in the newspaper, by letter to adjacent property owners
. within 400 feet of the proposal, and by notice on a sign posted on the proposal site.
The Hearing Examiner may consider additional environmental related testittnony at the
public heanr~g.
V , PLANNING DEPARTMENT SUMMARY
Proposed zone change is not consistent with goals, objecrives, and decision
guidelines of the Urban Comprehensive Plan category which encourage high density residential development to locate with direct or near direct access to designated
arterials, and mul~-family development that will enhance residential character of area.
Buffering and landscaping is also encouraged to mitigate differences between
proposed and existing uses. Proposed design does not provide an adequate buffer to
adjacent single family development to west and north, or provide a~ansition in
density from high density multiple family to single ~amily uses. Design also does not
prov~de duect or near direct access to a des~gnated arterial. Use of easement and local access s~eet (Maxwell Avenue} could result in excessive t~affic volume and
congestion at intersection of Pines Road and Maxwell Avenue. Delering the west 145
feet of subject property from the proposed zone change would reduce overall density,
provide area for density transit~on to fewer units and extensive landscape buffer on
western portion of site and minimize extension of multiple family development into

single family neighborhood. For the above stated reasons the Planning Department .
recommends denial of zone change as proposed. Planning Department would
support app~oval of the proposal with the following modi~ca~ons:

2) Internal density reducrion in the project with site plan to show density ~ransition
and reducrion from east to west, Density ~ansition to be accomplished by
increase of open space reduc~on in number of units and height of units.

1. All current standards of the Urban Residenaal-22 (UR=22) Zone as amended or
. applicable shall be complied with in development of the site. With the west 145 feet
complying with the crossover zoning for this parcel which is Urban Residential-3.5
(UR-3.5). Also the two (2) 22 unit apartment complexes located adjacent to the 12 unit complex on the western portion of the site sha11 be restricted to two stories not
to exceed 35 feet in height. The applicant shall develop subject property generally
in accordance within the concept presented to the Hearing Body. Variations, when
approved by the Planning Director/designee, may be permitted, including, but not
l~nuted to bwlcung loca~ion, landscape plans and general allowable uses of the
per~nitted zone. All variarions must conform to regulations set forth in the Zoning
Code for Spokane County, and the original intent of the development plans shall be maintain~.
2. Appnoval is required by the Planning Director/designee of a specific lighting and

3. A specific landscape plan, pianting schedule and provisions for maintenance

shall be in accordance with standard traffic engineering pracrices. Paving ar

the project which is to be occupied or traveled by vehicles.
7. The construcrion of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
8. The County Engineer has designated Typical Roadway Section Number One; Local
Access standard for the improvement of Maxwell Avenue, which is adjacent to the
proposed development. This will require the addition of approxirnately 6-8 feet of
asphalt along the frontage of the development. The canstruction of curbing and
sidewalk is also required.
9. All required impnovements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
Counry standards andior adopted resoludons pertaining to Road S tandards and -
Starmwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
10. Applicant shall const~ruct a paved and delineated approach to meet the existing pavement on Maxwell Avenue.
1 I. Roadway standards, typical roadway secrions and drainage plan requirements are
found in Spokane Board of Counry Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
12. This plat or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's office as having stormwater runoff
problems. Since this plat or development proposal is affected by or is a contributor

should be treated, and emissions from the tr~nansfer of earthen material must be
con~olled, as well as emissions from ali other cons~uc~on-reiated activities.
