PROPOSAL
The sponsor, Ronald Moland, requests approval of a Change of Condinons
ZE-59A-72/'LE-106A-72 to existing Urban Resldentia122 (UR-22) zones to modify
building height, delete condinons requinrig roadway dedications and improvements,
and to allow an increase in density for 109 multiple family dwelhngs on
approximately 5 3 acres
FINDINGS OF FACT AND CONCLUSIONS
l The property is generally located north of and adaacent to 6th Avenue approximately
200 feet east of Farr Road in the NW 1/4 of Section 20 Township 25 North Range
44 EWM, Spokane Cot,nty, Washington
2 The Heanng Examiner Commjttee adopts the Planning Department Report as a part of
this record
3 The existing land use(s) in the area are apartments, single family dwellings, a
manufactured home park and undeveloped property
4 The proposed use is compatible with existing uses in the area, which include a rrnx of
single family and mula family dwelhngs, a manufactured home park and commercial
uses
5 The Comprehensive Plan designates this site as Urban The Urban category is
intended to provide the opportunity for development of a"city-lilce" envuonment
which includes various Iand uses, intensive residential development and net densiues
of 1 to 17 dwelling units per acre The proposed density of 20 45 dwelhng units per
acre is consistent with the density range of the Urban category of the Comprehensive
Plan

1 Regarding the change of condiaons lc for ZE-59-72, 4th Avenue has already been
dedicated west of Farr Road there is no further requirement for the dedlcation of 14 feet
along Fourth Avenue, all other condiaons of approval are applicable
2 The request for change of condinons for ZE-106-72 lb, the County Engineer waives
any further requuement for nght of way dedicaaon on VVoodruff Road 50 feet of nght
of way was dedicated by the onginal property owner
3 The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans
4 The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health Distnct a detailed combined on-site sewage system plan
and surface water disposal plan for the enhre project, or pornon thereof, if the
development is to be phased
5 A parlang plan and traffic circulauon plan shall be submitted and approved by the
Spokane County Englneer The des2gn, locanon and arrangement of parlang stalls
shall be in accordance with standard traffic engineenng pracaces Paving or
surfacing as approved by the County Englneer, will be required for any portion of

6 To construct the roadway improvements stated herein, the applicant may with the
approval of the County Ellgineer, join in and be willing to participate in any
pention or resolution which purpose is the formation of a Road Improvement
Distnct (RID) for said improvement, pursuant to RCW 36 88, as amended
Spokane County will not participate in the cost of these improvements This is
applicable to Woodruff Road
7 As an alternative nlethod of constructing the road improvements stated herein, the
apphcant may, with the approval of the Counry Engineer, accomplish the road
improvements stated herein by joining and paracipaang in a County Road Project

11 All required unprovements shall conform to the cuirent State of Washuigton
Standard Specificanons for Road and Bndge Construction and other apphcable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer
12 Access to Woodruff Road shall be prohibited until such time as specifically
authonzed by the Spokane County Engineer
13 Roadway standards, typical roadway secnons and drainage plan requirements are
found in Spokane Board of County Comnussioners Resolution No 80-1592 as

2 ORIENTATION OF STRIICTURES, BUILDING HEIGHTS* APARTMFNT DENSITY.
The advertised property shall be developed in substantial conformance to the
approved development plan, i.e., two and three story garden apartments with
access to Farr Road. The total number of apartment units withln the project
shall not exceed 120.
3. OFF-STREET PARKING - DEVELOPTZENT.
a) Off-street parking facilities and connecting roadways shall not occupy
any area within 5 feet of an adjacent residential or Agricultural zone
outaide the apartment project area.
b) A screen, forty-two (42) inches in height shall be provided along the
periphery of any off-street parking facility or connecting roadway
adjoining any residential or Agricultural zone. The screen sha11 be
constructed of ornamental maeonry. The Director of Planning may approve
a planted screen or ornamental fence in lieu of said ornamental masonry
wall.
c) Any portion of the advertised property which is to be occupied or traveled
by automobiles shall be maintained in hard surface paving.
d) Open parking areas shall be unlightedl except that driveways, walkway-,,
and landscaped traffic islands may be illuminated by low intensa.ty lighting
on standards not exceeding eight (8) feet in height

Board that the Spokane County Planning Commission has given due notice of the hearing
on the roatter in the manner and for the time provided by law, that said Planning
Commission has held a public hearing as required, and that the said Planning Commis-
sion concurs in the plan to zone the followl.ng described property as

AND FURTHER BE IT RESOLVED that any development on the above-described property shall

anth large "block" rezones to Resmcted Industnal (RI), Mulaple Fanuly
Suburban (1VFS) and Agncultural (A) Later rezones, in the 1979s, reuiforced
that pattern of high uitensity zones along Ihshman-1Vhca Road with a transition to
lower intensity zorung tio the east of Dishman-1Vhca Road along 4th, 7th and 8th

ZE-59-72 and ZE-106-72, whnch changed the zoning firom Agncultural to
Multiple Farnily Suburban (1VFS) As per the Program to Implement the Spokane
County Zonuig Code, the MFS zone was redesignated to Urban Residential-22
(tJR-22) on January 1, 1991 The onguial zone reclassifications (ZE-59-72/
ZE-106-72) were approved in 1972, with spemfc conditions of approval limiting
builduig style (1 1/2 to 3 units) m,aximum number of allowed apartment uruts, and
far specific dedicaaon and roadway unprovements
ZE-59-72 consisted of approximately 7 34 acres, luYUted builduig height to 2 and 3
story structures, with the total number of apartments not to exceed 120, which
equals a density of 16 34 dwellmgs umts per acre
ZE-106-72 consisted of approximately 3 66 acres, lmnited building height to
1 1/2 to 2 story structures vcnth the total number of apartments not to exceed 55,
which equals a density of 15 02 dwelluigs umts per acre ZE-106-72 also requires
dedication and unprovement of Woodruff Road
The proposed Change of Conditions is to modify the conditions of approval for
wne changes ZE-59-72/'LE-106r72, by allowuig 4 story stivctures, deletion of
Woodruff Road dedzcation and unprovement, and to allow 109 multiple fanuly
dwelhngs on approximately 5 3 acres which equals a density of 20 45 dwelling
units per acre The 5 3 acres vnthin the proposed change of conditions consists of
the entue 3 66 acres of ZE-106-72 and approximately 1 64 acres of ZE-59-72
G1ven the allowable densities and area of ZE-59-72 and ZE-106-72, the apphcant
could construct (wnthout the Change of Conditions) approximately 81 mulaple
famfly dwellings as follows
ZE-59-72 1 64 acres x 16 34 umts per acre = 26 dwelling umts per acre
ZE-106-72 3 66 acres x 15 02 umts per acre = 55 dwelling umts per acre
Total 81 dwelluig umts per acre
The proposed Change of Conditions proposes the following

An Environmental Checkhst was subnutted by the sponsor and was reviewed by the
County Planrung Department The review considered the specifics of the proposal,
other available uifor,mation, County ordhnances, other regulations and laws, possible
standard Condztions of Approval, the Generalized Comprehensive Plan, and other
County policies and guideluies The Planning Department has detemuned that No

and has issued a~tenmnation of Nonsignificance ("DNS")
The "DNS" was circulated to 11 other agencies of junsdicuon and other
agenciesJdepartments affected by the future development for review and comment
The "DNS" comment penod ends October 19,1993 and was advemsed 15 calendar
days before said date ui the newspaper, by letter to adjacent property owners wnthm
400 feet of the proposal, and by noace on a sign posted on the proposal site The

I V PLAN1vING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposed development and Change of Cond.inons is generally consistent with the
Decision Giudeluie of the Urban Comprehensive Plan category wluch encourages
multi-family development with duwt access to a designated artenal Additionally, the
proposed density of 20 45 dwelluig umts per acre is consistent with the density range
suggested by the Urban category The proposed uses and density are not entirely
consistent with land use and zorung trends in the ar:a as the adjacent multi-family
developments to the west have a density of 16 to 20 dwelluig units per acne and the
adjomung prnpemes are a mix of residential types and densities In addiaon, previous
multi-family proposals m the vicuuty (ZE-59-72, ZE-18-74 and ZE-44-86) have been
luYUted to 1 1CZ to 2 story structures, maxunurn budding height, maximum number of
ututs and additional setbacks or buffenag To miagate potential unpacts upon adjacent
propemes, the apphcant has provided front and rear yard setbacks substantially greater
than those required by the Spokane County Zorung Code and the site plan has adequate
area to provide addhtional landscaping as a buffer to the adjacent land uses Builduig

any further reqwrement for nght of way dedication on Woodruff Road 50 feet of nght
of way was dedicated by the onginal property owner
3 The apphcant shall subnut for approval by the Spokane County Engmeer road,
drainage and access plans
4 The apphcant shall submit for approval by the Spokane County Engmeer and the
Spokane County Health Ihsmct a detailed combined on-site sewage system plan
and surfaoe water disposal plan for the entire project, or pornon thereof, ff the
development is to be phased
5 A parking plan and aaffic cuculauon plan shall be subnutted and approved by the
