INTROD~JCTION

This matter has come before the Hearing Exar~iner Committee on November 1$,
1993. The members of the Conr~naittee present are Verona Southern, Chaixperson, Phrl Ha~ris and Jan Reuter.
~ PROPOSAL
The sponsor, Jay Naccarato and Jeff McRae, request approv~l of a Zone
Reclassi.f~ication, ZE-38-93, from Urban Residentia~-3.5 (~JR-3.5) to Urban ~esidential-7 (UR-7) to allow two duplex dweiling units and those uses allowed in
the Urban Residen~al-7 (UR-7) zone. .
~ FINDINGS 4F FACT AND C~NCLUSIONS
1, The properry is generally ~ocated south of and adjacent to Valleyway and east of and adjacent to Pierce Road in Section 16, Township 25 North, Range 44 EWM,
Spokane County, Washi~gton.
2. The committee adopts the Plann.ing Department Report as a part of this record.
3. The e~isting land uses in the area are primarily single family residential and duplexes.
4. The propased use is compatible with existing uses in the area.
5. The property is located. within the Urban category of the Comprehensive Plan and
wi~hin the Priority Sewer Service Area (PSSA). ~'he Urban category is intended to
provide the opportunity for development of a"city-like" environment which includes
va~.ous land uses and ~ntens~ve residenrial developmen~ Urban areas will have
public water systems, sanitary sewer systems, storm sewer systems and other public
services available.
6. The proposed zoning does ixnplement and conform to the Comprehensive Plan. The
proposal can be defined as infill deve~opment and is consistent with the Goa1s and
Objectives of the Urban category.
7. The A.rterial ~oad Plan designates Valleyway as a Co~le~tor Arteria~, with an existing right-of-way of 40 feet and a proposed nght-of-way of 70 feet to implement the plan.
Dedacation of a 10 foot wide s~ip of additional right -of way and a 5 foot wide strip
for future acquisition are required. along Va~leyway. Pie~ce Road is identi~ied as a
loeal access s~eet and will require ded.ication of a 10 foot wide strip of addirional
right-of way. ~
8. The existi~ng zoning of the property described in the application is Urban ~esidential-3.5
~JR-3.5), previously establishe~ as Agricultural (A) zoning in 195 ~ and r~designated to Urban Residential-3.5 (~UR-3.5} on January 1,1991 pursuant to the Program to ,

Implement the Spokane County Zoning Cod.e. The proposal does conform to the
requixements of the p~roposed Urban Residen~a~-7 (UR-7) zone.
9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance was issued. The Committee,
~ after independent review, hereby adopts the DNS.
10. The legal requirements for public notice have been fulfilled. ~ ~
1~. The owners of adjacent lands expressed neither approval nor disapproval of the
. proposed use.
12. The applicant h,as demons~ated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassifcation is justified. Specifically, changed condi~ons include adoprion of the Spokane County
Zoning Cade, improvenaent of Universiry Road, increased need for affordable
housing, and the increase of higher denslty residential developments ~n the area.
13. The proposed use will not be detrimenta~ to the public health, safety, morals or
welfare especlally in light of the condirions recommended by the reviewing agencies.
14. The Committee addirionally finds/concludes:
a. The proposal is compatible with existing land use and development ~ends in the
area. .
CONDITIONS OR CONT~NGENCIES APP~IE~3 TO T1~XS A,PPR4VAL
1. All Condit~ons ir~nposed by the Heari.rlg Examiner Committee shall be binding on the
"Applicant," which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The followl.ng Condirions of Approval apply to the real property descr~bed below:
The West 2/5 of the NW 1/4 of Block ~ 30 of Opportunity as recorded in Volume K of
Plats in page 20 to 22 in Spokane County, Wash~ngton. Except t~e West 20 feet.
SPQKA►.NE COUNTX PLANNING DEPARTMENT
1. The proposal shall comply with the Urban Residential-7 (UR-7} zone(s) as
amended.. ~
2. The applicant shall develop subject ~roperty generally in accordance vv~thin the, ~
concept presented to the Hearing Body. Variarions, when approved by the
Planning Director/designee, may be pennitted, including, but not limited to building
location, landscape plans and general allowable uses of the permitted zone. All
variarions must conform to regulations set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintai.ned.
3. The Planning Department shall prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a variery of

special conditions imposed as a result of approval of a land use ac~on. This T~tle
Norice shall serve as public notice of the conditions of approva~ affecting the ~ ~
properry in quesrion. The Title Nonce should be recorded within the sa.me rime
frame as allowed for an appeal and shall only be released, in fuli or in part, by the
Planning Department. The Title Notice shall generally provide as follows:

4. ~'he Spokane County Planning Department sha11 prepare and record with the County Auditor a Title Nonce specify~ing a futu.re land acquisinon area for road
right-of way and unlines. The reserved future acquisition area Title Norice shall be
released, in ~ull or in part, by the Planning Department. The notice should be
recorded within the same time frame as an appeal a.nd shall provide the following:
, a. At least 5 feet of reserved future ac~uisition area for road right-of way and
urilities, in addition to the e~sn.ng and/or newly dedicated right-of-way along Valleyway. ~N~T`E: The County Eng~neer ~has required 14 feet of new
dedication along Valleyway.
b. Future building and other setbacks requi.red by ~he Spokane County Zoning
Code sha11 be measured from the reserved future acquisition area.
c. No require~ landscaping, parking, '208' areas, drainfield or a~lowed signs should be located within the future acquisition area for road right-of way and
utili~es. ~f any of the above improvements are made within this area, they
shall be re~ocated at the applicant's expense when roadway improvements are
r~ade. ~
d. The future acquisinon area, unril acquixed, shall be pr~vate property and may
be used as allowed in t~e zone, except that any iznprovements (such as landscap~ng, par~.ng, surface drainage, drainfield, signs or others) shall be
~ consldered ~ntenm uses.
e. The property owner shall be responsib~e for relocaring such "interim"
~ ir~provements at the time Spokane County makes roadway improvements
after acquiring said future acqu~sirion area.
5. Future subdivision of the subject property will require compliance with RCVV 58.17
and the Spokane County Subdivision~/Short Plat Ordinance.
6. The Owner shall negotiate with the Spokane County Parks Department and submit
. a recorded copy of a voluntary agreement making provisions for public parks prior
to issuance of bu~d~ng permlts. The agreement shall prov~de a written description
of the sub~ect property to wh~ch the agreement appl~es and also state the dollar amount and any other agreed to mingating measures.
Voiuntary agreements between the Owner and Spokane County Parks Department ~
shall conform to the requirements of the Revised Code of Washington Chapter
82.02. ~

SPOKANE COUNT~' DY`VISION ~F ENGINEERING
Prior to issuance of a bu~lding permit or at the request of the County Engineer in conjunction
with a County Road Project/Road Impravement Dis~ ict, whichever action comes first:
1. Applicant sha~I dedicate 10 feet on Valley Way and Pierce Road for right-of way.
2. The applicant shall declicate an applicable radius on Va11ey 'Way an.d Pierce Road.
Prior to release of a building permit or use of the properry as proposed:
3. Access permits for approaches to the counry road system shall be obtained from the
Spokane County Engineer.
4. The applicant shall subn~it for approval by the Spokane County Engineer road, ~
drainage and access plans.
5. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health ~istrict a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project, or portion thereof, if the
development is to be phased.
~ 6. A parking plan and ~affic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, locarion and arrangement of p~rking stalls sha11 be in accordance with standard traffic engineering pracnces. Paving or
surfaeing as approved by the County Engineer, will be required for any porrion of
the pro~ect which 1s to be occup~ed or ~aveled by.vehicles.
7. To construct the roadway improvements stated herein, the applicant may, with the ~
approva~ of the County Engineer, join in and be willing to participate in any
petition or resolution which purpose is the formation of a Road Improvement Dxstrict (RID} for said improvement, pursuant to RCW 36.88, as amended.
Spokane Counry will not parncipate in the cost of these improvements. T~11S 1S
applicable to Valley Way.
8. As an alterna~ve method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
xmprovements stated hereln by 1o~n~ng and par~cipa~ng in a County Road Project (CRP) to the extent of the required improvemen~ Spokane County will not
pamclpate ~n the cost of these lmprovements. ~'his is appllcable to Valley Way.
9. The cons~uction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer. a
10. The County Engineer has designated Typical Roadway Section Number One, Local ~
Access standard for the improvement of Pierce Road, whieh is adjacent to the
proposed development. This ~~vi.li require the addition of approximately 8-10 feet
of asphalt along the frontage of the developmen~ The cons~-uction ,of curbing and
s~dewalk ls also requ~red.

1~. 1~e County Engineer has designated Typica~ Roadway Section Number One,
Collector ,Arterial standard foz the improvement of Valley'~ay, which is adjacent to ~
the proposed development. This will require the addition of approximately 1Q -12
feet of asphalt a~o~g the frontage of the development. The construction of eurbing
and sidewalk is also req~ired.
12. All xequ~red improvements shall conform to the current State of 'V~ashington ~
Standard Spec~'ications for Road. and Bridge Construuctlon and other appl~cable
County standards and/or adopted resolurians pertai.ning to Road Standards and
Stormwater ~Vianagement in effect at the date of cons~-uction, unless otherwise
approved by the County Engineex.
13. Roadway standards, typical roadway sections and drainage plan requirements are
found ~n Spokane Board of County Commissloners Resolut~on No. 80-1592 as
amended and are applicable to this proposal.
14. No construction work shall be performed within the exisnng or proposed public
right-of way until a permit has been issued by the Caunty Engineer. AlI work
within the pub~xc road right-of-way is subject to inspection and approval by the
County Eng~neer.
15e All required construction within the existing or proposed public right-of-way is to
be completed pr~or to the release of a build.ing pern~.it, or a bond in an amount
estimated by the County Engineer to cover the cost of construcrion of improvements
shall be filed with the County Engineer.
16. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
spec~fies the following:
The owner`(s} or successor(s) ~n interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement District (RID) by
the petirion method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s) properry, and further not to object, by the signing of a bal~ot, the fozmarion of a RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution ineludes the owner~s} property. If an RID is formed by either the
petit~on or resolution methad, as provided for in Chapter 3b.88 RCW, the owner(s)
or successor(s} further agree:
(a) that the improvement or construc~ion contemplated within the proposed RID is
feasible; -
(b) that the benef~ts to be derived from the formarion of the RID by the property
~ncluded therein, together with the amount of any County participation,
exceeds the cost and expense of formation of the RID; and
(c} that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) sha11 retain the right, as authorized under RCW 36.88.090, to object to any assessment on the property as a
result of the improvements called for ~n con~unc~on vv~th the formarion .of the RID
~ by either petinon or resolution method under Chapter 36.88 RC'VV.
This requirement applies to Valley Way, from which the subject parcel takes access.

17. The Co~unry Arteria~ Road Plan identifies Va11ey Way as a Collector Arterial. The
exis~ng right-of way width of 40 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addition to the required ~
right-of way dedication, a strip of property 5 feet in width along the Valley Way
~ frontage shall be set aside i.n reserve. Th~s property may be acqu~red by Spokane
County at the time when arterial improvements are made to Valley Way.
18. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County ass~mes no financial obligarion for adjustments or relocarion ~
reg~~ing these utilities. Applicant(s) should check with the.applicable urility
purveyor and the Spokane Count~ Engineer to determine whether applicant(s) or
the uti~ity is responszble for adjustment or relocation costs and to make ~rrangements for any necessary work. ~
SPOKANE COUNTY DIVISION OF ~1TILITIES
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use
of on-site sewer clisposal systems is hexeby authorized. This authorizaaon is conc~tioned on compliance with all rules and regularions of the Spokane ~ounty
~ealth I~istrict and 1s further conditioned and subject to specific applicarion
approval and issuance of permits by the Health District.
2. The owner(s) or successor(s) in interest agree to authorize the County to place ~he~r
name~s) on a petition for the formation of ULID by petition method pursuant to
RCW 3b.94, which petinon ~ncludes the owner(s)' property; and further not to object by the signing of a protest p~tition against the formation of a U~.,ID by
resolution method pursuant to RCW Chapte~ 3b.94 which includes the owner(s)'
property. PROVIDED, this cond~rion sha~l not prohibit the owner(s) or
successor(s) from objecting to any assessr~ent(s} on the property as a result of
improvements called for in conjuncrion with the forma~on of a ULID by either
pention or resolution method under RCW Chapter 3b.94.
3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
4. Each new dwelling unit shall be double-plumbed for connection to future areawide
collecti.on systems.
SPOKANE COUNTX HEALTH DISTRXCT
1. Sewage d.isposal method shall be as authorized by the Direetor of Utilities, Spokane
County.
2. A sewer maintenance agreement shall be created/maintained for this project and
sha11 include: ~
1) Purpose: The purpose of th~s agreement is to provide for the utiliza~ion and
maintenance of a common on-site sewage disposal system consisring of a
si~gular septic tank and/ar drainfield. It is the common interest of the par~ies

whose premises are on separate lots to be responsib~e for the opera~ion an~ ~
properties using the sewage system and located on a sepa~ate properry. ~
2) Financial Assurance: The owners of the lots, tracts, parcels using the sewage
system shall agree to equally share the total costs of the needed repair,
replacement, reconstruction, or other procedure necessary to restore the sewage system. Failure of the property owners to perform the work
necessary to restore the system will result in Spokane Counry Health District
o~deri.ng the work to be completed with a11 costs associated therewith to be
shared among property owners using the sewage system.
3. Water service shall be coordinated through the Direetor of Utilities, Spokane
County.
4. Water service sha11 be by an e~cisting public water supply when approved by the ~
Regional Engineer (Spokane), State Department of Health.
5. DisFosa~ of s~ewage effluent beneath paved surfaces is currently prohibited.
6. Subject to speci~ic application a~proval and issuance of permits by the Health Officer, the use of (an} individual on-site sewage disposal system(s} may be
authorized.
7. Use of private wells and water ~systems is prohibited.
SPOKANE COUNTY DI'VISION OF BUILDINGS
The applicant shall contact the Department of Bui~dings at the earliest possible stage in
order to be infarmed of code requirements admin~steredJenforced as authorized by the
State Building Code Act. Design/development concerns include: Addressing, fue
apparat~s access roads, fire hydrant/flow, approved water systems, building ~
accessibility, cons~uction type, occupancy classification, exiring, exterior wall
protecrion, and energy code regulations. (Note: The Department of Buildings reserves
the right to confirm the actual address at the t~me of buildi.ng permit.) .
SPOKANE COUNTY AIR POLLUTIQN CONTROL AUTHORITY
1. All air pollu~on regulanons must be met.
2. Air pollution regularions require that dust emissions during demolition, construcnon
and excava~.on projects be con~olled. This may require the use of water sprays, tarps,
~ sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated and emissions from the transfer ~f earthen materials must be
eontrolled as well as emissions from all other cons~uction related activities. ~
3. AIl ~raveled surfaces (i.e., ingress, egress, parking areas, access roads) should be
, paved and kept clean.
4. Measures must be taken to avoid the deposirion of ci~irt and mud from unpaved surfaces
onto paved su.rfaces. If tracking or spills occur on paved surfaces, meas~res must be
taken immediately to clean these surfaces.

~ Debris generated as a result of this project must be clisposed of by means other than
burn~ng (i.e., cons~ruction waste, etc.).
6. All solid fuel burning devices (wood stoves, pellet stoves, etc. must comply with local, state, and federal rules and regulations.

Conclusion, APPROVES the application of Jay Naccarato and Jeff NicRae for the
Zone Reclassification from Urban Residennal-3.5 (UR-3.5) to Urban Residential-7
(UR-7) to allow two duplex dwelling units and those uses allowed in the Urban Residenrial-7 (UR-7) zone as described in the applicarion ZE-38-93. Note: A short
plat application must be submitted to create two lots if thls zone reclassification is
approved.

Gross Density: 4.8 dwelling units per acre
B . Comprehensive Plan
1. Land Use Plan; The property is located within the Urban category of the
Comprehensive Plan and within the Priority Sewer Service Area (PSSA). The
Urban category is intended to provide the opportunity for development of a
"city-like" environment which includes various land uses and intensive
residential development. Urban areas will have public water systems, sanitary sewer systems, starm sewer systems and other public services available.
- This category promotes "fill-in" within established development areas where
utiliries, arterials, sc~ools and community facilities are e~isting. Residenrial net

densities in this category w111 range from l to 17 units per acre. The proposal is
general~y consistent with the Goals and ~b~ectives of the Urban category and
the gross density of 4.$ units per acre is consistent with the dens~ry guidelines
of the Urban category.
2, Arterial Road Plan: The Spokane County Arterial Road Plan identifles
Valleyway as a Collector Arterial with an existing right-of-way of 4n feet and a
~roposed r~ght-of-way of 70 feet to implement the plan. Dedication of a 10 ~oot
wide s~rip of addirional right -of-way and a 5 foot wide strip for future
. acquisirion are required along Valleyway. Pierce Road is identified as a local
access s~eet and will require dedication of a 10 foot wide strip of addi~onal right-of-way.
3. County Parks Plan: The Spokane County Parks Plan indicates existing
park facilities in the VVest Valley Suburban Area are inadequate to meet current
and projected needs. The P1an proposes the acquisition of ne`v parks for the
West Valley Subuxban Area and the development and expansion of existing
facillnes. Balfo~r ~a~k, approximately 1/2 mile west, is the nearest County park facillty. The Park P~an also indicates future expansion of and development
of Balfour Park.
The Spokane County ~arks Department has ind.icated that they are currently in
the process of drafting an ordinance for a per lot park mitigation fee. Prior to
implementanon of the ordinance, the Parks Department requests, as a condition
of approval, that project applicants reach a voluntary mit~gation agreement pursuant to the Revised Code of Washington (RCW} 82.02 and RCV~
58.17.110, or present to the Parks Dep~rtment a letter agreeing to abide by the
provlsions of the mitiganon ordinance once ~t is adopted.
A condition to p~ovide voluntary mitigation measures, as requested by the Parks
Department, ~s 1ncluded in the Planning Department's recammended conditions
of approval.
C. Site Charaeteristics: The site is undeveloped, relatively flat with road frontage on
l~ierce Road and Valleyway which are asphalt roadways without curb or sidewalks.

D o Neighborhood CharacterisEics: The existing neighborhood has developed
slowly and includes primarily single family and duplex residences with numerous
duplex dwellings ~n the vicinity of the proposal. Broadway School is located approximately 1,OOQ feet north of the proposal and the Sprague Avenue commercial
~ corridor is located approximately 1,000 feet to the south.

The site and adjacent property were zoned Agricultural Suburban (ZE-90-51)
(ZE-294-58) prior to implementation of the Zoning Code in 1991.
Zoning in the general vicinity of the propos~l is primarily Urban Residential- 3.5
(UR-3.5). There has been little chan~e in the vicinity s~nce the original zoning in
195 ~ with the exce~rion of a Planned Unit Development with Urba.n Residential-12
(U~-12) zoning (ZE-7-90C) located to the southeast. High density residenti~l and
busrness zoning is found adjacent to the Sprague Avenue corr~mercial corridor to the
south. The proposal is generally compatible with the nv.x of zoning and land use types in the area.
F. Land Use Analysis:
Site: Vacant and undevelaped.
Narth: Single family residences.
South: Sin~le family residences.
East. Single family residences.
~Vest: Single famzly residences.
Land uses in the area are primarily singie family residennal and duplexes. The
Sprague Avenue commercial corridor is approxlmately ~,400 feet to the south and
consists of commercial and office uses, and some multi-family dwellings. The zone
redesxgna~.on, which would allow two duplex units, is compatible with adjacent land
uses and land use ~ends in the area.
G. Circulatian: Pierce Road and Valleyway will provide access to the site. Valleyway . is a Collector Arterial which connects to University Road to the west and to Bowdish
Road to the East. The County Engineer is requiring improvement to the roadway for
bo~h Pierce Road and Valleyway. The applicant has been allowed to sign a Road
Improvement District (RID) ag~eement for the improvements to Valleyway.
H. Design: The proposed site plan i~lus~ates two, standard residential duplex lots
fronnng on ~ierce Road. The duplex lots as shown on the site plan comply with the
deslgn standards of the Urban Residential-7 ~(UR-7) zone for lot size and frontage. If the zone reclassificarion is approved, a short plat to subdivide the two lots will be
required prior to development.
~ I. Density: The proposed density of 4.8 units per acre is within the density guidelines
of the Ur~an category of the Comprehensive Plan, but is somewhat higher than the
density of adjacent properties. It should be noted, however, that there are duplexes 1n the area with lot sizes similar to the proposal.

~.'Water Supply: The proposal is within the Modern Eleetric Water Company's
service aPea. Appropriate provisions for connection to a public water system will be

L. Sewage Disposal: On-site septic systems are proposed for sewage disposal. All
unlts wil~ be double plumbed and a dry Iine sewer will be instal~ed to connect to the
public sewer when it is available.
Nf . School: The proposal is in the Central Valley School Dis~ict. No comments have
been received from the School D~st~ct.
N. Fire Protection: The proposal is with7n Fire District No. l. The Fire District and
the Division of Buildings Department (Fi~e Marshall} are required to approve fire
protection provisions prior to issuance of building permits.
Transit: The proposal is located within the Public Translt Benefit Area (FTBA) and
~ansit routes are available on Bowdish Road and University Road.
IYIo EN'V~RONMENTAL REVIE'PV:
An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Condinons of Approval, the Generalized Comprehensive Plan, and other
County pollcies and guidelines. The Plannxng Department has determined that "No
probable significant adverse impacts" would result ~rom the proposal being developed
and has issued a Determination of Nonsi~nificance ("DNS").
The "DNS" was circulated to 12 other agencies of jurisd~ction ~nd other
agencies/departments affected by the future development for review and comment. The
"DNS" comment period ends November 16,1993 and was advertised 15 calendar days
before sa~d date in the newspa~er, by letter to adjacent property owners within 4~0 ~eet
of the proposal, and by notice on a sign posted on the proposal site. The Heanng
Examiner may consider additional environmental related testimony at the public
hearing.
IV. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATYON
,
The Zone Reclassi.f'icarion is consistent with the deve~opment standards of the Urban
Residential-7 (UR-7) zone. The proposal is also consistent with the Goals and Objec~ves
of the Urban category of the Comprehensive Plan which promotes in-fill development in areas with existing services. The proposed density of 4.8 units per acre is consistent with
the density guidelines of the Urban category, and the proposal is generally compatible with
the existing land uses and development ~ends in the area. Exisnng duplexes in the vicinity
pxovide precedent for duplex lots. The Planning Department recommends approval as .
con itloned.
V. CONDITIONS QF A►.PPROVAL

binding on the "Applicant", which terms shall include the owner or

SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Urban Residential-7 (UR-7) zone(s) as amended.
~ 2. The applicant sha~l develop subject property gener~lly in accordance within the concept
presente~ to the Hearing Body. , Variations, when approved by the Planning
D~rector/desig~aee, may be permitted, including, but not limited to building location,
landscape plans and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Code, and the original
intent of the development plans shall be maintained. .
3. The Planning Department shall prepare and record with the Spokane County Auditor a
Title Notice nonng that the property in question is subject to a vanet~ of special
conditions imposed as a result of a~proval of a land use action, This Title Nonce shall
serve as public no~ce of the cond~tions of approval affecting the property in quesnon.
The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. The
Title Norice shall generally provide as follows:

4. The Spokane County Planning Department shall prepare and record with the Counry
Auditor a Tit~e Notice specifying a future land acquisinon area for road right-of way
and utilities. The reserved future acquisition area Title Notice shall be released, in full
or in part, by the Planning Department. The norice should be recorded within the same
~me frar~e as an appeal and shall provide the following:
a. At least 5 feet of reserved future acquisition area for road nght-of way and
urilities, in addition to the existing and/or newly ded.icated nght-of-way along
Valleyway. NOTE: The County Engineer has required 10 feet of new
dedication along Valleyway.
b. Future building and other setbacks required by t~e Spokane Caunry Zoning . Code shall be measured from the reserved futur~ acqulsition al-~~.
c. No required landscaping, park~ng, '248' areas, dxainfield or allowed signs
should be located within the future acquisirion area for road ng~it-o~-way and
utilines. If any of the above improvements are made within this area, they shall
be relacated at the applicant's expense when roadway improve~ents are made.
d. The future acquisition area, unti~ acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping, _

5. Future subdivision of the subject properry w1ll require compliance with RCW 58.17
and the Spokane County SubdivisionlShort Plat ~rdinance.
6. The Owner shall negonate with the Spokane County Parks Department and submit a recorded copy of a voluntary agreement making provisians for public parks prior to
issuance of build~ng permits. The agreement shall provide a written description of the
subject property to which the agreement applies and also state the dollar amount and
any other agreed to rr~itiga~ng measures.
Voluntary agreements between the ~wner and Spokane County Parks Department
shall conform to the requirements of the Revzsed Code of VVashington Chapter 82.02.
SPOKA,NE CQUNTY DIVISION ~F ENGINEERING

shall be in accordance wlth standard traffic engineering practices. Paving or surfacing
as approved by the County Engrneer, will be required for any portion of the project

. 7. To construct the roadway improvements stated her~ein, the applicant may, with the
approval of the Counry Engineer, jo~n in and be willing to participate in any petition or
resolurion whi~h purpose is the formation of a Road Improvement Dis~ict (RID) for
said improvement, pursuant to RCW 36.88, as amended. Spokane Counry wi~l not

8. As an alternative methad of construc~ting the road ~mprovements st~ted here~n, the applicant may, with the approval of the County Engineer, accompllsh the road
improvements stated herein by joining and participating ~n a County Road Project ~
(C~') to the extent of the required improvement. Spokane Counry will not par~icipate
in the cost of these improvements. This is applic~ble to ~alley Way.
9. The cons~ruucrion of the road improvements stated herein shall b~ accomplished as
approved by the Spokane County Engineer.
10. The Counry Engineer has designated Typical Roadway Secrion Number Qne, Local
Access standard for the improvement of Pierce Road, which is adjacent to the ~roposed
development. This will requ7re the addi~on of ~ppro~cxmately 8-10 feet of asphalt
along the frontage of the development. The construcnon of curbing and sidewalk is
also required.
11. The ~ounry Engineer has designated Typic~l Roadway Secrion Number One, Collector
~ Arterial standard for the improvement of Valley Way, wh~ch is adjacent to the proposed
development. This will require the addition of approximately 10 2 feet of asphalt
along the frontage of the development. ~'he construcrion of curbing and sidewalk is
also required. _
12. All required improvements shall conform to the current S tate of Washington Standard Specifications for Road and Bridge Cons~ucrion and other applicable Co~nty standards
and/or adopted resolurions pertaining to Road Standards and Stormwater Management
in effect at the date of construction, unless otherwise approved by the County Engineer.
13. Roadway standards, rypical roa~way sections and drainage plan requirements are found
~n Spokane Board of County Commissioners Resolut~on No. 80-1592 a~ annended and
are applicable to this proposal. ~
14. No construction work shall be performed within the existing or proposed public right-
of-way until a~ermit has been issued by the County Engineer. All work within the
public road right-of-way is subject to inspection and approval by the County Engineer.
15. All required construction within the existing or prop4sed public right-of-way is to be
completed prior to the release of a building permit, or a bond in an amount esrimated by the County Engineer to cover the cost of cons~uction of improvements shall be filed
with the County Engineer.
16. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
specifies the foilowing:
The owner(s) or successor(s) in interest agree to authorize the County to place thei~r name(s} on a petirion for the forma~on of a Road Improvement Uistrict (RID) by the
petirion method pursuant to Chapter 36.88 RCW, which petition includes the owner~s)
properry, and fur~her not to object, by the signing of a ballot, the fonnanon of a RID by
the resolut~on method pursuant to Chapter 36.88 RCW, which resolution includes the
owner(s) properry. If an RID is formed by either the pention or resolution method, as
~ provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree:
~(a) that the improvement or construction contemplated within the proposed RID is ~ feasible; '

(b) that the benefits to be derived fro~n the formation of the RID by the property
inc~uded therein, together with the amount of any County particlpation, exceeds
the cost and expense of forma~on of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owne~(s} or successor(s} shall retain the right, as autho~ized
under RCW 36.88.09Q, to object to ~.ny assessment on the property as a result of the
improvements called for in conjunction with the formation of the RID by either petition
or resolunon method under Chapter 36.88 RCW.
This requirement applies to Valley Way, from which the subject parcel takes access.
~ 7. The Counry Arterial Road Plan idenrifies Valley Way as a Collector Arterial. The
existing right-o~-way width of 4Q feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addition to the requ~red right-of way
dedica~ion, a strip of property 5 feet in width along the Va~ley ~Vay frontage shall be set
aside in reserve. This property may be acquired by Spokane Counry at the nme when
arterial iznprovements are made to Valley Way.
18. There may exist ut~lities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obliga~on for adjustments or relocanon
~ regarding these utillties. Applicant(s} should check with the applicable utility purveyor
and the Spokane County Eng~neer to determine whether applicant{s} or the utility is responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
SPOKANE CO~UN'FY DIVISION UF UTILITIES
1 e Pursuant to the Board of County Commxssioners Resolution No. 80-04~ 8, the use of ' on-site sewer dlsposal systems is hereby author~zed. This authonzation is condirioned
on compliance with all rules and regulat~ons of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District. .
2. The owner(s} or successor~s) in interest agree to authorize the County to place their
name(s) on a petition for the formanon of UL,ID by pe~tion method pursuant ta RCW 36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest penaon against the formation of a ULID by resolurion method
pursuant to RC~V Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condinon shall not prohibit the owner(s) or successor(s) from objecting to any
assessment{s) on the property as a result of improvements called for in conjunc~on
with the formation of a~ULID by either petition or resolution method under RCW
Chapter 36.94.
3. Any water service for this project sha11 be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended. ~

Purpose: The purpose of this agreement is to provide for the urilization and~ ma.intenance of a common on-site sewage disposal system consisting of a singular
sepric tank andlor drain~ield. It is the common interest of the parties whose
premises ~re on separate Iots to be respons1ble for the operation and properties
using the sewage system and located on a separate property.
2) Financia~ Assurance: The owners of the lots, ~racts, parcels using the sewage
system shall agree to equally share the total costs of the needed repaix, replacement, recons~uction, or other procedure necessary to restore the sewage
system. Failure of the property owners to perform the work necessary to restore
the s~~stem will result in Spokane County Health ~istrict ordering ~he work to be
completed with all costs associated therewlth to be shared among property owners
usin~ the sewage system.
3. Water service shall be coordinated through the Dzrector of Utilities, Spokane County.
4. ~Vater sen~ice shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
5. Disposal of sewage effluent beneath paved sur~a~es is currently prohibited.
6. Subject to specific application approval and issuance of permits by the Health Officer,
the use o~ (an) individual on-site sewage disposal system(s) may be authorized.
7. Use of pri~ate wells and water systems is prohibited.

1. The applicant shall contact the Department of Build~ngs at the earliest possible stage in order to be informed of code requi.rements administered/enforced as authorized by the State
Building Code Act. Design/development concerns include: Addressing, fire apparatus
access roads, fire hydrant~flow, approved water systems, building accessibility,
eons~rucrion type, occupancy classification, exiting, exterior wa11 protection, and energy
code regula~ons. (Note: The Department of Buildings reserves the right to confirm ~he
actual address at the time of building permit.)
