HEARING EXAMIN~R C~MMITTEE
FINDINGS OF FACT, CONCLUSIONS AND ORDER
INTRODUCTIQN
This matter has come before the Hearing Examiner Committee on January 25,
1996. The members of the Committee present are: Frank Yuse, Chair, Donald
Moore and Brenda Bodenstein.
PROPOSAL
The sponsors, Pete Talarico and Rose Smith, request approval of a Zone
Reclassification, ZE-54-95, from Urban Residential-3.5 ~UR-3.5) to Urban
Residential-22 (UR-22) for those uses allowed in the~Urban Residential-22 (UR-22) zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located south of and adjacent to Broadway Avenue
approximately 334 feet west of Pines Road, in the SE 1/4 of Section 16, Township 25 North, Range 44 EVVM, Spokane County, Washington.
2. The Committee adopts the Division of B~ilding and Planning Report as a part of
this record.
3. The existing land uses in the area include a junior high schooi, professional offices,
single and multi family residences and commercial uses along Pines Road.
4. The proposed use is compatible with existing uses in the area and provides for an
appropriate txansition between Gommercial uses to the east and residential uses to
the west.
5. The Comprehensive Plan categor~ of the subject property is Urban. The Urban (U)
. category is intended to provide the opportunity for development of a"city-like" env~ronment which includes various land uses, intensive resldential development
and public facilities and services. The Urban Residential-22 zone, which permits
professional offices and multi-family residences, is intended to implement the
Urban categor~ of the Comprehensive Plan. Considering that the proposal is
ad~acent to a principal arterial and is in close proximity to commercial zorung on
Plnes Road, the proposed zone reclassification can be considered consistent with the Goals, Object~ves, and Decision Guidelines of the Urban category.
6. The proposed zoning does implement and conform to the Comprehensive Plan.
7. The Arterial Road Plan designates Broadway Avenue as a Principal Arterial, with a
recommended ribht of way width of 140 feet. In order to implement the Arterial
Road Plan, the County Engineer has requested dedication of a strip of property to

equal 50 feet from the centerline of Broadway Avenue to be set aside as a Future
Acquisition Area (FAA}.
8. The existing zoning of the property described in the application is Urban
Residential-3.5 (UR-3.5) previously established as Agricultural Suburban ~AS)
zoning in 1955 and redesignated to Urban Residential-3.5 (UR-3.5) on January l, 1991 pursuant to the Program to Implement the Spokane County Zoning Code.
The proposal does conform to ~he requirements of the proposed zone.
9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance (DNS) was issued. The
Committee, after independent review, hereby adopts the DNS.
10. The legal requirements for public notice have been fulfilled.
11. The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use.
12. The applicant has demonstrated that conditions have substantially changed since the
original zoning af this area and accordingly, the proposed zone reclassification is justified. Specifically, changed conditions include the provision of public utilities
to the area and the progressive development of office and commercial uses in the
project vicinity.
13. The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing . agencles.
14, The Com~mittee addit~onally ~ndslconciudes:
a. The applicant agrees with and accepts all the recommended conditions of
approval.
b. Due to the parcel size, location, and recommended conditions of approval, site
development is very limited and potential impacts mitigated.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPRQVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property,
. elrs, assigns, and successors-in-interest.
2. The Zone Reclassification and Conditions of Approval apply to the real property
described below:
Opportunity The North 110 feet of Block 85, Except the East 314.29 feet and Except
the North 5 feet for the Road.

1. The proposal shall comply with the Urban Residential-22 (UR-22) zone, as
amended.
2. The Division of Building and Planning shall prepare and record with the Spokane
County Auditor a Title Notice noting that the property in question is subject to a
varlety of special condltlons imposed as a result of approval of a land use action.
This Title Notice shall serve as public notice of the conditions of approval affectang
the property in question. The Tltle Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Division of Building and Planr~ing. The Title Notice shall generally provide as
follows:
The parcei of property legally described as [ ] is the
sub~ect of a land use action by a Spokane County Hearing Body or
Administrative 4fficial on [ imposing a variety of special
development conditions. File No. [ ] is available for
inspection and copying in the Spokane Division of Building and Planning.
3. The applicant shall contact the Division of Building and Planning at the earliest possible
stage ln order to be lnformed of code requ~rernents administeredlenforced as authorized
by the State Building Code Act. Designldevelopment concerns include: Addressing,
fire apparatus access roads, fire hydrantlflow, approved water systems, building
accessibility, construction type, occupancy classifica~ion, e~ting, exterior wall
~ protection, and energy code regulations. (Note: The Divi~ion of Building and ~ Planning reserves the right to confirm the actual address at the time of building permit.)
4. Approval is required by the Planning Director/designee of a specific lighting and
slgn~ng plan for the described property prior to the release of any building pernaits.
5. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping sha11 be
installed and maintained so that sight distance at access points is not obscured or
impaired.
6. Direct light from any exterior area lighting fixture shall not extend over the properry
boundary.
7. The Spokane County Division of Building and Planning shall prepare and record
with the County Auditor a Title Notice specifying a future land acquisition area for
road right-of-way and utilities. The reserved future acquisition area Title Notice
shall be released, in full or in part, by the Division of Building and Planning. The
notice should be recorded within the same time frame as an appeal and shall provide
the following;
a, At least a strip of property to equa150 feet from the centerline of reserved
future acquisition area for road right-of-way and utilities, along Broadway
Avenue.

b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acqulsitlon area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of way and
utilities. If any of the above improvements are made within th~s area, they
shall be relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, sha11 be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner sha11 be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements
after acquiring said future acquisition area.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior to release of a b~ildin~ permit or use of the propertv as proposed:
1. Access permits for approaches to the county road system sha11 be obtained from the
Spokane County Engineer.
2, The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
3. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
4. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bndge Construction and other applicable
County standards andlor adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
S. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Comm~ssloners Resolutlon No. 95-0498 as
amended and are applicable to this proposal.
6. No construction work shall be performed within the existing or proposed public
right-of way until a permit has been issued by the County Engineer. All work
within the public road right-of way is subject to inspection and approval by the County Engineer. '

7. All required construction within the existing or proposed public right-of way is to
be completed prior to the release of a building permit, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.
S. The County Arterial Road Plan identifies Broadway Avenue as a Principal Arterial.
The existing right-of way width of 25 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required
right-of-way dedication, a strip of property to equa150 feet from centerline in width
along the Broadway Avenue frontage sha11 be set aside in reserve. This property
may be acquired by Spokane County at the time when arterial improvements are
made to Broadway Avenue.
9. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant~s) should check with the applicable uti~ity
purveyor and the Spokane County Engineer to determine whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
SPOKANE COUNTY DIVISIQN QF UTILITIES
1. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
2. A wet (live) sewer connection to the area wide Public Sewer System is to be
constructed. Sewer connection permit is required.
3. Applicant shall submit expressly to the Spokane County Utilities Department "under
separate cover" only those plan sheets showing sewer plans and speci~cations for
public sewer prior to issuance of permit to connect. .
4. Arrangements for payments of additional sewer charges must be made for prior to
issuance of sewer connection permit.
5. Security shall be deposited with the Utilities Department for construction of public
sewer connections.
SPOKANE C4UNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane County.
3. Water service shall be by an existing public water supply when approved by the
Regional Englneer ~Spokane), S~ate Department of Health.

4. A public sewer system will be made available for the project and individual service will
be provided to the lot prior to sale. Use of individual on-site sewage disposal systems shall not be authorized.
5. Use of private wells and water systems is prohibited.
SPOKANE COUNTY AIR PULLUTIQN CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. Thls may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction-related activities.
3. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress,
parking areas, access roads) be paved and kept clean to nunimize dust emissions.
4, Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e., construction waste, etc.).
6. All solid fuel burning devices (wood stoves, pellet stoves etc) must comply with
local, state, and federal rules and regulations.

ORDER
The Hearing Examiner Committee, pursuant to the above Findings of Fact and
Conclusion, APPROVES the application of Pete Talarico and Rose Smith for the
Zone Reclassification from Urban Residential-3.5 (UR-3.5) to Urban Residential-22
(UR-22) for those uses allowed in the Urban Residential-22 (UR-22) zone as
described in the application ZE-54-95.

Proposal: Zone Reclassification from Urban Residential-3.5 (UR-3.5) to
Urban Residential-22 (UR-22} for those uses allowed in the Urban Residential-22 (UR-22) zone.
II. SITE INF4RMATION
A, Site Size: Approximately 35,000 square feet
B , Comprehensive Plan
1. Land Use Plan: The Comprehensive Plan category of the subject
property is Urban. The Urban (U) category is intended to provide the
opportunity for development of a"city-like" environment which includes
various land uses, intensive residential development and public facilities and services. The Urban Residential-22 zone, which permits professional
offices and multi-family residences, is intended to implement the Urban
category of the Comprehensive Plan. Considering that the proposal is
adjacent to a principal arterial and is in close proximity to commercial zoning
on Pines Road, the proposed zone reclassification can be considered
consistent with the Goals, Objectives, and Decision Guidelines of the Urban
category.
2. Arterial Road Plan: The proposal is located adjacent to Broadway Avenue. ,
Broadway Avenue is designated as a Principal Arterial by the Spokane County
A.rter~al Road Plan. To implement the Arter~al Road Plan the County Engineer

is requesting a strip o~"proper~~y to equal 50 feet from the centerline of ~roadway Avenue to be set aside as a Future Acquisition Area (FAA). ~
C. Site Characteristics: The site slopes slightly to the south and is covered by
native grasses and weeds, There are no structures on the site.
D. Neighborhood Characteristics: The neighborhood consists of a mix of multi-family and single family residential uses with office uses on Broadway
Avenue and a variety of commercial uses to the east on Pines Road (SR-27).
North Pines Junior High School is located south of and adjacent to the proposal.
E. Zoning Analysis: The proposal is located in a transitional area adjacent to the
intensive commercial development along Pines Road (SR-27). Directly north of
the proposal, Urban Residential-22(UR-22) zoning was implemented with the development of the Broadway Professional Center (45-92C, 48-85C). . The
Broadway Professional Center was developed in three phases between 1985 and
1992 and consists of inedical and dental offices. Urban Residential-22 (UR-22}
zoning is also found approximately 300 feet west of the proposal (ZE-153-76C).
This zone was orlglnally approved in 1976 as a Multi- Fanuly Suburban (MFS)
zone for apartments. The proposal is generally consistent with the zoning trends .
in the area.
Proposal: Urban Residential-3.5 (UR-3.5) established in 1991, previously
established as Agricultur~l Suburban (AS) in 1955 (99-55).
North: Urban Residential-22 (UR-22) established in 1991 and 1992 (45-
92C, 48-85C), previously established as Residential Office (RO} (48-85C} in 1985 and Urban Residential- 3.5 (UR-3.5) (99-55) in
1991 respectively.
South: Urban Residential-3.5 (UR-3.5) established in 1991, previously
established as Agricultural Suburban (AS) in 1955 (99-55).
East: Neighborhood Business (B-1) established in 1991, previously
established as Local Business (LB) (41-7bC) in 1976.
West: Urban Residential-3.5 (UR-3.5} established in 1991, previously
established as Agricultural Suburban (AS) in 1955 (99-55).
F. Land Use Analysis: Land use within the vicinity of the proposal consists of
cornmercial development along Pines Road (SR-27); office, multi-family, s~ngle
fan~ily and vacant land along Broadway Avenue; and the North Pines Junior High
School south of and adjacent to the proposal. The proposed Urban Residential-22 (UR-22) zone, which would allow multi-family or office uses, is consistent with
land uses and land use trends in the area.
Site: Vacant, undeveloped.
North: Medical and dental of~ices.
South: Junior high school.
East: Professional office.
West: Junior high school playfield.
G. Design: A specific site plan was not submitted with this proposal, The small slze of the site and the requ~rements for park~ng and landscaping will limit future
development of the site to a small scale multi-family or office development.
Impacts of future development on adjacent properties should be minimal.

H. Circulation: The property will be a~:cessed from Broadway Avenue which is a
four lane Principal Arterial.
I. Drainage: A drainage plan will be required prior to the issuance of any building
permits. TYus plan must be reviewed and approved by the County Engineer's
Department prior to building permits being issued.
J. Power Transmission Lines/Other Known Easements: None known.
K. ~Vater Supply: The proposal is served by Modern Electric. Provisions for
water service are required prior to the issuance of a building permit.
L. Sewage Disposal: A public sewer system will be made available to the site.
Plans and specifications will be reviewed and approved prior to the issuance of
any building permits.
M. School: The proposal is in the Central Valley School District. No comment has
. een received. .
N. Fire Protection: The proposal is within Fire District No, l. The Fire District
and the Division of Building and Planning are required to approve fire protection
provisions prior to issuance ~of building permits.
0. Cultural Resources: None have been identified. ~
P. Parks and Recreation; No comments have been received.
Q. Wetlands: No wetlands are shown on the Spokane County VVetlands Inventory
Maps.
III. ENVIRONMENTAL REVIEW:
An Environmental Checklist was submitted by the sponsor and was reviewed by the
Division of Building and Planning. The review considered the specifics of the
proposal, other available information, Count~ ordinances, other regulations and laws,
~ possible standard Coriditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Division of Building and Planning has
determ~ned that "No probable signlficant adverse lmpacts" would result from the
proposal being developed and has issued a Determination of Nonsigni~icance {"DNS").
The "DNS" was circulated to 13 other agencies of ju~sdiction and other agenciesl
departments affected by the future development for review and comment., The "DNS" comment period ends January 23,1996 and was advertised 15 calendar days
before sa~d date in the newspaper, by letter to ad~acent property owners within 400
feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing

V. CONDITI~NS ~F APPR~VAL
i. All conditions imposed by the Hearing Examiner Committee shall
be binding on the "Applicant", which terms shall include the
owner or owners of the property, heirs, assigns and successors.
ii. The zone reclassification applies to the following real property:
Opportunity The North 114 feet of Block 85, Except the East 314.29 feet and Except the North 5 feet for the Road.
SP~I~ANE COUNTY DIVISION OF BUILDING AND PLANNING
1. The proposal shall comply with the Urban Residential-22 (UR-22) zone, as
amended.
2. The Division of Building and Planning shall prepare and record with the Spokane
County Auditor a Title Notice noting that the property in question is subject to a
variety of special conditions imposed as a result of approval of a land use action.
This Title I~otice shall serve as public notice of the conditions of approval affecting
the property in question. The Title Notice should be recorded with~n the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Building and Planning. The Title Noti~e shall generally provide as
follows:
The parcel of property legally described as [ ] is the
subject of a land use action by a Spokane County Hearing Body or
Administrative Official on [ imposing a variety of special
development conditions. File No. [ ] ls avallable for ~ inspection and copying in the Spokane Division of Building and
Planning.
3. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be informed of code requirements administeredlenforced as authorized
by the State Building Code Act. Designldevelopment concerns include: Addressing, fire apparatus access roads, fire hydrant/flow, approved water systems, buil~ing
accessibility, construction type, occupancy classification, exiting, exterior wall
protection, and energy code regulations. ~Note: The Division of Building and
Planning reserves the right to confirm the actual address at the time of building permit.)
4. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits,

boundary.
7. The Spokane County Division of Building and Planning shall prepare and record
with the County Auditor a Title Notice specifying a future land acquisition area for
road right-of-way and utilities. The reserved future acquisition area Title Notice
shall be released, in full or in part, by the Planning Department. The notice should be recorded within the same time frame as an appeal and shall provide the
following:
a. At least a strip of property to equa150 feet from the centerline of reserved
future acquisition area for road right-of-way and utilities, along Broadway
Avenue.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acqu~ed, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements
after acquiring said future acquisition area.
SPOKANE COUNTY DIVISION OF ENGINEERING AND R4ADS
Prior to release of a buildin~ permit or use of the propertv as~proposed:
1. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
2. The applicant sha11 submit for approval by the Spokane County Engineer road, dra~nage and access plans.
3. A parking plan and ~affic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of ~
the pro~ect wh~ch is to be occupied or traveled by veYucles.
4. All required improvements sha11 conform to the current State of ~Vashington
Standard Specifications for Road and Bridge Construction and other applicable

County standards andlor adopted~'resolut~ons pertaining to Road Standard~ and Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
5. Roadway standards, rypical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 95-0498 as
amended and are applicable to this proposal.
b. No construction work shall be performed within the existing or proposed public
rlght-of-way untll a permit has been Issued by the County Engineer. All work
within the public road right-of way is subject to inspection and approval by the
County Engineer.
1. All required construction within the existing or proposed public right-of way is to
be completed prior to the release of a building permit, or a bond in an amount estimated by the County Engineer to cover the cost of construction of improvements
shall be ~led with the County Engineer.
S. The County Arterial Road Plan identifies Broadway Avenue as a Principal Arterial.
The exlst~ng r~ght-of way wldth of 25 feet ls not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addition to the required
right-of-way dedication, a strip of property to equal 50 feet from centerline in width along the Broadway Avenue frontage shall be set aside in reserve. This property
may be acquired by Spokane County at the time when arterial improvements are
made to Broadway Avenue.
9. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s} should check with the applicable utility
purveyor and the Spokane County Engineer to determine whether applicant(s) or
the utility Is responslble for ad~ustment or relocation costs and to make
arrangements for any necessary work.
SP4KANE COUNTY DIVISION 4F UTILITIES
1. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
2. A wet (live) sewer connection to the area wide Public Sewer System is to be
constructed. Sewer connection permit is required.
3. Applicant shall submit expressly to the Spokane County Utilities Department "under
separate cover" only those plan sheets showing sewer plans and specifications for
public sewer prior to issuance of permit to connect.
4. Arrangements for payments of additional sewer charges must be made for prior to
issuance of sewer connection permit.
5. Security shall be deposited with ~the Utilities Department for construction of public
sewer connections.

SPQKANE COUNTY HEALTH DIST~tICT '
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. '~Vater service shall be coordinated through the Director of Utilities, Spokane County.
3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health,
4. A public sewer system will be made available for the project and individual service will
be provided to the lot prior to sale. Use of individual on-site sewage disposal systems
shall not be authorized.
5. Use of private wells and water systems is prohibited.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHURITY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
3. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress,
parking areas, access roads) be paved and kept clean to min~mize dust emissions.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than ~
burning (i.e., construction waste, etc.). .
6. All solid fuel burning devices (wood stoves, pellet stoves etc) must comply with
local, state, and federal rules and regulations.
