Zoning: Neighborhood Busmess (B-1). The site is also located vvrthin the Aquifer Sensitive
Overlay Zone and the Pubhc Transit Benefit Area designated by the County Zoning Code.
Comprehensive Plan: Major Commercial category. The property is also located withi.n
the Aquifer Sensitive Area, Prionty Sewer Sernce Area and Urban Impact Area designated by
the Comprehensive Plan.
Environmental Review: The Division of Building and Planiung issued a Determination
of Nonsignificance on October 4,1996.
Site Description: The srte is approximately 27,440 square feet in size, level and "L-
shaped". It is currently unproved with a vacant commercial building, paved parking and
landscaping. The property was used previously as a conveiuence store, vnth a single gas pump

Snrrounding Conditions: Argonne Road and Mullan Road form a one-way couplet in the
area, are both designated as Pruicipal Artenals by the County Artenal Road Plan and comprise a
major traff c and commercial comdor in the area. The Interstate 90/Argonne Road freeway
mterchange is located just north of 1Vfission Avenue Mission Avenue is designated as a Muior
Arterial. The land lying south of the site is zoned B-1, whde the land lyuig north, east and west
across the artenals is zoned B-3. A restaurant and office buildi.ng are located to the north, retail
sales are found to the south, a new hotel is being constructed to the south, and an auto repair
business and grocery store are found to the west.
Project Description: The apphcant requests a rezone to the B-3 zone to allow development of
a restaurant The srte plan of record dated 7-23-96 indicates that the existing buzlduig will be used to
house the restaurant Site unprovements include the expansion of Type III landscaping along the
Mullan Road frontage of the properiy, and other improvements.

In consideruig a rezane apphcation, Washington case law generally pravides that 1) there is
no presumption ua. favor of the rezone, 2} the applzcant for the rezone must prove that canditians
have substaanally changed in the area since the Iast zorung of the property, and 3} the rezone
proposal must bear a substantial relationship to the public health, safefiy or weifare Parkrzdge v
Seattle, 98 Wn.2d 454, 462, 573 P.2d 359 (197$), and Bjarnson v Kttsap Caunty, 78 Wn. ApP
840, 899 P.2d 1290 (1995).

The Regional Busmess (B-3) zonuig is intended to unplement the Major Commercial
category of the Comprehensive Plan, including those pohcies which encourage commercial
development along Pnncipal Artenals or lughways and the establishment of regional-sernng
commercial uses. Zonuig Code 14.628.100. The proposed rezone clearly unplements such
pohcies, smce it is located along two (2) Pruicipal Arterial, B-3 uses are intended for the site, and
the project is served by a high level of pubhc services.
The Major Commercial category indicates that commercial developments should be
buffered to protect adjacent areas. Goa16.1, Objective 61 a. The srte is surrounded by other
commercial uses. The development standards of the B-3 zone ensure adequate buffenng for the
project in relation to adj acent uses.
The project is conditioned for compliance wnth the B-3 zone, vrnth detailed review for
compliance vvith such zone and other apphcable regulations to occur pnor to issuance of a
building permit.
A subsurface exploration of the site was done on the srte in July, 1995 due to the previous
service station use, which d.isclosed the presence of contaminants requ.inng remedial action. In
January, 1997, the 3 underground storage tanks and piping on the srte were decommissioned
No pubhc agencies requested that the Determination of Nonsigmficance (DNS) for the
project be withdrawn or modified, or alleged that the project would have significant, probable
adverse unpacts on the environment As conditioned, the proposal will not have more than a
moderate effect on the quahty of the environment, and issuance of the DNS was appropnate.
The procedural requirements of chapter 43 21 C RCW (SEPA) and chapter 11 10 of the Spokane
County Code have been met.

In applying the changed circumstances test, courts have looked at a variety of factors,
includuig changed public opuuon, changes in land use patterns in the area of the rezone proposal,
and changes on the property itself. Washulgton courts have not required a"strong" showing of
change. The rule is flexible, and each case is to be judged on rts own facts Bassanz v. County
Commisszoners, 70 Wn App. 389, 394 (1993)
Recent cases hold that changed cucumstances are not required for a rezone if the proposed
rezone implements pohcies of a comprehensive plan. See Bjarnson v Katsap County, 78 Wn.
App 840, 846 (1995), and Save Our Rural Environment v Snohomtsh County, 99 Wn 2d 363,
370-371 (1983), and Tugwell v Kimtas County, 90 Wn App. 12 8, footnote 6(1997). As
discussed above, the project does not generally conform to the Comprehensive Plan.
Changed conditions which support fihe rezone mclude traffic unprovements to the Argonne-
Mullan comdor, increased traffic along such comdor, commercial rezonuig and development
along such comdor in the area, the new hotel bemg constructed south of the site, and populanon
growth in the Valley area of the county.

IV. DECISION
Based on the Findings of Fact and Conclusions of Law above, the rezone apphcation is
hereby approved, subject to the conditions of approval attached below. Any condihons of pubhc
agencies wluch have been supplemented or significantly modified by the Hearuig Examiner below
are ttaliczzed
Failure to comply with the condrtions of this approval may result in revocation of this
approval by the Hearing Examiner.
SPOK;ANE COUNTY DIVISION OF BUILDING AND PLA►NNING
1. The proposal sha11 comply with the Regional Busvaess (B-3) and Aquifer Sensitive Area
(ASA) Overlay Zones, as amended.
2. The apphcant shall develop subject property generally m accordance within the concept
presented to the Hearing Body. Vanations, when approved by the Duector/designee, may be
pemutted, including, but not limited to building locarion, landscape plans and general allowable
uses of the pernutted zone. All vanations must conform to regulations set forth in the Spokane
County Zorung Code, and the onginal intent of the development plans sha11 be maintai.ned.
3 Approval is reqtured by the Director of Division of Building and Planning/designee of a
spe,cific lighting and sigaing plan for the descnbed property pnor to the release of any build.ing
permits.
4. Duect hght from any exterior area hghtuig fixture shall not extend over the property
boundary.
5. A specific landscape plan, planting schedule and provisions for maintenance acceptable to
the Builduig and Planning Director/designee shall be submitted wrth a performance bond for the
project pnor to release of building permits. Landscaping shall be installed and maintained so
that sight distance at access points is not obscured or impaired.
6. The Building and Planning Division shall prepare and record with the Spokane County
Aud.itor a Title Nohce notuig that the properly in queshon is subject to a variety of special
condihons imposed as a result of approval of a Iand use action. This Title Notice sha11 serve as
pubhc norice of the conditions of approval affecting the property in question. The Title Notice
should be recorded Rnthun the same time frame as allowed for an appeal and shall only be
released, in full or in part, by the Planiung Department. The Trtle Nohce sha11 generally provide

SPOKANE CUUNTY DIVISI4N UF ENGIlVEERING
Prior to release of a building permit ar nse of property as proposed:
1. P'nor to the release of a building or remodel permit the Spok,ane County Engineer shall
review the srte plan The County Engnaeer may or may not require comphance with 208
dra.nage plans for the proposal. The extent vf new unprovemen#s to the building and parkulg
area shall be based on percent of unprovement versus exzstsng value of the builduig and praperty
as it now exists

2. The applicant shall submit for approval by the Spokane County Engvaeer and the Regional
Health District a detailed combined on-srte sewage system plan and surface water disposal plan
for the entire project or portion thereof if the development is phased.
3. A parldng plan and traffc circulation plan shall be submitted and approved by the Spokane
County Engineer. The design, location and arrangement of parking stalls shall be in accordance
with standard engineering practices. Pavuig or surfacing as approved by the County Engineer
will be requued for any portion of the project which is to be occupied or traveled by vehicles.
4 All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bndge construction and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer.
5 Roadway standards, fiypical roadway sections and drainage plan requirements are found in
Spokane Board of County Cornmissioners resolution 95-0498 as amended and are applicable to
this proposal.
6 The County Artenal Road plan identifies Mission Avenue as an SO-foot Minor Arterial.
The existing nght of way width of 60 feet is not consistent with that specified in the plan. In
order to implement the Arterial Road plan rt is recommended that a stnp of property 10 feet in
wndth along the 1Vfission Avenue frontage be set aside in reserve. This property may be acquired
by Spokane County at the tune when arterial improvements are made to Mission Avenue.
7 The apphcant should be advised that there may exist utihhes either underground or
overhead affectmg the appucants property, including property to be ded.icated or set aside future
acquisition. Spokane County mnll assume no financial obhganon for adjustments or relocation
regarduig these utilities. The apphcant should check with the apphcable utilities and Spokane
County Engmeer to determuie whether the applicant or utilrty is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILTTIES
1. Pursuant to the Board of County Commissioners Resoluhon No. 80-0418, the use of on site
sewer dssposal systems is hereby authorized. This authorization is conditioned in comphance
with all rules and regulations of the Regional Health District and is further conditioned and
subject to specific apphcation approval and issuance of permits by the Health Distnct.
2. The dedication shall state: The owner(s) or successor(s) in interest agree to authorize the
county to place their name(s) on a pehtion for the formation of a ULID by petihon method
pursuant to RCW 36.94 which the petition includes the owner(s) property and ituther not to
object by signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW 36.94 which includes the owner(s) property PROVIDED, this condition shall
not prohibit the owner(s) or successor(s) from objection to any assessment(s) on the property as a
result of unprovements called for in conjunchon wrth the formahon of a ULID by either pehtion
or resolution under RCW 36.94.

Water System plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. A combined surface water and sewage disposal detalled plan shall be approved by the
Spokane County Enguieer and Regional Health District pnor to the issuance of any on-site
sewage disposal permit or builduig pernut for this project.
2 Sewage disposal method shall be as authorized by the Duector of Utilities, Spokane
County.
3. Water service sha11 be coordinated through the Duector of Uhhhes, Spokane County.
4. Water service shall be by an existing pubhc water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
5 Disposal of sewage effluent beneath paved surfaces is currently prolubited.
6 Subject to specific appucation approval and issuance of permits by the Health Officer, the
use of an individual on-srte sewage disposal system may be authonzed.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulanons sha11 be met.

The Spokane County Engineering Department has reviewed the above referenced
application. The following "Conditions of Approval" are subml.tted to the
Spokane County Planning Department for inclusion in the "Findings of Fact,
Conclusions and Order/Decision" should the request be approved.
Prs.or to release of a buildinq permit or uae of property as proposed:
1 Prior to the release of a building or remodel permit the Spokane County
Engineer shall review the site plan. The County Engineer may or may not
require compliance with 208 drainage plans for proposal. The extent of
new improvements to the building and parking area shall be based on
percent of improvement versus existing value of the building and
property as it now exists.
2 The applicant ahall submit for approval by the Spokane County Engineer
and the Spokane County Health District a detailed combined on-aite
sewage eystem plan and surface water disposal plan for the entire
project or portion thereof if the development is phased.
3 A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location and
arrangement of parking stalls shall be in accordance with standard
engineering practices. Paving or aurfacing as approved by the County
Engineer will be required for any portion of the proj ect which is to be
occupied or traveled by vehicles
4 All required improvementa shall conform to the current State of
Washington Standard Specifications for Road and Bridge construction and
other applicable county standarda and/or adopted resolutions pertaining
to Road Standards and Stormwater Management in effect at the date of
construction, unless otherwise approved by the County Engineer.
5 Roadway atandards, typical roadway aections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 95-0498 as amended and are applicable to thia proposal.

6 The County Arterial Road plan identifies Mission Avenue as a 80 foot
Minor Arterial. The existing right of way width of 60 feet ie not
consistent with that specified in The Plan. In order to implement the
Arterial Road Plan it is recommended that a strip of property 10 feet in
` width along the Mission Avenue frontage be set aside in reserve. This
property may be acquired by Spokane County at the time when Arterial
Improvements are made to Mission Avenue.
7 The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside future acquisition. Spokane
County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether
the applicant or utility is responsible for adjustment or relocation
coats and to make arrangements for any necessary work.

Pursuant to Spokane County Resolution Nos. 96-0 I 71, 96-0293 and 96-0294, as mav be stipplemented
by the Spokane County Code. I
All interested persons may attend the public hearing. Written comments or documents may be submitted
at or prior to the hearing, but if at all possible should be submitted to the Division of Building and
Planning prior to the hearing. Tunely written materials submitted will be considered by the Hearing
Examiner and made a part of the record. Testimony will be allowed on the proposal and related environrnental documents and issues. This will be the only open record hearing allowed on the
application. Any appeal of the Hearing Examiner's decision will be based on the record established at
this hearing. Appeals must be taken to the Board of County Commissioners of Spokane County for
decisions on applications for a rezone, or an application for a combined rezone and preliminary plat.
Appeals must be taken to the superior court for all other applications. State Environmental Policy Act
appeals shall follow the same procedural route as the underlying actions.
The following procedural rules have been established to allow a fair and orderly hearing:
1. The Hearing Examiner may limit the time given to speakers for or against a proposal.
2. A speaker representing each side of the issue is encouraged.
3. Only specifically relevant testimony to the proposal will be accepted.
4. Cross-examination may be allowed at the discretion of the Hearing Examiner.
5. The project file will be adopted by the Hearing Examiner as part of the record.
b. The Hearing Examiner will take notice of Spokane County's Generalized Comprehensive Land Use
Plan, Zoning Code, and County Code.
Inspection of File, Obtaining Copies of Documents: The project file is ava.ilable for inspection in the
Spokane County Division of Building and Planning, Public Works Building, 1026 West Broadway (MS-
P), Spokane, WA, 99260, between 8 am. and 4 p.m., Monday through Friday, except holidays. The Staff
Report of the Division will generally be available seven calendar days before the scheduled hearing.
Copies of the Staff Report and other materials will be made available for the cost of reproduction. If you
have any questions, please call the Division of Building and Planning at (509) 456-2205.
Additional Information: The Hearing Examiner will normally recess from 12 noon to 1 p.m. Items
not heard or completed before 4 p.m. may be continued to a later date by the Hearing Exazniner. 4 p.m.
is the tentative hearing adjournment time.
All hearings will be conducted in facilities which are accessible to disabled individuals.

category is intended to provide the opportunity for the
development of commercial uses, specifically community and
regional shopping centers and commercial users, directly related to
major throughways. The proposed zone reclassification
implements the Goals, Objectives and Decision Guidelines of the
Major Commercial category of the Comprehensive Plan.
2. Arterial Road Plan: The subject progerty is located adjacent to
and east of Argonne Road, adjacent to and south of Mission
Avenue, and adjacent to and west of Mullan Road. Argonne and

Plan as Principal Arterials. Mission Avenue is identified by the
Spokane County Artenal Road Plan as a Minor Artenal To

width along 1Vfission Avenue be set aside as a Future Acquisiton
Area (FAA).
3. County Parks Plan: The Spokane County Parks Plan identifies
Valley Mission Park as the County park facility located nearest to

Regional Business (B-3) zone can implement the Major Commercial
category of the Comprehensive Plan. It is the intent of the Regional
Business (B-3) zone to implement the policies of the Comprehensive Plan
wluch encourage commercial development along principal arterials or
highways and established regional-serving commercial areas. General
characteristics of these areas include paved roads and sidewalks, public
sewer and water, and a full line of public services including manned fire
protection and public transit accessibility.

Building and Planning has determined that "No probable significant adverse
impacts" would result from the proposal being developed and has issued a
Determination of nonsigruficance ("DNS").
The "DNS" was circulated to 14 other agencies ofjurisdiction and other
agencies/departments affected by the future development for review and
comment. The "DNS" comment penod ended October 28, 1996 and was
advertised 15 calendar days before said date in the newspaper, by letter to
adjacent property owners within 400 feet of the subject srte, and by nonce on a
sign posted on the subject site The Hearing Examiner may consider addirional
environnental related testimony at the pubuc hearing.
IV. DIVISION OF BUILDING AND PLANNING S Y
The proposed Regional Business (B-3) zone unplements the Goa1s, Objectives
and Decision Guidelines of the Major Commercial category of the Comprehensive
Plan. The proposal is generally consistent wrth the development standards of the
Regional Business (B-3) zone and is consistent with existing land uses and zotung
trends m the area. The Division of Builduig and Planiung recommends approval

The Spokane County Engineering Department has reviewed the above referenced
application. The following "Conditions of Approval" are submitted to the
Spokane County Planning Department for inclusion in the "Findings of Fact,
Conclusions and Order/Decision" should the request be approved.
Prior to release of a building permit or use of property as proposed:
1 Prior to the release of a building or remodel permit the Spokane County
Engineer shall review the site plan. The County Engineer may or may not
require compliance with 208 drainage plans for proposal. The extent of
new improvements to the building and parking area shall be based on
percent of improvement versus existing value of the building and
property as it now exists.
2 The applicant shall submit for approval by the Spokane County Engineer
and the Spokane County Health District a detailed combined on-site
sewage system plan and surface water disposal plan for the entire
project or portion thereof if the development is phased.
3 A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location and
arrangement of parking stalls shall be in accordance with standard
engineering practices. Paving or surfacing as approved by the County
Engineer will be required for any portion of the project which is to be
occupied or traveled by vehicles
4 All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge construction and
other applicable county standards and/or adopted resolutions pertaining
to Road Standards and Stormwater Management in effect at the date of
construction, unless otherwise approved by the County Engineer.
5 Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 95-0498 as amended and are applicable to this proposal.

6 The County Arterial Road plan identifies Mission Avenue as a 80 foot
Minor Arterial. The existing right of way width of 60 feet is not
consistent with that specified in The Plan. In order to implement the
Arterial Road Plan it is recommended that a strip of property 10 feet in
width along the Mission Avenue frontage be set aside in reserve. This
property may be acquired by Spokane County at the time when Arterial
Improvements are made to Mission Avenue.
7 The applicant ahould be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside future acquisition. Spokane
County will assume no financial obligatian for adjustments or relocation
regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether

Study The method of sewage disposal is subject to approval of the Duector of Unlities, Spokane
County, pursuant to County Resolution 80.0418 adopted March 24, 1980. The topography and soils in
the area are generally suitable for use of inciividual on-site sewage disposal systems. The lot is not of
the proper dunensions to pernut the use of both an individual well and sewage system

1. Land Use: The subject site is located within the Major
Commercial category of the Comprehensive Plan and within the
Priority Sewer Servlce Area (PSSA). The Major Conunercial
category is intended to provnde the opportwuty for the
development of commercial uses, specifically commututy and
regional shoppmg centers and commercial users, directly related to
major throughways. The proposed zone reclassification
implements the Goals, Objectives and Decision Guidelines of the
Maj or Commercial category of the Comprehensive Plan
2. Arterial Road Plan: The subject property is located adjacent to
and east of Argonne Road, adjacent to and south of 1Vhssion
Avenue, and adjacent to and west of Mullan Road. Argonne and
Mullan Roads are identified by the Spokane County Arterial Road

Plan as Principal Arterials. Mission Avenue is identified by the
Spokane County Arterial Road Plan as a Minor Artenal To
implement the Artenal Road Plan, the County Division of
Engineering will require that a strip of property ten (10) feet in
width along Mission Avenue be set aside as a Future Acquisition
Area (FA.A).
3. County Parks Plan: The Spokane County Parks Plan identifies
Valley Mission Park as the County park facility located nearest to
the proposal Valley Mission park is located approximately .83
miles east of the subject site on 1Vhssion Avenue.
C. Site Characteristics: The site is level and is occupied by a vacant
building, sidewalks, paved parking and landscaped areas.
D. Neighborhood Characteristics: The site is located between the A►rgonne
and Mullan Road corridors and south of Mission Avenue. The srte is
surrounded by major commercial activity.
E. Zoning Aaalysis: The purpose of the Regional Business (B-3) zone is to
provide for a large variety of retail and service activities. The proposed
Regional Business (B-3) zone can implement the Major Commerciai
category of the Comprehensive Plan. It is the intent of the Regional
Business (B-3) zone to irnplement the policies of the Comprehensive Plan
which encourage commercial development along principal arterials or
highways and estabhshed regional-serving commercial areas. General
characteristics of these areas include paved mads and sidewalks public
sewer and water, and a full line of public services including manned fire
protection and public transit accessibility.

North: Regional Business (B-3) and Urban Residential-22 (UR-22)
established in 1991, previously established as Freeway

South: Neighborhood Business (B-1) established in 1991,
previously estabhshed as Local Business (LB) in 1973

F. Land Use Anatysis: The subject site is located at the southwest corner of
the intersecnon of Mission Avenue and Mullan Road. The area is
dominated by commercial uses with residential development in the

from Mission Avenue. Access to the site is also provided from Mullan
Road to the east and Argonne Road from the west.
H. Design: Proposed sitealterations to development existing on the subject
site include the expansion of an existing landscape stnp along Mullan
Road, and provisions for additional pazking stalls and site entry curb detail
adjacent to 1Vlission Avenue access points It is not anticipated that the
exterior of the existing structure vvill be altered, although it will be painted
and refurbished.
I. Power Transmission Lines/Other Known Easements: None known.
J. Water Supply: The proposal is served by Modern Electric Water
Company
K. Sewage Disposal: The proposal is served by an on-site septic system.
L. School: The proposal is located in the West Valley School District
(#363) No comment has been received
M. Fire Protection: The proposal is located vathin Fire District No. 1. The
Spokane Valley Fire Department has indicated they have no objections to
the proposed zone reclassification.
N. Critical Areas: None have been identified.
0. Cultnral Resources: None have been identified.
P. Transit: The proposal is located within the Public Transit Benefit Area.

M. ENVIRONMENTAL REVIEW
An Environmental Checklist has been submitted by the sponsor and was reviewed
by the Division of Building and Planiung. The review considered the specifics of
the proposal, other available information, County ordinances, other regulations
and laws, possible standard Conditions of Approval, the Generalized
Comprehensive Plan and other County policies and guidelines The Division of
Building and Planning has determined that "No probable significant adverse
unpacts" would result from the proposal being developed and has issued a
Determinahon of nonsignificance ("DNS")

IV. DIVISIOI'+r OF BUILDING AND PLANNING SUMIVIARY
The proposed Regional Business (B-3) zane unplements the Goa1s, 4blectives
and Decision Guidelines of the Major Commercial category of the Comprehensive
Plan. The pmposal is generally consisten# vvith the development standards of the
Regional Business (B-3) zone and is consistent with existang land uses and zorung
trends in the area. The Division of Building and Planiung recommends apgroval

conditions imposed as a result of approval of a land use acrion T'his Title
Notice shall serve as public nonce of the conditions of approval affectuig the
property in question. The Title notice shall be recorded wrthin the same time
frame as allowed for an appeal and shall only be released, in full or part, by
the Division of Building and Planning. The Title Notice shall generally
provide as follows:

The Spokane County Engineering Department has reviewed the above referenced

SPECIAL CONDITION. Prior to the release of a building or remodel permit
the Spokane County Engineer shall review the site plan. The County
