FINDINGS OF FACT AND CONCLUSIONS The Heanng Examiner has reviewed the change of conditions application and the evidence of record, and hereby adopts the following findings of fact and conclusions 0 A. GENE1tAL INFORIVYA'I'ION: Applicant WAM Enterpnses, Inc, 601 West Riverside, Suite 280, Spokane, WA 99201 Address: 9317 East Sinto, Spokane, WA Location: Generally located north of and adjacent to Sinto Avenue, approximately 300 feet east of Mullan Road in the NW '/4 of Section 17, Township 25 North, Range 44 EWM, Spokane County, Waslungton Legal Y)escription: The south half of Tract 19 of Opportunity, as per plat recorded in Volume "K" of Plats, page 20, EXCEPT the east 2 acres of said south half of tract 19, ALSO EXCEPT the south 5 00 feet thereof deeded for roadway ngbt of way TOGETHER WITH the east 2 00 feet of the south half of Tract 20 of Opportunity, as per plat recorded in Volume "K" of Plats, page 20 ALSO EXCEPT the south 5 00 feet of said east 2 00 feet of the south half of Tract 20 Sihiate in the County of Spokane, State of Washington Zoning: Neighborhood Business (B-1), subJect to the conditions of approval in Building and Planning File No ZE-53-80 Comprehensive Plan Category: The property is designated in the Urban category of the Spokane County Generalized Comprehensive Plan The site is also located within the Pnonty Sewer Service Area and the Urban Impact Area designated in the Comprehensive Plan HE Findings, Conclusions and Decision ZE-53A-80 Page 1 ~ ~ J . Environmental Revaew: A Determination of Nonsignificance (DNS) was issued by the Division of Building and Planrung on August 22, 1997 Site I)escription The site is 2 75 acres in size, relatively flat and undeveloped The subject property is part of a 4 69 acre property that was rezoned in 1980 under the now expired Spokane County Zoning Ordinance, from the Agncultural Suburban (AS) zone to the Local Business (LB) zone, in Building and Planrung File No ZE-53-80 In 1997, the applicant received approval for two certificates of exemption, whlch divided the onginal4 69 acres into three parcels The site includes a 48 parcel on the east, and a 2 27 acre parcel on the west The site can also be interpreted to include the small portion of the parcel on the west through whlch the proposal secures access to Sinto Avenue Surrounding Conditions: The site is bordered on the west by an undeveloped 1 94 acre parcel that was part of the onginal property rezoned in File No ZE-53-80, which parcel fronts along the east side of Mullan Road Mullan Road is designated as a Pnncipal Artenai by the Spokane County Artenal Road Plan The Mullan Road/Argonne Road couplet west of the site is a major traffic and commercial comdor through the Spokane Valley Area Interstate 90 is located a few blocks north of the site The site borders along the north side of Sinto Avenue, which is designated as a Local Access Street Stout Road, a Local Access Street, terminates at Sinto Avenue just southwest of the site The land between Stout Road and Mullan Road, south of Sinto Avenue, is zoned B-1 The land south of Sinto Avenue, east of Stout Road, as well as the land east of the site, is zoned Urban Residential-3 5(LTR-3 5) and improved with single- family residences The land north of the site is zoned Regional Business (B-3), and a large Holiday Inn was recently constructed on such land Project Description: The applicant seeks a change of condition in the existing B-1 zone, to comply with a condition of approval of the 1980 rezone of the site, requinng that the specific site development plan be submitted for Heanng Examiner Committee review and approval pnor to the issuance of building permits The site plan of record illustrates office buildings on both parcels making up the site, with one common access point to Sinto Avenue through the adjacent parcel to the west owned by the applicant Such access point is within the westerly 190 feet of Sinto Avenue, as required by the conditions of approval for the 1980 rezone A fire department emergency access is located along Sinto Avenue in the southeast corner of the westernmost parcel making up the site A 23,300 square foot office building is illustrated on the west portion of the site, and a 500 square foot office building is shown on the east portion of the site Associated parkuig, landscaping and drainage swale areas are also illustrated for such uses A six-foot-high sight-obscuring fence is illustrated along the east boundary of the site B. CHANGE OF CONDITIONS ANALYSIS. 1 The chanee of conditions application is correctlv before the Heanncy Examiner In 1978, Spokane County created the Spokane County Heanno, Examiner Committee, comprised of three members of the County Planning Commission, to initially hear and decide zone reclassification (i e rezone) applications, subject to appeal before the Board of County Commissioners See Spokane County Ordinance No 784027 The Heanng Examiner Committee Ordinance vested the Heanng Examiner Committee with authonty to approve or deny the rezone application, or return the same to applicant or Planrung Department staff for clanfication, modification or correction In 1980, the Board of County Commissioners, in Bwlding and Planning File No ZE-53-50, rezoned 4 7 acres of land including the present site from the Agncultural Suburban (AS) zone to the Local Business (LB) zone, under the now expired County Zoning Ordinance See Findings of Fact, Decision and Conditions adopted 12-1-80, pursuant to Commissioners Document No 80-1472 While the rezone was approved without a specific site development plan, the conditlons of approval required that a specific site development plan be submitted for review and approval by the Spokane County Heanng Examiner Committee, pnor to the issuance of a building permit The approval also required that access to the site be limited to the west 190 feet of the onginal site, with the exception of emergency access as required by the County Fire Marshall The approval further adopted as conditions of approval the conditions set fortli on pages 2-5 of the staff analysis in ZE-53-80 dated September 4, 1980, except for condition (e) (4) HE Findings, Conclusions and Decision ZE-53A-80 Page 3 i r > > ~ The Heanng Examiner Comrruttee Ordinance was amended several times between the time of the Board of County Commissioner's decision in 1980 and 1985 Spokane County Resolution No 81-1078 provided that vvhen a zone reclassification was approved without a specific site plan and without conditions for further Heanng Examiner Committee review, the County Planning Director or designee could administratively review, approve and condition site plans subsequently submitted for the rezoned property, or require Heanng Examiner Committee approval of site plans Spokane County Resolution 85-0987 revised the wording of such provision as follows In the instance where a zone reclassificatlon has been approved without a speczfic site plan, and without conditions for furtheY zontng heartng examiner committee review, the planning dcrector or his/her designee, may, after review, give admintstrative approval of stte plans subsequently submitted for rezoned property The administrative approval may include requcrements to mitigate environmental impacts and to mitcgate impacts af the pro,Ject ensuring that the standards of the zone are upheld The planning director at hcs/her option may require zoning hearing examiner commattee approval of sate plans for clarafication as a change of condations at the next available publlc hearing The Heanng Examiner Committee Ordinance was codified in Chapter 1 44 of the Spokane County Code The above cited language is found m paragraph 1 44 050 (c) of the Spokane County Code In 1985, Spokane County adopted the Spokane County Zorung Code, along with a Program to Implement the Spokane County Zoning Code See Resolution No 95-0500 The Program to Implement provided for a five year transition penod dunng which the old zones of the County Zoning, Ordinance would be replaced with the new zones of the Zoning Code for all property in the county, using a transition guide and cross-over schedules contained in the Program to Implement The transition guide indicated that conditions of approval attached to a rezone approved pnor to the cross-over zoning taking effect would continue to apply to rezoned property after the cross-over, if such conditions limited uses more than ordinanly allowed outright in the new zone Pursuant to Spokane County Zoning Code 14 504 040, certain listed minor alterations or additions to the approved site development plans for past zone changes may be approved by the Division of Building and Planning administratively, if not contrary to the adopted findings and conditions adopted for the rezone Proposed alterations or additions that cannot be considered minor under the listed cntena, or that would violate the findings or conditions of the pnor zone change, can only be approved after a public heanng before the Heanng Examiner In 1991, the zoning for the site in ZE-53-80 "crossed over" to the Neighborhood Business (B-1) zone, but remained subJect to the conditions of the pnor rezone to the eYtent that such conditions were more limiting or stnct than the development standards of the B-1 zone The official County zorung map for the site designates the zoning of the site as "53-80C", to indicate that the site is sub}ect to conditions of approval in Building and Planning File No 53-80 HE Findings, Conclusions and Decision ZE-53A-80 Page 4 r ~ ~ In 1996, Spokane County replaced the heanng examiner commxttee system with a heanng e,caminer system, pursuant to the Spokane County Heanng Examiner Ordinance See Spokane County Resolution No 96-0171 The Heanng Examiner 4rdinance vested the County Heanng Examiner with the authonty to hear rezvne and change of conditlon appllcations The Heanng Examiner Ordinance contains no specific provisions relating to site plan review by the Heanng Examiner or the Gounty Division of Building and Planning The Heanng Examiner Ordinance takes precedence over all other ordinances or portlons thereof with wh.ich it may be in conflict See Resolution No S 1-0171, Attachment "A", Section 16 Slnee the Hearincy Examiner has similar authonty to that vested prevlousiy in the Heanng Examiner Commlttee over zone reclassification and change of condition applications, and future site plan review by the Heanng Examtner Comumttee was required in ZE-53-$0 as a condition of approval, the Heanng Examiner is the proper body to review the site plan submitted by the applicant in Building and Planning File No ZE-53A-84 Since the Heanng Examiner Ordinance and Zoning Code 14 504 040 vest the Heanng Examiner wlth authonty to revlew a site plan only after conducting a publ2c heanng, the Division of Buildtng and Planning properly processed the current appiication as a change of condition applicatlon, subject to a public heanng and review under the State Environmental Policy Act (SEPA) Also see County Resolution No 96-0293, descnbing the application procedure for a Type III application The holding of a public heanng in ZE-53A-80 is also appropnate considenng that the 1980 rezone in ZE-53-80 was oppased by neighbonno, property vwners, and the Board of County Commissioners imposed spec2al conditlons fio protect neighbonng property ouvners from the impact of future site development The review process for a change of conditions application 3s somewhat unclear The Heanng Examiner Ordinance requires the Examiner to set forth the manner in whlch a decision on a change of conditions application is eonsistent with the Comprehensive Plan, and authorizes the Examiner to consider the Comprehensive Plan and applicable development regulations in rendenng a decision See Resolution 96-0171, Attachment "A", Section 11 Therefore, the application should generally conform to the Comprehensive Plan, and must comply with the development standards of the B-1 zone and other applicable provisions of the Zonung Code, the provlsions of SEPA and the Spokane County Environmental Ordinance, and other applicable land use regulations The current application must also conform to the special conditions of approval imposed by the Board of County Commissioners in ZE-53-80, ta the extent that they are more limiting or stncter than the standards tn the B-1 zone Wrth these land use controls in mind, the Heanng Exam2ner may impose condrtions on the change of conditions application to protect the public health, safety and general welfare, or tQ mrtigate environmental impacts It must be kept in mind that a change of conditlons is not a rezone, because it does not chanae the actual zone of the property However, the permitted uses, location of buildings, landscaping, and other features of the slte development plan are nevertheless subject to review by the Examiner HE Findings, Conclusions and Decision ZE-53A-80 Page 5 i ~ ~ 2 The aDDlication eenerallv conforms to the Spokane County Generalized Com-Drehensive Plan The proposal is designated in the Urban category of the Comprehensive Plan The Urban category is intended to provide the opporturuty for a"citylike" environment, which includes vanous land uses, residential development and a high level of public facillties and urban services It is pnmanly a residential category of single-famlly, twa-family, multi-family, and condominium buildings along with neighborhood commercial, Zight industnal, and public and recreational facilities The Urban category recommends a residential net density range of one (1) to 17 units per acre The more intensive uses 1n the Urban category, such as light industnal and neighborhood commercial, would be located near or along the heavily traveled streets The least intensive single-family residential uses should be isolated from the noise and heavy traffic, and mulhfamily structures will usually be a transitional use Iocated between single-family residentlal and the more intensive areas See Comprehensive Plan, Section 1, "Purpose" and "Detailed Definitlon" The Urban category also indicates that buffenng and Iandscaping should be used to render land uses in such category compatible and avold adverse impact The property is also located withln the Urban Impact Area (UTA) design.ated in the Comprehensive Plan See Comprehensive Plan, Section 14 This is an area where growth, development and higher intensities of land use are encouraged Comprehensive Plan, Objeetive 14 1 a Traditlonal urban problems such as incompatible land uses, environmental pollution and traffic congestion are to be managed with greater attention to the general public's well-being inside the,UTA Comprehensive Plan, Objective 14 1 e The site is also located adjacent to the Major Commercial category of the Comprehensive Plan on the north, and is approximately 100 feet west of the Major Commereial category Accordingly, the proposal is subject to the "transition area" policy of the Comprehensrve Plan The "transition area" is the area along the boundary between adjacent land use categanes A development may cross or be adjacent to the fnnge area and considered to be srtuated in the "transition area" The transition area policy allows deVelopments complying with either of the land use categones involved in the transition area, depending on the distance a use intrudes into an adjacent land use category, the impacts to existing land use categones, and the decision- maker's site-speclfic approval See Comprehensive Plan, Introduction, "Transrtion Area", and Glossary, "Transitional Areas" The proposal is zoned Neighborhoad Business (B-1) The purpose of the B-1 zone is to allow for limited, small-scale neijhborhood serving retail and office uses as a means of implementino, the Urban, Major Commercial and Suburban categones of the Comprehensive Pian Withrn the Urban category, the size, number and location of B-1 zones are limlted so as to meet neighborhood needs Zorung Code 14624 100 Such B-1 zones should be in a business cluster no larger than five acres in stze, w1th frontage on a Collector Artenal or hzgher rvad classification not exceeding 600 feet, and spaced at least one-half mile from other B-1 zoned areas When located wholly withtn the Major Commercial category, B-1 zones are not subject to the area, fronta;e and locatlon restnctions or advisements that apply to B-1 zones in the Urban category, although frontage on a Collector Artenal is stili a requiremen# See Zoning Code Chapter 16 24 HE Findings, Conclusions and Decision ZE-53A-80 Page 6 i The applicant seeks to develop professional offices on the site, which is a permitted use in the B-1 zone Since the zoning of the site has already crossed over to B-1, the proposal is not subject to the separation and locational requirements of the B-1 zone Whlle the site does not have direct frontage on a Collector Artenal, the Board of County Commissioners decision in ZE- 53-80 specifically authonzed direct access from the onginal site to Sinto Avenue, as long as it was limited to the west 190 feet of the onginal site The proposal complies with this requirement It is also noted that the onginal property rezoned to Local Business under the County Zorung Ordinance in ZE-53-80 fronted on Mullan Road, a Principal Artenal The site development plan submitted by the applicant appears to allow cross access to the parcel located west of the site, through a parking area Further, the record indicates that professional offices do not generate near the traffic impacts that retail uses would generate if developed on the site under the B-1 zone See testimony of Walt Miller The transition policy of the Comprehensive Plan also favors approval of the application B-1 zones within the Major Commercial category are intended to provide transition between the Major Commercial category and less intense land use categones, and are usually located witrun and on the fnnges of a Major Commercial category The Regional Business (B-3) zone and four- story hotel located north of the site penetrates farther east than the current site, and the proposal provides needed transition between such use and the single-family uses located south of the site The proposal also provides transition between the retail uses along Mullan Road and the single- family homes east of the site While the proposed use of the site is not necessanly "neighborhood serving", its impacts are relatively small in scale relative to other uses that could be developed on the site under the B-1 zone The proposal will be served by a high level of public services, as recommended in the Urban category, Major Commercial category and Urban Impact Area The proposal will be connecting to a pnvate sewer line wluch extends south to the County public sewer system, in proximity to Sprague Avenue The proposal is also served with nearby public transit and modern utilities Very little opposition to the proJect was expressed dunng the public heanng process Jerry Duncan, a landowner along Sinto Avenue across from the project, testified that the traffic would add traffic congestion to the neighborhood and at the intersection of Mullan Road and Sinto Avenue A letter was also received from Larry Hoyt, a person who does not reside in the area, which letter expressed concern over traffic impacts of the project on Sinto Avenue and Stout Road However, County Engineenng did not express the need for a traffic study, and there is no evidence in the record from a traffic engineenng standpoint that the capacity of Sinto Avenue will be exceeded or that a failing level of service will result at the intersection of Sinto Avenue and Mullan Road County Engineenng has required the applicant to unprove Sinto Avenue along the frontage of the site, by adding 10-12 feet of asphalt, and installing curb and sidewalk The owner or lessee of commercial offices along Mission Avenue north of the site also expressed opposition to the project, including concerns over an oversupply of office space in the area, excessive penetration of the proJect east of Mullan Road, and establishing a precedent for excessive bullding height in the area However, the decision was made by Spokane County in 1980 to allow business zoning for the subject parcel east of Stout Road The project also buffers the residential uses south of the site from the hotel located to the north, and the residential uses to the east from the retail uses along Mullan Road in the area The applicant also testified that the office use would provide headquarters for a significant employer in the county, and which user HE Findln~s, Conclusions and Decision ZE-53A-80 Page 7 i ~ ~ will not generate a lot of peak hour traffic The large office building on the westerly parcel of the site will be located over 200 feet from the east property line of the site and 84 feet from Sinto Avenue See site development plan (revised) and testimony of Walt Miller The office use proposed on the easterly parcel of the site cannot exceed one story or 20 feet in height, and is shown as only 500 square feet in size on the site plan Further, an eight (8) foot high sight- obscunng fence is illustrated along the east boundary of the site under the development standards of the B-1 zone Twenty (20) feet of Type I landscaping is also required along such property line The project is adequately buffered from the single-family uses in the area 3 The pronosal, as conditioned, bears a substantial relationship to and will not be detnmental to the oublic health. safetv and general welfare, and complies with the Spokane Countv Zoning Code and other aonlicable develooment reeulations As indicated above, the proposal will not have any significant land use impacts on surrounding properties and provides buffenng of the adjacent single-family uses from more intense uses The proposal implements the Comprehensive Plan, which is evidence of consistency with the public health, safety and welfare The record indicates that the proposal will likely provide employment opportunities in the area The proposal incorporates and implements the conditions of approval from the 1980 rezone, and meets or exceeds the development standards of the B-1 zone No deficiencies with apphcable land use regulations were identified dunng the public heanng process 4 The proposal. as condrtioned comnlies with the provisions of the State Envuonmental, Policv Act and the Countv's Local Environmental Ordinance, The procedural requirements of chapter 43 21 C RCW and chapter 11 10 of the Spokane County Code have been met The Heanng Examiner concurs with the Determination of Nonsignificance (DNS) issued by the Division of Building and Planning No comments were received from public agencies requesting withdrawal of the DNS The proposal as conditioned will not have more than a moderate effect on the quality of the environment III. 1)ECISION Based on the Findings of Fact and Conclusions above, the above application for a change of conditions application is hereby approved, subject to the conditions of the vanous public agencies specified below Failure to comply with the conditions of this approval may result in revocation of this approval by the Heanng Examiner This approval does not waive the applicant's obligation to comply with all other requirements of other agencies with junsdiction over land development HE Findings, Conclusions and Decision ZE-53A-80 Page 8 ~ • 'e SPOKANE COUNTY DIVISION OF BIJILDING AND PLANNING 1 The proposal shall comply with the Neighborhood Business (B-1) zone, as amended 2 The applicant shall develop subject property generally in accordance within the concept presented to the Heanng Body Variations, when approved by the Director/designee, may be permitted, including, but not Lmited to building location, landscape plans and general allowable uses of the permitted zone All vanations must conform to regulations set forth in the Spokane County Zorung Code, and the onginal intent of the development plans shall be maintained 3 A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Building and Planning Director/designee shall be submitted with a performance bond or other suitable guarantee for the project prior to release of building permits Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired 4 Direct light from any extenor area lighting fixture shall not extend over the property boundary 5 The Buildina and Planning Division shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a vanety of special conditions imposed as a result of approval of a land use action This Title Notice shall serve as public notice of the conditions of approval affecting the property in question The Title Notice should be recorded witYun the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Building and Planning The Title Notice shall generally provide as follows The parcel of property legally described as is the subject of a land use action by a Spokane County Hearing Body or Administratrve Official on , imposmg a variety of special development conditions. File No is available for inspection and copying in the Spokane County Division of Building and Planning. 6 Approval is required by the Building and Planning Director/designee of a specific lighting and signing plan for the descnbed property pnor to the release of any building pennits 7 The Spokane County Divlsion of Building & Planning shall file with the Spokane County Auditor, within the same time frame as allowed for an appeal from the final disposition, including lapsing of appeal penod, a Title Notice, which shall generally provide as follows "Pnor to the issuance of any building permit for any building or any use on the property descnbed herein, the applicant shall be responsible for complying with the provisions of the Zoning Code for Spokane County, Section 14 706 (Aquifer Sensitive Area Overlay Zone) The property which is the subject of this notice is more particularly descnbed as follows " HE Findings, Concluslons and Decision ZE-53A-80 Page 9 s ~ SPOKANE COUNTY DIVISION OF ENGINEERYNG A1VI) ROADS Prior to release of a building permit or use of property as proposed: 1 Access permits for approaches to the County Road System shall be obtained from the County Engineer 2 Applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans 3 The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project or portion thereof if the development is phased 4 A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer The design, location and arrangement of parking stalls shall be in accordance with standard englneenng practices Paving or surfacing as approved by the County Engineer will be required for any portion of the project which is to be occupied or traveled by vehicles 5 The construction of the roadway improvements stated herein shall be accomplished as approved by the Spokane County Engineer ' 6 The County Engineer has designated a Local Acocess Roadway Section for the improvement of Sinto Avenue which is adjacent to the proposed development This will require the addition of approximately 10-12 feet of asphalt along the frontage of the development Curbing and sidewalk must also be constructed 7 All required improvements shall conform to the current State of Waslungton Standazd Specifications for Road and Bndge construction and other applicable county standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer 8 Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners resolution 95-0498 as amended and are applicable to this proposal 9 No construction work is to be performed within the existing or proposed nght of way until a permit has been issued by the County Engineer All work within the public road nght of way is subject to inspection and approval by the County Engineer 10 All
