1. SUMMARY OF PROPOSAL AND DECISION
Proposal: Application for a change of conditions to an existing Neighborhood Business
(B-1) zone, to modify the approved site development plan for the prior rezone of a 2.75 acre site.
Decision: Denied.
II. FINDINGS OF FACT AND CONCLUSIONS
The Hearing Examiner has reviewed the change of conditions application and the evidence
of record, and hereby adopts the following findings of fact and conclusions:
A. GENERAL INFORMATION:

east of Mullan Road in the NW '/4 of Section 17, Township 25 North, Range 44 EWM, Spokane
County, Washington.
Legal Description: The south half of Tract 19 of Opportunity, as per plat recorded in Volume
"K" of Plats, page 20, EXCEPT the east 2 acres of said south half of tract 19, ALSO EXCEPT
the south 5.00 feet thereof deeded for roadway right of way. TOGETHER WITH the east 2.00
feet of the south half of Tract 20 of Opportunity, as per plat recorded in Volume "K" of Plats,
page 20. ALSO EXCEPT the south 5.00 feet of said east 2.00 feet of the south half of Tract 20.
Situate in the County of Spokane, State of Washington.
Zoning: Neigllborhood Business (B-1), subject to the conditions of approval in Building and
Planning File No. ZE-53-80 and ZE-53A-80.
Camprehentsive Plan Category: The property is designated in the Urban category of the
Spokane Cotinty Generalized Comprehensive Plan. The site is also located within the Priority
Sewer Service Area and the Urban lmpact Area designated in the Comprehensive Plan.
Environmental Review: A Determination of Nonsignificance (DNS) was issued by the
Division of Building and Planning on February 20, 1998.

Site Description: The site is approximately 2.75 acres in size, relatively flat in topography,
and undeveloped. A large office complex was recently constructed on the westerly 2.26 acres of
the site, along with associated parking and landscaping. Access to the site is provided by a
private driveway, which extends westerly across the frontage of adjacent property with Sinto
Avenue for approximateiy 170 feet, where it accesses Sinto Avenue opposite Stout Road. An
emergency fire department access to Sinto Avenue is located at the southeast corner of such 2.26
acre parcel, which is ciosed to general vehicular access by a chain and lock. Between July and
August, 1997, certificates of exemption were approved by the County to divide the five (5) acres
rezoned in 1980 into a.49 acre parcel on the east, a 2.26 acre parcel in the middle, and a
remaining parcel fronting along Mullan Road on the west. The middie and east parcel created by
the certificates of exemption make up the current site. On December 22, 1997, a preliminary
binding site plan was approved by the Division of Building and Planning to allow the 2.26 acre
parcel to be increased to 2.34 acres, by extending its west boundary line a distance of 12 feet to
the west, and to divide the westerly parcel fronting along Mullan Road into two (2) equal parcels
of 1.14 acres. See binding site plan map and decision dated 12-22-97 in File No. BSP-59-97.
Zoning History of Site: In 1980, approximately five (5) acres of land fronting along Mullan
Road and Sinto Avenue, including the present site, was rezoned from the Agricultural Suburban
(AS) zone to the Local Business (LB) zone, under the now expired Spokane County Zoning
Ordinance. See final decision in File No. ZE-53-80. The rezone was conditioned on submittal of
a site development plan for review at a future public hearing, and the restriction of vehicular
access to Sinto Avenue to the frontage within 190 feet east of Mullan Road, except for
emergency vehicle access points approved by the County Fire Marshall. In 1991, the zoning of
such land was re-designated under the County Zoning Code to the Neighborhood Business (B-1)
zone, pursuant to the Program to Implement the Spokane County Zoning Code. The Program to
Implement specifically preserved conditions of approval attached to the prior rezone of the site,
in re-designating the zoning of the property under the Zoning Code. See County Resolution No.
85-0900, Program to Implement, Zone Classification Transition Guide.
On November 12, 1997, the Hearing Examiner approved a change of conditions application
submitted by the applicant for the current 2.75 acre site. This included the approval of a site plan
for development of a large office building on the westerly 2.26 acres of the site, and development
of a small office structure on the easterly .49 acres of the site. The site plan illustrated a private
driveway extending from the site through the frontage of the adj acent property to the west, and
accessing Sinto Avenue within 190 feet of Mullan Road. The approved site plan also illustrated
an emergency fire access driveway at the southeast corner of the westerly 2.27 acres of the site,
closed off by a chain and padlock. The Examiner's decision specifically limited development of
the site to the concept presented to the Hearing Examiner at the September 17, 1997 public
hearing held on the change of condition application. See final decision in File No. ZE-53A-80,
including Building and Planning conditions of appiaval.
Surrounding Conditioas: The site fronts along Sinto Avenue, and Stout Road terminates
along the south side of Sinto Avenue approximately 150 feet west of the site. Both Sinto Avenue
and Stout Road are designated as Local Access roads by the County Arterial Road Plan. The
adjacent 1.94 acre parcel to the west is undeveloped, and owned by a third party. Mullan Road
to the west is designated as a Principal Arterial, while Mission Avenue to the north is designated
as a Minor Arterial. The Mullan Road/Argonne Road couplet west of the site comprises a major

traffic and commercial corridor through the Spokane Valley Area. Interstate 90 is located a few
blocks north of the site, and has an interchange at Argonne Road/Mullan Road. The land north
of the site is zoned Regional Business (B-3), and a large Holiday Inn was recently constructed on
such land. The land between Stout Road and Mullan Road, fronting along the south side of Sinto
Avenue, is zoned B-1. The land lying south of Sinto Avenue, east of Stout Road, as well as the
land lying east of the site, is zoned Urban Residential-3.5 (LTR-3.5) and improved with single-
family residences.
Project Description: The applicant seeks a change of condition in the existing B-1 zone, to
revise the site plan of record approved in File No. ZE-53A-80, by making the emergency access
located at the southeast corner of the site a full driveway access, and moving the westerly
driveway access along Sinto Avenue to the southwest corner of the site. This would allow the
driveway access through the adjacent property to the west to be eliminated. See site plan of
record submitted 12-9-97.

C. CHANGE OF CONDITIONS ANALYSIS:
1. Change of conditions annroval criteria
Spokane County Zoning Code 14.504.040 requires that applications for significant changes
to the site development plan approved for a prior rezone, and changes to the conditions of ~
approval for a prior rezone reclassification, be approved by the Hearing Body following a public
hearing. The applicant seeks to change the approved site plan and conditions of approval in File
No. ZE-53B-80, by significantly changing the access to the site.
The County Hearing Examiner Ordinance authorizes the Hearing Examiner to consider
change of condition applications at a public hearing. The Hearing Examiner is required to set
forth in findings and conclusions the manner in which a land use decision carries out and
conforms to the Comprehensive Plan and development regulations. The Examiner is authorized
to grant, deny or grant with such conditions, modifications and restrictions as the Examiner finds
necessary to make the land use application compatible with the County's Comprehensive Plan
and development regulations. See County Resolution No. 96-0171, Attachment "A", paragraphs
7(d) and section 11. This includes compliance with the Spokane County Zoning Code, the State
Environmental Policy Act (SEPA) and the County's Local Environmental Ordinance (chapter
11.10 of the Spokane County Code).
Since a change of conditions application modifies a prior rezone action, the criteria for
approving a rezone is generally applicable. In considering a rezone application, Washington case
laNv generally provides that (1) there is no presumption in favor of the rezone, (2) the applicant
for the rezone must prove that conditions have substantially changed in the area since the last
zoning of the property, and (3) the rezone proposal must bear a substantial relationship to the
public health, safety or welfare. Parkrid2e v. Seattle, 98 Wn. 2d 454, 462 (1978); Biarnson v.
Kitsap County, 78 Wn. App. 840 (1995). Spokane County Zoning Code Section 14.402 (1)(2)
indicates that consistency with the Comprehensive Plan, detriment to the public welfare and
changed circumstances are relevant in deciding to amend the official County Zoning map.
A comprehensive plan serves as a guide to the adoption of zoning regulations, and strict
adherence thereto is not required. See RCW 36.70.970 (3); Barrie v. Kitsap Countv, 93 Wn.2d
843, 848-49 (1980). General conformance with a comprehensive plan is normally required
before a rezone may be approved. Bassani v. Countv Commissioners, 70 Wn. App. 389 (1993);
Belcher v. Kitsan Countv, 60 Wn. App. 949, 953 (1991); and Cathcart v. Snohomish Countv, 96
Wn.2d 201, 211-12 (1981); and Bame v. Kitsap Countv, 93 Wn.Zd 843, 848-49 (1980).
Consistency with a comprehensive plan is relevant in determining whether a rezone bears a

substantial relationship to the public welfare. Bassani, Wra, at 396--98. Recent ca,ses have held
that changed circumstances are nat required for a rezone if the proposed rezone closely
implements the policies of a Gomprehensive plan. Biarnsan v. Kitsap Counfv, 7$ Wn. App. $40,
846 (1995); Save Our Rural Enviranment v. Snohomish Cauntv, 99 Wn.2d 363, 370-371
(1983).
Sprakane County Zoning Code 14.100.104 states that the provisions of the Zoning Code
sha11be interpreted to carry out and implement the purpose and intent af the Comprehensive Plan
and the general p1ans for physical development adopted by the Board of County Commissianers.
The Cornprehensive Plan indicates that it should he used as a reference source and guide for
nmaking Iand use decisions. Comprehensive Plan, p. 2. The "decision guidelines" set forth in the
Comprehensive Plan are to be used in determining whether or nat a particular prapcasal should be
apprvved, conditioned ar denied.
A change of conditions is not a rezone, because it does nvt change the actual zone of the
property. Hawever, a change of conditions may affect the conditions of approval, as well as the
germitked uses, locati+on of buildings, landscaping, conditions of approval and vther features in a
site development plan, approved in conjunctiQn with a prior rezone. Provf of "changed

a. Ammlicabie nolicies
fihe proposal is designated in the Urban category of the Comprehemsiwe Plan, The EJrban
category is intended to prvvide the opportunity for a"citylike" environment, which includes
variaus land uses, residential development and a high level of public facilities and urban
services. It is primarily a residential category of single-family, two-family, multi-family, and
condominium buildings along with neighborhaod commerciat, light industrial, and public and
recreatianal facilities. The Urban category recommends a residential net density range of one {1}
to 17 units per acre. The more intensive uses in the Urban category, such as light industrial and
neighbarhood commercial, would be Iocated near or alang the heavily traveled streets. The least
intensive single-family residential uses shauld be isalated from the noise and heavy traffic, and
multifamily structures will usually be a transitianal use lacated between single-family residential
arYd the rnvre intensive areas. See Cvmprehensive Pian, Sectian 1, "Furpase" and "DetaiIed
Def nition". The Urban categary alsa indicates that buffering and landscapinc, should be useci to
render Iand uses in such category campatible and avflid adverse impact. IDecision Guideline

The property is alsa located within the Urban Irnpact Area (UTA) designated in the ~
Comparehensive Plan. See Comprehensive Plan, 5ection 14. This is an area where grawth,
development and higher intensities af land use are encouraged. Comprehensive Plan, +Objective
14.I.a. Traditiona] urban prablems such as incompatible land uses, environrnental pollutian and

traffic congestion are to be managed with greater attention to the general public's well-being
inside the UTA. Comprehensive Plan, Objective 14.1.e.
The site is aiso located adjacent to the Major Commercial category of the Comprehensive
Plan on the north, and is approximately 100 feet west of the Major Commercial category.
Accordingly, the proposal is subject to the "transition area" policy of the Comprehensive Plan.
The "transition area" is the area along the boundary between adjacent land use categories. A
development may cross or be adjacent to the fringe area and considered to be situated in the
"transition area". The transition area policy allows developments complying with either of the
land use categories involved in the transition area, depending on the distance a use intrudes into
an adjacent land use category, the impacts to existing land use categories, and the decision-
maker's site-specific approval. See Comprehensive Plan, Introduction, "Transition Area", and
Glossary, "Transitional Areas".
The Major Commercial category of the Comprehensive Plan is intended to pruvide the
opportunity for development of commercial uses, "...specifically community and regional
shopping centers and commercial uses, directly related to major throughways". Comprehensive
Plan, Major Commercial category, p. 89. Residential use is not intended to be a hii;h priority in
such category, due to the presence of intensive commercial uses. The heavy automobile traffic
and the related congestion associated with Major Commercial areas may create pollution
problems, especially along the commercial strip developments.
Objective 6.l .a of the Major Commercial category indicates that commercial developments
should be buffered to protect adjacent areas. Decision Guideline 6.1.1 states that the best means
of encouraging compatibility between commercial uses and adjacent land use categories is
through the orientation of the structures and/or facilities of the proposal to maintain or improve
upon the aesthetics and energy efficiency of all areas affected by the proposal; the provision of
buffering needs; and the provision of landscaping needs. Decision Guideline 6.1.2 recommends
that developers be required to provide buffering or spatial separation between proposed and
existing uses, if a proposed development's physical characteristics would be objectionable to
future development on nearby lands.
Objective 6.1 j of the Major Commercial category recommends that small-scale
convenience stores and commercial enterprises be considered adjacent to residential
neighborhoods. Decision Guideline 6.1.13: Stores and commercial services established to serve
residents within a few blocks' radius may be considered compatible, and therefore appropriate,
when they are adjacent to residential land-use categories. Decision Guideline 6.1.6 states that
before approving proposed commercial developments, it should be determined that the proposal
has adequate on-site areas for existing and potential parking and storm drainage control: the
proposal considers the impact upon existing or planned transportation facilities and conforms to
County transportation plans and policies; and the proposal considers access to existing and
planned public transit and routes
The Transportation section of the Comprehensive Plan is intended to provide guidelines for
the provision of appropriate and adequate transportation facilities and services for all land use
categories of the Comprehensive Plan. Comprehensive Plan, Section 21. The Transportation
section contains the text of the County's Arterial Road Plan, along with numerous policies for

the development of county local access roads and arterials, and of adjacent land uses. See
Comprehensive Plan, p. 238-242.
Decision Guideline 21.3.3 states that access roads should be designed to provide access to
abutting property and to deliver traffic to arterials. Decision Guideline 21.5.10 states that
"through" traffic should be discouraged from using residential access streets, and recommends
techniques such as offset intersections, curvilinear street design and cul-de-sacs be used to make
residential neighborhoods more attractive. Decision Guideline 21.4.2 encourages the
development of an adequate, efficient, safe, economical and energy conserving arterial
system which serves existing and future needs, which provides convenient access to homes,
employment, shopping, personal business and recreation, and which functions as a coordinated
part of the metropolitan arterial system". Decision Guideline 21.4.3 indicates that the arterial
system should preserve the integrity of residential neighborhoods, enhance the quality of life in
neighborhoods and protect the physical environment, through sensitive development of arterials.
Decision Guidelines 21.2.5 and 21.5.7 recommend that the function of existing and future
arterials be preserved by controlling land uses, parking and direct access along the arterials.
Decision Guideline 21.5.3 encourages land uses in areas that can take advantage of the available
capacity of existing arterial streets.
b. Consistencv with apDlicable policies, reizulations and the public, health, safetv a11d
wel fare.
The proposal is zoned Neighborhood Bmsiness (B-1). The purpose of the B-1 zone is to
allow for limited, small-scale neighborhood serving retail and office uses as a means of
implementing the Urban, Major Commercial and Suburban categories of the Comprehensive
Plan. Within the Urban category, the size, number and location of B-1 zones are limited so as to
meet neighborhood needs. Zoning Code 14.624.100. Such B-1 zones should be in a business
cluster no larger than five acres in size, with frontage on a Collector Arterial or higher road
classification not exceeding 600 feet, and spaced at least one-half mile from other B-1 zoned
areas. When located wholly within the Major Commercial category, B-1 zones are not subject to
the area, frontage and location restrictions or advisements that apply to 13-1 zones in the Urban
category, although frontage on a Collector Arterial is still a requirement. See Zoning Code
Chapter 16.24.
In approving the site development plan submitted for ZE-53A-80, the Hearing Examiner
found that such site plan, including its proposed uses and proposed access, was consistent with
the Comprehensive Plan. The applicant now seeks to change the access for the site, to allow a
driveway east of Stout Road near the southwest corner of the site, and to allow the emergency
access near the southeast corner of the 2.26 acre portion of the site to permit regular vehicular
traffic. The applicant claims that the large office complex that was constructed on the site will
restrict traffic circulation on the site, due to the "bottleneck" entrance to Sinto Avenue located
opposite Stout Road, and restrict traffic circulation along Sinto Avenue near Mullan Avenue.

Neighboring property owners living across from or near the proposed accesses opposed the
proposed change of conditions, contending that traffic would create congestion along Sinto
Avenue adjacent to single-family homes, generate commercial traffic along a residential street,

and create safety issues for small children and pets associated with such homes. See letter
submitted on 2-6-98 from Larry Hoyt, and letter dated 1-25-98 from Nancy Eldridge; and see
testimony of Nancy Eldridge and Anita Larsen. There are currently no sidewalks located along
the south side of Sinto Avenue in the area. See testimony of Anita Larsen.
The applicant argued that the area had changed significantly since the Board of County
Commissioners decision in 1980 which restricted access to Sinto Avenue, due to the amount of
commercial development in the area, including development of the site for offices. The applicant
also contended that traffic generation from the use of the site for offices would generate
considerably less traffic than development of the site for a retail center, as initially proposed in
1980, and that office traffic would be confined to daylight hours. See testimony of Walt Miller
and Bruce Miller. County Engineering felt that traffic from the proposal could cause cars to be
backed up along Sinto Avenue with or without the change of condition, and expressed no
concern that the current access for the project would cause congestion problems at the
intersection of Sinto Avenue and Mullan Road. See testimony of Scott Engelhard.
The current use of the site is technically nonconforming, since the site does not have at
least 50 feet of frontage along a public road of the Neighborhood Collector Arterial or higher
classification, as required in the B-1 zone for sites designated in the Urban category by the
_ Comprehensive Plan. See Zoning Code 14.624.315. The Hearing Examiner granted approval of
the site plan in File No. ZE-53A-80, even though the site fronts only along a Local Access road,
because the Board of County Commissioners final decision in Fite No. ZE-53-80 authorized the
- site to be developed for commercial purposes subject to access being restricted as previously
stated, and subject to the approval of a site development plan. See Hearing Examiner final
decision in File No. ZE-53A-80. Approval of the current change of condition would increase the
impact of the nonconformity of the site with the B-1 zone minimum frontage standards as well as
the intent of the B-1 zone, by introducing additional business traffic along a local access street
adjacent to single-family homes. Such approval would also be inconsistent with the intent of the
Urban category and Major Commercial, which seeks to protect existing residential development
from the impacts of commercial development by locating it primarily along arterials and not
local access streets.
While a retail center was proposed to be developed on the initial five (5) acre site in 19801
such site had 319 feet of frontage along Mullan Road, a Princioal Arterial. Further, the site plan
for the proposed retail center submitted at the time was withdrawn prior to the public hearing
held by the Board in 1980. See final decision in File No. ZE-53-80. It is true that the land lying
along Mullan Road, the site and the land lying between the site and Mission Avenue has been
developed and zoned for commercial purposes. However, the land lying south of Sinto Avenue,
east of Stout Road, and the land lying east of the site, has remained a single-family neighborhood
and zoned Urban Residential-3.5. The fact that some of the homes along Sinto Avenue west of
Stout Road may now be occupied on a rental basis, as stated by the applicants, does not change
the impacts on such residences.
Preliminary binding site plan BSP-59-97 shows a 20-foot wide driveway easement
extending between Mullan Road and the 2.34 acre parcel that includes the westerly 2.26 acres of
the site. This driveway easement was created for the ostensible purpose of providing frontage for
such 2.34 acre parcel, although such easement is not wide enough to satisfy the 50-foot frontage
requirement of Zoning Code 14.624.315. Further, County Engineering commented that such

easement would create safety problems along Mullan Road near Sinto Avenue, if used for
general vehicular access. See testimony of Scott Engelhard.
While a change of conditions does not usually need to be demonstrated for a change of
conditions application, the Examiner notes that the access concerns cited by the applicant are
self-created. The restrictions on access to the site were created in 1980, when the site had access
directly to Mullan Road. Division of the site by the applicant through the certificate of
exemption process and development of the current office complex are directly responsible for the
access problems complained of. The adjoining single family neighborhood should not suffer
from these voluntary choices by the applicant.
The procedural requirements of chapter 43.21 C RCW and chapter 11.10 of the Spokane
County Code have been met. No comments were received from public agencies requesting
withdrawal of the DNS. Since the Hearing Examiner is denying the project based on its .
inconsistency with the Comprehensive Plan, and the public health, safety and welfare, there is no
need to address concurrence with the Determination of Nonsignificance (DNS) issued by the
Division of Building and Planning.
III. DECISION _
Based on the Findings of Fact and Conclusions above, the above application for a change of
conditions application is hereby denied. -

Comments have been received from nearby property owners expressing concerns over increased traffic
problems along Sinto Avenue that would result if the requested change of conditions is approved.
Description of the Site:
The site is located north of and adjacent to Sinto Avenue. There is a newly constructed office complex on
the site with associated parking and landscaping. The site is currently accessed off Sinto Avenue by a
driveway that is in alignment with Stout Road. A second driveway access has been constructed further east
along Sinto Avenue and is currently blocked with a chain. Surrounding uses include vacant and
undeveloped land, a motel complex and single family residences to the east and south of the site. A mix of
commercial uses can be found west of the site along Mullan Road.
Back4round:
A zone reclassification, ZE-53-80, from agricultural Suburban (AS) to Local Business (B-1) for a retail center
on this site was approved by the Board of County Commissioners (BOCC) on December 1, 1980. The
BOCC attached the following conditions of approval:

3. Access to Sinto Avenue, from the project site, shall be limited to the westerly 190 feet; with the
exception of emergency vehicle access points as required by the County Fire Marshall.
The requested change of conditions is for the purpose of deleting BOCC condition #2 to allow unrestricted
access along Sinto Avenue.
The original zone classification of Local Business (LB) crossed over to Neighborhood Business (B-1) on
January 1, 1991, with the implementation of the Spokane County Zoning Code.
. A public hearing was held on September 17, 1997 to review a site plan submitted by the applicant for an
office building on the subject property (ZE-53A-80), as required by BOCC condition #3. The Hearing
Examiner approved the site plan, as presented, in a written decision issued on November 12, 1997. The
site plan presented illustrated one access point located within the westerly 190 feet of Sinto Avenue and in
alignment with Stout Road, and a chained emergency access to Sinto Avenue located near the southeast
corner of the site.
Staff Analysis:
The site is located within the Urban category of the Comprehensive Plan. The Urban category is intended to
provide for the development of a"city like" environment which includes various land uses, intensive
residential development, and public facilities and services.
The Urban category states that the more intensive land uses such as light industrial and neighborhood
commercial will be located near the heavily traveled streets, while the least intensive single-family uses will
be isolated from the noise and traffic.
At the time the zone reclassification (ZE-53-80) was approved, the requested Local Business (LB) zone had
no requirements concerning site access. The BOCC condition of approval #2 which limits access to the
• westerly 190 feet of Sinto Avenue was in excess of the development standards of the Local Business (LB)
zone. The site is currently zoned Neighborhood Business (B-1). The purpose and intent of the
Neighborhood Business (B-1) zone states that site access should be provided by a Collector Arterial or
higher arterial road classification. Sinto Avenue is designated as a Local Access Street within the Spokane
County Arterial Road Plan. .
Section 14.624.315 of the Zoning Code currently requires that minimum frontage for permitted uses in the
Neighborhood Business (B-1) zone shall be at least fifty (50) feet on a public street of the "Neighborhood
Collector' or higher classification, as established in the Spokane County Arterial Road Plan. The proposed
2"d access is from Sinto Avenue which is identified by the Spokane County Arterial Road Plan as a Local
Access Street. The site is a portion of a larger parcel of property which has frontage on Mullan Road (see
CE-333-97). The site is currently the subject of a preliminary binding site plan (BSP-59-97) that was
approved on December 22, 1997. The preliminary binding site plan map illustrates three (3) lots, two
located adjacent to Mullan Road and one lot located adjacent to Sinto Avenue. The lot adjacent to Sinto
Avenue is the subject of this requested change of conditions. In order to meet the Neighborhood Business
(B-1) zone frontage requirements, the Division of Building and Planning has required the final binding site
plan map to illustrate an easement fifty (50) feet in width from Mullan Road to the site. The Spokane County
Arterial Road Plan identifies Mullan Road as a Principal Arterial.
The BOCC condition of approval #2, that limits access to the westerly 190 feet of Sinto Avenue, was in
excess of the development standards of the Local Business (LB) zone and apparently was the result of
neighborhood concerns over traffic impacts. The condition is generally consistent with the purpose and
intent of the existing Neighborhood Business (13-1) zone. The applicant has stated that the requested
change of conditions is necessary to alleviate potential traffic congestion on Sinto Avenue as a result of
restrictive traffic circulation. The applicant has stated that changed conditions in the area justify deletion of
the BOCC condition of approval #2. The application states that changed conditions in the area include a
general change in the character of the area from residential to commercial uses.

area justify the deletion of BOCC condition of approval #2

1. The proposal shall comply with the Neighborhood Business (8-1) zone, as amended.
2. The applicant shall develop the subject property generally in accordance with the concept
presented to the Hearing Examiner. Variations, when approved by the Director of the
Division of Building and Planning/designee, may be permitted, including but not limited to
building location, landscape plans and general allowable uses of the permitted zone. All
variations must conform to regulations set forth in the Spokane County Zoning Code, and
the original intent of the development plans shall be maintained.
3. Approval is required from the Director of the Division of Building and Planning/designee of
a specific lighting and signing plan for the described property prior to the release of any
building permit.
4. Direct light from any exterior area lighting fixture shall not extend over the property
boundary. .
5. The Division of Building and Planning shall prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a variety of special
conditions imposed as a result of approval of a land use action. This Title Notice shall
serve as public notice of the conditions of approval affecting the property in question. The
Title Notice should be recorded within the same time frame as allowed for an appeal and
shalt only be released, in full or in part, by the Division of Building and Planning. The Title
Notice shall generally provide as follows:

Opportunity as per plat thereof recorded in Volume "K" of plats, page 20: and

Priar to release of a building permit or use of property as proposed:
1. Access permits for approaches to the County Road System shall be
obtained from the County Engineer
2. Applicant shall submit for approval by the Spokane Caunty Engineer
road, drainage and access plans
3. A parking plan and traffic eirculation plan shall be submitted and
approved by the Spokane County Engineer. The design, location and
arrangement of parking stalls shall be in accordance with standard
engineering gractices Paving or surfacing as approved by the County
Engineer will be required for any partion of the project which is to
be occupied or traveled by vehicles
4. The construction of the roadway improvernents stated herein shall be
accamplished as appraved by the Spokane County Engineer
The County Engineer has designated a Local Access Roadway Section for
the improvement of Sinto Avenue which is adjacent to the proposed
development. This will require the installation of asphalt equal to
20 feet from centerline along the frontage of the development The
construction of curbing and sidewalk is also required.

5. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge construction
and other applicable county standards and/or adopted resolutions
pertaining to Road Standards and Stormwater Management in effect at
the date of construction, unless otherwise approved by the County
Engineer.
6. Roadway standards, typlcal roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 95-0498 as amended and are applicable to this proposal.
7. No construction work ls to be performed within the existing or
proposed right of way until a permit has been issued by the County
Engineer. All work within the public road right of way is sub3ect to
inspection and approval by the County Engineer.
8. Al1 required construction within the existing or proposed public right
of way is to be completed prior to the release of a building permit or
a bond in an amount estimated by the County Engineer to cover the cost
of construction or improvements shall be filed with the County
Engineer.
9. The applicant shall grant applicable border easements ad3acent to
Spokane County Right of Way per Spokane County Standards
