it has been some time now since we last contacted you regarding
storage of inoperable vehicles on your property, located at E. 11803
Frederick, Spokane County, parcel number 09541-0115.
A recent visual inspection by our field inspector indicates that one
vehicle is still being stored openly.
As stated in our letter of June 5, 1985,you were given thirty (30)
days to either remove the vehicle or place it in the rear yard area
and completely screen it from view.
Due to the length of time this matter has been pending, we are of the
opinion that a period of 10 days, beginning with your receipt of this
letter, should be a sufficient extension of time for you to complete
the process of bringing your property into compliance with the
requirements of the Spokane County Zoning Ordinance. If these
matters are not taken care of within the previously mentioned 10
days, we will be unable to grant any further extensions of time and
will have no choice but to forward this case to the Spokane County
Prosecuting Attorney's Office for appropriate legal action without
further notice. A violation of the Spokane County Zoning Ordinance
is a criminal offense and does carry a penalty of, "... imprisonment
in the County Jail for a maximum term fixed by the court of not more
than ninety (90) days or by a fine in an amount fixed by the court of
not more than one thousand dollars ($1,000), or both such
imprisonment and fine."
Please he advised that this is not a matter that will go away if
ignored. I am sure it is important to you, as it is to me, that we
resolve this situation quickly.

Laws and regulations in our society are, at times, difficult to
understand and fully comprehend. This is true of zoning ordinances,
which are laws intended to protect and govern the many different uses
of land in Spokane County. It is my responsibility, as the Code
Coordinator, when the situation arises, to help resolve conflicts
involving the Spokane County Zoning Ordinance.
As discussed with you by phone on May 27, 1985, this office has
received reports regarding the storage of inoperable vehicles and
parts on your property, located at E. 11803 Frederick Spokane County,
parcel number 09541-0115. This property is zoned Agricultural -
Suburban.
A recent visual inspection by our field inspector indicated that
these reports are accurate. One inoperable vehicles is being stored
openly within the front yard area.
Section 4.03.020(32A) of the Spokane County Zoning Ordinance defines
inoperable vehicles as follows:
"Junk or Parts Vehicles" shall mean the remants or remains of a
motorized or non -motorized device capable of being moved upon a
public highway and in, upon, or by which any person or property
is or may be transported or drawn upon a public highway and which
is inoperative. Such term shall include, but not be limited to
vehicle hulks, trailers, semi -trailers, tractors, motorcycles,
trucks, and buses."
Section 4.17.170 requires that storage of inoperable vehicles or
parts thereof shall be in accordance with the following provisions:
1. No "Junk or Parts Vehicles" may be stored within the front,
flanking street, or side yard setback area; and
2. All "Junk or Parts Vehicles" must be completely sight-
screenedyear-round, from a non -elevated view, by a fence,
hedge, shrubs or (maintained landscaped berm) (natural
landscaped berm).

Section 4.05.070 of the Spokane County Zoning Ordinance regulates
storage within a Residential Zone classification to , "...storage of
materials used in the connection with the operation of a household
and activities associated with the normal operation of a household
except that property may be used for the storage of materials used in
the construction of the individual buildings on the property in the
project."
It is the intent of this letter to advise you of an apparent zoning
violation and to request compliance within a suitable time frame.
Accordingly, we are of the opinion that since you have now been
informed of the requirements of the Spokane County Zoning Ordinance,
a period of 30 days, beginning with the date of this letter, should be
sufficient time in which to bring your property into compliance by
either removing the inoperable vehicle and parts or by providing
sight -obscuring screening as noted above.
Do not hesitate to act upon this important matter, since a violation
of the Spokane County Zoning Ordinance is a misdemeanor and does
carry a penalty.

Our office has been informed that you are once again maintaining
animals on your property located at E. 11803 Frederick on parcel
number 09541-0115.
A review of our records indicates that you were determined to be in
violation of Section 4.05.080 of the Spokane County Zoning Ordinance
by keeping of chickens and geese within fifty (50) feet from adjacent
residences for a period between April and June, 1983. After issuing
written notices of violation on May 25, 1983, and again on June 13,
1983, compliance was noted on July 5, 1983, finding that only one
chicken was confirmed and that it was being kept 50 feet from
neighboring residences.
After receiving renewed complaints on April 1, 1985, this office
confirmed on April 4, 1985, that at least nine chickens and one goose
are being kept and were within 50 feet of adjacent residences.
Due to your previous notices and awareness of the zoning
requirements, we are of the opinion that a period of 10 days,
beginning with your receipt of this letter, should be a sufficient
extension of time for you to complete the process of bringing your
property into compliance with the requirements of the Spokane County
Zoning Ordinance. If these matters are not taken care of within the

Your letter dated April 10, 1985, addressed to Tom Mosher of the
County Planning Department regarding the keeping of roosters on
property located at E. 11803 Frederick, has been referred to this
department for response.
The attached letter notifying the owner of the violation should
explain what is being done. However, to clarify a couple of concerns
mentioned, this department responds to all citizen complaints filed.
In this instance, on April 1, 1985, a complaint was filed, with
verification of a violation made on April 4, 1985. The last contact
we have had with any concerned citizen prior to April 1985 was Spring
1983 when compliance was achieved.
Regarding the other concerns such as the keeping of a dog in an
unsanitary pen, the Spokane County Health District has issued a
notice to clean the pen.

In response to your letter dated April 10, 1985, regarding a letter of
complaint from a Mr. Cal Cederblom at East 11803 Frederick Avenue.
The zoning of the property ts Agricultural Suburban. The Spokane County
Zoning Ordinance, Chapter 4.05,080. (a) and (b), (see enclosed), allows house-
hold pets and poultry for the use of the occupant of the premises. This
section speci'fies a 50 foot setback for all buildings housing animal or fowl,
yards or runways 50 feet from any dwelling other than the dwelling of the
owner. As you can see from the above, the general use of household pets and
poultry is permitted provided they maintain setbacks. The issue unresolved
at this point is one of setbacks.
I have forwarded your letter to Mr. Torn Davis, the Zoning Investigator
for Spokane County for investigation. Any further contacts regarding this
issue should be through Mr. Davis at 456-3675.
For your information, I have also enclosed Chapter 4.18 of the Zoning
Ordinance, Non -Conforming Uses, for your consideration. This chapter deals
with the issue of non -conforming uses, although not specifically with regard
to the setbacks for the keeping of animals. The Zoning Ordinance provides
that the Zoning Administrator may make an official determination with regard
to noir-conforming uses within Spokane County. Should the parties involved with-
in this zoning matter desire such a determination, they can contact me at the
Spokane County Planning Department - Phone No. (509) 456-2205.

The purposes of this letter is to follow-up my letter dated May 25, 1983,
regarding location of chicken(s) on your property. In that letter, you
were informed that chickens must be kept at least 50 feet from any adjacent
residences at all times. This applies to their housing and yard area.
On June 9, 1983, and after receiving continuing complaints, I again made
a visual inspection of your property and confirmed that at least one chicken
(rooster) is being kept in your back yard, and within 50 feet of your neigh-
bor's residence.
The primary concern of the residences, is that the rooster is apparently
a nuisance with its night-time crowing, which under the provisions of the
Spokane County Zoning Ordinance there is no jurisdiction. However, the
county does have jurisdiction over the location of fowl, including fowl
as pets which shall be minimum of 50 feet from any residence other than
your own.
Because of your awareness of the zoning violation, we are of the opinion
that seven (7) days, beginning wiht the receipt of this letter is sufficient
time in which to bring this matter into compliance by either constructing
a shelter and yard at a distance of 50 feet from any neighboring residence
or by removing any chickens from the premises.
Do not hestiate to act upon this important matter since a violation of the
Spokane County Zoning Ordinance is a misdemeanor and does carry a penalty.

This letter is in regards to the chickens being kept on your property
located at East 11803 Frederick.
As you have been informed by this office, housing of such animals and
fowl including yards and runways shall not be less than fifty (50) feet
from any neighboring dwelling, Section 4.05.080 of the Spokane County
Zoning Ordinance.
On May 19, 1983, I telephoned your residence and talked with a lady who
informed me that all chickens had been removed.
On May 24, 1983, after receiving additional complaints, a visual inspection
was conducted of your property and confirmed that at least one roaster is
being kept.
In order to satisfy this matter, I will need from you a signed statement
attesting that the chickens and their yards and runways are being kept
a minimum of fifty (50) feet away from adjacent residences. Your
immediate attention and response by June 3, 1983 would be greatly
appreciated.

Dear Mr. Tallman:
Once again, we are being put into a situation whereby we must refer
the matter of storage of inoperable vehicles in violation of Section
4.17.170 of the zoning ordinance to the prosecuting attorney's
office for appropriate legal action.
On June 5, 1985 and again on July 30, 1985, you were notified of the
requirements for the storage of inoperable vehicles. On August 28,
1985, our district inspector reported that the vehicle has been
relocated to the rear yard but has not been fully screened from view.
Because of your initial effort to comply, we wi I l rehold the referral
of this matter to the prosecutor until September 16, 1985. I would
strongly urge compliance by constructing a sight -screened fence of
substantial construction prior to this date.

RE: Storage of junk or parts vehicles
Dear Mr. Tallman:
It has been more than thirty (30) days since this
office issued a notice for corrective action,
dated November 5, 1985, of a zoning violation on
your property located at East 11803 Frederick.
At our request, Tom Davis of the Spokane County
Department of Building and Safety rechecked your
property and found that two inoperable vehicles
are still being stored openly. However, Mr. Davis
did state that you had attempted to place a tarp
over the vehicles.
Please be advised that covering such vehicles in
this manner would not be in compliance with the
zoning ordinance. Specifically, Section 4.17.170
requires a completely sight -screened year-round
fence of substantial construction.
Since this provision of the Code may not have been
clear to you, we are withholding further legal
action for a period of thirty (30) days, beginning
from the date of this letter, in order for you to
either remove the vehicles being stored or
construct a sight -obscuring fence.
