HOLD HARMLESS AGREEMENT
•
WHEREAS, Valley Vista Estates has received final plat approval and was filed of
record on June 11, 1985, in Plat'Book 17, page 66; and
WHEREAS, the owner(s) of Lot 2, Block `2, Valley Vista Estates, would like to
construct a single family home on said lot, but the current location of the drainage easement
on the face of the plat, and the existing culvert conflict with the proposed home -site; and
WHEREAS, the owner(s) intends to seek an amendment or alteration of the plat,
relocating the drainage way and the culvert to a location acceptable to the County Engineer;
and
WHEREAS, the owner(s) has requested Spokane County to issue a building permit
for said lot pending approval by Spokane County of the altered or amended plat; and
WHEREAS, Spokane County is willing to issue a building permit to the owner(s) only
upon execution of this Hold Harmless Agreement,
NOW, THEREFORE, in consideration of Spokane County agreeing to issue the
undersigned owner(s) a building permit, before the altered/amended plat is approved, the
undesigned owner(s) hereby agrees to:
1. Immediately apply for amendment/alteration of that portion of the Valley Vista
Estates plat comprising Lot 2, Block 2, providing for the relocation of the existing drainage
easement and culvert to a location deemed suitable by the County Engineer.
2. Submit the proposed revision of the easement and culvert location, and other
pertinent information, to the County Engineer for approval, and obtain said approval.
3. Submit an amended/altered plat and plan showing the relocated easement and
culvert.
4. Obtain the approval of the County Planning Department and Board of County
Commissioners for the altered/amended plat before occupancy of any residence constructed
on the site, and before final inspection is granted.
5. Hold Spokane County, its officers, agents, and employees harmless from any and
all damages, expenses, claims, liabilities, courses of action, suits on and expenses, including
reasonable attorney fees, caused by or arising from the issuance of a building permit to the
undersigned owner(s) before the Valley Vista Estates plat has been amended/altered, or
caused by or arising from the failure by Spokane County to approve such alteration or
amendment when applied for, provided such failure is justified.
6. Agrees that the above obligations shall run with the land.
