hearing on September 29, 1981, and having fully considered all testimony
pr~sented thereat, and further naving individually visited with the site and
vicinity in question, and having rendered a decision on the 13th day of
October, 1y~1, denying said proposal, does hereby make the following:
FINOINGS OF FACt ~
, 1. Yhat the proposal is generally located between Argonne Road and
~~u11an Road approxi~~ately 250 feet north of Va11ey Way in Section 11-25-44.

Z. That the proposal consists of~a request to review a change in
s i te p 1 ans f rom off i ce and reta i 1 co~~p 1 exes to an auto repa i r and sa 1 es faci 1 ity on a portion of the site.
3. That the adopted Spokane County Generalized Comprehensive Land
Use P]an indicates Major Comaercial type usage of the area encompassed by the
proposal. This category provides that in considering developrnents, a goal
should be to promote develop~~ent in a manner which is complementary and co~~patible with adjacent land uses and the surrounding environment. Stores
and commerciai services adjacent to residential neighborhoods should be
established to serve residents wit~in a few block radius. The proposal of an
auto repair and sales business in the Argonne-Mullan couplet is not consistent
w i th th i s gaa 1 of the Ma jor Co~u~erc i a 1 1 and use category.
4, That no environmental finding is necessary inasmuch as the
proposal is being denied.
5. That the Spokane County Hearing Examiner Commit~ee held a public
hearing on Septe~nber 3, 1981, concerning the proposal, subsequent to which by
Fi nd i ngs of Fact, Dec i s i on and ~rder dated Septe~nber 3, 1981, they den i ed the
proposal based on Findings of Fact which the Board of County Commissioners ~
adopts herein py reference.
6. Tnat tne existing land uses in the area of the proposal include
single family residences, accessory buildings, church, New Hope Recruiting
Center, Kindercare Pre-School, parking lot, offices and undeveloped land.
That the proposal is not necessarily compatible with existing uses in the
area. That the Planning Agency advised the ~oard at their public hearing that
retail intense projects have been limited to arterial intersections within the Argonn~-~1u 11 an Corr i dor. For i ns tance, the i ntersect i ons of ~I i ss i on and
droadway with Argonne and Mullan include convenience stores, gas service and

deve ioped into apartment comp iexes, proressiona i, ou5 Int:yb driu IIIr~ I~Ial
offices, and liinited retail outlets. That the proposed auto repair and sales
business, even as conditioned by various departments is not compatible or
cons i s tent wi th the 1 and use trend for th i s area.
l. That of the past nineteen (19) zone changes between Mullan and
Argonne, fifteen (15) have been conditioned to require special landscaping
standards, use restrictions and/or sign controls which have promoted
compatibility between each other and the surrounding residential uses.

8. That the applicant has not de~~onstrated changed conditions in

conditions to justify an auto repair and sales faci 1 ity.
9. That the proposal, not being consistent with the surrounding
land uses, would grant a special privi lege or right to the appl icant different
than those enjoyed ey adjacent property owners.
10. That the Board finds that the propasal is located within the
recorded water service area of c~odern Electric Water Company.

Fro~n the foregoing Findings, a review of the Planning Departrnent
Staff Report dated September 3, 1987, the Staff presentation of File No. ZE-1~A-8~ and the Findings and Order of the Nearing Examiner Committee dated
Septe~nber 3, 1981, the Board hereby denies the proposed change of conditions
for a new site development plan.

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
September 3, 1981, and the members of the Committee present being Phillip
D. Harris, Chairman, and Gary N. Anderberg and John W. Skadan.
6. PROPOSAL .
The sponsor, Redeemer Evangelical Lutheran Church, is requesting approval
of a change of conditions in a Commercial Zone, File No. ZE-10A-84, for the purpose of reviewing a new site development plan to allow commercial,
retail, and automotive repair/sales.
C. FINDINGS OF FACT
1. That the existing land use in the area is single famiiy residential,
accessory buildings, church, New Hope Recruiting Center, Kindercare Pre-School, parking lot, vacant office and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
MAJOR COMMERCIAL development.
3. That the existing zoning of the property described in the application
i s Commerc i a 1.
4. That the provisions of RCW 43.21C (The State Environmental Policy
' Act) have been complied with, and the Committee concurs with the
Determi nat ion of Non-Signif i cance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulf i 1 led.
6. That the land in this area is unsuitable for the proposed use, or
uses within the proposed Zone Classification.
1. That the proposed use is incompatible with existing uses in the area.
8. That one owner of adjacent land expressed disapproval of the proposed
use.
9. The Nearing Examiner Committee does not find the proposed use to be
in harmony with the general purpose and will be otherwise detrimental
to the publ ic health, safety, and welfare.

11. The following are additional findings of fact considered by the
Hear~ng Exam~ner Comnittee:
a) That the Commerc i a 1 Zone wa s approved f or spec i f i c u ses be i ng
off i ces and genera 1 reta i 1 wh i ch are compat i b 1 e wi th 1 and u se trends established within the Argonne/Mullan Corridor.
b) That retail and office uses have generally different impacts to
surrounding,properties than does the proposed auto repair and
sales faci 1 ~ty.
c~ That office and retail uses are housed within a building, and the associated parking lots are lighted for security reasons,
different than auto repair and sales display areas.
d) That the no i se and act i vi t i es of auto repa i r are s i mi 1 ar to ~
machine shop and smal l fabrication faci 1 ities which are
inconsistent with the office and sales activities found within
the Argonne/Mullan Corridor. .
ey That the Planning Department and businesses developing within
the Corridor have encouraged quality development.
f} That the proposed use is not compatible with the development
trend for this area. Car sales and repair have historically
located in more retail intense areas.
- g) This area should continue to develop in a low intensity retail
and off~ce pattern.

finds that the application of Redeemer Evangelical lutheran Church for a
change of conditions as described in the application should be DENIED.

THIS MATTER, Being a reconsideration by the Board of County
Commissioners of Spokane County, hereinafter referred to as the "Board" of a
prior verbal decision on October 13, 1987, which denied the request for a change
of conditions regarding a revised site plan for the purpose of an auto repair and sales facility on a portion of the site, hereinafter referred to as tht "Proposal",
and the Board of County Commissioners having held a public hearing on January
12, 1988, to n i r its decision of October 13, 1988, and having rendered a
decision on the 19th day of January, 1988, did, by majority vote, reverse its
denial and grants a change of conditions in the Commercial Zone; ZE-70A-84,
does hereby make the following:
FINDINGS ~F FACT
1. That a change of conditions request has been submitted by Redeemer
Evangelical Lutheran Church, for a piece of property located in the Argonne- Mullan Corridor, presently zoned Commercial, and allowed for a specific office
development. The request is for a change of conditions for a revised site plan
which would allow an automobile repair/sales business.
2. That the Board, in a prior decision on October 13, 1987, denied the
requested change of conditions. In denying the request, the Board concluded that the proposed use of a automobile repair/sales business would not be consistent
with the Comprehensive Plan, Major Commercial category.
3. That subsequent to that hearing on October 13, 1987, the Board of
County Commissioners decided to reconsider its decision at a public hearing on
January 12, 1988, based upon one critical fact which was made known to the Board following the October 13, 1987, Board decision. That fact was that a piece
of property adjoining the church property had received a blanket rezone which
would have authorized the automobile repair/sales business. As a result of this
fact, the Board of County Commissioners took public testimony on the zoning of
the adjoining property and proposed conditions to be imposed in the event the
requested change of conditions, upon reconsideration, was granted.
4. That the proposal is generally located between Argonne Raad and
Mullan Road approximately 250 feet north of Valley Way in Section 17-25-44.
Tax Parcel Numbers: 17543-0614, 0615, and a portion of 0601.
5. That the proposal consists of a request to review a change in site plans
from office and retail complexes to an auto repair and sales facility on a portion of the site.
6. That the adopted Spokane County Generalized Comprehensive Land Use
Plan indicates Major Commercial type usage of the area encompassed by the
proposal. This category provides that in considering developments, a goal should
be to promote development in a manner which is complementary and compatible
with adjacent land uses and the surrounding environment. That the proposed change of conditions to allow an automabile repair/sales business is not
necessarily consistent with the Major Comm~rcial category of the Comprehensive
Plan, and doesn' t seem compatible with other development in the area, however, ,
in fairness, as a result of the adjoining property' s blanket rezone, this new . • . ~ ~ - -r ~
inrormation warrants reconsiaeration or inis matter.
7. That the provisions of RCW Chapter 43.21C (State Environmental Policy Act) have been complied with and the Board adopts a determination of
non-significance for this proposal.
8. That the Spokane County Hearing Examiner Committee held a public
hearing on September 3, 1987, concerning the proposal, subsequent to which by
Findings of Fact, Decision and Order dated September 3, 1987, they denied the
proposal.
9. That the existing land uses in the area of proposal include single family
residences, accessory buildings, church, retail, offices and undeveloped land.
The more intensive uses have been located between the Argonne-Mullan couplet.

10. That the proposals as conditioned are compatible with existing uses in
the area.
11, That the proposals as conditioned are not detrimental or otherwise
harmful to the public health, safety and welfare.
12. That the applicant has demonstrated changed conditions since the
original zone change warranting a revised site plan for the purpose of an auto repair and sales facility, namely, changed economic conditions dictating a change
in use.
13. That the proposals as conditioned are consistent with the surrounding
land use classifications and does not grant a special privilege or rights to the
applicant different than those enjoyed by adjacent property owners.
14. That the Board finds that the proposal is located within the recorded
water service area of Modern Electric Water Company and that the district
indicates there is an adequate system capacity, and that they are desirous of
serving the proposal with adequate water for domestic, fire and irrigation
purposes.
15. That the proposal is situated within the recorded fire service area of Fire
District #1. ~
1 b. That the proper legal requirements for advertising of the hearing before
the Board of County Commissioners of Spokane County have been met.
17. That on the 19th day of January, 1988, the Board of County
Commissioners of Spokane County at a regular meeting did reconsider their
decision regarding this matter and does hereby approve the proposal subject to certain conditions.
From the foregoing Findings, a review of the Planning Department S taff
Report dated S eptember 3, 1987, and the S taff presentation of File No. ZE-70A-
84, the Board hereby in approving the proposal for a revised site plan does make
the following conditions:
1. That the conditions set forth in the Spokane County Planning
Department Report dated September 3, 1987, on pages 1 through 8 are hereby
adopted as conditions of approval subject to the following amendments:
a. That all areas for storage of vehicle:s for sale, needing repairs, or
service vehicles and material or equipment associated with a business
shall be within a building or completely screened from view of the

pleasing development pattern.

accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administrator
wiil be permitted, including, but not limited to the following

allowable uses of the permitted Zone. All variations must conform to regulations set forth in~the SPOKANE COUNTY ZONING

6. The specific development plan will be submitted for Planning ~ Department review and approval prior to issuance of building

be complied with in the development of this site.
~ 8. That the project is subject to Chapter 4.16A, the Aquifer Sensitive Area Overlay Zone of the SPOKANE COUNTY ZONING
ORDINANCE, which sets forth various measures for Aquifer
protection; specifical ly, measures deal ing with wastewater
disposal, spill protection measures, and stormwater runoff.
9. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
10. Any division of land for the purpose of sale, lease or transfer,
sha11 comply with RCW 58-11 and the Spokane County Platting
Ordinances prior to issuance of building permits.

1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.

roads should be treated and emissions from the transfer of
" earthen material must be controlled as well as emissions from ~ all other construction related activities.
