to the Commerci al Zone was to el imi nate the signage control s of
the Local 6usiness Zone. The Nearing Examiner Committee finds,
due to the character of exi sti ng uses i n the area, there i s a
need to control si gnage wi thi n the corri dor. The Commerci al
Zone does not offer these needed controls. The Committee notes
- that the app]icant did propose signage limits that appeared reasonabl e for the area.
The Commi ttee, further notes that a grocery store woul d be a
permitted use within the Local Business Zone. However, the
existing approved~site plan for this site proposes office and
light retail uses.

opponents to the zone change are not criteria that can be used

access due to traffic congestion problems at the two traffic controlled intersections. F rom a Planning standpo~int, access to ~
Cataldo Avenue should be prohibited to discourage traffic patterns
through resi denti al areas to the east and west of the corri dor.
IV. CON~LUSION: The proposed rezone is consistent with the Comprehensive Plan
and past 1 and use acti ons. However, i t i s one of the f i rst commerci al ly intense land uses proposed for the corridor. Recommended measures dealing
w~th landscap~ng, l~ght~ng, signage, fire protection, and access points
should insure compatible deveiopment and protection to the area.

original zone change warranting a zone change from Local Business to
Cammercial. The Board no#es that since the rexoning of the site to Local
Bu s i ness, the Comprehensive Plan was adopted r des i gnat ing th is area as Majar Commercial. Additionally, a rezone to Commercial was approved Irr 1984 for
property just north of thls proposal. The Board furfiher nates that the
existing Local Business Zone has an approved site plan allowing for retail and
office space up to a maximum of 108,000 square feet. The praposed Cammercial
~ Zone site plan #or the grocery store anticipates approximai'e1y 40,000 square
feet of floor area.

10. That the proposal is not totally inconslstent with the
surrounding land use classiflcations and does not grant a speciel privilege or
rlghts to the applicant different than those enjoyed by adJacent property
owners; especially those propertles withln the interlor of the corridor and
bounded by Argonne Road and Mullan Road,
II. That trnffic impacts from this proposal on the Argonne/Mullan
Road corridor and to uses (n the area were of concern at both the Hearing
Exeminer Committee hearing and the Board's appeal hear(ng, New testimony on
trafflc Issues, by Dr. William J. Kelley, was presented to the Board ln both
written and orai form. This testimony tended to indicate that traffic lmpacts
caused by the grocery store would be no greater than those from the 108,000 square foot retall/office complex approved under the existing Local 6usiness
Zone. The Board fu~ther noted and concurred wlth the recommended restrictlon
of access to Broadway Avenue and Cateldo Avenue.
12. That proposals wlthin the Argonne/Mullan Road corrldor have
routinely been conditloned to provide for development features to complement
the quality of development wlthin the corridor. These standards have either
been contained ln the zone requlrements or added as speclel conditions to rezone app~ovels. Included have been speclal landscaping areas, buffer
treatments, and signage standards. The Board flnds that these speclal
features should be Incorporeted into thls proposal to make it more compatible
and consistent wlth other developments and uses. In regards to signs in the
corridor, lack of sign controls in the Commercial Zone, and public testimony
and recommendatlons, signage not exceeding 20~ above the requirements of the
Locel Buslness Zone should be appropriate for this proposal.
13. That at the 8oard's hearing the applicant requested a blanket
rezone to Commercial wlthout a tie to the previously submltted site plan for a
grocery store. Approval of the grocery store concept and site plan, coupled
with the Zoning Administrator's abillt to allow I~mited devlations wlll ~ Y ,
restrlct ultimate development to that which is comparable ln size, use, and
scope. The Zoning Adminlstrator will have the authority to conditlon the development to be compatible wlth the surrounding neighborhood.
14. That the Board finds that the proposal is located within the
recorded water service area of Modern Electrlc Water Company; and that the
Distrlct Indicates there Is an adequate system capacity, and that they are
deslrous of serving the proposal for domestic, fire and Irrlgation purposes.

16. That the proper legal requirements for advertising of the
hearing before the Board of County Commissioners of Spokane County have been

1. That the Hearing Examiner Committee action was in disregard for
