THIS MATTER, Being the consideration by the Board of Caunty
Commissioners of Spokane County, hereinafter referred to as the "Board" of an
appeal of Spokane County Zoning Hearing Examiner Committee Decision of
September 4, 1986, denying the change of condition request ~ZE-39A-85), to
delete a condition from the Local Business rezone approval (ZE-39-85) which prohibited access to Stout Road, hereinafter referred to as the "Proposal," ,
and the Board of County Commissioners of Spokane County having held a public
hearing on Octaber 14, 1986.and having fully considered all testimony
presented thereat, and further being individually familiar ~ith the site and
vi ci ni ty i n questi on, and havi ng rendered a deci si on on the 14th day of
October 1986, overturning the Zoning Hearing Examiner Cor~nittee's denial and
approving said proposal, does hereby make the following:
F I NO I NGS OF F ACT ~
1. That the proposal is generally located at the southeast corner
of Mullan Road and Boone Avenue and the southwest corner of Stout Road and
Boane Avenue in Section 17-25-44.
- 2, That the proposal consists of deleting Hearing Examiner
Committee Condition #1 from File ZE-39-85 which prohibited access from the
site to Stout Road unless specifically approved at a public h~aring.
3. That the adopted Spokane County Generalized Comprehensive Land
Use Plan designates the site as Major Commercial. The area east of Stout Road i s de.si gnated Urban. The area a1 ong Stout Road i s therefore consi dered a
transition area from one land use category to another.
4. That this Change of Condition request is exempt from the State
Environmental Policy Act ~SEPA) review process.
5, That the Spokane County Hearing Examiner Committee held a public
hearing on September 4, 1986, concerning the proposal, subsequent to which by Findings of Fact, Decision and Order dated September 4, 19a6 they denied the
proposal.
6, That the existing land uses in the area of proposal include
si ngl e f ami ly resi dences, of fi ces and a church. Resi denti al uses are 1 ocated
along Stout Road while nonresidential uses are generally along the
Argonne-r~ul l an corri dar. ~ ~
1, That the proposal can be made compatible with existing uses in
the area. ~
8, That the proposal, through compliance with specific conditions,
will not be detrimental or otherwise harmful to the public health, safety and wn 1 f a ro ~

9. That the applicant has demonstrated changed conditions since the
ori9inal zone change warranting the requested change of conditions proposal.
10. That the proposal is consistent with the surrounding land use
cl assi fi cati ons, i f properly condi ti oned, and does not grant a speci al
pri vi 1 e9e or ri ghts ta the appl i cant di fferent than those enj oyed by adjacent
PropertY owne rs; specific reference is made to the Local Business Zone at the southwest corner of Stout Road and Sinto Avenue which was allowed one access

11. Testimony from the applicant and a representative for a portion
of the neighborhood indicated that the two parties had resolved major disputes with the access to Stout P,aad subsequent to the Hearing Examiner Committee's
denial. As a result of the neighbarhood meeting the applicant agreed to the
following conditions and modifications to the site plan:
1} One access to each of the three adjoining streets (Mullan Road,
Boone Avenue, and Stout Road~ will be developed. The access to
Stout P,oad would be built as narrow as possible, signed for "exit only," and be located so as to minimize impacts to uses
along the east side of Stout Road.
2) The applicant will spearhead the effort to form a Road
Improvement District ~RID) on Stout Road by circulating the
petition and filing it with the County Engineer. .
3~ The applicant will apply a dust sealant to Stout Poad, between
Boone Avenue and Cataldo Avenue, on a yearly basis until such
time as Stout Road is paved.
12. That the above three conditions, which were agr-eed to by the
~ applicant and the neighborhood group, are mitigating measures relative to the impacts of a Stout Road access. As such, those conditions shall.be attached
to approval of the change of condition proposal.
~ 13. That the proper legal requirements for advertising of the
he~ring before the Board of County Commissioners of Spokane County have been
met.
14. That an the 14th day of October 1986, the Board of County Con~nissioners of Spokane County at a regular meeting did approve the proposal
subj ect to certa i n condi ti ons.

No. ZE-3~A-85, and public testimony, the Board hereby in approving the
proposal does make the following conditions:

(All Conditions imposed by the Board of County Commissioners shall be binding
on the "Applicant," which term shall include the owner or owners of the
property, heirs; assigns, and succe`ssors.~

1. That one access point to Stout Road, as shown on the site plan
revi eweci by the Board of County Cor~ni ssi oners on October 14, 1986,
shall be allowed. Said access drive shall be as narrow as possible
per County~Engineer standards and said drive shall be signed as an "exi t only" from the si t~.
2. That the applicant shall spearhead the effort to create a Road

1. That all conditions from File ZE-39-85 continue to apply to development of this site except as modified or amended above and
below.
2. That Hearing Examiner Condition #1 from File ZE-39-85 be deleted.
3, That the two existing trees, one along Boone Avenue, and the other
along 1~~ullan Road, as shown on the site plan dated October 14, 1986 and reviewed by the Board of County Commissioners, shall be preserved
and maintained by incorporation into the overall landscape plan.
c ~ COUNTY ENGIRJEERING DEPARTMENT
Prior to the Issuance of a Buildin~ Permit:
1. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
2. All required construction within the existing or proposed public .
right-of-way is to be completed prior to the release of a bui]ding
permit. ~ bond in the amount estimated by the County Engineer to
cover the cost of construction of improvements shall be filed with the County Engineer.
3. That the conditions of approval for ZE-3g-85 are applicable to this
Change of Conditions request.
4. That Stout Road shall be improved per the approved road plans which
are on fi 1 e at the offi ce of the County Engi neer,

The decisio~ on the original rezone was made in 1985, and the
sponsor accepted conditions attached thereto which included the prohibited access to Stout Road, The Hearing Examiner
Committee did not believe that the applicant had prove~n that

A. INTRODUCTION
This matter having come before the Zoning Nearing Examiner Committee on
September 4, 1986, and the members of the Comnittee present heing

B. PROPOSAL
The sponsor, WAP1 Enterprises, Inc., is requesting approval of a change of
conditions, File No. ZE-39A-85, Local 6usiness Zone, for the purpose of
deleting a condition of approval imposed by the Hearing Examiner Committee
which prohibited access to Stout Road.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, offices and a
church.
2. That the Comprehensive Plan designates this area as appropriate for Ma~or Commerc~ al devel opment.
3. That the existing zoning of the property described in the application
is Local Business.
4. This Change of Conditions request is exempt from the SEPA
Environmental Review process.
5. That the proper legal requirements for advertisement of the Agenda
Item have been ful f i 11 ed.
6. That the applicant has not demonstrated that conditions have
substantially changed since the original zoning of this site and
accordingly, the proposed change of conditions is not justified.
7, That the proposed access to Stout Road would be incompatible with

Hearing Examiner Committee:
a~ That the decision on the rezone and land use of the site
together with conditions under which the site would be
developed, particularly the prohibited access to Stout Road, was
made in 1985 and accepted by the sponsor as restrictions on the
property. Therefore, it is entirely the responsibility of the applicant to prove that situations have changed substantially to
warrrant access to Stout Road. The applicant did not prove that
the character of the area had changed or that Stout Road had
been redesignated. Both sides of Stout Road are still in
residential use and Stout Road pravides local access to those
single family uses.
b~ That the applicant received a building permit based upon a workable design of on-site circulation that provided one access
to Mullan Road and one access to Boone Avenue. The loss of the
existing tree at the Boone Avenue access is not critical since
new additional landscaping is being provided. Because there is .
a workable access alternative, as approved with the building
permit, the denial of access to Stout Road is not fatai to the
p ro j ec t.
D. ORDER
The Zoning Nearing Examiner Committee, pursuant to the aforementioned,
finds that the application of WAM Enterprises, Inc, for a change of
conditions as described in the application should be DENIED.
