INTRODUCTION This matter having come before the Zoning Nearing Examiner Committee on September 4, 1986, and the members of the Comnittee present heing Phi 11 i p D. Harri s, Chai rman, Ron Odel 1 and Jim Schurra. B. PROPOSAL The sponsor, WAP1 Enterprises, Inc., is requesting approval of a change of conditions, File No. ZE-39A-85, Local 6usiness Zone, for the purpose of deleting a condition of approval imposed by the Hearing Examiner Committee which prohibited access to Stout Road. C. FINDINGS OF FACT 1. That the existing land use in the area is residential, offices and a church. 2. That the Comprehensive Plan designates this area as appropriate for Ma~or Commerc~ al devel opment. 3. That the existing zoning of the property described in the application is Local Business. 4. This Change of Conditions request is exempt from the SEPA Environmental Review process. 5. That the proper legal requirements for advertisement of the Agenda Item have been ful f i 11 ed. 6. That the applicant has not demonstrated that conditions have substantially changed since the original zoning of this site and accordingly, the proposed change of conditions is not justified. 7, That the proposed access to Stout Road would be incompatible with exi sti ng uses i n the area. . 8. That the owners of adjacent lands expressed both approval and disapproval of the proposed use. 9. The Hearing Exarniner Committee does not find the proposed Stout P,oad access to be i n harmony wi th the general purpose and coul d be r~nfrimont~l tn thn r,~~hl„► tie~l+h ~~fs+~~ ~Ma ~.,~1~~N~ v~, VI ~ ~~I%.I I Vu I %.v %.1 1%; Nuv i I V I IGal 1t.o 1 9 .7a1 1 GL.,I 0 QIIU IIIC I I QI C• M► CNANGE OF CQt~QITIONS N0. ZE-39A-85 C, FINDINGS OF FACT fcontinued) 10. The fol 1 owi ng are addi ti onal fi ndi ngs of fact consi dered by the Hearing Examiner Committee: a~ That the decision on the rezone and land use of the site together with conditions under which the site would be developed, particularly the prohibited access to Stout Road, was made in 1985 and accepted by the sponsor as restrictions on the property. Therefore, it is entirely the responsibility of the applicant to prove that situations have changed substantially to warrrant access to Stout Road. The applicant did not prove that the character of the area had changed or that Stout Road had been redesignated. Both sides of Stout Road are still in residential use and Stout Road pravides local access to those single family uses. b~ That the applicant received a building permit based upon a workable design of on-site circulation that provided one access to Mullan Road and one access to Boone Avenue. The loss of the existing tree at the Boone Avenue access is not critical since new additional landscaping is being provided. Because there is . a workable access alternative, as approved with the building permit, the denial of access to Stout Road is not fatai to the p ro j ec t. D.
