THIS MATTER, Being the consideration by the Board of County
Cornmissioners of Spokane County, hereinafter referred to as the "Board" of an
appeal of Spokane County Zoning Hearing Examiner Committee Decision of
December 5, 1985, denying without prpjudice the zone reclassification ~ZE-1fi-85~, Agricultural Suburban to ~~ultiple Farnily Suburban for the
purpose of developing a 12-Unit Apartment Complex, hereinafter referred to as
the "Proposal", and the Board of County Commissioners of Spokane County having
held a public hearing on January 21, 1986, and having fully considered all
testimony presented thereat, and further having individually visited with the
site and vicinity in question, and having rendered a decision on the llth da~y
of February, 198b, DENYING said proposal, does hereby make the following:
FINDINGS OF FACT
1, That the proposal is generally located north of and adjacent to
6roadway Avenue, approximately ?00-feet west of University Road and
approximately 450-feet east of Felts Road in Section 11-25-44.
2. That t~e proposal consists of rezoning a 28,400-square foot site
from Agricultural Suburban to Multiple Family Suburban for the purpose of
developing a 12-Unit Apartment Complex.
3. That the adopted Spokane County Generalited Comprehensive Land
Use Plan indicates Urban type usage of the area encompassed by the proposal.
The Urban category recommends buffering through landscaping, setbacks, or
structure height limits when located next to single family uses. The proposed density of 18.43-units per acre with structures at 2-1/2 stories is
incompatible with the Comprehensive Plan Guidelines. In particula r,
residential densities are suggested to range between 1 and 11 units per acre.
Multi-family structures will usually be a transitional use located between
in le-famil residential and more intensive areas. ~ s g y
4, That the provisions of RCW Chapter 43.21C, ~State Environmental
Policy Act) have been complied with; however, since the proposal is being
denied, no environmental determination is necessary.
5. That the Spokane County Hearing Examiner Committee held a public ~
i~earing on December 5, 1985, concerning the proposal, subsequent to which by
Findings of Fact, Decision and Order dated December 5, 1985, they denied the .
proposal without prejudice.
6. That the existing land uses in the area of proposal include
single family residences, some dupiexes, a day care and undeveloped land.

surrounding property.
8. That the proposal may be detrimental or otherwise harrnful to the
public health, safety and welfare. The site plan does not demonstrate
mitigation of the impacts to the area; namely, density, structure height and
buffering.
9. That the applicant has not demonstrated changed conditions
since the original zone change in 1958, warranting a zone change f rom Agricultural Suburban to Multiple Family Suburban.
10. That the proposal is not consistent with the surrounding land
use classifications and does grant a special privilege or rights to the
applicant different than those enjoyed by adjacent property owners. There is
only one Multiple Family Suburban Zone in the area, approximately one mile
away.

11, That the Board finds that the proposal is located within the
recorded water service area of Modern Electric Water Company; and that the Di stri ct i ndi cates there i s an adequate system capaci ty, and that they are
desirous of serving the proposal for domestic, fire and irrigation purposes.
12, That the proposal is situated within the recorded fire service
area of Fire District # 1.
13. That the proper legal requirements for advertisin~ of the
hea ring before the Board of County Commissioners of Spokane County have been met.
14, That on the llth day of February, 1986, the Board of County ~
Commissioners of Spokane County at a regular rneeting did QENY the proposal.
15. That the proposal i s a major change to the character of the
a rea, especially in light of the contour of the land and proposed 2-1/2 stor~ es of the structure.
lb. The proposed density of 18.43 units per acre is substantially
different from the 4-6 dwelling units per acre of the surrounding property.
17. These differences; i.e., No. 7, S, 10, 15 and 1~, cumulatively
indicate that the project would not be of general ~enefit to the public
~~eal th, safety and wel fare of the communi ty.
From the foregoing Findings, a review of the Planning Departme nt
Staff Report dated December 5, 1985, and the Staff presentation of File No.
ZE-16 -85, the Board hereby DENIES the proposal.

An Environmental Checklist was submitted by the sponsor and was
reviewed by the County ~lanning Department, Tf~e review considered
the speci fi cs of the proposal , other avai ~ abl e i nf~rmati on, County
ordinances, other regulations and law~, possible s~andard Conditions
of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a DEtermination of
Non-Significance ~"DNS").
The "DNS" was circu~ated to 10 other agEncie~ of jurisdiction and
other agencies/departments affected by t~e future dE~elopment for ~ review and comment. The "DNS" comm~nt peri~d ends Decembe~ 4, 1985,
and was advertised 15 calendar days before said date ~n the
newspaper, by letter to adjacent property owners h~~ th~~ n 400 feet of
