Re: Residential Use Encroaching into a Mining Zone
Dear Mr. Brady:
In reviewing your request to stradle a zoning line between a Mining Zone (MZ) and a
Urban Residential 3.5 Zone (UR 3.5) with a residence we find that this activity would not
be permitted. Allowing a use that is not identified as a permitted use under the Zoning
Code to be established in this manner would constitute a zone change. A zone change an
only occur through the Public Hearing Process pursuant to Section 14.402.120 of the
Spokane County Zoning Code.
This determination is appealable as provided for in Chapter 14.412 of the Zoning Code
within 14 days.

that if my new lot retained a majority area of residential zoning UR 3.5,
I could place the home to be built anywhere within the new lot subject to
standard setbacks.
