1983 letter, John Nunnery's lett~r of February ~,19~4 and your r~esponse to ~allis Hubbard of February 14,19~4.
It's come to my attention that Sutter's Addition exists on the Assessor s maps exacdy as it did
prior to the amendment and, in fac~, Mr. C~osby (thc present o~vn~r) states that he continues to
get tax bills for lots 2, 3, 4 and 5, the ones which were supposed.ly eliminated by Resolurion
82 ~6~. It seems that carrecrive action should b~ taken to elinunate these lots from the Ta~easurer's records and that they should be removed fram thc ,Assessor's maps. ~ut, on the
other hand, the ~oard's Rcsolution implies to me that a directive was given for an amended or
altered plat ~o ~e filcd and appar~ently nobody went ahead t~ take that official action. As a result
of no amended ar altened plat dacument being filed, are th~ origi,nal five divisions of Sutter's
Addition still in existcnce; ~hat is, are all the records cornect even though it was the intention of
the Counry Commissioners that they be eliminated?
How would you advise ~hc county agencies v~ith regard to thcir official records? Should we
leade things as they arc, ~rith Sutter's Addition shown as a~ive lot plat with a private road on
the assessor's records and individual tax bills sent far lots 1 through 5? ~r should the

Dear Mr. Nunnery:
I'm requesting at this time tha~ the resolution passed by the Spokane
County Cor~nissioners on June 229 1982 on PE 1259-18 in the matter amending
Final Plat of Sutter's Addition to Vera be RESENDED.
The History is as follows:
1) PE 1259-18 was approved on December 6, 1978 by the Hearing Examiner
Committee with a zone c~ange from agricultural to R-l.

• 2) The "Final Plat" to Sutter's Addition was filed in 19790
3} Lot 1 was a seperate lot with a home on it and under seperate owner- ship. Lots 2, 3, 49 and 5, were and are vacant.
4) In 1980-81 Washington Trust 6ank aquired the vacant property.
5) In 1982 Washington Tr~st Bank had a sale on Lots 29 39 4, and 5a
Lots 2, 3, 4, and 59 "sub~ect to" their receivingand FINALIZING the resolution in question. Their purchaser's wanted to place
a mobile home on the property which could not be accomplished
unless the property was zoned agricultural~allowing mobile homes).
The resolution was cm~np~eted (unknown to Washington Trust 6ank, •
so they say~ and the zone change was not comp~eted at this point.
6} In J u ly y 1982, Crosby Enterprises, Inc. offered to purchase
said 4 lots understan~~ng thru Washington Trust Bank and thru checking with Spokane County Eng~neers Office that Sutter's
Addition WAS a filed plat.
1) December,1982, we Crosby Enterprises Inc. closed purchase on said
property with the hope and intent to get the mater cleared up to
be 4 lots.

8) In July and August9 Washington Trust Bank was going thru a change
in management and personal in their real estate depa~tment, leaving
the "left" hand not knowing what the "right" hand was doing. Con- sequently the right person didn't know that the original real estate
purchaser backed out of the deal, that the "Resolution" procedure should
be stopped9 what needed to be done to complete the change in zoning,
if it was or was not desired for a future buyer, OR be able to tell
"us", the new purchaser's9 what the true status of this property wasv
Wouidn't you agree that this could be can~using,even if we we're Bankers::
9~ The Engineet~s Office gave us the information that it was 4 seperate
lots because the resolution had not or has not been received or at
least, to this date, it has not been processed.
STATUS to Date;
a~ Crosby Enterprises9Inc owns said property.
b~ The Spokane County Treasurer's Office taxes EACH lot seperately and
bills EACH seperately~copies enclosed~
c} The Spokane County Engineer's Office prsently shows that "Sutter's
Addition to Vera" is an approved and filed 5 lot Plat.
d) Spokane County Planning shows the Resolution is approved, making the
4~acant lots one lot with R-1 zoninge
e)Under (d) this leaves a OIdE ACRE PLUSsized parcel Zoned "Single F~mily
Residential--Not Uery Compatable:
It would not seem COST EFFECTIVE for me to have to go thru all the hoops and
expense to start from square one to rectify this matterg as I can relate to
Spokane County's Budget problems and concerns. Why have 5 or 6 departments
finish the undue and then have the same 5or6 departments redue.. "Money Saved is
Money Earned"......
I feel that,at this time9 it would simplify this matter by Resending the Resolution, dated 22nd of June 9 1982

9 exist. And since the Final Plat is sti11 on file at the County Auditor's
Office would it be le al and simpler to rescind (by another resolution} the 9 9
~ ori inal Resolution Noo 82-060b, as opposed to requiring Mr. Crosby to replat . 9

photocopy of Spokane County Resolution Noo 82-0606a That

to therein. The actions were authorized pursuant to RCW

Pursuant to correspondence dated February 8, 1984, you requested that this office review certain correspondence
submitted to you by Wesley C. Crosby, President of Crosby
Enterprises, Inco concerning a vacated portion of the final
plat known as Sutter's Additione Your memo included a
photocopy of Spokane Count~r Resolution Noo 82-0606a That
document executed on the 22nd day of June, 1982 vacated
Lots 2, 3, 4 and 5 of Bloc'k 1 and Bolivar Lane ~ithin the f inal plat of Sutter's Additione You have advised that Mro
Crosby is apparently now the owner of the vacated lots,
and desires to vacate Spokane County Resolution Noo 82-0606.
Such vacation would in effect, replat Lots 2, 3, 4 and 5
of Block 1 and Bolivar Lane of the final plat of Sutter's
Addition.
Although I can certai.nly appreciate the desire on
the part of the Planning Department to simplify the procedure
to be employed by Mra Crosby in conjunction with his
development of the property within that portion of Sutter's
Addition vacated, I do not believe legally, the Board of
County Commissioners can rescind Spokane County Resolution
Noe 82-06060
As you are aware, the Board of County Commissioners
of Spokane County in passing Spokane County Resolution Noo
~2-0606 vacated that portion of Sutter's Addition referred
to therein. The actions were authorized pursuant to RCW
Chapter 58012o The terminology "vacate," is legally defined
as "o e o to make legally voida . o"
Accordingly, when the Board of County Commissioners
executed Spokane County Resolution Noo 82~0606 they did, in
facto legally void those portions of Sutter°s Addition
referred to in the resolutiono That resolution I am further
advised, was recorded in the Spokane County Auditor's
Off iceo Pursuant to the provisions of RCW Section 58o12v0~0,

As you can see in Mr. Crosby's letter the Final Plat of Sutter's
Addition was partly vacated by the attached Res. No. 82-0606, Basically,
the original reasons for vacating some of the internal lot 1 ines no longer exist. And since the Final Plat is still on file at the County Auditor's
Office, would it be legal and simpler to rescind (by another resolution) the
orioinal Resolution No. 82-0646, as opposed to requiring Mr. Crosby to replat
this property back into its original lot configuration as Final Plat of
Sutter's Addition?
If a rescind resolution is appropriate, I will prepare a draft resolution for your review.

be stopped, what needed to be done to complete the change in zoning,
if it was or was not desired for a future buyer, OR be able to tell

Money Earned"e.....

In April 1982, Washington Trust Bank was the owner of four lots i.n an
unimproved plat lrnown as Sutter's Addition to Vera. At that time the
Banlc was seeking your assistance in vacating the plat in an attempt to
marlcet it as one large lot rather than lots 2, 3, 4, and 5, Block 1,
Sutter's Addition to Verao
Your letter and addendwn dated May 269 1982 identified certain reauire-
ments in order to vacate the p1at. The ~a.nk felt that the time and ex-
pense involved to com~ly with these reauirements could not justify the
final result and thought the entire ma.tter was ended. On ~~ay 28, 198Z
the Bank reauested a 1oca1 real estate firm to list the property as four
unimproved building lots and they have been listed as such ever since. an August Z4, 1982 the Bank entered into a sale agreement for the four
lots ~~ith Crosby Enterprises, Inc. . In late September, the closing
agent disco~ered that the parcel ~.ad been vacated by Resolution dated
Jt~e 2 2 p 19$ 2. This was Washington Tz~us t Bank' s f irst knowledge of the
change in status of the ~aroperty.
Even t~hough the County actecl in good faith and only did what was originally requested by the Bank, it is felt t~here was a great deal o~ mis~derstanding
as well as a laclc of commun,icationo To further complicate ma.tters the
Residential Mortgage Department has undergone some major personnel changes
and t~e two individuals who originally handled the matter are na longer
with the Banka
It is ~he Banks desire to see the resolution vacating the plat nullified and the four-lot short plat reinstated in order that Crosby Enterprises,
Inc, can purchase the property for the construction of residencese Your

I think it is appropriate to send some information as to where my invo~ve-
ment lies with a four 1ot subdivision named Sutter's Addition, located
in Spokane Valley on E. lZth. Sometime in July I began negotiating with Washington Trust Bank on the sale of the four lotso On or about August 20,
1982 Washington Trust Bank and Crosby's Enterprises Inc. agreed upon a
sales price. It was our understanding that we were buying a four 1ot
plat that had been filed in Spokane County. Now, on October 1, 1982 we
find that there was a misunderstanding with Washington Trust Bank and
now Sutter's Addition, no longer exists and the property is just one
si ngl e 1 ot.
We now have a tentative pre-sold house on one of the lots which really
puts us in a difficult situation. We understand that it could be a
possibility that the one lot si~uation could be resended and it could
go bad k to Sutter's Addition with four lots. We would appreciate any
consideration that you or your office could have upon such a request
because it sure would resolve some of our problems and expedite in re~ solving them.

In reviewing the file and corresponding with our legal council it is clear to me that this unfortunate situation is due to a rather unusual set of
circumstances and possib1e lack of communication. ~;evertheless I cannot,
at this time, see where it would harm the publi~ health, safety or g~neral
wel f are by nul 1 i fyi ng the 8oard of Counzy Commi ss i oners Resol ut i on ~82-060G
which vacated portions of this final pla~. In fact, it appears presently
that rei nstati ng the ori g i nal f i n al pl at woul d i n f act bett~er serve ~h at
public health, safety and general welfare.
The task before us, therefore, i s to make the publ i c record and f i 1 es c1 ear
as to the purpose and reasons for our past transaction regarding this ~inal
plat. To that end, I will recognize your October 5, 1982 letter and
Mr. Wesley C. Crosby's letter of October 2, 1982 bath as being "informational"
and "letters of inquiry". I am in agreement that it is appropriate to request
the reinstatement of the original final plat and list the following items necessary to constitute an application for same:
1. Another letter requesting tha~t the (3oard of County Commissioners
Resolution #82-0646 be nullified or resend and include specific
reasons or bases for this request (please expand on your reasons
for reversing the plat amendment by listing fiacts and changed
circumstances rather ~han explaining the sequence of events~.
2. Have the letter signed by all owners and parties of interest for all
the property within Sutter's Addition. This would include the owner
of Lot 1; Wesley C. Crosby, if a contract purchaser; and whomever

5. A check for $15,00 payable to Spokane County Treasurer,
Once we are in receipt of these items I will initiate a review process with:
a) County Ut.i 1 i fi i es for current poi i ci es and regu 1 ati ons;
b) County Engineering Department for private road standards and
regulations; and
c) County Health District for current regulations.
With the~e department comments a determination will be made of what will be
required wi~h the request to the Board of County Commissioners.
Once I am ab 1 e to determi ne ~the proper method of request i ng and subsequently °
resending (if approved~ the Board's resolution, I will place this request on
the Board of County Commissioners regular public hearing agenda. Presently, it appears the transaction with the Board can be accompl ished through a secc~»d
resolution addressing ~his matt~r, I do wish to s~ress that this overall
effort is on1y a request of the Board and wil1 require their concurrence of
this process and their decision to resend their resolution.

After a nuinber of phone conversations with you, responsE back from the
County Engineer's Department, and a varied number of interruptions, ~ve are
no~l able to for~lard the appropriate procedures necessary to sazisfy your
request per your letter of April 9, 1982, which was also si~ned by Kenneih Brown.
First, the County En~ineer's staff indicates that voiding zhe road bond
and el imi nati ng th~e roadway ~roul d be possi bl e.
Second, the request should be processed in two steps:
Step 1-- Amend the Final Plat by vacating appropriate lot lines and
cer~ain language of the Final Plat Dedication. This will be accomp1ished
through RCW 58.12, a resolution signed by the Spokane County ~oard of County
Con~ni ss i oners at a publ i c heari ng wi th a f ee of ~~5 and 100~ of the pl at
ownerships. ,
Step 2-- Make application for a zone change for the property (a) fo~~ both owners {preferred), or ~b} anly the Bank-owned property. The fee is $250
for the zone change and $60 for an Environmental Checklist. Other departments
also have fe~s involved, The zone change request would be p~~acessed by the
Spokane County Zoning Administrator and taken befare the County Hearing Exa~ni-
ner Committee at a public hearing.
Having reviewed your "down zone" request ~~ith the Zoning Administrator, and
