WHEREAS, The Spokane County Platting Mearing Examiner Committee did, after
public hearing on December 6, 191~, take action by motion that the preliminary plat
to be known as South Progress Addition (File No, PEr1252^78) be approved; and,
WHEREAS, Thomas Slade, N 1014 Pines, Spokane, Washington, 99206, did request
a special hearing before the Board of County Commissioners to present evidence and
testimony aga+nst the motion of the Hearing Examiner to approve the above described
preliminary plat and zone reclassification with conditions deleting duplexes; and,
',~HEREAS, The Board of County Commissioners did hold a public hearing on
January 22, 1979, to consider the Findings and Order of the Hearing Examiner and
testimony and request of the plat sponsor, objectors, and other interested parties;
and,
WHEREAS, At said hearing opportunity was afforded those favoring and those
opposing the above described preliminary plat proposal and zone reclassification,
the Board of County Commissioners of Spokane County, having fully considered the
testimony given, the Findings and Order of the Hearing Examiner, the environmental
checklist, and all other evidence presented, and further having personally acquainted
themselves with the site and vicinity in question, does hereby find that the conr
clusions of the Hearing Examiner were generally valid and sufficient.
N04l, THEREFORE, The Board of County Commissioners does conclude that the

been made with the plat spansor for construction of the water system, in
accordance with the approved plan, and in accordance with a time
schedule. The time schedule will provide, in any case, for completion of
the water system and inspection by the appropriate health authorities prior
to application for building permits within the plat. The contractual
arrangements will include a provision holding Spokane County and the
purveyor harmless from claims by any lot purchaser refused a building
permit due to the failure of the plat sponsor to satisfactorily complete the
approved water system.
The plat dedication will contain a statement to the effect that the pub{ic
water system as approved by County and State Hea{th authorities and the
local fire district and purveyor will be installed within this plat, and the
subdivider will pravide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
8. That a certificate of title be furnished the Planning Department prior to

- The approved map of the Comprehensive Plan indicates residential usage of this
area, as well as aIl nearby surrounding lands, with no density designation.
D. Land U s e Analys is
1. Existing Land U ses
The proposed site has existing natural ground cover with an existing residence .
There are no significant topographic features associated with this site. There are s ome active ag ricultural u s e s such a s cultivation and pa sture land in the
vicinity. The surrounding uses are generally residential on 11, 000 square feet
lots to 10 acre segregations with some single family subdivisions nearby. To
the north is Madden's Subdivision, typical lot size is 11, 200 sq . ft, with 80
feet of frontage and also some segregations with residences on about 1 acre of
land. Ta the east is Sullivan Way Addition, typical lot size is about 11, 000
sq . ft. with 85 feet of frontage and also some segregations with residences on
about 1/2 acres of land. To the south are segregations with residences and
. duplexes on parcels from 12 , 000 sq . ft to 10 acres in size . To the west are
seqregations with residences on parcels from 11, 000 sq . ft. to approximately
2 acres in size .
2. Compatibility with Existing Land U ses
South Progress Addition proposes 3 duplexes on a typical lot size of 14, 000
sq, ft. This proposal is compatible wifih the residential uses north of 16th
Avenue and is generally compatible with the duplexes south of 16th on Progres s
with the exception of the 10 acre agricultural tracts south of 16th Avenue . The
proposal would act as a buffer to the residential uses north of l6th Avenue.

II. SPECIAL INFORMATI~N
A . C irculation
- The County Road Engineer has examined the proposed preliminary plat of record
and reports that the proposed plat will be served by existing county roads and
that the County Engineer has required existing roads providing direct access
be paved and curbed.
L. Sewage Disposal
- The applicant's engineer has prepared an analysis of alternative sewage disposal
means; including on-site septic tank disposal, community septic tank disposal~
and community package treatment plant disposal. For economic reasons, and
to provide the most realistic altemative, the applicant's engineer feels on-site
septic tanks should be utilized.
- The Spokane County Health District has authorized the use of individual on-site
sewage systems for each lot within the plat. The District states that an on-
site sewage management system should be created and approved by their office
prior to the signing of the final plat if more than a total of 14 dwelling units
are authorized within the plat . The plat is situated over the Spokane ~Ialley
Aquifer and the Health District in their examination of the possible impact on
groundwater quality from this proposal have the followinq comments .
Impact Discussion
a. The plat sponsor has proposed 4 lots on 2 acres with typical lot size of 103 by
135 feet. Each lot is to be served by a public water system and its individual
on-site sewage disposal system. This raises the question of significance of
the impact on the groundwater in the area and possible altematives for sewage
dispo sal .
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater, and the effect of continued urban development in the Spokane River Valley upon the
quality of the groundwater. In summary, he concluded that:
l. In normal precipitation years subsurface disposal of sewage treatment
effluent does reach and recharge the groundwater.
2, All the dissolved salts in sewage effluent will be carried to the ground-
water. However, bacteria and detergents (phosphate pation) are mostly
remo~ed by the deep soil layer above the groundwater and "minor dissolved
constituents such as phosphates, which are known to react with soil particles,
or nitrates, which are taken up by plant roots, " will be less than the total
found in septic tank effluents .
3. The calculated results at the downstream end of groundwater flow line
indicate that the maximum range of (dissolved) solids concentration ex-
pected at present (1975~ is up to 93 mg/1 ~milligrams per liter~ above the
natural groundwater background of 155 mg/l. The forecast year 2020 maxi-

mum incremental concentration is 101 mg/1 above the natural background.
---The analytical results of the forecast impact of year 2020 when compared
with the present impact, both measured in terms of leachate volume and
dissolved solids concentration, indicate that the present impact on
groundwater quality is already a substantial proportion of the ultimate level.
c. C urrently, res ults of chemical analys is show the total nitrogen content of
the groundwater as in the range of I.7 ppm. A pro jected incre-
mental increase using Dr. Todd's expected 8.6 percent would result in a
range of 1. 8 ppm . Current Federal and State drinking water standards
permit up to 10 ppm .
d. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics;
1. Collector and cenfiral treatment systems discharging to surface waters
would require at least tertiary treatment and perhaps more to obtain a
permit for the discharge from the Department of Ecology. These systems
are not currently economically available for this pro ject.
2. Sealed systems, whether individual or community, depend on evaporation
for liquid removal. These systems require more land area than a conven-
tional subsurface drainfield. Some, such as lagoons, have safety hazards
associated with them and relatively poor community acceptance. Land,
installation and operational cost are generally more expensive than those
for septic tanks and drainfields.
C . Drainage
- The County Utilities Engineer reports that the preliminary storm drainage plan
submitted by the applicant indicates that on-site st~rm drainage provisions ,
will adequately handle surface water runoff . However, final construction plans
should be reviewed and approved prior to the final plat filing .
D. Water Supply
- The Proposal is located within the recorded service area of Vera Water and Power.
- The District advises the staff that adequate system capacity, and a desire on
their part to serve, exists for the provision of water for domestic, fire and
irrigation uses .
E . Fire Protection
- The proposal is situated within the recorded service area of Spokane Fire District
#1.
- The Fire District staff requests that the Hearing Examiner Committee require
mains and hydrants of sufficient size for fire protection as a condition of final

approval. The District also requests that they be allowed to review and
approve final construction plans .
F. Schools
- Proposal lies within the boundaries of Central Valley School District #35 6.
G. Parks
- The report "Planning for Parks" ~revised 1976) indicates that the proposal is
situated with the Adams neighborhood. There are currently no parks within
this neighborhood. However, a 19 acre park would be required to serve the
residents of the neighborhood. The park is anticipated to be located ad jacent '
to or in the vicinity of the Junior High School.
H. Unique Environmental Features

III. ZOIVING ANALYSIS
The proposal is currently zoned Agricultural as is the area to the south and the
west. Restricted Residential zoning is found to the east and scattered intermit-
tently to the north and northwest areas . The proposed Two-Family Residential
zoning is compatible with the uses to the south and would serve as an adequate buffer at the intersection of 16th and Progress .
IV. ENVIRONMENTAL REVIEW
- An Environmental Checklist was submitted by the sponsor and has been reviewed
by the Planning staff . No significant adverse environmental impacts were ~
judged to exist.
- Slight adverse environmental impacts were identified on the checklist in the
following categories; earth; air; water; flora; noise; light and glare; land
~ use; population; housing; transportation/circulation; public services; and
utilities ,
- The Planning Director issued a proposed Declaration of Non-Significance,• and
it was circulated fio other agencies of jurisdiction.

1. Existing Land U ses
The proposed site has existing natural ground cover with an existing residence .
There are no significant ~opographic features associated with this s~te. There
are some active agricultural uses such as cultiva~ion and pasture land in the
vicinity. The surrounding uses are generally residential on 11, 000 square ~eet
lots to 10 acre segregations with some single family subdivisions nearby, To
the nor~h is Madden's Subdivision, typical ~ot size is 11, 2 00 sq . ft. with 80
feet of frontage and also some segregations with residences on about 1 acre of
land. To the east is Sullivan UVay Addition, typical lot size is about 11, 000
sq . ft . with 85 feet of frontage and also some segregations with residences on
about 1/2 acres of land. To the south are segregations with residences and
duplexes on parcels from 12, 000 sq, ft to 10 acres in size. To the west are
segregations with residences on parcels from 11, 000 sq. ft. ~o approximately
2 acres in size.
2. Compatibility with Existing Land U ses
South Progress Addition proposes 3 duplexes on a typical lot size of 14, 000
sq. ft. This proposal is compatible with the residential uses north of 16th
Avenue and is generally compatible with the duplexes south of 16th on Progres s
with ~he exception of the 10 acre agricultural tracts south of 16th Avenue . The
proposal would act as a buffer ~o the residential us~s north of 16th Avenue.

II, SPECIAL INFORMATION
A . Circulation
- The County Road Engineer has examined the proposed preliminary plat of record
and reports that the proposed plat will be served by existing county roads and
that the Coun~y Engineer has required existing roads providing direct access
be paved and curbed .
L. Sewage Disposal
- The applicant's engineer has prepared an analysis of alternative sewage disposal
means; including on-site septic tank disposal, community septic tank disposal,
and community package treatment plant disposal. For economic reasons, and
to provide the most realis~ic alternative, the applicant's engineer feels on-sifie
septic tanks should be utilized. ~
- The Spokane Coun~y Health District has authorized the use of individual on-site
sewage systems for each lot within the plat. The District sta~es tha~ an on-
site sewage management system should be created and approved by their office
prior to the signing of the final plat if more than a total of 14 dwelling units
are authorized within the plat . The plat is situated over the Spokane ~lalley
Aquifer and the Health District in their examination of the possible impact on
groundwater quality from this proposal have the following comments.
Impact Discussion
a. The plat sponsor has proposed 4 lots on 2 acres with typical lot size of I03 by
135 feet. Each lot is to be served by a public water system and its individual
on-site sewage disposal system . This raises the question of significance of
the impact on the groundwater in the area and possible altematives for sewage
disposal,
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwa~er, and the effec~ of continued urban development in the Spokane River Valle~ upon the
quality of the groundwater. In summary, he concluded that:
l. In normal precipitation years subsurface disposal of sewage treatment
effluent does reach and recharge the groundwater.
2. All the dissolved salts in sewage effluent will be carried to the ground-
water, However, bacteria and detergents (phosphate portion~ are mostly
removed by the deep soil layer above the groundwater and "minor dissolved
constituents such as phosphates, which are known to react with soil particles,
or nitrates , which are taken up by plant roots will be les s than the total
found in septic tank effluents .
3. The calculated results at the downstream end of groundwater flow Iine
indicate that the maximum range of (dissolved) solids concentration ex-
pected at present ~1975) is up to 93 mg/1 (milligrams per liter) above the
natural groundwazer background of 155 mg/l. The forecast year 2020 maxi-

mum incremental concentration is 101 mg/1 above the natural background. ---The analytical results of the for~cast impact of year 2020 when compared
with the present impact, both measured in terms of leachate volume and
dissolved solids concentration, indicate that the present impact on
groundwater quality is already a substantial proportion of the ultimate level.
c. Currently, results of chemical analysis show the total nitrogen content of
~he groundwater as in the range of I.7 ppm. A projected incre-
mental increase using Dr. Todd's expected 8. fi percent would result in a
range of 1, 8 ppm. Current Federal and State drinking water standards
permit up to 10 ppm .
d. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics:
l. Collector and central treatment systems discharging to surface waters
would require at least tertiary treatment and perhaps more to obtain a
permit for the discharge from the Department of Ecology. These systems
are not currently economically available for this project. ~
2. Sealed systems, whether individual or community, depend on evaporation
for liquid removal. These systems require more land area than a conven-
tional subsurface drainfield. Some, such as lagoons, have safety hazards as sociated with them and relatively poor community acceptance . Land,
installation and operational cost are generally more expensi~e than those
for septic tanks and drainfields .
C , Drainage
- The County Utilities Engineer reports that the preliminary storm drainage plan
submitted by the applicant indicates that on-site st~rm drainage provisions
will adequately handle surface water runoff . However, final construction plans
should be reviewed and approved prior to the final plat ~iling .
D. Water Supply
- The Proposal is located within the recorded service area of ~Iera Water and Power,
- The District advises the staff that adequate system capacity, and a desire on
fiheir part to serve, exists for the provision of water for domestic, fire and
irrigation uses .
E . Fire Protection
- The proposal is situated within the recorded service area of Spokane Fire District
~1.
- The Fire District staff requests that the Hearing Examiner Commififiee require
mains and h~drants of sufficient size for fire protection as a condition of final

- Proposal lies within the boundaries of Central Valley School District #35 6,

si~uated with the Adams neighborhood. There are currently no parks within
this neighborhood. Howe~rer, a 19 acre park v~ould be required to serve the
residents of the neighborhood. The park is anticipated to be located adjacent
to or in the ~icinity of the junior High School.

III , ZONING ANALYSIS
The proposal is currently zoned Agricultural as is the area to the south and the
west. Restricted Residential zoning is found to the east and scattered intermit-

zoning is compatible with the uses to the south and would serve a~ an adequate bu~fer at the intersection of 16th and Progress .

2. Topography, soils and water:
a. Relatively flat area with sharp rfse on west side, normal ground cover.
Slope should not affect on-site sewage disposal if installed on north
sfde of lots.
b. Soils are Garrison gravel, listed as having slight limitations for
sewage disposal systems with possible contamination of groundwater.
c. Vera Water and Power Company has indicated on part II short plat application
dated September 18, 1978, that they are willing and able to fuxnish
water to this plat and that satisfactory arrangements have been made with the developer.
d. Field survey done by Gene Sharp, September 22,. 1978, did not reveal any
we11s located on or ad~acent to the sub~ect plat,
3. Recvmmended that:
a. The final plat shall be designed as indicated on the preliminary plat
. of record ~nd/or attached sheets as noted.
b. The dedicatory language of the plat wfll state that each lot is authorized
the use of an individual an-site seaage disposal system,
c. A plan for water facilities adequate for domestic use, domestic irrigatfon use and fire protection use shall be approved by the water supplier.
Said water plan must have been approved by the fire protection district
and the appropriate health authorities. The health authori.ties, water
supplier (purveyor), and f ire protection district will certify, prior
to the filing of the f inal plat, on the fa~e of said water plan that
the plan is in conformance with their requirements and will adequately
satisfy their respective needs. Said water plan and certification wi11
be drafted on a transparency suitable for reproduction.
