neW things are still coming to the suYface xegasdirig xhat might be the best
way to apptoach some of the zoning xequi=ements to best utilize the Yazdley
paroperty Howeves, my zesponse to youx lette= is as folloxs=
1) I am soYZy foz the poo= quality and lack of pmofessional talent in the
site plan I have submitted to you I guesa Iwill 3ust have to say,
"pooZ people have poor xays" Hoxevez, the site plan is d=aWn to scale
and indicates dimensions of items such ae stzeets, alleys, setbacks,
sights of xay and property boundasies It also indicates location of
stzuctuies, fences, gates, tsees and landacaping To specify in an
elevation d=axing, the size, type and constxuction mateYial fos the
sequised sight-obscuYing fence leaves me somewhat ba,ffled in as much as
all that information appears on my o=iginal site plan Regazding the
Stormwater Draina,ge Plan and method of drainage disposal We have no
intention of changing the existing terzain no= do xe intend to pave the
stoZa.ge yazd l therefoze, I do not feel this is a necessazy item You
go on to aay - any other graphic infozmation necessaxy to make the plan
undezstandable oz to meet County sequi=ements This statement again
leaves me a little confused as to 3ust what you mean oZ expect fiom me
to meet the Cotuity sequirements
2) There is NO pmopesty fa the town of Yaucdley, , that I am awaze of, that
meets the requized setbacks However, youx Zoning Investigato= and
Zoning AdministYator are both aWare of my getting the applications fox

osganization that may be a costly item to me I also do not intend
to fuznish a bond as you sequested Howeve=, I do not disa,g=ee with
the ultimate goal if it is feasible fo= me to do
6) It was my intention to discuss the three time phases with youY Zoning
Administxatoz and agree on some timely manneZ of pe=foZmance Thexe
is no building planned at this time
7) The cusrent site plan indicates the 'cleas-viex tYiangle' at the in-
teYSection. I, again, dislike bzinging up my ignoYance about this
zoning, but, the pxotection f=om obstzuctions? I zeally don't inox
what kind of protection you axe zefezYiag to.
8) Regaxding the 5-foot fence along the west piopeYty line I have dis-
cus8ed this with youx zoning administ=ation and they indicated to me,
at the time, that if the adjoining psopezty owne=s didn't xant a
6-foot sight-obscuriug fence and xould prefe= to leave the 5-foot
existing fence, I xas to get a statement fzom them. This is exactly
what I intend to do
9) We ha.ve the forms foZ the vacating of the alley We axe nox seeking
the signatu=es that axe =equised by the County fo= the vacation
10) We axe in the process of obtaining a building pezmit foZ the change
of use from axesidence to an office, We do not plan any nex et=uc-
tures at this time
11) We have no intention of handling or stoYing any critical mateYials on
this site, at this time,

It is equal to, if not betteY than, most of the Yazdley azea We will con-

I have reviewed your site development plan, submitted August 2, 1985, on the above-
described property. I find that the stte plan doesn`t demonstrate compliance wtth require-
ments of the Spokane County Zoning Ordinance or condttions of approval on the two
referenced zoning actions On several occas.ions over the past few months, you have been
informed of development requirements bjr both Steve Horibiowski, Zoning Admtnistrator and
Tom Davis, Zoning Investigator So that there is no further misunderstanding of require-
ments, this 1 etter outl fines the pro61 ems wit th the su[nni tted site pl an and the requirements
you still need to meet They are as follows
1) The submitted si te plan is lacktng 3n detai l and general ly of poor qual tty I strongly
urge you to employ a consultant, such as a draftsman, landscape architect, or other
professional, to draft a detailed and clearly understandable site plan At a minimum,
the plan should
- be drawn to scale and indicate dtmensions of ttems such as streets, alley,set-
backs, structures, ri yhts of way, and property boundaries
- show existing features to remaln or proposed improvements and location of struc-
tures, fences, gates, vegetation, streets, street improvements, drlveways,
paving, and fire hydrants
- specxfically show and state type, size, and quantity of landscape plants and type
of sprinkler system for maintenance
- specify in an elevation drawing the size, type, and construction material for the
required sight-obscuring fence
- indicate stormwater drainagP plan and methnd of drainage disposal per the Spokane
12081 Stormwater Drainage Plan
- any other graphic informatlon necessary to make the plan understandable or to
meet County requirements

2) The fencing shown doesn't comply with required setbacks The fence setbacks from
your property 1 i nes are as fol l ows
- 35 feet from Desrret Avenue property 1 i ne
- 35 feet from Cataldo Avenue property line
- 20 feet from Stanley Street property line
- 0 feet from Westerly property 1 i ne
- 15 feet from both Alley property lines
A Variance from these setbacks could be requested by you through a public hearing
If you apply for the Variance, the submitted site plan for the Variance must still
address all other concerns expressed by this letter
3) The required setback areas must be landscaped and maintained We don't specify the
type of landscape plants or ground cover to be used, that is your decision Nowever,
we do require a mixture of high/low plantings and a sprinkler system for maintenance
All landscape features must be shown in detail
4) Regulations for storage are very specific, that is, the materia] stored must be
completelyscreened from views Screening can be accomplished by sight-obscuring
fencing at least 6-feet in height, tall landscaping, and orientation of taller
equipment to interior of site All three methods should be incorporated into this
site and demonstrated by your site plan
5) Once the landscaping and fencing pian are approved by this office, you will need to
obtain a qualified estimate of landscaping and fencing costs from a nursery or land-
scape architect Based on this estimate, a bond must be secured guaranteeing installa-
tion by an agreed upon deadline
6) The current site plan indicates three separate phases of development but no addi-
tional infoYmation What is each phase? What improvements will be made with each
phase? Mhich structures wiil1 remain? What new structures are planned? What ugds
are planned? What is the timing of each phase? The site plan must provide a
detailed description of these phas3ng items
7) Traffic sight distances at intersections and driveways must be protected from
obstructions The current site plan generally indicates the 'clear-view triangle'
at one intersection This must be shown and kept clear at all intersections, drive-
ways, and al l eys
8) The five (5) foot fence along the west property line is not sufficient to meet
Ordinance requirements It must be at least six (6) feet tall and sight-obscuring
9) The site plan shows use of an alley that is onl proposed to be vacated We will not
consider any use of that alley until you at east file for vacation with the County
Engineer and have a favorable indication that it can be vacated Please provide
this documentation with the new site plan, if you intend to use the alley
10) Any structures converted from residential use or any new structures will require
building permits or change in occupancy permits from the Department of Building and
Safety These must be applied for after review and approval of your new site plan

11) Use of the site is subJect to the provisions of the Aquifer Sensitive Area Overlay
tone These provisions require protection of the Spokane Valley Aquifer from storage
or handling of critical materials Prior to approval of your site plan or building
permits, the use of the site w311 6e evaluated as to whether it's a critical
material use activity If it is, then you will be required to store and protect the
materials from seepage into the ground as required by law
You should act as_soon as possible to submit an acceptable site plan to our Department
for review You cannot occupy or use the site for storage until all above concerns have
been resolved, approved, and building permits issued Keep in mind that the items and
concerns I have listed are separate from legal actions being pursued by Tom Davis of the
Department of Building and Safety What I am requesting is necessary for any use of the
site Tom is pursuing a criminal complaint because he has found you in violation of
County Codes and Ordinances As I understand, he will continue with his legal course of
action regardless of the processing of the site plan The only way to avoid a trial, as
I understand, is for you to have an approved site plan with building permits issued The
sooner you act, the sooner you can avoid these problems
As we have attempted to do in the past, we wtll work to expedite this matter, if you
provide the information requested Please contact me when you are ready to submit the site
plan, or if you have questions
