Spokane, Washington 99201 RE: Possible Zoning Violation Uear Mr. Konen: On Friday, March 3, 1973, I received a call from Laura Odette, who works with the check detail at the City Police Department (456-2252). She and neighbors living in the vicinity of her iiome at East 8603 Mansfield, are concerned about the zoning violations of G1 en E. McNerney. Mrs. Odette reported that for the 1 ast three weeks Mr. McNerney has had sei-iii -trai ler trucks parked on his premises. The trucks are there when she leaves for work and when she returns from work. Some are loaded with fresh-cut timber, others are not. On her own, Mrs. Odette copied down the license numbers of the trucks and upon checking was able to learn that one was registered to Glen F. McNerney. It is her and the neighbor's concern that Mr. McNerney may be conducting the business of heavy equipment and truck repair in violation of a County Ordinance. Enclosed you will find a copy of a November 9, 1971 letter concerning a prior reported violation. Background: The applicant proposes to use a triangular parcel located west of Sargent Road extended between Montgomery Avenue and the Burlington Northern mainline for an automobile and truck repair garage. Because of the unusual shape and restricted depth of the property, the applicant propose s vacation of Montgomery Avenue to accommodate a 401x70' garage structure.(The applicant owns the advertised parcel as well as Lots 1- 6, Block 1, Vista Gardens.) In a zone change proposal to the east of the advertised property (See ZE-70-69- Robisch) the former owner of the property apparently recognized the limitations of the small triangular parcel and excluded most of the subject property from consideration in the shopping center proposal. The previous owner indicated that the advertised area would be appropriate for a duplex. A. Reasons: 1. The Comprehensive Plan does not indicate an industrial corridor along the Northern Pacific Railway tracks (B . N. ) between Park Road and Argonne Road. Such industrial corridors have been established in the Yardley area, the Trentwood area, and along certain portions of the Spokane International Railway nght of way. The Comprehensive Plan also relegates commercial development in the neighborhood to the Argonne-Montgomery intersection. The advertised parcel is over 1/4 mile from the intersection. 2. The property to the east of the advertised parcel is zoned Commercial in accordance with an approved development plan for a shopping center oriented toward the Montgomery-Argonne intersection. The development proposal includes appropriate street improvements, instal].atfon and maintenance of substantial landscaping, proper lighting of structures and parking axeas, and sign restricfiions to "protect residential properties to the south of Montgomery Avenue and to assure safe access to and from adjoining streets". The Planning Commission is of the opinion that the application may not be construed as an extension of the shopping center concept because: - 8 - (contd. ) . The West 350 feet of the shopping center site would be utilized for parking and protective screening only. bj The applicant has not incorporated landscaping, signing, access controls, etc. into the submitted development plan to conform with the shopping center proposal to the east. c) The Commission notes that a truck repair garage is not a normal use conducted within a retail shopping center. 3. The Planning Commission is of the opinion that the proposed use, namely an automotive or truck repair garage, would have a detrimental effect on the sunounding residential neighborhood. The Commission contends that performance standards could not be incorporated in the development proposal to confine the effects of the actatvity to'the advertf sed site; i. e., the nof se , lighting and storage activity , normally associated with such repair facilfties would affect residents within the immediate neighborhood regardless of landscaping, fencing, paving, etc. 4. The Planning Commission contends that the east portion of the advertised area could be utilized for residential development. Because of the angular nature of the advertised property, the extreme west portion of the sfte is virtually unusable for any purpose, including commercial storage. B. General Data: 1.
