Section 38. Gontracts and Documents, Execution Of, A11 written con-
tracta, bonds and instruments of every kind and, descriptivn to which the
city sha11 be a party shall be exeeu#.ecl in the name of the city by the
MasFar or the Manager under the direction of the City C:UilT3C1I, and at-
tested by the Clerk, and w}aen necessary, ahall be acknowledged.

Section 39. Publicity Prrrvisions-Officiat Gazette. The council shall
cause the clerk to print and issue each week a pamphlet entitled THE
(]FF'ICIAL GAZETTE, in which shall be ptiblished a summarp of its pro-

gardens, eollections of natural hastory, observatories, buildings, fountains,

ARTICLE V.
PARKS AND PARK BOARD
Section 41 Park Board-How Created A park board is hereby created which
shall consist of ten (10) electors of the City of Spokane, who sha11 be appointed
by the council, and one member of the council to be desig-nated by the council
The ten appointed members of the paxk board existing at the time of the adop-
tion of this Charter shall continue to serve respectively until the first Z"uesday
of Februaxy next preceding the expiration of their terms, as at present fixed,
and until their successors are appointed The council shall have power to re-
move any member for ca,use and to fill vacancies in the board
Section 42 Park Board-Term of Office The term of office of the 10 appoint-
ed members shall be 5 years, provided that the present members at the time this
amendment is adopted shall serve the remainder of their 10 yeax terms previously
provided for in the Charter Members appointed after the effective date of this
amendment shall be limited to two terms, less than a half term not constituting
a term should an individual be appointed to fill the unexpired term of one, who
for any reason, dQes not serve his entire five year term The term of office of
two members shall expire each year on the first Tuesday of February at 12 00
noon The mayor shall designate the members as to expiration of term

Section 43 Park Board-Removal From It sha11 be the duty of the council to
remove from office any member, who, after due notice of the meetings of the
board, shall be absent therefrom, without leave, for three successive months
Section 44 Park Board-Organizateon
(a) On the second Tuesday of February of each yeax the boaxd shall elect a
president and a vice president from its members, and a secretary, who may, or
may not, be a member of the board
(b) Six members of the board shall constitute a quorum for the transaction
of business, and but six affirmative votes shall be necessary to adopt or carry
any measure The board shall have regulax public meetings at least once a
month, at their regular place of ineeting
(c) The board sha11 have power to make by-laws and rules for the conduct
of its business

Planning Commission Recommendation: Approve to Commercial Zone* subject
to the followa.ng conditions:
A. Conditions :
1. The site shall be developed in substantial conformance with the
approve d plot plan on file with the application; i, e., a one -story
office building shall occupy the we st portion of the site, a one -story
retail store building shall occupy the southeast quadrant of the site,
and a restaurant building shall occupy the northeast portion of the
site .
2. Landscaping along Sprague Avenue shall be installed in accordance
with the approved plot plan on file with the application o Plantings
within tre Sprague Avenue landscape strip shall be of a species
wluch will not attain a height of more than three feet. An automatic
sprinkler system shall be installed to serve the landscape stn.p.
(If the project is developed in stages, this requirement shall apply
as each portion is developed. )
3. Approval of access driveway locations to Sprague Avenue by the
County Engineer's Office.
4. No free-standing sign on the premises shall exceed forty (40) square
feet in area or thirty-five (35) feet in height. All signs may be
illuminated provided that they shall not be animated nor flashung and
shall be of low intensity not exceeding the equivalent of four hundred
twenty-five (425) milliamperes fluorescent tubing behind plexface
spaced on seven (7) inch or more centers, or of exposed neon not
exceeding thirty (30) milliamperes.
5. The Director of Planning shall approve a specific extenor lighting
plan for the advertised area or porta.ons thereof prior to installation
of such lighting. (Such plan shall attempt to confine illuminata.on to
the Commercial area with full consideration to adjacent residential
propertie s . ) ,
B. Reasons:
1. The Comprehensive Plan indicates that the properties between Sprague
Avenue and the Milwaukee Road tracks in the Vera and Opportunity
communitie s are appropriate for commercial use s.
