Re: Stop work order on lot #5 on Highland Dr.
We contacted Hahn Engineering, Inc. to draw up plans for a 6' high
retaining wall using 2' x 2' x 6' concrete blocks. Their
recommendation is for us to remove all debris on the "up hill" side
back to 4.0 feet of back of wall and backfill with good structural fill.
Any large pieces of concrete will be buried 4' to 15' from the wall and
p�. 140' across the back and will be mixed with good backfill material.
Fifty yards of topsoil will be hauled in to go on top of that. ,

This area is intended of yard and garden only and not for a building
site.
Due to the minimum amount of dirt work to be done, Randy Hahn
said we shouldn't need a grading permit. The material that was
hauled to this site was there before the new ordinance was in effect.
A previous owner already had the basement dug and leveled out. All
we did was to remove a few trees that had grown up there and
cleaned up the area.
There is an eight -foot utility easement across the back of this property
and we've allowed an additional two feet before starting our wall.
You may find additional helpful information in the attached deed
restrictions.

BEVERLY RILLS FIRST
Restrictive covenants and easement referred to in Policy
No. of the Transamerica Title Insurance Company which
are imposed by the dedication of the plat of BEVERLY HILLS FIRST
ADDITION, dated June 23, 1956, filed June 29, 1956 as Document
No. 397519B, and recorded in Volume 5 of Plats page 5, are as
follows:
All lots in said Addition shall be known and used as residential
lots. Only one (1) family dwelling on any one lot shall be per-
mitted.
No building shall be located on any lot nearer than 25 feet to the
front lot line. No building shall be located nearer than 15 feet
to the side street lines, or nearer than 5 feet to the adjoining
lot lines. No building, except a detached garage located 70 feet
or more from the front lot line, shall be located nearer than 5
feet to any side lot line.
0 -The grantor reserves the easement, right and privilege on a strip
of land 8 feet in width along and parallel to the lot lines as
shown on the map for telephone, gas, water, electric service and
other utilities.
Only dwellings not to exceed two (2) stories in height, and a one
(1), two (2), or three (3) car garage may be erected on any lot.
None but new dwellings shall be permitted in this addition.
No trailer, basement, tent, shack, garage, barn or other outbuilding
erected in the tract shall at any time be used as a residence, tempo-
rarily or permanently, nor shall any residence of a temporary char-
acter be permitted.
The total value of any structure, including garages and land value,
on any lot in Block 7 and Lots 4 through 17 of Block 6 in said Add-
ition shall not be less than 20,000 dollars based upon costs pre-
vailing on the date these covenants are recorded. No dwelling on
the aforementioned lots and blocks having a floor space of less than
1400 square feet shall be permitted, exclusive of porches and garages.
The total value of any structure, including garages and land value,
on any lot in Block 5 and Lots 1 through 9 of Block 2 in said Addi-
tion shall not be less than 17,000 dollars based upon costs prevail-
ing on the date these covenants are recorded. No dwelling on the
aforementioned lots and blocks having a•floor space of less than
1200 square feet shall be permitted, exclusive of porches and garages.
