HEARING EXAMINER COMMITTEE
FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Corrmittee on
April 5, 1984, and the members of the Committee present being
Kathleen M. Carstens, Chairperson; Kenneth Kennedy, and Ronald L. McVicker.
B. PROPOSAI.
The sponsor, Ralph Guthrie, is requesting approval of a change of
conditions, File No. ZE-7A-69 and ZE-17A-71, Multiple Family Suburban Zone
and Residential Office Zone, for the purpose of allowing administrative
review vf future detailed site plans under both Zoning files.
C. FINDINGS OF FACT
1. That the existing land use in the area is nursing home, offices,
resldential, Valley General Hospital, medical office building, and
vacant.
2. That the Comprehensive Plan designates this area as appropriate for
Urban development.
3. That the existing zoning of the property described in the application
is Multiple Family Suburban and Residential Office.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) havelbeen complied with, and the Committee concurs with the
Declaration of Non-Significance.

5. That the proper legal requirements for advertisement of the Agenda
Item have been f ulf illed .
6. That the land in this area is suitable for the proposed use, or uses
within the proposed Zone Classification.

C. FINDINGS OF FACT (continued)
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed change of conditions is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed approval of the proposed
use.
10. The Hearing Examiner Comnittee finds the proposed use to be ln
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the proerty, heirs, assigns, and successors.)
a) COUNTY PLANNING DEPARTMENT
1. The Zoning Administrator shall approve a specific exterior
llghting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illumination
to the area with full consideration to adjacent properties).
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits.
3. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
4. Applicant shall comply with 1208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoffe

County Platting Ordinances prior to issuance of building permits.

a) COUNTY PLANNING DEPARTMENT (continued)
6. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final dlsposition of this
application, and prlor to any on-site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTION is
waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982.
7. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at least fif teen (15) days prior to this date; the
official file, written comments and/or public testimony contain
information regarding assessment of the proposal's adverse
impacts to the physical environment; a finding is hereby made
that no potentially signif icant adverse impacts upon the
physical environ ment are anticipated as a result of the
project; and a final declaration of non-signif icance is hereby
to be issued. ,
8. That the prolect is subject to Section 4e16A.050, the Aquifer
Sensitive Area Overlay Zone of the Spokane County Zoning
Ordinance, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.
b) COUNTY ENGINEERING DEPARTMENT
1. Those Conditions of Approval as contained within Flle Nos.
ZE-7-69 and ZE-17-71.

c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
District.

c) COUNTY UTILITIES DEPARTMENT (continued)
2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULIO by petition method pursuant to RC,W 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each new unit shall be double-plumbed for connection to future
areawide collection systemse
5. Plans and specifications for the double plumbing are to be
reviewed and approved by the Utilities Departmente
d) COUNTY HEALTH DISTRICT
l. That those conditions of approval as contained in Files ZE-7-69
and ZE-17-71 be complied with in the development of this
property.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
I
1. The $ite is located in Fire District # 1.
2. Mains and fire hydrants will be required to be installed in
accordance with the requirements of the Spokane County
Department of Building and Safety.

f) WATER PURVEYOR
1. Water Purveyor is Modern Electric Water Company, and they will
supply the site with adequate water for domestic, fire and
irrigation uses.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Spokane County Air Pollution Control Authority regulations
require that dust control measures be taken during all phases of
the project. We further require that ingress, egress, and
parking areas be paved and kept clean.
E. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that
the application of Ralph Guthrie, for a change of conditions as described
in the application should be APPROVED.

I am in receipt of your letter dated January 19, 1984, which was forwarded from the
County Engineer's Department to the Planning Department. Your letter is concerr.ed
with property legally described as Tract 24 of Assessor's Plat No. 6, except the
Easterly 140 feet,located in the County of Spokane, Washington.
Your inquiry as I understand it, specifically is in reference to a 60-bed addition
to an existing nursing home on the above-described property. Your letter asks whether
zoning is permissi5le for the proposed project. My response to your qiiestion is a
qualified affirmative.
The existing zoning on the described propPrty is Multiple Family Suburban, which
Chapter 4.07.080-e allows as a use permitted, nursing homes and rettrement homes.
However, in research of the files pertaining to the Multiple Family Suburban zoning
on this property, ZE-7-69 and ZE-17-71, the approved project plans indicate the site
as developed ;n substantial conformance with those plans. The 60-bed addition would
take the project beyond its approved status and, therefore, a Change of Conditions
would necessarily have to be processed. As of January 31, 1984, I have received f rom the property owner an application for
said Change of Ccndltions and personally feel as Zoning Administrator, that the
requested change is procedural in nature and should receive approval at its scheduled
public hearing of April 5, 1984 (Please find enclosed the applicant's description of
the requested change of condition.)
Unfortunately, the applicant's request is beyond that which I can administratively
approve and, therefore, the public hearing system is required. The Planning Depart-
ment staff is taking a favorable position upon the applicant's request and unless
new information is received prior to the hearing, would recommend approval of the
60-bed addition.

There are two specific actions that are being requested. The first is
requesting a change in the conditions of approval for ZE 7-69. This ~
,
, particular condition is contained in Commissioners Resolution #69-347.
~ IC binds the Zone Change approval to a particular site plan. At the
, time of the Zoning approval there was not a need for an additional 60
~ nursing home beds in the Spokane Valley. This situation has changed.
The Washington State Department of Social and Health Services has issued
a"Certificate of Need" for an additional 60 Beds. (Attached)
? In order to be in compliance with the rules and regulations of the Spo-
kane County Zoning Ordinance, we are required to amend this site plan
to show the additional 60 nursing home beds. We are requesting that the
Zoning administrator be allowed to approve the specifics of this new site
plan. (Parking, landscaping, etc.) '
The second action is a change in the conditions o£ agproval for ZE 17-71.
This again binds the zone change to a specific site plan, as contained in
Commissioners Resolution #71-11$. This site plan envisioned a series of
professional office structures. A portion of this property has already
been developed contrary to the approved site plan. The East 246.6 feet
of the property has been developed as apartments for "Congregate Care".
The applicant does not, at this time have any specific plans for his own-
ershlp, other than it might be developed as additional nursing home beds
or professional offices. He would like to have the freedom to develope
this property in a manner that is most responsive to the needs of the mar-
~ ketplace. Thus, he is requesting that future site development on this pro
j perty be determined through an administrative review process.

Dear Mr. Archey:
Thank you for your plan for the proposed Mission Medical Center.
Spokane Valley General Hospital is currently 95 beds, offering a complete
range of acute general medical services. Starting the first of April we
will add 34 beds. Concurrently with this construction we have submitted
plans to the State Board of Health to double the present size of the Hospital
to 280 beds, which we anticipate will start in 1972 with completion in 1973.
Our bed projections are based on the most recent census figures for the
Ualley and we are roughly using four beds per one thousand population. It
is also important to note that the hospital does receive patients from
the valley and surroundinq areas, such as; Post Falls, Fairfield, Tekoa,
Couer d'Alene, etc.
We feel it is in the best interest of the Hospital and the patients to have
available collateral medical facilities such as the institution you are pro-
posing and which appears to be in keeping with the Opportunity Convalescent
Center and the Spokane Rehabilitation Institute.
