INTRODUCTION This matter having come before the Examiner Committee on March 30, 1979, and the members of the Committee present being Abby Byrne, Chairperson, John Culler, and Kenneth Kennedy. B. PROPOSAL The sponsor, Jimmie W. Bates, is requesting approval of a preliminary plat and zone change, PE-1289-79, Faith Addition #1 to Greenacres, and ZE-29-79, Agricuitural to Single Family Residential for subdivision of 3.0 acres into 7 lots for single family dweflings and there being present, the following applicant or representative: DAN CLARK C. FINDINGS OF FACT 1. That the existing land use in the area is residential and pasture land. 2. That the Comprehensive Plan designates this area as residential usage. 3. That the existing zoning of the property described in the application is Agricultural. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with. 5. SPECIAL CONDITIONS OR CONTIGENCIES APPLICABLE TO THIS SUBDIVISION APPROVAL: NOTE: Any amendments to said conditions are stated separately and listed hereafter. 1. That the plat be designated as indicated on the preliminary plat of record and/or attached sheets as noted. 2. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes of creating additional lots or building sites without filing a replat. 3. That appropriate utility easements be indicated on copies of the approved preliminary plat for distribution to the Planning Department and the utility companies. Written approval of the easements by the utility company must be received prior to the submittal of the final plat. 7. That the plan for water facilities adequate for fire protection be approved by the water supplier and fire protection district. Said water plan must also have been approved by the appropriate health authorities. The health authorities, water supplier (purveyor), and fire, protection district will certify, prior to the filing of the final plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. The purveyor will also certify prior to the filing of the final plat on a copy of said water plan that appropriate contractual arrangements have been made with the plat sponsor for construction of the water system, in accordance with the approved plan, and in accordance with a time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the plat. The plat dedication will contain a statement to the effect that the public water system as approved by County and State Health authorities and the local fire district and purveyor will be installed within this plat, and the subdivider wi11 provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot. 8. That a certificate of title be furnished the Planning pepartment prior to the filing of the final plat. 9. That the preliminary plat be given conditional approval to April 1, 1980. 10. That a declaration of Non-Significance be issued, in accordance with Section 11.15.340 of the Spokane County Environmenta) Ordinance (SCEO) prior to approval, or any approving action in accordance with SCEO 11.15.340. NOTE: The official file contains an environmental checklist for the proposal and a staff review of their checklist as required by WAC 197-10-320. 11. That conditional approval of the plat is given subject to the dedication of right of way to the public and approval of the road system in the plat by the County Engineer. 12. That plans, profiles, and cross sections showing proposed street centerline and curb grades be submitted to the County Engineer for approval prior to construction and the filing of a final plat. 13. Construction within the proposed public streets and easements shall be performed under the direct supervision of a licensed land surveyor, who shall be responsible for perpetuating all evidence of the location of survey monuments which may be distrubed during construction and who shall furnish the County Engineer with "As Built" plans and a certificate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 15. No construction work is to be performed with the Public Right of Way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 16. All construction within the Public Right of Way is to be completed prior to filing the final plat or a bond in the amount estimated by the County Engineer to cover the cast or construction of improvements, construction certification, "As Built" plans, and monumenting the street centerlines, shall be filed with the County Engineer. 17. That a narne be indicated before the final plat is filed; such name to be approved by the County Assessor and the Planning staff. 18. That each lot be authoriZed for the use of individual on-site sewage disposal systems. 19. GENERAL INFORM.4TI0At A. Location The proposal is located in the Greenacres area of the Spokane Valley at the northwest corner of Flora Road and Mission Avenue. B. Proposal - 3.0 acres subdivided into 7 lots for single family use - Lot frontages = Varies f rom 85 feet to 109 feet - Lat sizes = Varies from 17,765 sq. ft. to 22,345 sq. ft. C. Relationship to the Comprehensive Plan The approved map of the Comprehensive Plaa indicates residential usage of this area, as well as all nearby surrounding lands, with no density designation. D. Land Use Analysis: 1. Existing Land Uses The proposed site for Faith Addition currently.contains one residence with the remainder of the parcel utilized for pasture. In general the surrounding area consists of rural residential uses associated with active agricultural pursuits; primarily animal keeping and pastures. as originally platted, the area consisted of 6 to 10 acre tracts which have now been reduced to tax segregations ranging in size from approximately 11,000 sq. ft. to 4 acres. Some mobile home uses can be found generally aorth and northesat of the site. Some recent platting has occurred in the irnmediate area to the east and northeast. Janke Addition to the east along Mission Avenue, approximately ~ mile, received recent approval for 22 single family aad two family lots with sizes ranging from 12,000 sq. ft. to 17,520 sq. ft. Furhter Lo the east is Upper Columbia Addition with single family lots of approximately 19,000 sq. - ft. To the northeast of Faith Addition is Baldwin Acres which is approved for 3 single family lots of approximately 1 acre each. Little platting activity has occurred to the west and southwest of the site. 2. Compatibility with Existing Land Uses The location of the proposal is somewhat withdrawn from the areas of recent platting activity. However, the proposal is in keeping with the recent trend of platting along Missioa Avenue aad the proposed lot sizes are comparable to those approved in the area and existing through tax segregations. The proposed single family uses would be compatible with existing single family uses, however, there could be some short term conflicts with the existing mobile home and agricultural uses. - Ig - , , ~ STAFF ARTALYSIS - March 30, 9 FAITH ADDITION #1 TO ;ENACRES - continued II. SPECIAI, INFORMATTON A. Circulation The County Road Eugineer has examined the propased preliminary plat of record and reports that existing rights-of-way, with some basic improvements, should adequately serve the proposal. B. Sewage Disposal The applicant's engineer has prepared an analysis of alternative sewage dis- posal means; including on-site septic tank disposal, community septic tank disposal, and community package treatment plant disposal. For economic reasons, and to provide the most realistic alternative, the applicant's engi- neer feels on-site septic tanks should be utilized. The Spokane County Health District has authorized the use of individual on-site sewage systems for each lot within the plat. The District states that an on-site sewage management system should be created and approved by their office prior to the signing of the final plat if more than a total of 10 dwelling units are authorized within the plat. The plat is situated over the Spokane Valley Aquifer and the Heaith District in their examination of the possible impact on groundwater quality from this proposal have the following caminents : Impact Discussioa a. The plat sponsor has proposed 7 lots on 3.0 acres with lot sizes of 17,765 square feet to 22,345 square feet. Each lot is to be served by a public water system and its individual on-site sewage disposal system. This raises the question of significance of the impact on the groundwater in the area and possible alternatives for sewage disposal. b. In the course of the conduct of the Army Corps study, Dr. Todd considered typical soils, natural and sewage disposal recharge to the groundwater, and the effect of continued urban development in the Spokane River Valley upon the quality of the groundwater. In summary, he concluded that: 1. In normal precipitation years subsurface disposal of sewage treatment effluent does reach and recharge the groundwater. 2. All the dissolved salts in sewage effluent will be carried to the groundwater. However, bacteria and detergents (phosphate portion) are mostly removed by the deep soil layer above the groundwater and "minor dissolved constituents such as phosphates, which are known to react with soil particles, or nitrates, which are taken up by the plant roots," will be less than the total found in septic tank effluents. - 1C - ~ ~ STAFF ANALYSIS - March , 1979 FAITH ADDITION ~ '0 GREENACRES - continued 3. The calculated results at the downstream end of groundwater flow line indicate that the maximum range of (dissolved) solids concentration expected at presnet (1975) is up to 93 mg/1 (milligrams per Iiter) above the riatural groundwater background of 155 mg/1. The forecast year 2020 maximum increIDental coacentration is 10I mg/1 abave the natural background. - - - The analytical results of the forecast impact of year 2020 when compared with the present impact, both measured in terms of leachate volume and dissolved solids concentration, - indicate that the present impact on groundwater quality is already a substantial proportion of the ultimate level. c. Current].y, resu}.ts of chemical analysis show the total nitrogen content of the groundwater as in the range of .89 to .94 ppm. A projected incremental increase using Dr. Todd's expected 8.6 percent would result in a range of .96 to 1.02 ppm. Current Federal and State drinking water standards permit up to 10 ppm. d. Alternative sewage disposal methods that would not recharge the ground- water have the following general characteristics: 1. Collector and central treatment systems discharging to surface waters would require at least tertiary treatment and perhaps more to obtain a permit for the discharge from the Department of Ecology. These systems are not currently economicaily available for this project. 2. Sealed systems, whether individual or community, depead on evaporation for liquid removal. These systems require more land area than a conventional subsurface drainfield. Some, such as . lagoons, have safety hazards associated with them and relatively poor community acceptance. Land, installation and operational cost are generally more expensive than those for septic tanks and drainfields. C. Drainage The County Utilities Engineer reports that the preliminary storm drainage plan submitted by the applicant indicates that on-site storm drainage provisions will adequately bandle surface water runoff. However, final construction plans should be reviewed and approved prior to the final plat filing. D. Water Supply The proposal is located within the recorded service area of ConsoZidated Irrigation District #19. The District advises the staff that adequate system capacity, and a desire on their part to serve, exists for the provision of water for domestic, fire and irrigation uses. - 1D - ~ ~ ~ STAFF aI+tALYSIS - March 30, 79 FAITH ADDITION #1 TQ EENACRES - continued E. Fire Protection The proposal is situated within the recorded servzce area of Spokane County Fire Protection District #1. The Fire District staff requests that the Hearing Examiner Committee require mains and hydrants of sufficient si2e for fire protection as a coadition of final plat approval. The District also requests that they be allowed to review and approve final cvnstruction plans. ' F. Schools ProposaZ lies within the boundaries of Central Valley School District #356. G. Parks The report "Planning for Parks" (revised 1976) indicates that Faith Addition #1 to Greenacres is situated in the Greenacres #4 Study Neighborhood. A 7 acre neighborhood park, located in conjunction with a proposed elementary school near the intersection of Missioa Avenue and Long Road would be required to serve the recreatioaal needs of the neighborhood. , H. Uaique Enviroamental Features None have been indentified. I. Cu3.tural Resources None have been indentified. III. ZONING ANALYSIS The proposed site and all adjacent properties within an approximately k mile radius are currently zoned Agricultural. The two recently approved plats within the area, Baldwin Acres and Upper Columbia Addition, have approval for Agricultural Suburban zoning. Janke Addition has received approval for R-1 and R-2 zoning. While R-1 zoning doesn't currently exist in the immediate area, with the exception of the preliminary approval of Janke Addition, the proposal does meet the basic requirements of that 2oae classification. The R-1 zone would be consistent with the proposed single family use, however it may be in conflict with the existing and • surrouading Agricultural zoning and uses. IV. ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the spoosor and has been reviewed by the Planning staff. No significant adverse environmentaZ iiupacts were judged to exist. Slight adverse enviroamental impacts were identified on the checklist in the following categories: earth; air; water; €lora; fauna; noise; Iight and glare; land use; population; housing; transportation/circulation; public services; energy and utilities. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placect on any one iot, nor sha11 any lot be further subdivided for the purposes of creating additioaal lots or building sites without filing a replat. 3. That the plat provide for right of way width for streets as indicated on the preliminary plat of record. 4. That appropriate provision be made that the following described property be held in trust until the coatinuation of the streets be dedicated or deeded: A 1' strip at the ends or edges of all streets that terminate or border the plat boundary. W. M., Spokane County, Washington. It is a proposed replat of the soufih 209 feet of Tract 33 of Plat "A" Greenacres Irrigation District. The land is flat and open with no peculiar topographic features. The soi) is classified by the Soil Conservation Service as Garrison Gravelly Loam (GgA & GgB). This area is served by Consolidated Irrigation District. Scope of Project This proposal involves the subdivision of 3.0 acres into 7 single family lots of from 17,765 square feet to 22,345 square feet. Sewerage Alternatives Following is a brief analysis of three alternative means of sewage disposal for the project. Individual on-site sewage disposal systems (septic tank-drainfield) This type of sewage disposa) would involve the installation of 7 individual septic tank-drainfield systems. The per unit cost of this system, based on: (1) a 50 year I ife; (2) dra i nf i eld replacement after 25 years; (3) pumping septic tanks at 4 year intervals and (4) inspection afi 2 year intervals, is estimated to be $6000/1ot. This includes all installation and maintenance costs for the 50 year period at todays dollar value. The positive aspects of this type of sewage treatment for this project are: (1) low initial installation cost; (2) dispersal of sewage treatment effluent over a wide-spread area. In our opinion the danger of ground water pollution is increased, in this type of gravelly soil condition, by methods which concentrate effluent discharge; (3) relatively low maintenance cost and low rate of failure. cont...... page 2 . Package treatment plant The size of this project rules out this and other type treotment systems such as lagoons which have minimum area and cost requirements too great to allow their use. Genera) Comments Concerning These and Other Types of Sewage Treatment Systems. The success of the individual on-site treatment system in the Spokane Valley as measured by its low rate of failure and therefore (ow maintenance cost and (ong drainfield life makes its economic feasibility unquestionable. Large and small developments alike show the same cost comparisons. The ground water pollution problem is, of course, a serious concern to all people in the Spokane area. None of the systems considered herein guarantees that pollution of ground water won'fi occur. Other alternative sewage d i sposa I methods such as centra I systems di scharg i ng to surface waters wou Id not be permitted by the Department of Ecology without at leost tertiary treatment. These systems are not economically feasible for projects of this size. Lagoons and other types of sealed systems depend on evaporation for liquid removal. tndividual systems of the seoled type haven't yet proved workoble in this climate. Study Conclusions and Recommendafiions Economic, governmental, and community acceptance considerations limit the choice of sewage treatment systems to the three evaluated by this study. In our opinion the individual on-site method will provide less ground wafier pollution potential than will the ofiher methods. This property lies in a relatively flat area west of Flora Road and North of Mission Avenue. Plat dimension is 630' along Mission Avenue and 209' along Flora Road. It is located over the Spokane Valley Aquifer. b. Surface soils are classed as Garrison gravelly loam with 0 to S% slopes. They have a septic tank filter field limitation of slight with possible contaznination of groundwater. Geologically the soils are glaciofluvial deposits; stream-laid sand and gravel; contains some boulders in places; includes some undifferentiated glacial depasits. The lower terrace remnants have probably been reworked by streams. These geologic structures yield moderate to very large amounts of water. d. The data contained in the draft 208 Study Sampling Report indicates a total nitrogen level in the range o£ .89 to .94 ppm. Consolidated Irrigation District has indicated that it is able and willing to supply domestic use water to the plat. Satisfactory arrangements have been made with the developer. 3. Impact Discussion: a. The plat sponsor has proposed 7 lots on 3.0 acres. Each lot is to be served by a public water system and its individual on-site sewage dis- posal system. This raises the question of significance of the impact on the groundwater in the area and possible alternatives for sewage disposal. b. In the course of the conduct of the Army Corps study, Dr. Todd considered typical soils, natural and sewage disposal recharge to groundwater, and the effect of continued urban development in the Spokane River Valley upon the quality of the groundwater. In summary, he concluded that: (1) In normal precipitation years subsurface disposal of sewage treatment effluent does reach and recharge the groundwater. (2) All dissolved salts in sewage effluent will be carried to the groundwater. However, bacteria and detergents (phosphate por- tion) are mostly removed by the deep soil layer above the groundwater and "minor dissolved constituents such as phos- phates, which are known to react with soil particles, or nitrates, which are taken up by plant roots" will be less than the total found in septic tank effluents. (3) "The calculated results at the downstream end of groundwater flow line indicate that the maximum range of (dissolved) sol- ids concentration expected at present (1975) is up to 93 mg/1 (milligrams per liter) above the natural groundwater back- ground of 155 mg/1. The forecast year 2020 maximum incremental concentration is 101 mg/1 above the natural background."---"The analytical results of the forecast impact of year 2020 xahen com- pared with the present impact, both measured in terms of leachate volume and dissolved solids concentration, indicate that the present impact on groundwater quality is already a substantial proportion of the ultimate level." .r' February 27, 1979 Faith Addition No. 1 to Greenacres Page 3 c. Currently, results of chemical analysis show the nitrogen content of the groundwater as in the range of .89 to .94 ppm. A projected incremental increase using Dr. Todd's expected 8.6 per cent would result in a range of .96 to 1.02 ppm. Current Federal and State drinking water standards permit up to 10 ppm. 4. Recommended that: a. The final plat shall be designed as indicated on the preliminary plat of record and/or attached sheets as noted. b.
