On Wednesday, November 3, 1971 Mr Ronald Kelling of our office attempted L
to file an Application for Land Use or Structure Permit at the Building
Codes Dept The Building Code Dept refused to issue a receipt for our
check and stated that the plans would have to be approved by the Planning
Commission before the Application would be accepted
The Appl i cati on was for four bui1 dings for Qui ki Tree Products, N 1201 j
6arker Road, Greenacres, Washington. ,
Three of these proposed buildings are located on land re-zoned to Restricted Industrial, (with the condition that the property shall be utilized for ~
storage purposes only), at the September 24, 1971 meeting of the Planning
Commission The fourth building is to be located on the original Quiki ►
Box Manufacturing Company property ~
The application which we tried to submit stated that the use of the build- ~
ings was 'Storage' On the Plot Plan which we submitted, the three build- f
ings were designated as "Group F-2" occupancy, a Uniform Building Code ~
classification which permits "storage for combustible goods", but which
will not permit 'planing mills and box factories' ~

M r John Konen of the Planning Commission, when contacted, stated that
we would have to submit a Plot Plan with a statement contained thereon
that the three buildings would be used for storage only.
In view of the above circumstances, I contend that ~
1. Every time we re-draw a plan or make another trip to the Court House
for a personal interview it costs us money, a fact that some County
Employees who do not have to show a profit in their operations9 fail ~
to consider
2. We, as a third party and legitimate contractor, have fulfilled the
requirements to the best of our knowledge, and the Building Code Dept.
has no right to pre-judge the proposed application and refuse to accept `
it. ~

3. N o matter how many times we write on a Plot Plan "The Owner will not
use this building for any thing other than storage', will not make it
anymore certain than if it is only stated once. Less than 60 days ago
this property was conditionally re-zoned for the F-2 occupancy we have
proposed. One statement using terminology defined in the Uniform Build-
Code should be sufficient.
4. The actions of the Building Code Department and Planning Corrmission in
penalizing Garceau Steel before any crime has been committed by either
Garceau Steel or by Quiki Tree Products is unwarranted, unjustified, I
and extremely arbitrary '

Background
In 19 5 7, Lots 1 and 2, Block 2, were zoned from Unclas sified to Re stncted
Industnal in accordance with a zoning plan which recognized the establishment of
the box factory in 1955. (See ZE-22-57.) Lot 3 was zoned from the Agn.cultural
Suburban Zone to the Restricted Industnal classification in 1958 to accommodate
the expansion of the operationo (See ZE-35-58.) The zoned lots as well as Lot 4
(See VE-1-60) are currently utilized by Quiki Box Manufactunng Company, Inc.
The firm has requested Restrlcted Industnal zomng for lots 4 and 5, Block 2 to
allow construction of additional storage buildings for the existing operation.
Reasons
1) The applicant has assured the Planning Comrrussion that the advertised
area will be utilized for storage purposes onlyo The applxcant indicated
that the proposed storage area would allow more efficient and less
obnoxi.ous operation of the existing installation o
2) The box factory (i.e. Lots 1, 2, and 3) is zoned Restncted Industrial.
The Planning Comrrussion is of the opinion that the expansfon is
warranted because a) the advertised area would be limited to storage
only; b) portions of Lot 4 have been used since 1960, c) the performance
standards of the Restricted Industnal Zone should reduce the effect of the
operation on adjoimng residential properties, and d) the Commission
concurs with the appl2cant's stated need for expansion and xs of the
opinion that the addita.onal lot proposed would both facilitate a more
efficient operation and tend to have less impact upon surrounding
re sidential propertie s than expansion acros s ad j oining streets.

Additional Comment:
The residents in the area have expressed concern to the Planning Commission
about the present operation of the box factory. The Commission notes that
Section 4.11.120 of the Spokane County Zomng Ordinance requires sight-obscunng
fencing of all open storage areas A recent inspection of the prerruses ;eveals that
the operator of the factory has installed cyclone type fencing with redwood slats
around the penmeter of the operation.
The off-street parking provisions of the Ordinance are reviewed upon application
for building permits for additional structures. The Plalnning Commission shall also
request the County Engineer's offrce to investigate loading operations of the box
factory along Boone Avenue.
The Planrung Commission also notes that legal action has been a.nitiated by
at least one resident in the area who contends that the box factory does not presently
conform to certain zoning regulations and County codes. The courts will presumably
determine the val3dity of these allegations, and the Comrrussion expressly stated
that it was not attempting to evaluate the substance of the allegations.

All parties hereto are reaidents of Spokane County, Washinqton.

The plaintiff resides on a tract of land at the Northeast
corner of Boone and Barker Roads near Greenacres, Washington. The
defendant operates a box manufacturing plant on a tract of land
located at the Northxest corner of Boone and Barker Roads near
Greenacres, Washinqton. The plaintiff has reaided on hie property
for the past 25 years and #he defendault hae occupied ite property
for the past la to 12 years. The plaintiff's property is zoned
aqricultural-aurburban and the portion of the defendant's property
is zoned restricted industrial.

Spokane County has adopted a zoning ordinance which provides
for the orderly developmenta of land uses and provfdes certain
restricticans on said land usea in order to insure and promote the

qeneral health, weltare and morals of the community. That the
p lainti f f has at all times observed the aoninq res trictions placed
upon hie land use and the defendant has at all times violated all
or aome of the restriotions imposed upon its land use.

The defendant's violation of ita land use hae resulted in
industrial dust being deposited on the plaintiff's propertyl
excessive noise; unsiqhtly accumulatioae of industrial waete and
trash; fire hazards to adjoininq properties and traffic hazards
on the abutting stresta. Because of tho permansnt and coAtinuing
nature of the defendant's opsratian, its preaenee and caatinwed
operatioa results in a public nuissnce and if allowed to continue,
subetantially devalues t.he plaintiff'$ property.

defendant has c4nsistently parked railroad bax cars on the public
riQht-of-way knawn as Boone Avenue for the purpoae of unloading
lumber. The unloadinq operation takes place in the public atreet
and frequently reaults in a camplete blockage af the =ight-of--way.

In addition to the unloadinq operation, over-wide loads are
transported by unlicenssd vehicle: on Soone and Barker Roads with

was allaared and buflt under a permit for the aonstruction of a

a8ditional machinery which incresse8 the productian of the
defendant's operation and proportionately increasea activfties

steadfastly failed and refused to cease and desist as requested,
but has, on the contrary, incseased its offensive activities. As
a direct and proximate result of the defendant's activities, the
