I NTRODUCTION This matter having come before the Examiner Committee on January 26, 1979, and the members of the Committee present being John Culler, Ted McCoury, and Chairperson, Abby Byrne. B. PROPOSAL The sponsor, Charles E. Simpson, is requesting approval of a preliminary plat and zone change Trentwood Orchards Replat, PE-1278-78) and Agricultural and Commercial to Multiple Family Suburban for subdivision of 3.8 acres into five lots and there being present, the follqwing applicant or representatives: CHARLES E. SIMPSON C. FINDINGS OF FACT 1. That the existing land use in the area is residential and commercial. 2. That the Comprehensive Plan designates this area as commercial. 3. That the existing zoning of the Qroperty described in the application is Agricultural and Commercial. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been compl ied with. 5. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the proposed use is compatible with existing uses in the area. 8. The Hearing Examiner Committee finds the proposed use is not detrimental to the general purpose or otherwise harmfull to the public health, safety, and welfare. 9. That the owners of ad jacent lands expressed opposition of the proposed use. 10. The following are additional findings of fact considered by the Hearing Examiner Committee: a) That condition #29 should be changed to prior to the issuance of a building permit. b) That access for fire fighting equipment should be provided . c). That a landscape maintenance schedule should be submitted, D. SPECIAL CONDITIONS OR CONTIGENCIES APPLICABLE TO THIS SUBDIVISION APPROVAL: If approval is granted, the following conditions are recommended. NOTE: Any amendments to said conditions are stated separately and listed hereafter 1. That the plat be designated as indicated on the preliminary plat of record and/or attached sheets as noted. 2. That the plat provide for right of way width for streets as indicated on the preliminary plat of record. 2 L I . . No. PE-1278-78 ~ Z E-204-78 . 3. That the plan for water facilities adequate for fire protection be approved by the water supplier and fire protection district. Said water plan must also have been approved by the appropriate health authorities. The health authorities, water supplier (purveyor), and fire protection district will certify, prior to the filing of the final plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. The purveyor will also certify prior to the filing of the final plat on a copy of said water plan that appropriate contractual arrangements have been made with the plat sponsor for construction of the water system, in accordance with the approved plan, and in accordance with a time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the plat. The contractual arrangements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The plat dedication will contain a statement to the effect that the public water system as approved by County and State Health authorities and the local fire district and purveyor will be installed within this plat, and the subdivider will provide for individual domestic water service as well as fire ~ protection to each lot prior to sale of each lot. 3 ' . e No. PE-1278-78 ' ZE-204-78 4. That a certificate of title be furnished the Planning Department prior to the filing of the final plat. , 5. That the preliminary plat be given conditional approval to February 1, 1980. 6. That a declaration of Non-Significance be issued, in accordance with Section 11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior to approval of this recommendation by the Board of County Commissioners, or that any approving action in accordance with SCEO 11.15.340. GENERAL INFORMATION A. Location The proposal is situated in the Trentwood area of the Spokane Valley. It is adjacent to and north of Trent Avenue and between Best and Adams Road. B. Proposal - 3.8 acres subdivided into S lots for Commercial and Multi Family use. - Multi Family: Lot 4 at slightly over 1 acre and a density of 22 dwelling units. - Commercial: Lots 1, 2, 3, with 9,960 sq. ft. Lot S with 2 acres. C. Relationship to the Comprehensive Plan The approved map of the Comprehensive Plan indicates commercial usage of this area, adjacent to Trent Avenue. D. Land Use Analysis: 1. Existing Land Uses The site is level with a portion of the parcel being used for residential and small commercial uses in the past. The immediate area has various types of land uses existing such as: mobile homes, multi family dwellings, commercial establishments, duplexes, single family residences and some larger parcels still used for pasture and farming pursuits. Directly north and adjacent to this proposal are 40,units of multi family ' dwellings in the East Valley Manor development. Further north, in the area between Trent and Wellesley Avenue, are several subdivisions with urban densities. East and west are the commercial uses along Trent and to the south is the industrial area that includes the Kaiser Aluminwn Plant. 2. Compatibility with Existing Land Uses The staff feels that the plat as proposed is a compatible use for the area. -86- . , STAFF ANALYSIS - January 26, 1979 TRENTWOOD ORCHARD REPLAT - continued II. SPECIAL INFORMATION A. Circulation The County Road Engineer has examined the proposed preliminary plat and finds that the circulation pattern is acceptable if additional dedication along Ellen Road is provided. B. Sewage Disposal The applicant's engineer has prepared an analysis of alternative sewage disposal means; including on-site septic tank disposal, sewage lagoon, and community package treatment plan disposal. For economic reasons, and to provide the most realistic alternative, the applicant's engineer feels on-site septic tanks should be utilized. The Spokane County Health District has authorized the use of individual on-site sewage systems for each lot within the plat. The District states that an on-site sewage management system shall be created and approved by their office prior to the signing of the final plat. The plat is situated over the Spokane Valley Aquifer and the Health District in their examination of the possible impact on groundwater quality from this proposal have the following comments: Impact Discussion a. The plat sponsor has proposed 5 lots on 3.8 acres; lot 4 that has a proposed density of 22 units. Each lot is to be served by a private water system and its individual on-site sewage disposal system. This raises the question of significance of the impact on the groundwater in the area and possible alternatives for sewage disposal. b. In the course of the conduct of the Army Corps study, Dr. Todd considered typical soils, natural and sewage disposal recharge to the groundwater, and the effect of continued urban development in the Spokane River Valley upon the quality of the groundwater. In summary, he coacluded that: 1. In normal precipitation years subsurface disposal of sewage treatment effluent does reach and recharge the groundwater. 2. All the dissolved salts in sewage effluent will be carried to the groundwater. However, bacteria and detergents (phosphate portion) are mostly removed by the deep soil layer above the groundwater and "minor dissolved constituents such as phosphates, which are. known to react with soil particles, or . nitrates, which are taken up by the plant roots," will be less than the total found in septic tank effluents. -8C- STAFF ANAI,YSIS - January 26, 1979 TRENTWOOD ORCHARU REPLAT - continued 3. The calculated results at the downstream end of groundwater flow line indicate that the roaximum range of (dissolved) solids concentration expected at presnet (1975) is up to 93 mg/1 (milligrams per liter) above the natural groundwater background of 155 mg/l. The forecast year 2020 maximum incremental concentration is 101 mg/1 above the natural background. - - - The analytical results of the forecast impact of year 2020 when compared with the present impact, both measured in terms of leachate volume and dissolved solids concentration, indicate that the present impact on groundwater quality is already a substantial proportion of the ultimate level. c. Currently, results of chemical analysis show the total nitrogen content of the groundwater as in the range of 3.0 to 5.3 ppm. A projected incremental increase using Dr. Todd's expected 8.6 percent would result in a range of 3.3 to 5.8 ppm. Current Federal and State drinking water standards permit up to 10 ppm. d. Alternative sewage disposal systems are not economically feasible for " this plat. 1. Collector and central treatment systems discharging to surface waters would require at least tertiary treatment and perhaps more to obtain a permit for the discharge from the Department of Ecology. These systems are not currently economically available for this project. 2. Sealed systems, whetber individual or community, depend on evaporation for liquid removal. These systems require more land area than a conventional subsurface drainfield. Some, such as lagoons, have safety hazards associated with them and relatively poor community acceptance. Land, installation and operational cost are generally more expensive than those for septic tanks and drainfields. C. Drainage The County Utilities Engineer reports that the preliminary storm drainage plan submitted by the applicant indicates that on-site storm drainage provisions will adequately handle surface water runoff. However, final construction ' plans should be reviewed and approved prior to the final plat filing. i D. Water Supply ~ ~ The proposal is located within the recorded service area of Trentwood , Irrigation District #3. - ~ ) The District advises the staff that adequate system capacity, and a desire on ~ their part to serve, exists for the provision of water for domestic, fire and ' irrigation uses. Fire Protection The proposal is situated within the recorded service area of Fire District #1. The Fire District staff requests that the Hearing Examiner Committee require mains and hydrants of sufficient size for fire protection as a condition of final plat approval. The District also requests that they be allowed to review and approve final construction plans. F. Schools Proposal lies within the boundaries of East Valley School District #361. G. Parks The report "Planning for Parks" (revised 1976) indicates several community parks planned in the area, particularly near the school sites adjacent to Wellesley Avenue. III. ZONING ANALYSIS Given the proposed use of the plat and adjacent commercial and multi family zoning the proposed zone changes appear both compatible and consistent with the area. The proposed multi family lot is near the maximum density of 2,000 sq. ft. of land area allowed within the multi family zone, which does compare with densities within the immediate area. IV. ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and has been reviewed by the Planning staff. No significant adverse environmental impacts were judged to exist. Slight adverse environmental impacts were identified on the checklist in the following categories: earth; air; water; flora; noise; light and glare; land use; population; housing; transportation/circulation; public services and utilities. The Planning Director issued a proposed Declaration of Non-Significance, and ~ it was circulated to other agencies of jurisdiction. V. CONDITIONS: If approval is granted, the following conditions are recommended. NOTE: Any amendments to said conditions are stated separately and listed hereafter 1. That the plat be designated as indicated on the preliminary plat of record and/or attached sheets as noted. 2.
