Gentlemen-
With regard to Resolution #71650, dated the llth day of November, 1971,
the County of Spokane published a resolution regarding University City's
expansion to the rear giving the outline of a site development plan for the
proposed additionai parking and development of this area (see copy of
resolution attachec) .
In conformance with the intent of this resolution, Ed James of James & Hicks,
Architects, and Orville Barnes, President of McCarthy Management Corporation,
are carrying to you our present concept of a partial development plan, which
partial development plan has become an emergency so far as University City is
concerned
For sometime now, we have been studying the problems with our disposal
system at University City and we find that our coin-op laundry is disposing of
Iiquids in such large amounts that the disposal plant is not working properly
AII of the advice that we can get from the experts that we have had over the past
months makes it certain that we must relocate the coin-op laundry.
We wish to do so immediately and request that this portion of the pian be handled
on an emergency basis and that approval be given at the earliest possible moment
Going through the winter with the coin-op in the center would needlessly burden
the sewage system, and we, at substantial financial loss, aretaking on this
development to avoid undue strain on the existing sewage piant

A. CONDITION
1 The east 159' of the advertf sed property shall be developed in sub-
stantial conformance vvith the revised site development plan, i e,
a single story retail building containing li, 000 square feet of retail
space as speciffed in Condrtion No 6 of Resolution 71-650, a paved
parking lot containing 22 parking stalls and a landscape strip
along University Road acceptable to the Director of Flanning A
specific landscape plan acceptable to the Director of Planning
shall be submitted for the landscaped areas along University Road
and Tlurd Avenue extended prior to applications for building permits
2 The subject property shall be lighted in a manner which will not
produce glare on ad)oining residential properties on University Road

On November 11, 1971, the Board of County Commissioners approved
Commercial Zoning for the advertised property subject to the submittal of
a site development plan. The applicants have submitted a development

B REASONS
1. The Planning Commission is of the opfnion that the approved site
development plan, conditions of approval, and conditions of
Resolution 71-650 will adequately protect nefghboring residenual
properties from many of the nuisance factors normally associated
with the allowed commercial uses The approved plan also assures
proper controls along University Road

Although the pedestrian crossings under the raflroad track are not indicated
in this phase, the Commission notes that the conditions of Resolution
No . 71-650 would apply to future stages whfch would require additional

we can not show the balance of this because the approvalf+Dr the under-
passes has not yet been received from the Milwaukee Railroad and until
this is received, it is impossible to define further building locations
2 A drawing which shows in detail, the area which would be developed
immediately

University City, Inc, is willing to enter into an agreement with the County
of Spokane wherein if the property designated as "Phase 1" on the enclosed
drawing is zoned "commercial" (this same property was entitled "Contingency
1" on the original application for zoning, dated September 1, 1971 - legal
description attached hereto), that it will observe the following development
plan and development restriction.

1. Of the approximately 216,000 sq ft involved (roughly 5 acres),
gross leaseable area of new construction sha I I be conf ined to no more than
30,000 sq, ft of single-story construction (a parking ratio of V-1) thus
assuring that the area will be primarily used for parking to support University
City proper.
2. Uses permitted in the arrea shall be confined to office buildings,
retaiyservices, such as, barber shops, beauty parlors, health services, self-
service laundry, theatre and other entertainment facil ities, business or trade
schools, financial institutions; automoti~e services; fire station, and other
public facilities. Uses specifically not permitted among the classifications permitted above would
be beer taverns, drive-in type restaurants, outdoor theatre, automobile sales,
trailer sales and trailer courts.

3. Planting and fencing to suit County standards will be constructed
on the southerly property line to provide permanent buffer to multiple residence
property to the south.

DRAFT OF CONDITIONS TO BE MADE A PART OF RESOLUTION
ESTABLISHING COMMERCIA.L ZONE, ZE-90-71, (E. D. MC CARTHY)
Prior to construction upon or use of the hereinabove -de scribed property for
parking or other purpose s allowed within the Commercial Zone, the owner thereof
shall submit for approval by the Board of County Commissioners after public heanng
and recommendation thereon by the Spokane County Planning Commission, a szte
developmenfi plan of the subject property. Construction upon or use of the property
xs not authonzed until said site development plan shall have been approved by the
Board of County Commissioners.
Such site development plan shall provide for the following•
1) Dedication, paving and curbing to County standards of a pubhc road on
the South 50 feet of the hereinabove -de scribed property. Acce s s to
University Road from the property shall be otherwise prohibited.
2) Construction of at least one pedestnan undercrossing of the adjoimng
rai.lroad tracks and installation of fencing along the railroad right of way
line for the entire length of the property adequate to prevent pedestnan
crossing of the railroad tracks.
3) Paving and development of an off-street parking lot to seYVe the
commercial properties known as Uruversity City and any establishments
that may be developed upon the subject property.
4) Such landscaping and screening of the subject property as may be
required by the Board of County Commissioners to provide protecta.on to
the properties to the south and east. The Plan shall also provide that
any lighting of the parking area shall be shielded and directed inward
so a s not to produce a glare upon adjoining propertie s.
5) Signs proposed to identify the parking facility or commercial establish-
ments upon the property. Such signs sha11 be located and designed with
full consideration to the properties to the south and east. No free-
standYng sign shall be established at a he3ght exceeding twenty feet.
6) At the owners' option the site development plan may also provide for
construction and use of up to 30, 000 square feet of one story commercial

A. Reasons
1. The Comprehensive Plan provides for commercial uses between

of the advertised area. Testimony by the applicant at the hearing
indicated that the theater and tavern-restaurant proposal in
conjunctYOn with development of off-street parking facilita.es (see
subrrutted development plan) exemplified only pos sible typical
ufiilization of the commercial area. The Commzssion noted that the
development proposal did not contain the guarantees which would be
reqtured in the Planned Unit development section of the Ordinance
(See Section 4.20 - Planned Urut Development). The Commission
contends that such a development, because of its impact on the
residenfi,ial neighborhood to the south and its contemplated relation-
ship with the shopping center to the north of the tracks, should be
reviewed as a Planned Unit Development.
4. The Planning Commission is of the opiruon that the advertised area
could be developed to provide parking for the shopping center to the
north withun the provisions of the Conditional Use section of the
Ordi.nance wlv.ch provzdes for development of off-street parking
faci,lities in accordance with Section 4.24.310. Such approval would
a11ow additional parking for the shopping center without introducing
general commercial uses between the raalroad tracks and Fourth Avenue.

1. The County Engineer's Office indicated to the Comrrussion that in order to
accomplish the traffic flow obJectives of the submztted development plan,
the underpas s would have to be built to the specifications and in full
cooperation with the railroad, Minimum grade for the underpas s was
recommended at 6%. Such a grade wou].d involve redesign and realignment
of the indicated roadways and ramps Ieading to the underpass. There
would be considerable difficulty in bnnging the underpass roadway back
to grade within the parkzng area both north and south of the tracks. A
pump station would be required to prevent flooding of the proposed
structure.
The Engxneer's Office also indicated that construction of the pedestrian
underpasses would not present an unusual engineenng problem although
the Mzlwaukee Road would have to approve such construction.

We have not yet received the minutes of the Commission's meeting
(the decision was made after our appearance), so we do not know
precisely the reason for turning down the petition, however, this zoning
is so important to us that we want to take no chances on having an
appeal before the County Commissioners.
We, therefore, respectfully request that we do receive an appeai hearing
before the County Commissioners and request as early a notice as
poss b le as to the date thereof.
