that call for development "Fill-a.n," city-like aesthetic setting, and
densi.ty of ownerships that range from 17 resideJitial units per acrP to
one residential unit per acre. The Comprehensive Plan is the guide for
a]_1 physical development of Spokane County's unincorporated lands.
d. is located within the Priority Sewer Service Area of the County Wastewater
Management Plan, which also has "Fill-in" development policies that
address physical development.

purveyor harmless from claims by any lot purchaser refused a building
permit due to the failure of the plat sponsor to satisfactorily complete the
approved water system.

a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.

accomplished by the project applicant within thirty (30) days of formal
action by the Hearing Examiner Committee, with regard to the preliminary
plat approval; as instructed by the Planning Department staff.
17. That upon filing of the final plat, the zoning be reclassified on Lot 2 to
Multiple Family Suburban.
18. That the project sponsor is responsible for requesting an extension of time
to review any preliminary plat approval. All extensions applied for may
subject the project sponsor to new conditions required by Reviewing
Agencies. 19. That the Hearing Examiner Committee sustain the issuance of a proposed

a Purpos : The purpose of the landscaping provision is:
1. To break up the visual effect created by large expanses of barren asphalt;
2. To encourage the preservation of rrtature trees which presently graw #hroughout the
County; and
3. Tv ensure the preservativn af land values by crealing an environmental quality
which connplements the objectives of the respec#ive land uses.

until a landscaping plan has been submitted and approved by #he Department.
c. LandscaRina o street frontgge: lJnless athenwise stated herein, a parking area or
outdoor display area fronfing on a stfeet right-of-way shall pravide a Iandscaped
planting area vf Type IV landscaping (P$r Sectiorr 5.06.060 of the Spokane County
Zaning Code) of at least three (3) feet in width a[ong the entire street frontage excapt
for drivev►rays, provided #hat the pEantings shall nv# abstruct the s3ght distance at street
kntersec#ions or driveway approaches.
d Additional planfinga: Add+tional p6antEngs may be placed in street right-of-way behind
the sidewaEk fine if the praper#y ❑wner provides the County Engineer writh a written
release of fiability #ar damages which may be incurred ta the planting area frorn any
public use of right-o#-way.
e. :At least ten percent (1 0°lo) of the parking area shall be devoted to
landscaping (exclusive of landscaping required by {d} abave within the public right-of-
way), provided that:
1. IVo landscaping area shal[ be Iess than thirty-twa (32) square feet in area;
2. No parkFng s#all shall be [ocated rnore than sixty (60) feet frarn a landscaped area.
The Departmen# may approve landscaping plans invalving alternatives to
this specificatiorr far individual properties if it finds the alternative would be more
ef#ective in meeting the purpvses of this sectian;
3. All landscaping rnust be lacated between parking stalls, at the end of parking
. columns, or be#vxreen stalfs and the property line. No landscaping which occurs
between the parking Iot and a building or recreatian area shall be considered as
satisfaction af these requirements; and
4. All required landscaping shall meet the "clear vMew triangle" requirernents pursuan#
lo Sectiof9 4.17.040.

hundred twenty {120}-day delay when planting season conflicts vwrould produce high

regulations of the Spokane County Health District and is furfiher

of permits by the Health District.
7. The owner, his heirs or successors shall join and participate in any
petition or resolution which purpose is the formation of a utility local
improvement district (ULID) pursuant to RCW, Chapter 36.94, as
amended. The owner, his heirs and successors shall further agree
not to oppose or protest any legal assessments for any utility local
improvement district (ULID) established pursuant to RCW Chaptffr
36 . 94, as amended.

PRELIMINARY SUBDIVISION AND ZONE RECLASSIFICATION - EXTENSION OF TIME
I. GENERAL INFORMATION
A. History The preliminary plat received approval from the Hearing Examiner Committee on
September 27, 1979. The sponsor indicates the plat is ready to file, however,
Washington Water Power has to move poles before road improvements can be done.
This cannot be accomplished before October 1, 1981. Therefore the sponsor is
requesting a Time Extension. ,
B. Location
The proposal is located in the Spokane Valley between Fourth and Eighth
Avneues, approximately 300 feet west of Felts Road.
C. Proposal
- 8.6 acres subdivided into 2 lots, Lot number one for single family use and lot
number two for multiple family use. Lot #1 has an existing single family
dwelling, lot 2 is proposed for 26 two bedroom town houses on approximately
2.48 acres. Building coverage would equal approxzmately 23% while the
remaining 77% would be for yard areas, sidewalks, roadways and driveways.
II. SPECIAI, INFORMATION
A. Circulation
The County Road Engineer has not recommended any new conditions. Only those
conditions already attached to the preliminary plat of record.
B. SewaRe Disposal
The sponsor has proposed individual on-site sewage disposal systems which have
been authorized by the Health District. The Health District has also
requested that changes and additions be made to the Findings and Order of the
Hearing Examiner Committee Dated September 27, 1979 as indicated in this Staff
Analysis.
C. Drainage
The County Engineer reports that the final construction plans must be reviewed
and approved prior to the filing of the final plat.
D. Water Supply
The south half of the proposal is located within the recorded service area of
Washington Water Power Company. The aorth half of the proposal lies within
the recorded service area of Modern Electric Water Company.

provement district (ULID) pursuant to RCW, Chapter 36.94, as amended. The

PRELIMINARY SUBDTVISION AND ZONE RECLASSIFICATION
I. GENERAL INFORMATION
A. Location
The proposal is located in the Spokane Valley between Fourth and Eighth
Avenues approximately 430 feet west of Felts Road.
B. Proposal '
- 8.6 acres subdivided into 2 lots, lot aumber one for single family use and lot ~
number two for multiple family use
- Lot #1 has an existing single family dwelling, Lot 2 is proposed for 26 two ~
bedroom townhouses on approximately 2.48 acres. Building coverage would equal '
approximately 23% while the remaining 77% would be yard areas, sidewalks, '
roadways and driveways.
C. Relationship to the Comprehensive Plan
The approved map of the Comprehensive Plan indicates residential usage of this
area, as well as all nearby surrounding lands, with no density designation.
D. Land Use Analysis:
1. Existing Land Uses
The site is currentlp occupied with one single family residence. The balance
of the property is undeveloped or vacant. Adjacent and north of the proposal
are single family uses on a variety of lot sizes varying from approximately
10,000 sq. ft. to 2 acres. Further north approximately k mile are commercial
uses associated with Sprague Avenue such as University City. To the east of
the proposal are vacant parcels of land with scattered single family
residential and duplex uses on a variety of lot sizes from approximately
10,000 sq. ft. to 2 acre lots. Further east are a variety of land uses
including a stable and corral, the University Manor Nursing Home, and a
12-unit apartment house. To the south of the proposal is largely single
family residences. University High School is located approximately 450 feet
directly south of the proposal. East of the high school is a nursing home and
to the south there are seven, 6-unit apartment houses. To the west and
adjacent to the site is largely vacant undeveloped land with single family
residences along 4th Avenue and duplex use and single family along 8th Avenue.
Further west are single family uses, pasture, mobile homes, The University
Mobile Home Park, and along Dishman Mica Road various commercial uses.
2. Compatibility with Existing Land Uses
The proposed multiple family housing units or towahouses would be coasistent
with multiple family land uses found in the area and would appear to be
compatible with surrounding Iand use.

B. SewaRe Disposal
The applicant's engineer has prepared an analysis of alternative sewage dis-
posal means; including on-site septic tank disposal, treatment plant and
sewage lagoon. For economic reasons, and to provide the most realistic
alternative, the applicant's engineer feels a community drainfield system with
individual septic tanks should be utilized.
The Spokaae County Health District has authorized the use of individual ~
on-site sewage systems for each lot within the plat. The District states that
an on-site sewage management system should be created and approved by their
office prior to the signing of the final plat. The plat is situated over the
Spokane Valley Aquifer and the Health District in their examination of the
possible impact on groundwater quality from this proposal have the following

Impact Discussion
a. The plat sponsor has proposed 2 lots on 8.6 acres. Each lot is to be
served by a public water system and its individual oa-site sewage
disposal system. This raises the question of significance of the impact
on the groundwater in the area and possible alternatives for sewage
disposal.
b. In the course af the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In summary, he concluded that:
1. In normal precipitation years subsurface disposal of sewage
. treatment effluent does reach and recharge the groundwater.
2. All the dissolved salts in sewage effluent will be carried to
the groundwater. However, bacteria and detergents
(phosphate portion) are mostly removed by the deep soil layer
above the groundwater and "minor dissolved constituents such as
phosphates, which are known to react with soil particles, or
nitrates, which are taken up by the plant roots," will be less
than the total found in septic tank effluents.
3. The calculated results at the downstream end of groundwater
flow line indicate that the maxzmum range of (dissolved) solids
concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater background
of 155 mg/-1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background.

- - - The analytical results of the forecast impact of year
2020 whea compared with the present impact, both measnred in
terms of leachate volume and dissolved solids concentration,
indicate that the present impact on groundwater qualitq is
already a substantial proportion of the ultimate level.
c. Currently, results of chemical analysis show the total nitrogen content
of the groundwater as in the range of 1.23 to 4.8 ppm. A projected
incremental increase using Dr. Todd's expected 8.6 percent would result
in a range of 1.39 to 5.21 ppm. Current Federal and State drinking water
standards permit up to 10 ppm.
d. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics:
1. Collector and central treatment systems discharging to surface
waters would require at least tertiary treatment and perhaps more to
obtain a permit for the discharge from the Department of Ecology.
These systems are not currently economically available for this
project.
2. Sealed systems, whether individual or community, depend on
evaporation for liquid removal. These systems require more land
area than a conventional subsurface drainfield. Some, such as
lagoons, have safety hazards associated with them and relatively
poor community acceptance. Land, installation and operational cost
are generally more expensive than those for septic tanks and
drainfields.
C. Drainage
The County Engineer reports that the preliminary storm drainage plan submitted
by the applicant indicates that on-site storm drainage provisions will
adequately handle surface water runoff. However, final construction plans
should be reviewed and approved by both the County Engineer and Health
District prior to the final plat filing.
D. Water Supply
The south half of the proposal is located within the recorded service area of
Washington Water Power Company. The north half of the property is located
within recorded service area of Modern Electric Water Company.
The District advises the staff that adequate system capacity, and a desire on
their part to serve, exists for the provision of water for domestic, fire and
irrigation uses.
E. Fire Protectioa
The proposal is situated within the recorded service area of Fire District #1.
The Fire District staff requests that the Hearing Examiner Committee require
mains and hydrants of suf£icient size for fire protection as a condition of
final plat approval. The District also requests that they be allowed to
review and approve final fire flows and water plans.

Proposal lies within the boundaries of Central Valley School District #356. _
G. Parks
The report "Planning for Parks" (revised 1976) indicates that the neighborhood
has ultimately a need for an elementary school and neighborhood park of 10.0
and 6.0 acres respectively in the area of the proposal.
H. Unique Environmental Features
None have been indentified.
I. Cultural Resources
None have been indentified.
III. ZONING ANAZYSIS
The site is currentlp zoned Agricultural except for a strip of land approximately
150 feet deep along Fourth Avenue on the northern boundary of the site. The
sponsor is requesting that Lot 2 of this proposal be rezoned from Agricultural to
Multiple Family Suburban. There are several recent Multiple Family Suburban zone
changes to the west of this proposal; Zoning Reselution #77-1327, 77-1328 aad
75-418 which is 30 feet west of the proposal, in addition is Residential Mobile
Home, and Agricultural Suburban zoning in this area. To the north of the proposal
is Agricultural Suburban zoning and Commercial zoning along Sprague. To the east
of the site is Agricultural zoning, Agricultural Suburban, Multiple Family
Suburban, and Single Family Residential. South of the proposal is predominately
Agricultural Suburban zoning with one area south of the University High School that
has Multiple Family Suburban zoning. There is also Single Family Residential and
Two Family Residential within the Sherwood Forest Plat to the southwest. Given the
plat proposal and land use, the land would be most appropriately zoned Multiple
Family Suburban. Given recent trends to zone Multiple Family Suburban in the
immediate vicinity, the proposal would appear to be consistent with these rezones
and does comply with the requirements of the Zoning Ordinance.
IV. ENVIRONMENTAI, REVIEW
An Environmental Checklist was submitted by the sponsor and has been reviewed by
the Planning staff. No significant adverse environmental impacts were judged to
exist.
Slight adverse environmental impacts were identified oa the checklist in the
following categories: earth; air; water; flora; fauna; noise; light and glare;
land use; population; housing; transportation/circulation; public services;
utilities; and energy.
The Planning Director issued a proposed Declaration of Non-Significance, and it was
circulated to other agencies of jurisdiction.

V. CONDITIONS:
If approval is granted, the following conditions are recommended.
1. That the plat be designated as indicated on the preliminary plat of record
and/or attached sheets as noted.
2. That appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planning Department and the utility
companies. Written approval of the easements by the utility company must be
received prior to the submittal of the final plat.
3. That the plan for water facilities adequate for fire protection be approved by
the water supplier and fire protection district. Said water plan must also
have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in conformance with their requirements and will adequatelp
satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.
The purveyor will also certify prior to the filing of the final plat on a copy
of said water plan that appropriate contractual arrangements have been made
with the plat sponsor for construction of the water system, in accordance with
the approved plan, and in accordance with a time schedule. The time scheduie
will provide, in any case, for completion of the water system and inspection
by the appropriate health authorities prior to application for building
permits within the plat. The contractual arrangements will include a
provision holding Spokane County and the purveyor harmless from claims by any
lot purchaser refused a building permit due to the failure of the plat sponsor
to satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities and the local
fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
4. That a certificate of title be furnished the Planning Department prior to the
filing of the final plat.
5. That the preliminary plat be given conditional approval to October 1, 1980.
6. That a declaration of Noa-Significance be issued, in accordance with
Sectioa 11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior
to approval, or any approving action in accordance with SCEO 11.15.340.
NOTE: The official file contains an environmental checklist for the
proposal and a staff review of their checklist as required by
WAC 197-10-320.
7. That conditional approval of the plat is given subject to the dedication of
right of way to the public and approval of the road system in the plat by the
County Engineer.

8. That plans, profiles, and cross sections showing proposed street centerline
and curb grades be submitted to the County Engineer for approval prior to
construction and the filing of a final plat. ;

drainage facilities be submitted to the County Engineer for approval prior to ~

10. Construction within the proposed public streets and easements shall be `
performed under the direct supervision of a licensed land surveyor, who shall

13. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor and the Planning staff.
14. That each lot be authorized for the use of individual on-site sewage disposal
systems.
15. Prior to filing of the final plat, the sponsor shall present evidence that the
plat lies within the recorded service area of the proposed water district.
Special Conditions
16. That the provisions of SEPA'S NOTICE OF ACTION pursuant to 43.21C.080 RCW and
the Board of County Commissioner's Resolution No. 77-1392 be accomplished by
the project applicant within thirty (30) days of formal action by the Hearing
Examiner Cotnmittee, with regard to the preliminary plat approval; as
instructed by the Planning Department staff.
17. That upon filing of the fiaal plat, the zoning be reclassified on Lot 2 to
Multiple Family Suburban.
18. That the project sponsor is responsible for requesting an extensioa of time to
review any preliminary plat approval. All extensions applied far may subject
the project sponsor to new conditions required by Reviewing Agencies.
19. That the Hearing Examiner Committee sustain the issuance of a proposed
Declaration of Non-Significance and recommends issuance of a final Declaration
of Non-Significance.

20. That a public water system serviced by Washington Water Power, and including
fire flows, serve each lot prior to the sale of the lot.
21. That final construction plans for on-site storm drainage facilities be
reviewed and approved prior to filing of the final plat by the County
Utilities Engineer and the County Health District.
22. That the plat dedication contain the statement: "Use of private we11s and
water systems is prohibited.
23. That all public roads within the plat be curbed and paved to the specifi-
cations of the County Engineer. Existing County roads providing direct access
to lots of the plat shall be paved and curbed to the standards of the County
Engineer.
24. An on-site management system shall be created and approved by Spokane County '
Health District or final plat dedication shall obligate all owners, heirs and ~
assigns to agree to manage the on-site wastewater systems according to the
terms and conditions specified by Spokane County Health District within each
application for a sewage permit. Sponsor shall conclude prior to final plat '
that any existing single family wastewater system, which is to remain in use
shall be identified and located 10 feet interior of the new property boundary.
Prior to final plat, sponsor shall certify in writing, that there are no
private or public water systems within 150 feet of the plat boundaries.
25. That a landscape plan and bond must be submitted before building permits are
issued. The landscape plan shall include fencing (cyclone fencing not to
exceed 5 feet in height) to buffer adjacent residential uses to the east and
west of the plat.
26. That storage yard as designated on the site development plan shall be approved
by the Zoning Administrator as to access, use, type, fencing and surfacing as
required.
27. That sign plan must be approved by Zoning Administrator.
28. That lighting plan shall be submitted and approved by Zoning Administrator
prior to issuance of building permits indicating that lighting from any
exterior lighting fixture shall not extend over the property boundaries.

2. Topography, soils and water:
a. This project lies in a rel.atively flat area between 4th and 8th Streets
and 330' west of Felts Road. Local drainage ways ate insigaificant.
It is located over the Spokane Valley Aquifer. b. 'Surface soila are classed as Marble Sandy loam and Garrison gravelly lAam
with 0 to SX slopes. They have a septic tank filter field limitztion of
slight with possible contamination of groundwater.
c. Geologically the soils are glaciofluvial deposits; stream-laid saad and
gravel; contains some bonlders in places; includes some undiffereatiated
glacial deposits. The lower terrace remnants have probably been reworked
by streams. These geologic stsuetures yield moderate to very large
amounts of water.

an on-site management system shall be created and approved by Spokane

Location, Topography, Soi I and Wafier
This project lies in the Spokane Volley between 4th and 8th Avenues,
330 feet west of Felts Rood in the NE 1/4 of Secfiion 20, Township
25 North, Range 44 East, W. M., Spokane County, Wash i ngton . The
Iond consists of two plat areas, one fronting on 4th, the other on 8th,
with a steep (25% 44 foot slope between them. ($ee accompany-
ing prel iminary plot map) The wi I on the lower orea fronting on
4th is classified by the Soil Conservation Service as Garrison Grovelly
Loam (GgA) and the upper atea fronti ng on 8th i s c lassi f i ed as
Marble Sandy Loam (McB). The water service to the area is provided
by Wcashington Water Power Co, and Modern Irrigation District,
Scope of Proj ect
This proposal involves the subdivision of 8.54 ocre$ into 2 lots. (6.06
acres vnd 2,48 ocres.) Lot 1 will continue in its present use. Loi'
2 is proposed for mulFi-fctmily zoning. Twenty-six single family
condominiums, in six buildings, will be constructed on the 2.48 acre
lot.
Sewerage Alternatives
Following is o brief anolysis of three alternative meons of sewage
disposal for the project.
Individua) on-site sewage disposcl systems (septic tank-drainfield)
This type of sewage disposol would involve the installotion of 26
individual septic tank-drainfield systems. The per unit cost of this
system, based on: (1) a 50 year life; (2) drainfield replacement
after 25 yeors; (3) pumping septic tanks at 4 year intervals and
(4) i nspection at 2 yeQr i nterva ls, i s esti moted to be $6, OQO/Iot.
This includes all installation and maintenance costs for the 50 yeor
period at today's dollar volue.

The positive aspects of this type of sewage treatment for fihis project
are: (1) low initial installvtion cost; (2) dispersal oF sewoge
treatment effluent over a wide-spread area. In our opinion, the
donger of ground wafier pollution is increased, in this type of
aravelly soil condition, by methods which concentrate effluent dis-
ch-arge; (3) relatively low mainfienance cost and low rate of failure.
The negati ve aspects of th i s fiype of sewage treofimenfi for th i s proj ect
are: (1) individual sewage treatment systems are space consuming and
thus not general ly compatible with multi-fami ly bui Idings; (2) concb-
minium maintenonce agreements are more eosily effected by use of
consolidated septic tcank-drainfield systems.
Community drainfield system with individual septic tanks
This type of system would involve the installation of 6 septic tonks
(one for each building). Sewc,ge effluent would be piped from each
tdnk through collector systems to six drainfield sites. The per unit
cost of this sytem based on: (1) a 50 yeor life; (2) drainfield
replacemenfi ofter 25 yeors; (3) pumping septic fianks at 2 yeor intervals
and (4) inspection at 1 year intervals, is estimated to be $S,OOO/Iot.

at least tertiary treatment. These sysfiems are not economicolly feasible
for projects of this size. Lagoons und other types of sealed sysfiems
depend on evaporation for liquid removal. Individua) systems of the
teoled type haven't yet proved workable in this climate. Larger ones
such as lagoons have poor community occeptance and unrealistic land
area requirements for smaller subdivisions such as this.
Conclusions and Recommendations Economic, governmental, and community acceptonce considerotions limit
th e cho i ce of sewage trea tment systems to the th ree eva I uoted by th i s
study. Economic analysis of the three considered systems favors the
community drainfield method. Thus, we recommend that the community
, drdinfield method as described herein be allowed for this proposal.

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Examiner Committee on September 26, 1980,
and the members of the Committee present being Ted McCoury Chairperson,
John Culler and Kenneth Kennedy.
B. PROPOSAL
The sponsor, Dwight Hume, is requesting approval of an Extension of Time and
Zone Change, PE-1328-79 Esl.her's Addition and ZE-191-79, Agricultural to
Multiple Family Suburban for subdivision of 8.6 acres into 2 lots for Multiple
family dwellings (townhouses) and there being present, the following applicant
or representative:

C. FINDINGS OF FACT
1. That the provisions of RCW 43.21C (The State Environmental Policy Act)
, have been compl ied with.
2. That the proper legal requirements For advertisement of the Agenda Item
have been fulfi I led .
3. That the owners of adjacent lands expressed neither approval nor dis-
approval of the proposed Extension of Time.

D. SPECIAL CONDITIONS OR CONTIGENCIES APPLICABLE TO THIS EXTENSION OF TIME APPROVAL:
PLANNING DEPARTMENT
1. Those conditions already attached to the preliminary plat of record.
_ 2. That the project sponsor is responsible for requesting a time
extension to review any preliminary plat approval. All extiensions
applied for may subject the project sponsor to new conditions
required by Reviewing Agencies.
3. That a time extension be granted to October 1, 1981.

6. Pursuant to Board of Counly Comrnissioners Resolution No. 80-418,
the use of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance,*, with all rules and
regulations of the Spokane County Health District and is further
conditioned and subject to specific application approval and issuance
of permits by the Health District.

7. The owner, his heirs or successors shall join and participate in any
petition or resolution which purpose is the formation of a utility local
improvement district (ULID) pursuant to RCW, Chapter 36.94, as
amended. The o4vner, his heirs and successors shall further agree
not to oppose or protest any legal assessments for any utility local
improvement district (ULID) established pursuant to RCbU Chapter
36 . 94, as amended.
. Any water service for this praject shall be provided in accor-dance
with the coordinated water system plan for Spokane County.
E. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds
that the application of PE-1328-79, Esther's Addition for an Extension of
Time, and ZE-191-79, Agricultural to Multiple Family Suburban a and Zone
Change as described in the application should be approved.
