Recommendations are as circled.
(1) Pursuant to the Board of County Commissioners Resolution No. 80-0418, the
use of on-site sewer disposal systems is hereby authorized. This authoriza-
tion is conditioned on compliance with all rules and regulations of the
Spokane County Health District and is further conditioned and subject to
specific application approval and issuance of permits by the Health District.
(2) The owner, his heirs or successors shall join and participate in any peti-
tion or resolution which purpose is the formation of a utility local im-
provement district (ULID) pursuant to RCW Chapter 36.94, as amended. The
owner, his heirs and successors shall further agree not to oppose or pro-
test any legal assessments for any utility local improvement district (ULID)
established pursuant to RCW Chapter 36.94, as amended.
(3) Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County.
(4) There are no recommendations concerning the method of sewage disposal as the
project is outside of the 201 sewer study area.
(5) Water service as approved by the Spokane County Health District and/or the
Washington State Department of Social and Nealth Services.
(6) Each dwelling unit shall be double plumbed for connection to future area-
wide collection systems.
(7) A dry sewer connection to the future North Spokane Sewerage System is to be
constructed. Plans and specifications for the dry sewer connection are to
be reviewed and approved by the Utilities Department prior to construction.
(8) Located within the Critical Water Supply Service Area but not within any
purveyor's district. May be serviced by an individual well owned and oper-
ated by lot owner.

PRELIMINARY SUBDIVISION AND ZONE RECLASSIFICATION - EXTENSION OF TIME
I. GENERAL INFORMATION
A. History
The.preliminary plat was approved in September 1979; one previous Time
Egtension has been granted. The sponsor indicates no work has been done to
complete the project due to economic conditions and he is therefore requesting
a Time Extension until October 1, 1982.
B. Location
In, the Spokane Valley generally east of the intersection of 9th Avenue and
Evergreen Road.
C. Proposal
" - 4.7 acres subdivided into 14 lots for single family use
- Lot frontage = 90 feet
- Lot sizes = 12,300 sq. ft.
II. SPECIAL INFORMATION
A. Circulation
The County Road Engineer has not recommended any new conditions, only those
conditions already attached to the preliminary plat of record, but have
indicated this project is subject to the provisions and fee scheduling of the
Engineer's Department as adopted by the Spokane Board of County Commissioners
on December 22, 1980 as amended.
B. Sewage Disposal
The sponsor has proposed individual on-site sewage disposal systems which have
been authorized by the Health.District. The Utilities Department has
recommended that each dwelling unit be double plumbed for connection to future
area-wide collection systems and has authorized the interim use of on-site
sewer disposal systems.
C. Drainage
The County Engineer reports that the final construction plans must be reviewed
and approved prior to the filing of the final plat.
D. Water Supp-1-Y
The proposal is located within the recorded service area of Vera Water and
Power Co.

III. CONDITIONS:
If approval is granted, the following conditions are recommended.

2. That the project sponsor is responsible for requesting a time extension to

approval and issuance of permits by the Health District.
2. The owner, his heirs and successors shall join and participate in any petition
or resolution which purpose is the formation of a utility local improvement
district (ULID) pursuant to RCW Chapter 36.94, as amended. The owaer, his
heirs and successors shall further agree not to oppose or protest any legal

purveyor's district. May be serviced by an individual well owned and oper-
ated by lot owner.

the obligations set forth in thi-s contract, a Secondary Contractor
will be utilized.
l. The Prime Contractor agrees to serve in Pend
Oreille, Spokane and Stevens Counties, under the direct super-
vision of the Operating CommiLtee designated by the Trail
Groomir.g Advisory Committee. The Prime Contractor agrees to so
serve, and to perform the duties and carry out the functions enum-
erated below, as an independent contract-or, and not as an employee
of the Commission. A 48 hour notice of the intent to terminate
this contrac} must be given by the party initiating the termination.
It is understood that no employer-employee relationship will arise
as a result oi the execution of this contract. rTo withholding for
social security or federal income tax will be made by Lhe Commission
and no -retirement benefits will be provided by the Commission.
Wasnington State Industrial Insurance will be provided.
2. The Prime Contractor will be compensated for t::e
services to be rendered under this agreement as follows:

Compensation for per diem will not exceed $15 per day, and used
solely for overnight lodging. Payment for such services is
conditioned upon the satisfactory performance of the below enu-
merated duties.
3. In serving as the Prime Contractor for the Snowmobile
Program, the Prime Contractor will be involved in the promotion of
a trail grooming and maintenance program. The Prime Contractor
agrees to perform, but not be limited to, the following functions:
(a) Must perform servicing and maintenance work on
equipment.
(b) Operate a trail groomer provided by the state in c le aring and leve ling trai ls .
(c) Load and unload unit.
(d) Grease, oil, service and make minor repairs to
equipment.
(e) Maintain records of equipment use, gasoline and
oil consumption.
(f) Maintain liaison with appropriate governmental
agencies, public organizations and associations in matters re-
lating to the trail grooming programs.
(g) Will furnish to the Trail Grooming Advisory
ComQnittee, a daily log of operations, indicating equipment used
and hours/minutes used per day.
4. The Prime Contractor agrees to hold the Trail
Grooming Advisory Committee and the Commission harmless from any
liability for damages, either to himself or to others, arising out
of his conduct in the performance of the provisions of this
agreement.

The prelimiaary plat and zone change were approved by the Hearing Examiner
Committee on September 27, 1979 with conditions concerning removal of existing
buildings and no access to Evergreen Road. The sponsor indicates no further
work toward finalization has been attempted due to the economic conditions.

In the Spokane Valley generally east of the intersection of 9th Avenue and
Evergreen Road. ~

FINDINGS AND ORDER
A. I NTRODUCTION
This matter having come before the Examiner Committee on September 27, 1979,
and the members of the Committee present being Eldon Thomas, Chairperson,
Jane Myers, and Paul Sceva, Jr.
B. PROPOSAL
The sponsor, Gordon W. Curry, is requesting approval of a preliminary plat
and zone change, PE-1325-79, Evergreen South and ZE-183-79, Agricultural to
R-1 for subdivision of 4.7 acres into 14 lots for single family dwellings and
there being present, the following applicant or representative:

C. FINDINGS OF FACT
1. That the existing land use in the area is vacant with existing house and
barn.
2. That the Comprehensive Plan designates this area as residential usage.
3. That the existing zoning of the property described in the application is
Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.

6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
7. That the proposed use is compatible with existing uses in the area.
8. The Hearing Examiner Committee finds the proposed use is not detrimental
to the general purpose or otherwise harmfull to the public health, safety,
and welfare.
9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
D. SPECIAL CONDITIONS OR CONTIGENCIES APPLICABLE TO THIS
SUBDIVISION APPROVAL:
1. That the plat be designated as indicated on the preliminary plat of record
and/or attached sheets as noted.
2. That a statement be placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shall any lot be
further subdivided for the purposes of creating additional lots or building
sites without filing a replat.
3. That appropriate provision be made that the following described property
be held in trust until the continuation of the streets be dedicated or
deeded: A I' strip at the ends or edges of all streets that terminate or
border the plat boundary. (Temporary cul de sacs are required when
streets terminate at the plat boundaries. )
4. That appropriate street names be indicated.
5. That appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planning Department and the utility
companies. Written approval of the easements by the utility company must
be received prior to the submittal of the final plat.

6. That the plan for water facilities adequate for fire protection be approved
by the water supplier and fire protection district. Said water plan must
also have been approved by the appropriate health authorities. The heatth
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in conformance with their requirements and will adequately
satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.
The purveyor will also certify prior to the filing of the final plat on a
copy of said water plan that appropriate contractual arrangements have
been made with the plat sponsor for construction of the water system, in
accordance with the approved plan, and in accordance with a time
schedule. The time schedule will provide, in any case, for completion of
the water system and inspection by the appropriate health authorities prior
to application for building permits within the plat. The contractual
arrangements will include a provision holding Spokane County and the
purveyor harmless from claims by any lot purchaser refused a building
permit due to the failure of the plat sponsor to satisfactorily complete the
approved water system.
The plat dedication witl contain a statement to the effect that the public
water system as approved by County and State Health authorities and the
local fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
7. That a certificate of title be furnished the Planning Department prior to
the filing of the final plat.
8. That the preliminary plat be given conditional approval to October 1, 1980.

9. That a dqclaration of Non-Significance be issued, in accordance with
Section
11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior
to approval, or any approving action in accordance with SCEO 11.15.340.
NOTE: The official file contains an environmental checklist for the
proposal and a staff review of their checklist as required by
WAC 197-10-320.
10. That conditional approval of the plat is given subject to the dedication of
right of way to the public and approval of the road system in the plat 'by
the County Engineer.
11. That plans, profiles, and cross sections showing proposed street centerline
and curb grades be submitted to the County Engineer for approval prior
to construction and the filing of a final plat.
12. The drainage plans and design calculations showing the grades and
alignment of drainage facilities be submitted to the County Engineer for
approval prior to construction and the filing of a final plat.
13. Construction within fihe proposed public streets and easements shall be
performed under the direct supervision of a licensed land surveyor, who
shall be responsible for perpetuating all evidence of the location of survey
monuments which may be distrubed during construction and who shall
furnish the County Engineer with "As Built" plans and a certifiCate in
writing that all improvements were installed to the lines and grades shown
on the approved construction plans and that all disturbed monuments have
been replaced.
14. No construction work is to be performed with the Public Right of Way until
a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.

15. All construction within the Public Right of Way is to be completed prior to
filing the final plat or a bond in the amount estimated by the County
Engineer to cover the cost or construction of improvements, construction
certification, "As Built" plans, and monumenting the street centerlines,
shall be filed with the County Engineer.
16. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor and the Planning staff.
17. That each lot be authorized for the use of individual on-site sewage
disposal systems.
18. Prior to filing of the final plat, the sponsoh shall present evidence that
the plat lies within the recorded service area of the proposed water
district.
Special Conditions
19. That the provisions of SEPA'S NOTICE OF ACTION pursuant to 43.21C.080
RCW and the goard of County Commissioner's Resolution No. 77-1392 be
accomplished by the project applicant within thirty (30) days of formal
action by the Hearing Examiner Committee, with regard to the preliminary
ptat approval; as instructed by the Planning Department staff.
20. That upon filing of ' the final plat, the zoning be reclassified tp Singte
Fami ly Residential.
21. That the project sponsor is responsible for requesting an extension of time
to review any preliminary plat approval. All extensions applied for may
subject the project sponsor to new conditions required by Reviewing
Agencies.
22. That the Hearing Examiner Committee sustain the issuance of a proposed
Declaration of Non-Significance and recommends issuance of a final
Declaration of Non-Significance.

23. That a public water system serviced by Vera Water and Power, and
including fire flows, serve each lot prior to the sale of the lot.
24. That final construction plans for on-site storm drainage facilities be
reviewed and approved prior to filing of the final plat by the County
Utilities Engineer and the County Health District.

water systems is prohibited.
26. That the house, garage and barn on the property are to be removed as
indicated on the preliminary plat of record.

PRELIMINARY SUBDIVISION AND ZONE RECLASSIFICATION
1. GENERAI, INFORMATION A. Location
East and adjacent to the "T" intersection of 9th and Evergreen, approximately '
320 feet south of Eighth.
B. Proposal ~

- 4.7 acres subdivided into 14 lots for single family use ~
- Lot frontage = 90 feet - Lot size = 12,330 sq. ft.
C. Relationship to the Comprehensive Plan ~
The approved map of the Comprehensive Plan indicates residential usage of this
area, as well as all nearby surrounding lands, with no density designation. ~
D. Land Use Analysis:
1. Existing Land Uses The proposed site is currently vacant with a single family house and barn
located on the proposed Lots 1, 2, and 3. To the north of the proposal are
single family houses on a wide range of lot sizes with some areas for pastures
and farming activities. To the east of the proposal and directly adjacent is
Tally Ho Subdivision with lot sizes of approximately 10,900 sq. ft. To the
south of the project are scattered residential uses on vacant lots varying in
size from 5 acres to 13,520 sq. ft. West of the proposal is the Blake and
Hanson Subdivision with residential lots of approximately 11,200 sq. ft.
2. Compatibility with Existing Land Uses
The proposal is consistent with existing residential development found in the
area, and appears to be compatible with existing land uses.
II. SPECIAL INFORMATION
A. Circulation
The County Road Engineer has examined the proposed preliminary plat and has
recommended specific conditions to insure satisfactory developments of the
plat.

B. Sewage Disposal
The applicant's engineer has prepared an analysis of alternative sewage dis-
posal means; including on-site septic tank disposal, sewage treatment plant,
drainfield and sewage lagoon. For economic reasons, and to provide the most
realistic alternative, the applicant's engineer feels on-site septic tanks
should be utilized.
The Spokane County Health District has authorized the use of individual
on-site sewage systems for each lot within the plat. The plat is situated
over the Spokane Valley Aquifer and the Health District in their examination
of the possible impact on groundwater quality from this proposal have the '
following comments:
Impact Discussion
a. The plat sponsor has proposed 14 lots on 4.7 acres. Each lot is to be
served by a public water system and its individual on-site sewage
disposal system. This raises the question of significance of the impact on the groundwater in the area and possible alternatives for sewage
disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In summary, he concluded that:
1. In normal precipitation years subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
2. All the dissolved salts in sewage effluent will be carried to
the groundwater. However, bacteria and detergents
(phosphate portion) are mostly removed by the deep soil layer ~
above the groundwater and "minor dissolved constituents such as :
phosphates, which are known to react with soil particles, or
nitrates, which are taken up by the plant roots," will be less than the total found in septic tank effluents.
3. The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) solids
concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater background
of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background.
- - - The analytical results of the forecast impact of year
2020 when compared with the present impact, both measured in
terms of leachate volwne and dissolved solids concentration,
indicate that the present impact on groundwater quality is
already a substantial proportion of the ultimate Ievel.
c. Currently, results of chemical analysis show the total nitrogen content
of the groundwater as in the range of 1.21 to 2.9 ppm. A projected
incremental increase using Dr. Todd's expected 8.6 percent would result
in a range of 1.30 to 3.17 ppm. Current Federal and State drinking water
standards permit up to 10 ppm.

d. Alternative sewage disposal methods that would not recharge the ground-
_ water have the following general characteristics:
1. Collector and central treatment systems discharging to surface
waters would require at least tertiary treatment and perhaps more to
obtain a permit for the discharge from the Department of Ecology.
These systems are not currently economicaliy available for this
project.
2. Sealed systems, whether individual or community, depend on
evaporation for liquid removal. These systems require more land
area than a conventional subsurface drainfield. Some, such as
lagoons, have safety hazards associated with them and relatively
poor community acceptance. Land, installation and operational cost
are generally more expensive thaa those for septic tanks and ,
drainfields. ,
C. Drainage
The County Utilities Engineer reports that the preliminary storm drainage plan
submitted by the applicant indicates that on-site storm drainage provisions
. will adequately handle surface water runoff. However, final construction
plans should be reviewed and approved by both the County Engineer and Health
District prior to the final plat filing.
D. Water Supply
The proposal is located within the recorded service area of Vera Water and a
Power. `
The District advises the staff that adequate system capacity, and a desire on
their part to serve, exists for the provision of water for domestic, fire aad E
irrigation uses. ,
E. Fire Protection
The proposal is situated within the recorded service area of Fire District #1.
The Fire District staff requests that the Hearing Examiner Committee require
mains and hydrants of sufficient size for fire protection as a condition of
final plat approval. The District also requests that they be allowed to
review and approve final fire flows and water plans.
F. Schools
Proposal lies within the boundaries of Central Valley School District #356.
G. Parks
The report "Planning for Parks" (revised 1976) indicates that as the area
develops, a community park of 19.0 acres would be needed located adjacent or
in the vicinity of the junior high school on 16th Avenue.

III. ZONING ANALYSIS
The proposal is currently zoned Agricultural. The sponsor is requesting that the
zone be upgraded to Single Family Residential, R-1. The zoning to the north and
east of the proposai is generally Agricultural Suburban, while zoning to the south
is Agricultural, with zoning to the west being Two Family Residential, R-2, in the
Blake and Hanson Subdivision. Given the proposed uses aad lot sizes the proposal
would be most approximately zoned Single Family Residential, R-1.
IV. ENVIRONMENTAZ REVIEW
An Environmental Checklist was submitted by the sponsor and has been reviewed by
the Planning staff. No significant adverse environmental impacts were judged to
exist.
Slight adverse environmental impacts were identified on the checklist in the
following categories: earth; air; water; flora; noise; Iight and glare; land use;
population; housing; transportation/circulation; public services and utilities.
The Planning Director issued a proposed Declaration of Non-Significance, and it was
circulated to other agencies of jurisdiction.
V. CONDITIONS:
If approval is granted, the following conditions are recommended.
1. That the plat be designated as indicated on the preliminary plat of record
and/or attached sheets as noted.
2. That a statement be placed in the dedication to the effect that no more than

6. That the plan for water facilities adequate for fire protection be approved by
the water supplier and fire protection district. Said water plan must also
have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in conformance with their requirements and will adequately
satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.
The purveyor will also certify prior to the filing of the final plat on a copy ,
of said water plan that appropriate contractual arrangements have been made
with the plat sponsor for construction of the water system, in accordance with
the approved plan, and in accordance with a time schedule. The time schedule
will provide, in any case, for completion of the water system and inspection '
by the appropriate health authorities prior to application for building
pezmits within the plat. The contractual arrangements will include a
provision holding Spokane County and the purveyor harmless from claims by any
lot purchaser refused a building permit due to the failure of the plat sponsor
to satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities and the local
fire district and purveyor will be installed within this plat, and the ~
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
7. That a certificate of title be furnished the Planning Department prior to the ~
filing of the final plat.
8. That the preliminary plat be given conditional approval to September 1, 1980.
9. That a declaration of Non-Significance be issued, in accordance with Section
11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior to
approval, or any approving action in accordance with SCEO 11.15.340.
NOTE: The official file contains an environmental checklist for the
proposal and a staff review of their checklist as required by
WAC 197-10-320.
10. That conditional approval of the plat is given subject to the dedication of
right of way to the public and approval of the road system in the plat by the
County Engineer.
11. That plans, profiles, and cross sections showing proposed street centerline
and curb grades be submitted to the County Engineer for approval prior to
construction and the filing of a final plat.
12. The drainage plans and design calculations showing the grades and alignment of
drainage facilities be submitted to the County Engineer for approval prior to
construction and the filing of a final plat.
13. Construction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed land surveyor, who shall
be respoasible for perpetuating all evidence of the location of survey
monuments which may be dis trubed during construction and who shall furnish the
County Engiaeer with "As Built" plans and a certificate in writing that all
improvements were installed to the lines and grades shown on the approved
construction plans and that all disturbed monuments have been replaced.

14. No construction work is to be performed with the Public Right of Way until a
permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
15. AI1 construction within the Public R.ight of Way is to be completed prior to
fiiing the final plat or a bond in the amount estimated by the County Engineer
to cover the cost or construction of improvements, construction certification,
"As Built" plans, and moaumenting the street centerlines, shall be filed with
the County Engineer.
16. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor and the Planning staff.
17. That each lot be authorized for the use of individual on-site sewage disposal
systems.
18. Prior to filing of the final plat, the sponsor shall present evidence that the
plat lies within the recorded service area of the proposed water district.
Special Conditions
19. That the provisions of SEPA'S NOTICE OF ACTION pursuant to 43.21C.080 RCW and
the Board of County Commissioner's Resolution No. 77-1392 be accomplished by
the project applicant within thirty (30) days of formal actioa by the Hearing
Examiner Committee, with regard to the preliminary plat approval; as
instructed by the Planning Department staff.
20. That upon filing of the fiaal plat, the zoning be reclassified to Single
Family Residential.
21. That the project sponsor is responsible for requesting an extension of time to
review any preliminary plat approval. All extensions applied for may subject
the project sponsor to new conditions required by Reviewing Agencies.
22. That the Hearing Examiner Committee sustain the issuance of a proposed
Declaration of Non-Significance and recommends issuance of a final Declaration
of Non-Significance.
23. That a public water system serviced by Vera Water and Power, and including
fire flows, serve each lot prior to the sale of the lot.
24. That fiaal construction plans for on-site storm drainage facilities be
reviewed and approved prior to filing of the final plat by the County
Utilities Engineer and the County Health District.
25. That the plat dedication contain the statement: "Use of private wells and
water systems is prohibited.
26. That the garage and barn on the property are to be removed as indicated on the
preliminary plat of record.
27. That all public roads within the plat be curbed and paved to the
specifications of the County Engineer. Existing County roads providing access
to the plat sha11 be paved and curbed to the standards of the County Engineer.
28. That no direct access from lots to Evergreen Road.

PRELIMYNARY SUBDIVISION AND ZONE RECLASSIFICATION
I. GENERAL INFORI`1AT T ON
A. Location
East and adjacent to the "T" intersection of 9th and Evergreen, approximately
320 feet south of Eighth.
B. Proposal
- 4.7 acres subdivided into 14 lots for single family use
- Lot frontage = 90 feet
- Lot size = 12,330 sq. ft.
C. Relationship to the Comprehensive Plan
The approved map of the Comprehensive Plan indicates residential usage of this
area, as well as all nearby surrounding lands, with no density designation.
D. Land Use Analysis:
l. Existing Land Uses
The proposed site is currently vacant with a single family house and barn
located on the proposed Lots 1, 2, and 3. To the north of the proposal are
single family houses on a wide range of lot sizes with some areas for pastures
and farming activities. To the east of the proposal and directly adjacent is
Tally Ho Subdivision with lot sizes of approximately 10,900 sq. ft. To the
south of the project are scattered residential uses on vacant lots varying in
size from S acres to 13,520 sq. ft. West of the proposal is the Blake and
Hanson Subdivision with residential lots of approximately 11,200 sq. ft.
2. Compatibility with Existing Land Uses
The proposal is consistent with existing residential development foued in the
area, and appears to be compatible with existing land uses.
II. SPECIAL INFORI`1ATION
A. Circulation
The County Road Engineer has examined the proposed preliminary plat and has
recommended specific conditions to insure satisfactory developments of the
plat.

B. Sewage Disposal
The applicant's engineer has prepared an analysis of alternative sewage dis-.
posal means; including on-site septic tank disposal, sewage treatment plant,
drainfield and sewage lagoon. For economic reasons, and to provide the most
realistic alternative, the applicant's engineer feels on-site septic tanks
should be utilized.
The Spokane County Health District has authorized the use of individual
on-site sewage systems for each lot within the plat. The plat is situated
over the Spokane Valley Aquifer and the Health District in their examination
of the possible impact on groundwater quality from this proposal have the
following comments:
Impact Discussion
a. The plat sponsor has proposed 14 lots on 4.7 acres. Each lot is to be
served by a public water system and its individual on-site sewage
disposal system. This raises the question of significance of the impact
on the groundwater in the area and possible alternatives for sewage
disposal.
b. In the course of the conduct of the army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In summary, he concluded that:
1. In normal precipitation years subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
2. All the dissolved salts in sewage effluent will be c3rried to
the groundwater. However, bacteria and detergents
(phosphate portion) are mostly removed by the deep soil layer
above the groundwater and "minor dissolved constituents such as
phosphates, which are known to react with soil particles, or
nitrates, which are taken up by the plant roots," will be less
than the total found in septic tank effluents.
3. The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) solids
concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater background
of 155 mg/1. The forecast year 2020 maximum incr.emental
concentration is 101 mg/1 above the natural background.
- - - The analytical results of the forecast impact of year
2020 when compared with the present impact, both measured in
terms of leachate volume and dissolved solids concentration,
indicate that the present zmpact on groundwater quality is
already a substantial proportion of the ultxmate level.
c. Currently, results of chemical analysis show the total nitrogen content
of the groundwater as in the range of 1.21 to 2.9 ppm. A projected
incremental increase using Dr. Todd's expected 8.6 percent would result
in a range of 1.30 to 3.17 ppm. Current Federal and State drinking water
standards permit up to 10 ppm.

d. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics:
1. Collector and central treatment systems discharging to surface
waters would require at least tertiary treatment and perhaps more to
obtain a permit for the discharge from the Department of Ecology.
These systems are not currently economically available for this
project.
2. Sealed systems, whether individual or community, depend on
evaporation for liquid removal. These systems require more land
area than a conventional subsurface drainfield. Some, such as
lagoons, have safety hazards associated with them and relatively
poor community acceptance. Land, installation and operational cost
are generally more expensive than those for septic tanks and
drainfields.
C. Drainage
The County Utilities Engineer reports that the preliminary storm drainage plan
submitted by the applicant indicates that on-site storm drainage provisions
will adequately handle surface water runoff. However, final construction
plans should be revzewed and approved by both the County Engineer and Health
District prior to the final plat filing.
D. tJater Supply
The proposal is located within the recorded service area of Vera Water and
Power.
The District advlses the staff that adequate system capacity, and a desire on
their part to serve, exists for the provision of water for domestic, fire and
irrigation uses.
E. Fire Protection
The proposal is situated within the recorded service area of Fire District #1.
The Fire District staff requests that the Hearing Examiner Committee require
mains and hydrants of sufficient szze for fire protection as a condition of
final plat approval. The District also requests that they be allowed to
review and approve final fire flows and water plans.
F. Schools
Proposal lies with'in the boundaries of Central Valley School District #356.
G. Parks
The report "Planning for Parks" (revised 1976) indicates that as the area
develops, a community park of 19.0 acres would be needed located adjacent or
in the vicinity of the junior high school on lbth Avenue.

I. Cultural Resources
None have been indentified.
III. ZONING ANALYSIS
The proposal is currently zoned Agricultural. The sponsor is requesting that the
zone be upgraded to Single Family Residential, R-1. The zoning to the north and
east of the proposal is generally Agricultural Suburban, while zoning to the south
is Agricultural, with zoning to the west being Two Family Residential, R-2, in the
Blake and Hanson Subdivision. Given the proposed uses and 1ot sizes the proposal
would be most approprteately zoned Single Family Residential, R-1.
TV. ENVIROIVI`IENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and has been reviewed by
the Planning staff. No significant adverse environmental impacts were judged to
exist.
Slight adverse environmental impacts were identified on the checklist in the
following categories: earth; air; water; flora; noise; light and glare; land use;
population; housing; transportation/circulation; public services and utilities.
The Planning Director issued a proposed Declaration of Non-Significance, and it was
circulated to other agencies of jurisdiction.
V. CONDITIONS:
Tf approval is granted, the following conditions are recommended.
1. That the plat be designated as indicated on the preliminary plat of record
and/or attached sheets as noted.
2. That a statement be placed in the dedication to the effect that no rnore than
one dwelling structure be placed on any one lot, nor shall any lot be further
subdivided for the purposes of creatzng additional lots or buildzng sites
without filing a replat.
4. That appropriate provision be made that the following described property be
held ln trust until the continuation of the streets be dedicated or deeded: A
1' strip at the ends or edges of all streets that terminate or border the plat
boundary. (Temporary cul de sacs are required when streets terminate at the
plat boundaries.)
4. That appropriate street names be indicated.
5. That appropriate utility easements be indicated on coples of the approved
preliminary plat for distribution to the Planning Department and the utility
companies. Written approval of the easements by the utility company must be
received prior to the submittal of the final plat.

b. That the plan for water facilities adequate for fire protection be approved by
the water supplier and fire protection district. Said water plan must also
have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in conformance caith their requirements and will adequately
satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.
The purveyor will also certify prior to the filing of the final plat on a copy
of said water plan that appropriate contractual arrangements have been made
with the plat sponsor for construction of the water system, in accordance with
the approved plan, and in accordance with a time schedul.e. The time schedule
will provide, in any case, for completion of the water system and inspection
by the appropriate health authorities prior to application for building
permits within the plat. The contractual arrangements will include a
provision holding Spokane County and the purveyor harmless from claims by any
lot purchaser refused a building permit due to the faa.lure of the plat sponsor
to satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities and the local
fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
7. That a certificate of title be furnished the Planning Department prior to the
filing of the final plat.
8. That the preliminary plat be given conditional approval to September 1, 1980.
9. That a declaration of Non-Significance be issued, in accordance with Section
11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior to
approval, or any approving action in accordance with SCEO 11.15.340.
NOTE: The official file contains an envlronmental checklist for the
proposal and a staff review of their checklist as required by
WAC 197-10-320.
10. That conditional approval of the plat is given subject to the dedication of
right of way to the public and approval of the road system in the plat by the
County Engineer.
11. That plans, profiles, and cross sections stlowing proposed street centerline
and curb grades be submitted to the County Englneer for approval prior to
construction and the filing of a final plat.
12. The drainage plans and design calculations showing the grades and alignment of
drainage facilities be submitted to the County Engineer for approval prior to
construction and the filing of a final plat.
13. Construction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed land surveyor, who shall
be responsible for perpetuating all evidence of the location of survey
monuments which may be distrubed during construction and who shall f.urnish the
County Engineer with "As Built" plans and a certificate in writing that all
improvements were installed to the lines and grades shown on the approved
coastruction plans and that all disturbed monuments have been replaced.

14. No construction work is to be performed with the Public Right of Way until a
permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
15. All construction within the Public Right of Way is to be completed prior to
filing the final plat or a bond in the amount estimated by the County Engineer
to cover the cost or construction of improvements, construction certification,
"As Built" plans, and monumenting the street centerlines, shall be filed with
the County Engineer.
16. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor and the Planning staff.

17. That each lot be authorized for the use of individual on-site sewage disposal
systems.
18. Prior to filing of the final plat, the spoasor shall present evidence that the
plat lies within the recorded service area of the proposed water district.
Special Conditions
19. That the provisions of SEPA'S NOTICE OF ACTION pursuant to 43.21C.080 RCW and
the Board of County Commissioner's Resolution No. 77-1392 be accomplished by
the project applicant within thirty (30) days of formal action by the Hearing
Examiner Committee, with regard to the preliminary plat approval; as
instructed by the Planning Department staff.
20. That upon filing of the final plat, the zoning be reclassified to Single
Family Residential.
21. That the project sponsor is responsible for requesting an extension of time to
review any preliminary plat approval. A11 extensions applied for may subject
the project sponsor to new conditions required by Reviewing Agencies.
22. That the Hearing Examiner Committee sustain the issuance of a proposed
Declaration of Non-Significance and recommends issuance of a final Declaration
of Non-Significance.
23. That a public water system serviced by Vera Water and Power, and including
fire flows, serve each lot prior to the sale of the lot.
24. That final construction plans for on-site storm drainage facilities be
reviewed and approved prior to filing of the final plat by the County
Utilities Engineer and the County Health District.
25. That the plat dedication coatain the statement: "Use of private wells and
water systems is prohibited.
26. That the garage and barn on the property are to be removed as indicated on the
preliminary plat of record.
27. That all public roads within fhe plat be curbed and paved to the
specifications of the County Engineer. Existing County roads providing access
to the plat shall be paved and curbed to the standards of the County Engineer.
28. That no direct access from lots to Evergreen Road.

Local drainaqe ways are insignificant. It is located over the Spokane
Valley Aquifer.
b. .9urface soils are classed as Garrison gravelly loam with 0 to 5% slopes.
They have a septic tank filter field limitation of slight with possible
contamination of groundwater.
c. Geologically, the soils are glaciofluvial deposits; stream-laid sand and gravel; contains some boulders in places; includes some undifferentiated
glacial deposits. The lower terrace remnants have probably been reworked
by streams. These geologic structures yield moderate to very large amounts
of water

1. Septic Tanks - This method is the most comnonly accepted practice in
the Spokane Valley. The recent '208' Study has indicated that
recharge of the aquifer is occuring and septic tank effluent is
reaching the ground water. According to the study, this recharge is
having adverse impacts upon the aquifer water quality.
2. Treatment Plant - To effectively reduce the amount of pollutants that
would enter the aquifer, a treatment plant would need to remove
nitrates, phosphates and other contaminants that septic tanks do not
remove. This advanced wastewater treatment is not economically
feasible for a small plant such as this plat would require.
3. La.goon - This plat doesn't have the additional land required for alagoon. Also, the odor which may occur would be objectionable to
this plat a.nd the surrounding properties.
Si.nce the County doesn't have a comprehensive sewer plan for this area, the
advanced wastewater treatment option is not feasible at this time. Until
such time as adva.nced wastewater treatment is offered on a large scale to
this portion of the Spokane Valley, the most feasible method of sewa.ge
disposal will be with individual septic tanks and drainfields with a
management system if required by your office.

2. Topography, Soils, and Water:
a. This project lies in a relatively flat area between Evergreen and Adams Road.
Local drainage ways are insignificant. It is located over the Spokane
Valley Aquifer.
b. Surface soils are classed as Garrison gravelly loam with 0 to 5$ slopes.
They have a septic tank filter field limitation of slight with possible
contamination of groundwater.
c. Geologically, the soils are glaciofluvial deposits; stream-laid sand and
gravel; contains some boulders in places; includes some undifferentiated
glacial deposits. The lower terrace remnants have probably been reworked
by streams. These geologic structures yield moderate to very large amounts
of water

d. The data from Vera Irrigation District #15 wells in the area shows the
wells are 160 to 176 feet deep. The highest total nitrogen level was
2.9 ppm. The Vera Water District has indicated that it can supply
domestic use water for the plat upon completion of agreements with the
developer.
3. Impact discussion:
a. The plat sponsor has proposed 14 lots on 4.7 acres. Each lot is to be
served by a public water system and its individual on-site sewage disposal
system. This raises the question of significance of the impact on the
groundwater in the area and possible alternatives for sewage disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in tlie Spokane River Valley
upon the quality of the groundwater. In sununary, he concluded that:
(1) In normal precipitation years, subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
(2) All dissolved salts in sewage effluent will be carried to the
groundwater. However, bacteria and detergents (phosphate portion)
are mostly removed by the deep soil layer above the groundwater
and "minor dissolved constituents such as phosphates, which are
known to react with solid particles, or nitrates, which are taken
up by plant roots" will be less than the total found in septic
tank effluents.
(3) "The calculated results at the downstream end of groundwater flow
line indicate that the maximum range of (dissolved) solids
concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater background
of 155 mg/1. The forecast year 2020 maximum incremental concentration
is 101 mg/1 above the natural background."---"The analytical results
of the forecast impact of year 2020 when compared with the present
impact, both measured in terms of leachate volume and dissolved
solids concentration, indicate that the present impact on groundwater
quality is already a substantial proportion of the ultimate level."
c. Currently, results of chemical analysis show the total nitrogen content of
the groundwater as in the range of 1.21 to 2.9 ppm. A projected incremental
increase using Dr. Todd's expected 8.6 percent would result in ranges
1.30 ppm, to 3.17 ppm. Current Federal and State drinking water standards
permit up to 10 ppm.
d. Alternative sewage disposal methods that would not recharge the groundwater
have the following general characteristics:
(1) Collector and central treatment systems discharging to surface waters
would require at least tertiary treatment and perhaps more to obtain
a permit for the discharge from the Department of Ecology. These
systems are not currently economically available for this project.

l~ Pursuant to Board of County Comrnissioners Resolution No. 80-0418, the use
of on-site sewer disposal systems is hereby authorized. This authorization
is conditioned on campliance with all rules and regulations of the Spokane
County Health District and is further conditioned and subject to specific
application approval and issuance of perrnits by the Health District.
The owner, his heirs or successors shall join and participate in any peti-
tion or resolution which purpose is the formation of a utility local im-
provement district (UIID) pursuant to RCW, Chapter 36.94, as amended. The
owner, his heirs and successors shall further agree not to oppose or pro-
test any legal assessments for any utility local improvement district (ULID)
established pursuant to RCW Chapter 36.94, as amended.

(3a) Any water service for this project shall be coordinated with

to be reviewed and approved by the Utilities Department prior to construction.
(8) Located within the Critical Water Supply Service Area but not within any
purveyor's district. May he serviced by an individual well owned and operated
