REVIEW OF FREEWAY COMMERCIAL ZONE SITE ) AND CONDITIONS
PLAN AMENDMENT )
THIS MATTER, Being the consideration by the Zoning Adjustor of Spokar~,County, in hearing the application (ZE-lO1C-70), for the purpose of rev1ewinca
a proposed addition to a Freeway Commercial site plan, hereinaf ter referred tc
as the "Proposal", and the Zoning Adjustor of Spokane County having held a
public hearing on June 25, 1984 and having fully considered all testimony pre-
sented thereat, and further having visited the site and vicinity in question,
and having rendered a decision on the 5th day of July, 1984, APPROVING said
proposal, does hereby make the following:
FINDINGS OF FACT
l. That the proposal is generally located east of Barker Road, sou th of
Boone and north of I-90 in Section 17-25-45.
2. Tha t the proposal consists of amending an existing s1te plan to add a
restaurant onto an existing service station facility.
3. That the adopted Spokane County Generalized Comprehensive Land Use Plan
indicates Industrial usage of the area encompassed by the proposal.
4. That the site is zoned Freeway Commercial.
5. That the existing land uses in the area of proposal include commercialand
industrial and I-90.
6. That the proposal is consistent with the Freeway Commercial zone and has
been favorably reviewed by the Spokane County Zoning section.
7. That the proposed site plan indica tes tha t setbacks, parking, height of
the structure(s) will conform to the Spokane County Zoning Ordinance.
S. That no one appeared to oppose the proposal nor were any written comments
adverse to the proposal received.
9. That the project was found exempt from the State Environmental Pol icy Act
under WAC 97.10.160 (c) (minor new construction).
10. That the applicant expressed opposition to the imposing of conditions
recommended by the Spokane County Utilities Department and the Spokane County
Engineers Department.
11. It was explained to the applicant tha t the recommendations submitted from
the County Engineers were conslstent with adjoining commercial development
(ZE-11-83). The applicant retains the ability to seek a design deviation from the
Spokane County Engineers if he is able to establish to their satisfaction that
certain recommendations for improvement are not necessary.
12. The recommendations of the Spokane County Utilities Department are standard
conditions which are imposed for new development occuring within the Spokane County
Priority Sewer Service Area. These conditions are found by the Zoning Adjustor to
advance the public health, safety and welfare and pursuant to county land use policy,
these conditions are included as requirements in conjunction with the approval of
the applicants request.
13. The applicant was otherwise made aware of conditions from the County Build-
ing and Safety Department and the Spokane County Valley Fire Department.
14. The applicants proposal may need review and approval from the Spokane
County Health District prior to release of building permits.
15. That the propet^ legal requirements for adYertising of the hearing before
the Zoning Adjustor of Spokane County have been met.

CONCLUSION
Following review of the Planning Department file, considera tion of the public
testimony, and circumstances in the area of proposal, the Zoning Adjustor concludes
that the proposal is not detrimental and is compa tible with the Freeway Commercial
zone and with the original zoning granted for this property.
DECISION
From the foregoing Findings, a review of the Planning Department File No.
ZE-IOlC-70, testimony at the public hearing, and a site visit, the Zoning Adjustor
hereby in APPROVING the proposal establishes the following conditions:
A. CONDITIONS OF APPROVAL
1) The applicant shall develop the site consistent with the plot plan on file
with this applica tion.
2) Fu ther, the applicant shall indicate sufficient space on the site plan to
accommodate on-site parking for the restaurant and service station facilities.
3) All buildings and structures require building permits as per Section 301 of
the Uniform Building Code.
4) The required fire flow for this complex is 3000 GPM. This complex requires
2 fire hydrants to be installed.
5) The hydrants shall be installed as per approved vrater plan and shall be
installed prior to construction.
6) One hydrant shall be installed a t the northeast corner of Barker and
Cataldo, the other hydrant shall be installed at the southwest corner of
the property.
7) Pursuant to the Board of County Commissioners Resolution No. 80-0418, the
use of on-site sewer disposal systems is hereby authorized. This au thori-
za tion is conditioned on compliance with all rules and regula tions of the I
Spokane County Health District and is further conditioned and subject to
specific application approval and issuance of permits by the Nealth
District.
8) The Owner(s) or Successor(s) in interest agree to authorize the County to
place their name(s) on a petition for the formatio n of a ULID by petition
. method pursuant to RCW 36.94 which the petition includes the Owner(s)
property and further not to object by the signing of a protest petition
against the forma tion of a UILD by resolution method pursuant to RCW 36.94
which includes the Owner(s) propert . PROVIDED, this condition shall not
prohibit the Owner(s) or Successor(s~ from objection to any assessment(s)
on the property as a result of improvements called for in conjunction with
the formation of a ULID by either petition or resolution under RCW Chapter
36.94.
9) Access permits for approaches to the County Road System shall be obtained
from the Spokane County Engineer.
10) Applicant shall improve Cataldo Avenue in a manner consistent with Spokane
County TYPICAL roadway Section No. l, minimum paving width Access Std.
11) Applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans prior to the issuance of a building permit on
the property.
12) A parking plan and traffic circulation plan shall be submitted and approved
by the Spokane County Engi neer prior to the i ssuance of a bu i 1 di ng permi t
on the property. The design, location, and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving
or surfacing as approved by the Spokane County Engineer, will be required
for any portion of the project which is to be occupied or travelled by
vehicles.
13) The word "applicant" shall include the owner or owners of the property, his
heirs, assigns and successors. continued

northeasterly side of the frontage road connecting Cataldo Avenue and Barker Road
in Lots S and 6 of Tract 2, Corbin Addition to Greenacres, in the Southwest Quarter
of the Northwest Quarter of Section 17, Township 25 North, Range 45 East, W.M.
Said approaches are to be located on the easterly side of said frontage road at
Highway Engineer's Stations 0+73 and 1+71, Mile Post 293.97, as shown on Right of Way
Sheet 19 of 25 Sheets for SR 90, Spokane to Greenacres.
Pave the proposed epproaches with asphaltic concrete, 4-inch minimum compacted depth.
Drainage shall be provided away frorn the roadway by continuing the existing shoulder
slope of approximately one-half inch tu one (1) foot to the right of way line.
Asphaltic inaterial placed on the roadside shall be machine spread and rolled whenever
possible. Careful attention shall be paid to the drainage pattern. Inlet gratings,
valve box covers, etc., shall be adjusted to grade. Sufficient pregrading shall be
done to insure a uniform depth of surfacing with the specified sloping. Flared con-
necti.ona shall be made to the highway pavement.
Highway traffic shall be protected by flagmen whenever any portion of the traveled
aurface is obatructed by equipment working on this project.

It is unlawful to erect a structure or establishment or maiiitain a business, the nature
of which requires the use by patrons of property adjoining the structure or establish-
ment, unless the structure or establishnient is so located at a distance from the right
of way of a etate highway that none of the right of way is required for the use of the
patrons.
All building restricCions established by the Spokane Planning Camm;ssion shall be
complied with.
A suitable traffic barrier shall be constructed along the right of way line between
the side property lines and the driveways, and between the driveways.
In accordance with the provisions of Washingt(in State Highway CoRUnission Resolution

lj Approval of access points by the State Highway Department (a copy of
the access permit shall be submitted prior to approval of the firal
"Development and Traffic Control Plan").

A. Reasons:
1. The Planning Commission is of the opinion that the proposed sitP
is appropriate for Freeway Commercial development because it
meets the criteria contained in the text portion of the Cemprehe;•si~~ F•
Plan. The criteria relate to the following objectives for deLermi-:i--
ing the best locations for Freeway Commercial zoning.
a) To provide the highest degree of usefulness and convenience
to Freeway users. The proposed site is visible from the
Freeway and the Barker Interchange affords convenient acc? c=.
to the site.
b) To create a minimum of traffic congestion or hazards on the
limited acce s s highway, its acce s s and egre s s ramps, an-d
connecting County roads.(The State Highway Department has
withdrawn their previous concern of the Freeway Comrnercial
devclopment.)
c) To create a minimum of adverse effect upon property developeci

Planning Commission Recommendation: Approve to Freeway Comrriercial
Zone r subiect to the followinq conditions:
1) Approval of access points by the State Highway Department (a copy of
the access permit shall be submitted prior to approval of the final
"Development and Traffic Control Plan") .
2) Submittal by the applicant and apptoval by the Board of County
Commissioners of a final"Development and Traf#fc Control Plan".
Such plan shall be substantially in conformance with the previously
submitted plan on file and shall adhere to the provisions of Chapter
9. 08A of the Spokane County Zoning Ordinance.
A. Reasons:
1. The Planning Commission is of the opinfon that the proposed site
is appropriate for Freeway Commercial development because it
meets the criteria contained in the text portion of the Comprehensive
Plan. The criteria relate to the following objectives for determin-
ing the best locations for Freeway Commercial zoning.
a) To provide the highe st degree of u sefulne s s and convenience
to Freeway users. Tha proposed site is visible from the
Freeway and the Barker Interchange affords convenient access
to fihe site.
b) To create a minimum of traffic congestion or hazards on the
limited acce s s highway, its acce s s and eqre s s ramp s, and
connecting County roads. (The State Highway Department has
withdrawn their previous concern of the Freeway Commercial
development. )
c) To create a minimum of adverse effect upon property dEveloped
or planned for development for residential use, (The Comm.s-
sion is of the opinion that the subject property is not
appropriate for residential uses because of its proximity to the
Freeway Interchange to the south and the railroad tracks to the
north.
