REVIEW OF FREEWAY COMMERCIAL ZONE SITE ) AND CONDITIONS
PLAN AMENDMENT )
THIS MATTER, Being the considel^ation by the Zoning Adjustar of Spokane
County, in hearing the application (ZE-101C-70), for the purpose of reviewing
a proposed addition to a Freeway Commercial site plan, hereinaf ter referred to
as the "Proposal", and the Zoning Adjustor of Spokane County having held a
public hearing on June 25, 1984 and having fully considered all testimony pre-
sented thereat, and further having visited the site and vicinity in question,
and having rendered a decision on the 5th day of July, 1984, APPROVING said
proposal, does hereby make the following
FINDINGS OF FACT
1 That the proposal is generally loca ted east of Barker Road, sou th of
Boone and north of I-90 in Section 17-25-45
2 That the proposal consists of amending an existing site plan to add a
restaurant onto an existing service station facil ity
3 That the adopted Spokane County Generalized Comprehensive Land Use Plan
indicates Industrial usage of the area encompassed by the proposal
4 That the site is zoned Freeway Commercial
5 That the existing land uses in the area of proposal include commercialand
industrial and I-90
6 That the proposal is consistent with the Freeway Commercial zone and has
been favorably reviewed by the Spokane County Zoning section
7 That the proposed si te pl an i ndicates that setbacks, parki ng, height of
the structure(s) wi 11 conform to the Spokane County Zoni ng Ordi nance
8 That no one appeared to oppose the proposal nor were any written comments
adverse to the proposal received
9 That the project was found exempt from the State Environmental Pol icy Act
under WAC 97 10 160 (c) (minor new construction)
10 That the applicant expressed opposition to the imposing of cond7tions
recommended by the Spokane County Utilities Department and the Spokane County
Engineers Department
11 It was explained to the applicant that the recommendations submitted from
the Count Engineers were consistent with adjoining commercial development
(ZE-11-83~ The applicant retains the ability to seek a design deviation from the
Spokane County Engineers if he is able to establish to their satisfaction tha t
certain recommendations for improvement are not necessal^y
12 The recommendations of the Spokane County Util ities Depa1^tment are standard
conditions which are imposed for new development occuring withln the Spokane County
Priority Sewer Service Area These conditions are found by the Zoning Adjustor to
advance the public health, safety and welfare and pursuant to county land use policy,
these conditions are included as requirements in conjunction with the approval of
the applicants request
13 The applicant was otherwise made aware of conditions from the County Build-
ing and Safety Department and the Spokane County Valley Fire Department
14 The applicants proposal may need review and approval from the Spokane
County Health District prior to release of building permits
15 That the proper legal requirements for advertising of the hearing before
the Zoning Adjustor of Spokane County have been met

CONCLUSION
Following review of the Planning Department file, considera tion of the public
testimony, and circumstances in the area of proposal, the Zoning Adjustor concludes
that the proposal is not detrimental and is compatible with the Freeway Commercial
zone and with the original zoning granted for this property
DECISION
From the foregoi ng Findi ngs , a revi ew of the P1 anning Department Fi 1 e No
ZE-101C-70, testimony a t the public hearing, and a site visit, the Zoning Adjustor
hereby in APPROVING the proposal establishes the following conditions
A CONDITIONS OF APPROVAL
~1) The applicant shall develop the site consistent with the plo t plan on file
with this application
- 2) Fu ther, the applicant shall indicate sufficient space on the site plan to
accommodate on-site parking for the restaurant and service station facilities
3) Al1 buildings and struc tures require building permits as per Section 301 of
the Uniform Building Code
4) The required fire flow for this complex is 3000 GPM This complex requires
2 f i re hydrants to be i nstal l ed
5) The hydrants shall be installed as per approved water plan and shall be
i nstal 1 ed prior to construction
6) One hydrant shall be installed at the northeast corner of Barker and
Cataldo, the other hydrant shall be installed at the southwest corner of
the property
7) Pursuant to the Board of County Commissioners Resolution No 80-0418, the
use of on-site sewer disposal systems is hereby authorized This authori-
zation is conditioned on compliance with all rules and regulations of the
Spokane County Health Distric t and is further conditioned and subject to
specific application approval and issuance of permits by the Health
Di strict
8) The Owner(s) or Successor(s) in interest agree to authorize the County to
place their name(s) on a petition for the formation of a ULID by petition
method pursuant to RCW 36 94 which the petition includes the Owner(s)
property and further not to object by the signing of a protest petition
against the formation of a UILD by resolution method pursuant to RCW 36 94
which includes the Owner(s) property PROVIDED, this condition shall not
prohibit the Owner(s) or Successor(s) from objection to any assessment(s)
on the property as a result of improvements called for in conjunction with
the formation of a ULID by either petition or resolution under RCW Chapter
36 94
9) Access nermits for approaches to the County Road System shall be obtained
from the Spokane County Engineer
10) Applicant shall improve Cataldo Avenue in a manner consistent with Spokane
County TYPICAL roadway Section No 1, minimum paving width Access Std
11) Applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans prior to the issuance of a building permlt on
the property
12) A parking plan and traffic circulation plan shall be submitted and approved
by the Spokane County Engi neer prior to the i ssuance of a bu i1 di ng permi t
on the property The design, location, and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices Paving
or surfacing as approved by the Spokane County Engineer, will be required
for any portion of the project which is to be occupied or travelled by
vehicles
13) The word "applicant" shall include the owner or owners of the property, his
heirs, assigns and successors

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires all state and local
governmental agencies to consider envirnnmentaT values both for their own actions and when licensing private
proposals. The Act also requires that an Environmental Impact Statement be prepared for all major actions
significantly (and "adversely", as per WAC 197-10) affecting the quality of the physical environment. The
purpose of this checklist is to help the agencies involved determine whether pr not a proposal is such a
major action.
Please answer the following questions as completely as you can with the information presently availabie to
you. Please answer questions as "yes" or "maybe" if, in your opinion, even only slight impacts will result.
The reviewers of the checklist will be aware of and concern themselves with the degree of impact, asking you
for more information, if necessary. Where explanations of your answers are required, or where you believe
an explanation would be helpful to government decision-makers, include your expianation in the space provided,
or use additional paqes, if nec sSar~( . You should include references to any reports or studies of which you
are aware and which are relevan~ to the answen you provide. Complete answers to these questions now will
heip all agencies involved with your proposal to undertake the required environmental review without unnec-
essary deiay.
The following questions apply to your total proposal, not just to the license for which you are currently
applying or the proposal for which approvai is sought. Your answers should include the impacts which will be
caused by your proposal when it is completed, even thauqh completion may not occur until sometime in the
future. This will allow all of the agencies which will be involved to complete their environmental review
now, without duplicating paperwork in the future.
No application shall be processed until the checklist has been completed and returned to the appropriate
County depart~nent. State law requires explan~tions for everv "yes" and "mavbe" answer on the check]ist.
The person completing the form may be require to provide explanation for "no" answers, and in some cases,
more detailed informati.on to aid in a threshold determination.

ZONE RECLASSIFICA i ION PROCEDURE
A. Prel iminary Submittal
Prior to filing a zone reclassification application, the project sponsor shall
become familiar with the current procedures and forms. Planning Depart-
ment staff inembers are available for advice on current procedures, past
actions which may affect the proposal and the appropriate Zone classifica-
tion for the use proposed.
B. Application Deadline
Minimum deadline for submittal of an application for zone reclassification is
t e first working day of each month. Complete applications received by
oon on the first working day of the month will be scheduled for public

imately three weeks prior to the public hearing date, and provide the
information needed to fulfill the notification requirements outlined below.
C. Suhmittal Requirements
The Planning Department staff requries that the following information be
submitted for a zone reclassification :
1 Completed application form (yellow)
2 Completed environmental checklist (pink)
3 Engineer's section map - siabmit one (1) up-to-date print of the
section map(s) covering the area proposal for zone reclassification.
Outline the subject property boundary in red.
Assessor's section maQ - submit two (2) up-to-date prints of the
section map(s) covering the area pr d for zone reclassification,
all property within 400 feet of the boundary of the total owned and/or
controlled property. Outline the subject property boundary in red.
Indicate parcels which are wholly or partially within 400 feet of the
subject property boundary.

D. ~-Notification Re uirement
The applicant is required to provide two forms of notification for a zone
reclassification, as follows:
1 Mailed notice shall be provided to property owners and taxpayers in
the vicinity of the project site a minimum of ten 9!'Kdays prior to
the public hearing.
