On June 23, 1970 the following statement was presented to
the Spokane County Planning Commission:
"The Zeague of Women Voters of the Greater Spokane
Area places highest priority upon measures to
protect our groundwater supply, improv e the quality
of our air and insure logical, consistent land-use
planning. We feel that the proposed rezoning of
land adjacent to Sulliv an Park to allow industrial
uses violates all three of these principles.
An industrial zoning, immediately next to a park,
allowing deposit of industrial wastes which run a
high risk of producing air and viater pollution
does not seem to take into account human needs or
envlronmental factors, and therefore in our judg-
ment constitutes unwise planning. Our studies
of this matter hane convinced us that proper safe-
guards are not feasible in this situation, and
that the overall good of the community would not
be served by allowing this petition.
We are concerned that many of our questions
regarding the request have been insufficiently
anstivered. We would hope that adequate information
will be made available to our planning commission
so that they may make sound judgments that will
promote the orderly growth of our community."
As far as the Zeague of Women Voters has been able to
ascertain, nothing has changed since this statement was
read in 1970. We remain opposed tio use of the State-owned
gravel pit adjacent to Sulliv an Park by the Hillyard
Processing Company.

"River Dev elopment. One of the most important
natural assets of the Spokane I42etropolitan Area
is the Spokane River. Effort should be taken
to assure the protection, improvement and
beautification of the riv er and expansion of
its recreational development."
We feel that heavily-used Sulliv an Fark must be protected
from industrial encroachment, and that the following
questions should be answered before any zoning change is
implemen.ted.
1. If Hillyard Frocessing Company's need for the
additional land was immediate as indicated at the
previous hearing, why has there been a 2J-year delay
in finalizing the necessary axrangements9
2. Why should any operation that cannot meet the
performance standards of a Restricted Industrial
Zone be allowed manufacturing zoning, which possibly
provides even less control for protection of the
environment'?
3. Since the State land has been in use for some time,
why hasn't the lease been filed at the County Assessor's
Office9 What is the nature of the lease?
4• If temporary storage for a flve-yeax period in a manu-
facturing zone is specifled, is there any possibillty
of renewal?
5. Is dependence on the temporary nature of a State lease
a proper safeguard to prevent other manufacturing zone
uses9 Could Hillyard Frocessing Co. go ahead with
its original plans for a smelter on the site?
6. What will a reclamation plan consist of, how will it
be carried out, and vrho vrill judge its adequacy9
7. If the information frorr the County Assessor's Office
is correct and the utility poles next to the Hillyard
Processing Coinpany plant mark the boundary of the
agricultural-zoned State land adjacent to the plant,

plant outflow indicated that the Hillyard Processing
Company is in compliance with Department of Ecology
surface water standards9
11. What provisions are going to be made for dust control
from tailings and dross, and for elimination of
ammonium hydroxide released to the air from wet dross?
12. Why haven't Mr. Shiosaki's recommendations for
covering the dross to prevent formation of ammoruum
hydroxide = been complied with9
13• Since some drainage in the gravel pit area is necessary
to prevent standing water, how can leaching be
prev ented'?
14. According to the regulations of the County Englneers
for the I,icensing of Dumping Sites,"Refuse shall not
be placed in mines, pits, old wells, or other areas
where resul_ting seepaFe or leacrate may carry waste to
water-bearing strata or wells." Why doesn't the
Department of Ecology hav e a similar concern for the
potentlal of contaxr~ination at the site in question?
15. Since the land is desired for temporary storage, how
and where will the tailings be disposed of at the end
of the 1 ease period?
16. Isn't it true that the Park Department vrould like to
acquire the gravel pit site for recreational use and
as a buffer zone between industry and Sullivan Park9
Perhaps the best way to ansv;er so many diverse questions
and resolve so many potential pollution problems would be
to require an environmental impact statement.

We are opposed to the extension of time requested by the Hill yard Processing
Company. This is based on our plans to expand Sulliven Park to the North
and the Northwest. At the present time we are negotiating with the Inland
Empire Paper Company for additional land to provide camping facilities. Also,
we hope to work out an agreement with the State Highway Department for
additional acreage to Sullivan Park.

the Otis Orchards study group with the proposal and to continue work on the

Dear Mr. Huggins:
As I stated in my letter of A,pril 17, 1972, our business had
been extremely slow and that we had not experienced a need for the
property in question. Of this date, we do foresee a very definite
need and would like to proceed with all conditions remaining the
same.
There will be a considerable expenditure to ready this par-
tial for use. We would like to extend the term of this zone change
to expire December 31, 1977 instead of the existing June, 1975.
This will enable us to better utilize our expenditure. It will
improve the storage of this material both from a safety aspect and
by keeping the material below grade.
We request that you review this carefully and favorably extend
this zoning.

Since they never posted a bond for reclamation9 after the

change 9 doesn' t this property remain agricultural ?
Also 9 if a lease has been 1.n effect wz.th the State Highway
Department for some years, why has it never been filed tnnth
the County Assessor' s office for tax purpoaes?

As is always the case wnth hindsight, subsequent questions have arisen
since the Hillyard Processing Co. Zoning Hearing. Those we consider
most important are as follows -
1. Is dependance on the temporary nature of a state lease a proper
safeguard to prevent other "M" zone uses
2. Since dome stic waste must now have treatment facilitie s, shouldn't
industrial waste require even closer scrutiny?
3. What agency (or agencies) wnll inspect on a continuing basis to
see that reqw.rements are met?
4. Applicant stated at hearing that Trentwood tailings would be trucked
away. Where? Licensed dumpsite or market? If this is feasible, why
a need for pit at all?
5. Was told originally that temporary storage would be allowed in a
Restricted Industrial zone, At the hearing was told this would be
considered fill and not allowable. Have similar uses been acceptable
in other R. I. Zones in the past?
6. What will reclamation plan consist of ?
Did the County Health Officer approve the original zone change ?
8. Has the County's Legal Counsel been consulted as to the legality of
stipulations or to draw up the ne ce s sary pape r s?
9. Since state land has been in use for some time, why hasn't the lease
been filed at the Assessors?

(Referred back to the Planning Commission by the, Board of County
Commissioners)
Planning Commission Recommendation: Deny Parcel "B" as leqally
described hereine ApArove to Manufacturfng, Parcel "A" as leqally described
herein., and subiect fio the followin4 conditions;
A. Conditions:
1, The Planning Commission reserves the right to readvertise the

2. The pit area shall be utilized for the storage of the aluminum
oxide tailings only, and such storage shall be im conformance

Pollution Control Commission, the Spokane County Health
District, and the Spokane Air Pollution Control Authorxty.
3. The tailinqs storage shall be confined to fihe pit area and in no
case shall such storage rise above the nm of the pit area (i,ae.,
no hi~ll shall be created),
4. Provisions shall be made for the rehabilitation of the pit and
storage area when such storage is discontinued. A specific plan
for such rehabilitation within five (S) years and an adequate
bond shall be approved by the Board of County Commissioners
prior to final action on the zone change,
5. Security fencing of a type satisfactory to the County Parks
Di~rector shall be provided between the storage area and Sullivan
Park e
B. R,easons:
The Planning Commission has reviewed the proposal and finds the
following criteria for approval unchanqed from the Ma y 1, 1970..

l. The Comprehensive Plan indicates that this general area is
appropriate for industrial use s o

2. The zone change proposal is immediately adjacent to an efisting
Manufactuving Zone .
3. The zone change proposal i s on the frfnge of a recognized indus-
trial district and immediately south of an existinq industrial
operation which seeks temporary expansion.
4. Provisfons should be taken for the protection and viabflity of
Sullivan Park which is immediately south of the zone change
propo sal .
The Planning Commission in reviewing the proposal has taken definite
measures for the protection and viabilfty of culullivan Park by: 1) Establish-
ing a definite time perlod (5 years or sooner) for the usage of the storage
area; 2) Obnfitirq the storage to a receptacle operation; 3) Making provision
for adequate security fancing between the storage area and Sullivan Park.
At the june 23, 1970 hearing, the Planning Commission revfewed testimony
on possible pollution hazards associated with Hillyard Processing
Company's operations. The Commission was informed that the slag or
dross material which is processed by the ffrm contains chemical reactants
which produce ammonium hydroxfde (ammonia) when exposed to water and
soluble salts which may leach into the water table. Therefore, the
Planni.ng Commis sion recommended denial of the applicant's reque st for
zoning Parcel "B" to Manufacturing because of the pollution hazards
associated with the dross storage. (The dross is a by-product of the
larger smelter operations of Kaiser Aluminum. ) The applicant has
indicated to the Commi s sion that the dros s storage will be confined to the
present plant site. The Commis sion f s advised that adequate protective
measures can and will be taken on the presently zoned site to control both
the emis si.on of ammonium hydroxide and leaching into the soil.
On the other hand, it was indicated that tailings of the operata.on are
relatively inert and have a low salt content, and, therefore, constitute a
minimQl health and pollution hazard. A letter from Thomas G. Haggarty of
the Water Pollution Control Commission explained that a plastic material
to control seepage would be required beneath the tailings storage area.
The Commission is of the opinion that adequate measures can be taken to
control possible pollution from the tailings storage and, therefore,
recommend the approval of Parcel "A" as legally de scribed herein. In
addition, the Commission has recommended several conditions which will
provfde for: 1) proper storage of the taflings materlal, 2) rehabilitation of
the pit area, 3) security fencing between the storage area and Sullivan
Park, and 4) termination of the storage operation within 5 years.

As a general comment the Commission notes that the Air Pollution and
iNater Pollution Controi aqencies are equipped with both adequate regulatory
authority and professional technical staff and that these agencies have

As I explained, we would gr ade all the walls, build up
the voids in the wall between our property and the
Caunty property, and then fill this basin fram the
North side. The bottom and sides will be lined with
plastlc prior to dumpYng. There will be a six foat
wire fence with three barbs all araund this property;
we will also post it as private property.
The material to be stared on this site is the washed
residue from our processing operation. A typical

Gentlemen:
On an earlier occasion we advised the Spokane Board of Commfssioners of our concern
about waste ma.terials generated by the above referenced industry. Since that tinae
we have had an opportunity, to investigate the industry's activities in further
detail and would like to relay our conclusions to you at this time.
The industry proposes to use the gravel pit area for storage of their solid waste
material remaining after processing. This will be a tailings pile similar to the
one now in existence on their site. Plastic sheeting wz.ll be laid down first to
prevent concentrated and continual seepage and to permit evaporation of most of the
residual waters Secondly, analpsis of the material to be stored does not indicate
the presence of any toxic materials or otb.er material that may be deleterious to
ground water should seepage occur. Assuming these situations to be true, we do not
believe there would be any, adverse effects on water quality in the surrounding area.
From the aspects of water pollution, we state our concurrence with their proposal.
On another note, you may be interested in some of our other activities concerning
this same induetry and site. Some of the particular material processed by Hillyard
Processing from the Kaiser Trentwood plant contained fiigh concentrations of soluble
chloride salts. High salt concentrations were being discharged to the Spokane River
by Hillyard Processing and some time back this same material was responsible for
high salt concentrations in the ground water in this particular area. We have
placed limiting requirements on Hi.llqard Processing's discharge to the river and as
a result they will discontinue processing the material from Kaiser Trentwood. It
appears that their existing facilities will now be adequate to meet our requirements.
We should also note that the material from Kaiser Trentwood is now being disposed
of as a solid waste in an area outside of the valley perimeter.
We trust our comments will assist you in your endeavors and that you will not hesi-
tate to call on us if you have further questions.
