Ref: Non -conforming use rights to Parcel #'s 45184.1947, 4.2045, and 4.9146 located in
the vicinity of Hutchinson and Harrington.
Dear Mr. Hume:
I have reviewed your letter of 9-22-05 conceming your client's properties and the on-
going non -conforming use rights to a warehouse and enclosed storage area. This is to
advise you that 1 concur with your findings and that the interim marketing of the property
does not affect or cause the non -conforming use to expire, as there has been no intent
to abandon the use. Accordingly, the non -conforming rights to warehouse use still exist.
Please be aware too, that the City intends to zone the subject properties to Corridor
Mixed Use as part of the comprehensive plan update. We expect warehouse uses to be
part of that zone when it is adopted.
