TERM: These covenants are to run with the land and shall be binding on all parties and all persons claiming under them for a period of thirty-five (35) years from the date these covenants are recorded, and after which 1:iMe said covenants shall be automatically extended for successive periods of ten (10) years unless an instru- ment signed by a majority of the then ovmers of the lots has been recorded, agreeing to change said covenants in whole or in part. 2. As appur- Lent and incidental to the residential use of any mobil home a patio, canopy and one single or double detached garage or car port, archi- tecturally in harmony with and of permanent structure may be erected on said lot, subject to the limitations herein. The owner of any lot, once construction of a patio, canopy or detached garage or car port is comrnenced shall, within nine ty (90) days thereafter, have the patio, canopy, garage or car port completed, and in the case of a garage or car port shall have the exterior completely finished and all necessary painting or staining completed. Only tvro aizes o#' garages or car ports shall be permitted on any lot, narnely 241 x 26, or 18, x 261. The roof pitch on any garage or car port shall be the same pitch as that of the mobile home located on the lot and shall in no event exceed 2/12 pitch. Plans and spe- cifications for such improvements shall be submitted to the Control Committee and approved as provided in paragraph 6 hereof. No mobile home less than 12 feet in width and 50 feet in length shall be per- mitted on any lo t. 5. ARCHITECTURAL CONTROL: No building or structure shall be erected, placed, permitted or altered on any lot until. the construc-. tion plans and apecifications and a plan showing the location of the structure on the lot has been approved by the Control Committee as to quality and worlflnanship and.materials, harmony of exterior design - CONTINUED - with the exist:ing stiructures and as to location with respect to topo- graphy and finished grade elevation. No fence, hedge or boundary vrall abutting on a street shall exceed three (3) feet in elevation above the finished grade surface of the ground upon which such fence, hedge or boundary wall is situated unless similarly approved by the Control Committee. Approval shall be as provided in paragraph 6 hereo f . 6. CONTROL COMI11ITTEE: The Control Committee is composed of MIKE BASCETTA, JOSEPH BASCETTA and LLOYD K. MILLER. A majority of the committee may designate a representative to act for it. In the event of the death or resignation of any member of the commit- tee the remaining members shall have full authority to designate a successor. Neither the members of the committee nor its designated representative shall be entitled Lo any compensation for service performed pursuant to this covenant. At any time the then record owners of a majority of the lots shall have the power with a duly reco rded written instrument, to change the membership of the committee or to withdraw from the committee or to restore to it any of its povrers and duties. The committee's approval or disapproval as re- quired in these covenants shall be in writing. In the event the com- mittee or its designated representative fails to approve or disapprove within thirty (30) days after plans and specifications have been I submitted to it or if, in any event, no suit to enjoin the construc- tion has been commended prior to the completion thereof, approval will not be required and the related covenants shall be deemed to have been fully complied with. 7. NUISANCES AND RULES: No noxious or offensive activities shall be carried on upon any lot nor shall anything be done thereon which may be or may become an annoyance o r nuisance to the neigh- borhood. All occupants of mobile homes in said additjon shall sub- ject to weekly garbage service from a commercial garbage collection service in the Spo kane Valley Area and shall at no time allow garbage to accumulate or collect in the area. The North 435 feet of that portion of the W1/2 of the N W 1/4 of Sec. 19 lying south of 3rd Ave. Our reasons for protesting are listed as follows; (1) Many of the homes here still have wells and we all have septic tanks. How long will i_t be before the water is polluted by the number of septic tanks that would have to be installed? (2) Who is going to pay for the road building that will be necessary to take care of the additional traffic? Who will pay the taxes for the un- keep on these roads? (3) Trailer parks are filled with temporary residents. What about the rundown, messy garbage filled trailers that are vacated? What will this do to the value of the permanent homes? Who will want to bui_ld a home next to a trailer jungle if this is permitted? (4) What are the long range plans of this group? Are they to go astray as did their last venture? We are definitely opposed to this zone change. Should the wishes of two people take away the way of life of all the permanent residents in this neigh- borhood? We built our home in Veradale last because this was zoned for agri- culture and to get away from one home on top of another and the glorified business districts of this type in the city.
