A. Reasons-
1. The Comprehensive Plan distinguishes between hic_:
residential development (apartments) and low density resia,~::_
development, but the Plan does not distinguish between mobilE
home development and standard construction single family.

Therefore, because the submitted plat indicates low densit;-
residential lots and the development lies on the fringe of a
planned low density neighborhood, the Planning Commission i.s
of the opinion that the proposed development is not in conflict
with the Comprehensive Plan.
2. Transient Living (1953) and Re sidential Mobile Home (1969) zone s
have been established north of the development proposal. A
steep bluff defines the southern boundary of the proposal. Tiiis
proposed development is an extension of an existinq residential
mobile home development.
3. The Planning Commission has recommended on the preliminary
plat of Apple Valley Estates, First Addition (PE-7306-70), that the
developnent incorporate a public sewer system to prevent a
potential health hazard.

A. Conditions:
1. That the plat be redesigned substantially as indicated on the
preliminary plat of record to provfde for a private recreation area
as noted and to adjust the alignment of Fourth Avenue to match
with Fourth Avenue eY.isting and also to relocate a north-south
street in the plat to provide for an adjusted lot arrangement on
Flora.
A) The sponsor shall submit the proposed farm of the legal
documents for continued retention, development, and main-
tenance of all comman open space land prior to the filing of
the final plat; which documents shall provide, among other
things, for a minimum assessment of inembers of a home
o;,jners' association for such open space development and
rriaintenance. Safd documents to be approved by the Planning
Director prior to filing of the final plat.
B) The areas shown as recreation area and sewer treatment site
must be accurately defined and given lot and block numbers.
'rhe final plat will show the future ownership status of
parcels to be sold, parcels to remain public (i , e., sevver
treatment site) and parcels to remain in common ownership.
C) That the sponsor, prior to filfng of the final plat, provide for
minimum improverrrent of the common open space land; such
improvements wil.l be accomplf shed at the sponsor's expense
and shall include proper guarantee of minimum standards of
improvement (i . e, turfing and adequate sprinkling system)
which shall be approved by the Planning Director.
D) If a final plat is to be filed that does not include the entire

Provisions contained in declaration of protective covenants of
Apple Valley Estates, dated June 6, 1969, recor.ded June 13, 1969
under auditor' s f ile No.431871C, as fo llows :
1. TERM: These covenants are to run with the land and shall
be binding on all parties and all persons claiming under them for
a period of thirty-five (35) years from the date these covenants are
recorded, and after which 1:iMe said covenants shall be automatically
extended for successive periods of ten (10) years unless an instru-
ment signed by a majority of the then ovmers of the lots has been
recorded, agreeing to change said covenants in whole or in part.
2. ENFORCEPdENT: Enforcement shall be by proceedings at law
or in equity against any pzrson or persons violating or attempting
to violate any covenants, either to restrain violation or to recover
danages.
3. SEVERABILITY: Invalidation of any one of these covenants
by judgment or court order shall in no wise affect any of the other
provisions which shall remain in full force and effect.
4. LAND USE AND BUILDING TYPE: Al1 lo ts shall be used for
residential mobil homes. No structure or building other than a
single mobile home shall be permitted on each of said lots and said
mobil homes shall be manufactured by a nationally krnown manufactur-
ing firm or otherwise approved by the Control Committee. As appur-
Lent and incidental to the residential use of any mobil home a patio,
canopy and one single or double detached garage or car port, archi-
tecturally in harmony with and of permanent structure may be erected
on said lot, subject to the limitations herein. The owner of any lot,
once construction of a patio, canopy or detached garage or car port
is comrnenced shall, within nine ty (90) days thereafter, have the
patio, canopy, garage or car port completed, and in the case of a
garage or car port shall have the exterior completely
finished and all necessary painting or staining completed. Only
tvro aizes o#' garages or car ports shall be permitted on any lot,
narnely 241 x 26, or 18, x 261. The roof pitch on any garage or
car port shall be the same pitch as that of the mobile home located
on the lot and shall in no event exceed 2/12 pitch. Plans and spe-
cifications for such improvements shall be submitted to the Control
Committee and approved as provided in paragraph 6 hereof. No mobile
home less than 12 feet in width and 50 feet in length shall be per-
mitted on any lo t.
5. ARCHITECTURAL CONTROL: No building or structure shall be
erected, placed, permitted or altered on any lot until. the construc-.
tion plans and apecifications and a plan showing the location of the
structure on the lot has been approved by the Control Committee as
to quality and worlflnanship and.materials, harmony of exterior design

with the exist:ing stiructures and as to location with respect to topo-
graphy and finished grade elevation. No fence, hedge or boundary
vrall abutting on a street shall exceed three (3) feet in elevation
above the finished grade surface of the ground upon which such fence,
hedge or boundary wall is situated unless similarly approved by the
Control Committee. Approval shall be as provided in paragraph 6
hereo f .
6. CONTROL COMI11ITTEE: The Control Committee is composed of
MIKE BASCETTA, JOSEPH BASCETTA and LLOYD K. MILLER. A majority
of the committee may designate a representative to act for it. In
the event of the death or resignation of any member of the commit-
tee the remaining members shall have full authority to designate a
successor. Neither the members of the committee nor its designated
representative shall be entitled Lo any compensation for service
performed pursuant to this covenant. At any time the then record
owners of a majority of the lots shall have the power with a duly
reco rded written instrument, to change the membership of the committee
or to withdraw from the committee or to restore to it any of its
povrers and duties. The committee's approval or disapproval as re-
quired in these covenants shall be in writing. In the event the com-
mittee or its designated representative fails to approve or disapprove
within thirty (30) days after plans and specifications have been I
submitted to it or if, in any event, no suit to enjoin the construc-
tion has been commended prior to the completion thereof, approval
will not be required and the related covenants shall be deemed to
have been fully complied with.
7. NUISANCES AND RULES: No noxious or offensive activities
shall be carried on upon any lot nor shall anything be done thereon
which may be or may become an annoyance o r nuisance to the neigh-
borhood. All occupants of mobile homes in said additjon shall sub-
ject to weekly garbage service from a commercial garbage collection
service in the Spo kane Valley Area and shall at no time allow garbage
to accumulate or collect in the area. In addition thereto, all own-
ers of property situated within this pla-t must conform to such reason-
able rules and regulations as the Control Committee may fro;n time to
time adopt for the protection, comfort and convenience of the re-
sidents therein.
8. TEMPORARY STRUCTURES: No structures of any temporary charao-
l ter, basement, tent, shack, garage, barn or other structure or
building shall be placed or permitted on any lot at any time as a
rebidence, either temporarily or permanently.
9. VEHICLES: No major repair of any mo to r vehicle or other
eguipment shall be permitted on any lot in the addition. No storage
of any motor vehicle or other equipment, either temporary or perman-
ently shall be permitted on any lot in the addition. EXCEPT that

one camper and one boat may be stored on each lot. No rnore than
three motor vehicles, in operating condition, shall be maintained
and parked at any one time by any owner of the lots in the addii;ion.
10. ANIMALS: No animals or livesLock of any kind shall be
raised, bred or kept on any lot in the addition except as provided
in paragraph ll hereof.
11. CHILDREN AND PETS: It is the intention and purpose of the
plater and subdivider herein to se t aside a certain portion of
this subdivision for owners and occupants with children and pets
and to exclude from the remaining portion of the addition otitiTners
and occupants with children and pets. Accordingly, ovlners and oc-
cupants with children and pets shall be permitted only in lots 1
through 5 inclusive in block l, and all of block 3 and 4 of the sub-
division. PROVIDED, HOWEVER, that pets shall be restricted to one
cat and one dog of miniature breed or conibination thereof (not ex-
ceeding 12 pounds in weight) on each lot in the portion of the sub-
division where pets are permitted. PROVTDED FURTHER, HOWEVER, that
any dog shall be penned or on leash. In the event of a violation
of this restriction and failure to comply with the same after thirty
(30)'days written notice from the Control Committee, the owner of ~
said dog shall remove the animal from the area.
12. SIGNS: No signs of any kind shall be displayed to the
public view on any lot without the approval of the Control Committee. i
13. CHANGE OF RESTRICTIONS: The subdivider reserves the right
to change or cancel any or all of these restrictions, if in its
jv.dgment the development or lack of development of this or adjoining
property malces this course necessary or advisable.

Dear sias:
Due to illness I will be unable to be present at the hearing of application
of West Valley Builders Inc., for an addition of nine (9) acres to be added
to Apple-N*lley Mobile Homes. I hope nW letter will be considered as though
I were present.
I am opposed to tl4e extention of the present area now called Apple Valley
Mobile Homes.
Because of Urban sprawl which would be caused by this extention it would
engulf the last of the beauty spots of the Va11ey and crea.te a type of Ghetto
living when individualo lot owners failed to keep their property up to
sta:ndards of the coamminity life.
Such deterioration can be noted in older locations „that time and indifference
of individual lot own.ers hsve created.
It seems to me the expansion of Apple Valley Mobil Homes should be liral.ted
to Third Avenue, where it now is.
With so much open land still available in the Valley where an expanding
unit of this kind can find ample room to spread instead of engulfing one of the
last beauty spots in the area., which can only result in the damage and unhappiness
for home owners in the neighb9thood.
Is this trend to continue by addition after add.ition untilthere is a trailer
on every spot tdlat can be added. Li.ke the old e"mer who said he d.idn,t wan6t

The present trailer court is we11 done and fits into the neighborhood as
wSll as is possible, but I do not feel the present detelopers i~`re entitled to
the expansion proposed. This would just about gobble up the rest od the area
abutting on the beautifal cliffs on which is located the Lutheran Home.
This problem is close to the hea.rts of the home owners. We are few in
numbers but I am sure you folks on the Planning Commission are able to discern
the difference between our desire for a good home environment bnd the desire
of the Constxuction Company to add to its holdings.
I would ask? -Is there a need for added trailer cities in this spot?

Gentlemen:
This letter is being written to protest the pronosed zone change of Sec. 19
Township 25N., Range 45, E.W.M. The North 435 feet of that portion of the W1/2
of the N W 1/4 of Sec. 19 lying south of 3rd Ave.
Our reasons for protesting are listed as follows;
(1) Many of the homes here still have wells and we all have septic tanks.
How long will i_t be before the water is polluted by the number of septic
tanks that would have to be installed?
(2) Who is going to pay for the road building that will be necessary to
take care of the additional traffic? Who will pay the taxes for the un-
keep on these roads?
(3) Trailer parks are filled with temporary residents. What about the
rundown, messy garbage filled trailers that are vacated? What will this
do to the value of the permanent homes? Who will want to bui_ld a home
next to a trailer jungle if this is permitted?
(4) What are the long range plans of this group? Are they to go astray
as did their last venture?
We are definitely opposed to this zone change. Should the wishes of two
people take away the way of life of all the permanent residents in this neigh-
borhood? We built our home in Veradale last because this was zoned for agri-
culture and to get away from one home on top of another and the glorified
business districts of this type in the city. All this proposed zone change is
is a glorified business.
