FINDINGS AND ORDER REGARDING PRELIMINARY PLAT PROPOSAL AND ZONE RECLASSIFICATION,
PE-1311-79, JAN'S ADDITION; ZE-124-79, AGRICULTURAL TO SINGLE-FAMILY RESIDENTIAL.
WHEREAS, The Spokane County Subdivision Hearing Examiner Committee did, after
public hearing on June 28, 1979, and August 30, 1979, take action by motion that the
preliminary pla t to be known as Jan's- Addition (File No. PE-1311-79) be approved
subject to certain conditions; and,
WHEREAS, James S. Craven, Attorney for the Sponsor, Joe Ward, did request
a special hearing before the Board of County Commissioners to present evidence and
testimony against the motion of the Hearing Examiner to attach certain conditions as
described in their Findings and Order; and,
WHEREAS, The Board of County Commissioners did hold a public hearing on
October 8, 1979, to consider the Findings and Order of the Hearing Examiner and
testimony and request of the plat sponsor, objectors, and other interested parties;
and,
WHEREAS, At said hearing opportunity was afforded those favoring and those
opposing the proposed conditions and the Board of County Commissioners of Spokane
County, having fully considered the testimony given, the Findings and Order of the
Hearing Examiner, the environmental checklist, and all other evidence presented, and
further having personally acquainted themselves with the site and vicinity in question,
does hereby find that the conclusions of the Hearing Examiner were generally valid and
sufficient, except the following conditions will apply:
l. The plat sponsor is not required to construct sidewalks
on 16th Avenue
2. The plat sponsor is not required to improve Qurns Road beyond
the boundaries of subject plat.
3. The plat sponsor is required to construct the road system
without the benefit of the County RID system.
NOW9 THEREFORE, The Board of County Commissioners does conclude that the
preliminary plat to be known as JAN'S ADDITION and zone reclassification upgrading to
Single-Family Residential should be and hereby is approved.

This being the time set by the Board of County Commissioners of Spokane County, Washington to render its decision concerning the request of
Joe Ward, South 813 Pines Road, Spokane, 4JA 99206 for the above captioned
preliminary subdivision and zone reclassification; and
The Spokane County Hearing Examiner Committee having heard the above
request on June 28, 1979 and August 30, 1979, did approve said application
subject to certain conditions; and
Thd Board having conducted its own public hearing on October 8, 1979,
at the request of James S. Craven, Attorney for the sponsor, Mr. Ward,
and after visiting the site and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to uphold the approval of the Hearing Examiner Committee,
subject to conditions;
EXCEPT
1) The plat sponsor is not required to construct sidewalks

A. INTRODUCTION
This matter having come before the Examiner Committee on August 30, 1979
for discussion and clarification of conditions within the approval of the
proposal on June 28, 1979, and the members of the Committee present being
Eldon Thomas, Chairman, Jane Myers and Ted McCoury.
B. °ROPOSAL
The proposal PE-1311-79, Jan's Addition and ZE-124-79, Single Family Residential
originally approved on June 28, 1979, is now being heard for a clarification
of engineering conditions placed on the plat, and there being present the
folloviing applicant or representative: Joseph Ward. '
C. FINDINGS OF FACT AND CLARIFIED CONDITIONS
1. The Hearing Examiner, after hearing testimony from the staff, plat sponsor
,
and the public, generally supports the original conditions as stated
on the Findings and Order dated June 28, 1979
2. Those conditions concerning the County paving policy regarding the dedication,
paving, curbing and sidewalk where necessary along 16th and Progress
are affirmed by the Hearing Examiner Committee.
3. Condition #31 will be revised to read "Lots 15, 16 & Tract A" will remain .
Agricultural.
4. Condition 7IT29 concerning paving the road south to Vera Crest addition
will be deleted.

Gentlemen:
On August 30, 19`739, the Plat Hearing Examiner Committee met at 9:00 A.M. to
consider four Extensions of Time and seven Preliminary Plats and one Discussion
on clarification of engineering conditions for Jan's Addition. Following are the
applications in sequence and the action taken by the Committee. If not appealed,
these decisions are final 10 days after P-tinutes have been signed by the Hearing
Exami ner Comrii ttee, whi ch was August 31, 1979.

l. PE-1311-79, Jan's Addition - Clarification of Engineering Conditions
- Hearing Examiner Committee generally supports the original conditions as
stated on Findings and Order da ted June 28, 1979.
- Those conditions concerning County paving policy regarding dedication, paving,
curbing and sidewalk where necessary along 16th & Progress are affirmed by
Hearing Examiner Comnittee.

D. SPECIAL CONDITIONS OR CONTIGENCIES APPLiCABLE TO THIS
SUBDIVISION APPROVAL:
1. ' That the plat be designated as indicated on the preliminary plat of record
and/or attached sheets as noted.
2. That a statement be placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shall any lot be
further subdivided for the purposes of creating additional lots or building
sites without filing a replat.
3. That the plat provide for right of way width for streets as indicated on
the preliminary plat of record.
4. That appropriate provision be made that the foltowing described property
be held in trust until the continuation of the streets be dedicated or
deeded: A I' strip at the ends or edges of all streets that terminate or
border the plat boundary. (Temporary cul de sacs are required when
streets terminate at the plat boundaries.)

Section 11.15.340 of the Spokane County Environmental Ordinance (SCEO)
prior to approval, or any approving action in accordance with SCEO
11.15.340.
NOTE: The official file contains an environmental checklist for the
proposal and a staff review of their checklist as required by
WAC 197-10-320.
11. That conditional approval of the plat is given subject to the dedication of
right of way to the public and approval of the road system in the plat by
the County Engineer.

12. That plans, profiles, and cross sections showing proposed street centerline
and curb grades be submitted to the County Engineer for approval prior

13. The drainage plans and design calculations showing the grades and

shall be responsible for perpetuating all evidence of the location of survey
monuments which may be distrubed during construction and who shall
furnish the County Engineer with "As Built" plans and a certificate in
writing that all improvements were installed to the lines and grades shown
on the approved construction plans and that all disturbed monuments have
been replaced.

23. That the Hearing Examiner Committee sustain the issuance of a proposed
Declaration of Non-Significance and recommends issuance of a final
Declaration of Non-Significance.
24. That a public water system serviced by Vera Water and Power, and
including fire flows, serve each lot prior to the sale of the lot.
25. That final construction plans for on-site storm drainage facilities be
reviewed and approved prior to filing of the final plat by the County
Utilities Engineer and the County Health District.
26. That the plat dedication contain the statement: "Use of private wells and
water systems is prohibited.
27. That the plat is to be filled in its entirety with no phasing allowed.
28. That all public roads within the plat be curbed and paved to the speci-
fications of the County Engineer. Existing County roads providing direct
access to the plat shall be paved and curbed to the standards of the
County Engineer.
29. That the sponsor provide fulfy improved road connection to Vera Crest
Subdivision and Burns Road. Roadway improvements and right-of-way for
this connection shall be full width and in compliance with County
standards.
30. That the proposed plat to the west of this property must be filed prior to
the filing of this plat to provide necessary access to this plat.
31. That Lots 16, 17 and Tract "A" be rezoned Agricultural Suburban with
duplexes prohibited.

15. No construction work is to be performed with the Public Right of Way untii
a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
16. All construction within the Public Right of bUay is to be compieted prior to
filing the final plat or a bond in the amount estimated by the County
Engineer to cover the cost or construction of improvements, construction
certification, "As Built" plans, and monumenting the street center{ines,
shall be filed with the County Engineer.
17. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessar and the Planning staff.
18. That each lot be authoriZed for the use of individual on-site sewage
disposal systems.
19. Prior to filing of the final plat, the sponsor shall present evidence that
the plat lies within the recorded service area of the proposed water
district.
Special Conditions
20. That the provisions of SEPA'S NOTICE OF ACTION pursuant to
43.21C.080 RCW and the 8oard of County Commissioner's Resolution
No. 77-1392 be accomplished by the project applicant within thirty (30)
days of formal action by the Hearing Examiner Committee, with regard to
the preliminary plat approval; as instructed by the Planning Department
staff.
21. That upon filing of the final plat, the zoning be reclassified from
- Agricultural to Single Family Residential.
22. That the project sponsor is responsible for requesting an extension of time
to review any preliminary plat approval. All extensions applied for may
subject the project sponsor to new conditions required by Reviewing
Agencies.

The propased site is ctxrrently in pasture laud with twv existing dwellings on
the property. Ta the nQrth, west and sauth are .resi.dential subdivisions with
similar lot sizes as those proposed. There are dupI.ex uses to the narth along
16th Avenue aad alsa 3 duplexes located on Pragress Road on segregated lots
sauth of 16th Avenue, This proposal includes Short Plat 78-082 which
encomgasses Lots I through S al.ong 16th Avenue arrd will be vacated if this
prnpvsal is approved. The spnnsflr did receive a Canditianal ll'se Permit on ane
of the Short Plat lots for a duplex use. Recently another applicatian far a
duplex was denied by the Zoniag Adjustor due ta the pending action af this
proposed plat.
2. Compatibi.lity with Existing Land Uses
Adaacent tv and west of this prapased plat is South Adams Addition which was
recently approved by the County Commissioners +witb the stigulation that there
be gross density half acre Iots and a11 duplex uses be deleted. Ia regard to
this decision it would appear the density of the praposal is consistent but
the duplex uses are not compatible. Those duplex uses aow in the immediate
aicanity are primarily located on segregatians that were gat reviewed through
the public hearing p rocess.

Il. SPECIAL INFORMATION
A. Circulation
The Caunty Road Engineer has examined the praposed prelimiQary plat and
conditioned the plat to asstire rvad eonnections ta the west and south.
B. Sewage Disposal
The applicant's engineer has prepared an analysis of alternatzve sewage dis-
posal means; iacluding on-site septic tank disgosal, comrnunity septic tank
dispasal, and community package treatrnent p1.ast disposal. For econornic
reasorls, and to prouide the most reali'stic alternative, the apglicant's engi-
neer feels on-site septic tanks should be utilized.
The Spokane Cauaty Health Drstrict has autharized the use of individual
on-site sewage systems fvr each lat within the glat. The p}.a°t is situated
over the 5pokane Valley Aquifer and the Health District in thez.r exarnination
of the possible impact oa groundwater quaIity fzam this proposal have the
fallawing commeats :
Imgact Discussiaa
a. The plat sponsnr has groposed 16 lots on 8 acres. Each lnt is to be
served by a public water system and its individual on-site sewage
dispasal system. This raises the questinn of significance of the impact
an the groundurater in the area and passible alternatives for sewage
disposal.
b. In the evurse of the conduct of the Army Corps study, Dr. Todd considered
tygieal sails, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Va11ey
upvn the quality of the graundwater. In summary, he cancluded that:
1. In narrnal precipitatian years subsurface disposal of sewage
- treatment effiuent daes reach and recharge the graundwater.
2. Al1 the dissalved salts in sewage effluent wil,l be carried to
the groundwater. Hvwever, bacteria an,d detergeflts
(Phosphate portkan) are rnost},y removed bp the deep soil layer
above the groundwater and '}minor dissolved constituents such as
phvsphates, wbLz.ch are known to react with sail particles, ❑r .
nitrates, which are taken up by the plant roats,'s will be less
than the tatal faund in septic tank effluents.
3. The caleulated results at the downstream end of groundwater
flow line indicate that the maximurn range of (dissalved) solids
concentration expected at presnet (1975) is ug to 93 mgJl
(anilligrams per Iiter) above the naturaI groundwater background
of 155 mgJl. The forecast year 2024 maxirnurn incremental
can+centration is 101 mg/i above the natural backgrounda

terms of leachate volume and dissolved solids concentration,
indicate that the present impact on groundwater quality is
already a substantial proportion of the ultimate level.
c. Currently, results of chemical analysis show the total nitrogen content
of the groundwater as in the range of 1.35 to 1.7 ppm. A projected
incremental increase using Dr. Todd's expected 8.6 percent would result
in a range of 1.56 to 1.94 ppm. Current Federal and State drinking water
standards permit up to 10 ppm.
C. Draina&e
The County Utilities Engineer reports that-the preliminary storm drainage plan
submitted by the applicant indicates that on-site storm drainage provisions
will adequately handle surface water runoff. However, final construction
plans and specifications should be approved prior to the final plat filing.
D. Water Supp ly
The proposal is located within the recorded service area of Vera Water and
Power
The District advises the staff that adequate system capacity, and a desire on
their part to serve, exists for the provision of water for domestic and fire
uses, although arrangements have not been made.
E. Fire Protectioa
The proposal is situated within the recorded service atea of Fire District #1.
The Fire District staff requests that the Hearing Examiner Committee require
mains and hydrants of sufficient size for fire protection as a condition of
. final plat approval. The District also requests that they be allowed to
review and approve water plans for fire flows.
F. Schools
Proposal lies within the boundaries of Central Valley School District #356.
G. Parks
The report "Planning for Parks" (revised 1976) indicates an existing
elementary school (Adams) at the northeast corner of Adams Road and 8th Avenue
and and existing junior high school (Evergreen) adjacent to and north of 16th
Avenue approximately k mile west of Adams Road. A community park site has
been proposed in the general area adjacent to and north of Evergreen Junior
High School.
H. Unique Environmental Features
None have been indentified.

The Plannfng Director issued a proposed Declaratioa of Non-Significaace, and it was
+circulated to other agencies of jurisdiction.
V. CONDITIONS :
If appraval is granted, the following corLditions are recammencied.

1. That the plat be designated as indicated on the preliminary plat vf record
and/or attached sheets as noted.
2. That a statement be piaced in the dedicat~on to the effect that no more than

subdivided for the purpases of creata.ng additional lats or building sites
without filiag a replat.
3. That the plat pravide for right of way width for streets as indicated oa the
• preliminary plat of record.

the water supplier and fire protection district. Said water plan must also
have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in conformance with their requirements and will adequately
satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.
The purveyor will also certify prior to the filing of the final plat on a copy
of said water plan that appropriate contractual arrangements have been made
with the plat sponsor for construction of the water system, in accordance with
the approved plan, and in accordance with a time schedule. The time schedule
will provide, in any case, for completion of the water system and inspection
by the appropriate health authorities prior to application for building
permits within the plat. The contractual arrangements will include a
provision holding Spokane County and the purveyor harmless from claims by any
lot purchaser refused a building permit due to the failure of the plat sponsor
to satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities and the local
fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
8. That a certificate of title be furnished the Planning Department prior to the
filing of the final plat.
9. That the preliminary plat be given conditional approval to July 1, 1980.
10. That a declaration of Non-Significance be issued, in accordance with
Section 11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior
to approval, or any approving action in accordance with SCEO 11.15.340.
NOTE: The official file contains an environmental checklist for the
proposal and a staff review of their checklist as required by
WAC 197-10-320.
11. That conditional approval of the plat is given subject to the dedication of
right of way to the public and approval of the road system in the plat by the
County Engineer.
12. That plans, profiles, and cross sections showing proposed street centerline
aad curb grades be submitted to the County Engineer for approval prior to
construction and the filing of a final plat.
13. The drainage plans and design calculations showing the grades and alignment of
drainage facilities be submitted to the County Engineer for approval prior to
construction and the filing of a final plat.
14. Construction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed land surveyor, who shall
be responsible for perpetuating all evidence of the location of survey
monuments which may be distrubed during construction and who shall furnish the
County Engineer with "As Built" plans and a certificate in writing that all
improvements were installed to the lines and grades shown on the approved
construction plans and that all disturbed monuments have been replaced.

15. No construction work is to be performed with the Public Right of Way until a
permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
16. All construction within the Public Right of Way is to be completed prior to
filing the final plat or a bond in the amount estimated by the County Engineer
to cover the cost or construction of improvements, constructioa certification,
"As Built" plans, and monumenting the street centerlines, shall be filed with
the County Engineer.
17. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor and the Plan.ning staff.
18. That each lot be authorized for the use of individual on-site sewage disposal
systems.
19. Prior to filing of the final plat, the sponsor shall present evidence that the
plat lies within the recorded service area of the proposed water district.
Special Conditions
20. That the provisions of SEPA'S NOTICE OF ACTION pursuant to 43.21C.080 RCW and
the Board of County Commissioner's Resolution No. 77-1392 be accomplished by
the project applicant within thirty (30) days of formal action by the Hearing
Examiner Committee, with regard to the preliminary plat approval; as
instructed by the Planning Department staff.
21. That upon filing of the final plat, the zoning be reclassified to Single and
Two Family Residential.
22. That the project sponsor is responsible for requesting an extension of time to
review any preliminary plat approval. All extensions applied for may subject
the project sponsor to new conditions required by Reviewing Agencies.
23r That the Hearing Examiner Committee sustain the issuance of a proposed
Declaration of Non-Significance and recommends issuance of a final Declaration
of Non-Significance.
24. , That a public water system serviced by Vera Water and Power, aad including
fire flows, serve each lot prior to the sale of the lot.
25. That final construction plans for oa-site storm drainage facilities be
reviewed and approved prior to filing of the final plat by the County
Utilities Engineer and the County Health District. ~
26. That the plat dedication contain the statement: 'fUse of private wells and
water systems is prohibited.
27. That the plat is to be filled in its entirety with no phasing allowed.

2. Topography, Soils and Water:
a. This project lies in a relatively flat area, 0-15% slope. It is irregular
in shape bordered on north by 16th Avenue and on the east by Progress Road.
The east property line extends from the southeast corner south 633', thence
east 640' to Progress Road, thence 320' north, thence 230' west, thence 300'
north to 16th Avenue, thence 407' west to the east property line. It is
located over the Spokane Valley Aquifer.
b. Surface soils are classed as Garrison gravelly loam with 0 to S% slopes.
They have a septic tank filter field limitation of slight with possible.
contamination of groundwater.
c. Geologically, the soils are glaciofluvial deposits; stream-laid sand and
gravel; contains some boulders in places; includes some undifferentiated
glacial deposits. The lower terrace remnants have probably been reworked
by streams. These geologic structures yield moderate to very large
amounts of water.

d. The data contained in the 208 Study Sampling indicated a total nitrogen
level in the range of 1.35 to 1.7 ppm. The Vera Water District has in-
dicated that it is willing and able to furnish domestic use water to the
plat. Satisfactory arrangements have not been made with the developer.
3. Impact Discussion:
a. The plat sponsor has proposed 16 lots on 8 acres. Each lot is to be
served by a public water system and its individual on-site sewage dis-
posal system. This raises the question of significance of the impact
on the groundwater in the area and possible alternatives for sewage
disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In summary, he concluded that:
(1) In normal precipitation years, subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
(2) All dissolved salts in sewage effluent will be carried to the
groundwater. However, bacteria and detergents (phosphate por- .
tion) are mostly removed by the deep soil layer above the
groundwater and "minor dissolved constituents such as phos-
phates, which are known to react with solid particles, or
nitrates, which are taken up by plant roots" will be less
than the total found in septic tank effluents.
(3) "The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) sol-
ids concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater back-
ground of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background."---"The
analytical results of the forecast impact of year 2020 when com-
pared with the present impact, both measured in terms of leachate
volume and dissolved solids concentration, indicate that the
present impact on groundwater quality is already a substantial
proportion of the ultimate level."
c. Currently, results of a chemical analysis show the nitrogen content of
the groundwater as in the range of 1.35 to 1.7 ppm. A projected incre-
mental increase using Dr. Todd's expected 8.6 percent would result in a
range of 1.56 to 1.94 ppm. Current Federal and State drinking water
standards permit up to 10 ppm.

4. Recommended that:
, a. The final plat shall be designed as indicated on the preliminary plat of
record and/or attached sheets as noted.
, b. The dedicatory language of the plat will state that each lot is authorized
the use of an individual on-site sewage disposal system.
c. The plat dedication will contain a statement to the effect that: "The public
water system as approved by County and State Health authorities and the local
fire district and purveyor will be installed within this plat, and the sub-
divider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot."
d. A plan for water facilities adequate for domesCic use, domestic irrigation
use and f ire protection use shall be approved bq the water supplier. Said
water plan must have been approved by the fire protection district and the
appropriate health authorities. The health authorities, water supplier
(purveyor), and f ire protection district will certify, prior to the filing
of the final plat, on the face of said water plan that the plan is in con-
>formance with their requirements and will adequately satisfy their respective
needs. Said water plan and certification will be drafted on a transparency
suitable for reproduction.
e. Appropriate utility easements sha11 be indicated on copies of the prelimi-
nary plat of record for distribution by the Planning Department to the
.I/ utility companies, County Engineer and Spokane County Health District.
Written approval of the easements by the utility company must be received prior
to the submittal of the final plat. (Note: The first sentence is superfluous
is the easements are shown on the preliminary map as required by Ordinance
Chapters S and 6.) ' -
f. Prior to filing of the final plat, the sponsor shall present evidence that
the plat lies within the recorded service area of the water system proposed
to serve the plat. The dedicatory language on the plat shall state: "Use of
private wells and water systems is prohibited."
g. Drainage plans and design calculations showing the grades and alignment of
drainage facilities shall be submitted to the County Engineer and Spokane
County Health District for approval prior to construction and the filing of
the f inal plat.

The soils classification, based on Soil Survey, Spokane County,
Washington, Soil Conservation Service, U.S.D.A., March 1968,
is Garrison Very Gravelly Loam.
Soils of this type are listed as having slight limitations for
sewage disposal systems with possible contamination of ground
water, according to the Soil Conservation Service.

The average monthly operating costs for maintenance and operation
that the county charges for residential hookups is approximately
$6. 50/month . The monthly cost involved here with either the
Community Septic Tank or the Community Package Treatment Plant
is approximately $17.00/month, quite a significant di.fference.
Use of a community sewer system would not be economically f.easible
for a subdi.vision of this size.
No community facilities currPntly exist near the project site nor
are there prospects in the near future of a ma jor community secaerage
system.
Concentrations of septic tank effltaents or package treatment plant
ef f luents into one community drainf ield area may create greater
potential for ground caater contamination.
It is, therefore, recommended that sewage disposal by onsite septic
tanks for JAN'S ADDITION would be most feasible based on capital
costs, annual 0& M costs, and reduced potential for ground water
contamination.
