of a bluff
10 That County Health District and County Utilities are reasonably sure that
interim 'individual septic tan{<s will function, but the final plat review
process will assure this before approving the final plat
11 That the remaining lots are on siopes and have marginal soils that caused
the original condition for public sewer and should have public sewer
12 That additional finalizing of this preliminary piat in phases wouid not
satisfy the need for a public sewer if additional interim individual septic
tanks systems were allowed
13 That the preliminary piat substantially conforms to current adopted
policies
14 That the preliminary plat will constitute Priority Sewer Service Area
"fill-in" and is in near proximity to the pending Valley Sewer trunk line

The County Utilities Department is recommending additional coaditions to allow
a first phase of this preliminary plat to be finalized and still conform to
the condition for a public sewer for this proposal The plat approval dxd not
preclude phasing and the sponsor working with the various departments over the
past two years has developed Draft FLna1 Plats for two phases The sponsor's
new engineer has been recently working with County Utrlities regarding methods
of complying with the requirement for a public sewer for this project The
sponsor now desires to, as the first phase, finalize the 11 lots along 14th
Avenue, which is fully improved with curbs, paving, water mains and water
service lines to each 11 lots Since no "area-wide" nor "site" public sewer
system is available, the County Utilxties is recommending that this first 11
lot phase be coaditioned for interim sewer systems (septa.c taaks) aad eoricli-
tions to assure conversion to the "site" or "area-wide" public sewer system
when available Note developing the public sewer system for the site would
require finalization of most it aot all of the preliminary plat (54 lots) to
have a cost effective system

The Planning Department is recommending that all preliminaLy plat approvals be
brought into conformance with RCW 58 17 regarding the amount of time allowed
before a preliminary plat must be finalized. State law currently allows a
preliminary plat three (3) years (without any new conditions ) and allows one
extension of tirne for one year, if the sponsor requests the additional year,
however, this 4th year may have new conditions added
No other additional conditions of approval are being recommended by the re-
maining departroents

WHEREAS, The Spokane County Platting Hearing Examiner Committee did, after public
hearing on May 31, 1979, take action by motion that the preliminary plat to be known as
BUTTERCUP ADDITION (File No PE-1299-79) be approved, and,
WHEREAS, Russel F Herman, E 6207 12th Avenue, Spokane, Washington, 99206, did
request a special hearing before the Board oF County Commissioners to present evidence
and testimony against the motion of the Hearing Examiner to approve the above descrihed
preliminary plat and zone reclassification, and,
WHEREAS, The Board of County Comnissioners did hold a public hearing on July 23, 1979,
to consider the Findings and Order of the Hearing Examiner and testlmony and request of ,
the plat sponsor, objectors, and other interested parties, and,
WHEREAS, At said hearing opportunity was afforded those favoriny and those opposing
the above described preliminary plat proposal and zone reclassification, the Board of
County Commissioners of Spokane County, having fully considered the testimony given, the
Findings and Order of the Hearing Examiner, the environmental checklist, and all other
evidence presented, and further having personally acquainted themselves with the site and
vicinity in question, does hhereby find that the conclusions of the Hearing Examiner were
generally valid and sufficient, provided that

I GENERAL INFOR.rIATION
A Location
Buttercup Addition is situated in the western portion of the Spokane Valley
Generally, the site is bordered by llth Avenue, 14th .Avenue, Eastern Street on
the west, and the e\tension of Therman Street on the east

- 19 5 acres subdivided into 54 lots for single family use
- Lot frontages = Vary from 88 feet to 100 feet
- Lot sizes =Vary from 11,550 sq ft to 12,848 sq ft

The approved map of the Comprehensive Plan indlcates residential usage of this
area, as well as all nearby surrounding lands, with no density designation

1 Existing Land Uses
Buttercup Addition is a proposed replat of a portion of Sparks Addition, an
approved subciivision, with 5,000 sq ft lots, that was never fully developed
The proposed site is currently vacant with sloping topography Areas
surrounding the plat have develoged into residential uses Generallj, the
more conceatrated residential areas occur to the northe3st and south T;early
all plats in the area are relata.vely old with little or no platting activlty
occurring in the last few years
Northeast of the site is found a high concentratx.on of single family uses
existzng on lots as small as 6,000 sq ft and 7,000 sq ft The neH°est
subdivisZOn ia the area, Wa].lace First Addition, is situated adjacent to
Buttercup Addition on the northeast This plat contains 11 lots of
approximately 1 acre each with 10 existiag duplexes The size of those lots
is a function of a£loodplain zone that bisects the lots and the plat
Residential uses to the northwest of Buttercup Addition are scattered
sporadically and include both single family and dupleA dwellings Some
agricultural uses, primarily pastures, can be foiind north of 8th Avenue
South of the proposal are the VaJley View Hills Adda.tions with lot sizes
ranging froin approvimately 11,400 sq ft to 15,000 sq ft Approximately 75%
of the lots have been developed and contain single family uses

The area inunediately surrounding Buttercup Addition is primarily urban
residential in nature, hlghest densities are northeast of the site wlth
relatively lower densities to the south Buttercup Additlon proposes
residential uses that appear to be compatible with the aYea on lot sizes that
are consistent with those in the immediate vicin3ty

A Circulatioa
The County Road Engineer has examined the proposed preliminary plat of record
and has reconunended specific conditions to insure the satisfactory development
of this plat Generally, those recommendatzons deal with the futher
dedicatioa of rights-of-way and the improvement of all roads to current County
standards
B Sewage Disposal
The applicant's engineer has prepared an analysis of alternative sewage dis-
posal means, including on-site septic tank dispnsal, community septic tank
disposal, arld community package treatment plant disposal For economic
reasons, and to provide the most realistic alternative, the applicant's engi-
neer feels on-site septic tanks with a community dxainfield should be
utllized
The plat is situated over the Spokane Valley Aqux.fer and the Health Distirct
in their examination of the possible impact on groundwater quality from this
proposal have the following comments

some R-1 and R-2 zoning approved
The applicant has requested that the proposal be either left ln the Agricultural
