2. Findings:
a. This project lies over the Spokane-Rathdrum Aquifer.
b. The project is within Critical Water Supply Service Area #3 arid
within the service area of Spokane County Water District #3. Water
supply will be a public system.
c. The project is inside the Spokane County Comprehensive Wastewater
Management Area, inside the General Sewer Service Area, and inside
the Priority Sewer Service Area recommended in the '201' Study. The
method of sewage disposal is subject to approval of the Director of
Utilities, Spokane County, pursuant to County Resolution 80.0418
adopted March 24, 1980. The topography and soils in the area are
generally suitable for use of individual on-site sewage dispos(il
systems. The lot is not of the proper dimensians to permit the iise
of both an i ndi vi dua 1 wel 1and set-jage system.

d. The project lies in a relatively flat area west of Argonne Road ancl ,

Garrison gravelly loam with 0% to 5% slopes. They have a septic
tank filter field limitation of slight. There is also possible
contamination of groundwater. This soil would be classified as Type
IV.
f. Geologically, the soils are glaciofluvial deposits. These
geological structures generally yield moderate to very large amounts
of water. Data f rom we 11 s i n the area ref erenced i n secti on 1( f)
shows they are from 30' to 196' deep and have static water levels
varying from 5' to 101' below the surface. The Spokane County Water
District #3 has indicated that it can supply domestic use water for
the project upon completion of agreements with the proponent.
3. Required (mandatory) Conditions If Approved:
a. A combined surface water and sewage disposal detailed plan shall be
approved by the Spokane County Engineer and Spokane County Health
District prior to the issuance of any on-site sewage disposal permit
or building permit for this project.
b. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
c. Water service shall be coordinated through the Director of
Utilities, Spokane County.
d. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Oepartment of
Nealth.
e. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
f. Subj ect to spec i f i c appl i cati on approva 1 and i ssuance of permi ts by
the Health Officer, the use of an individual on-site sewage disposal
system may be authorized.
g. Contact shall be made to the Food Program Coordinator for the new
addition in regards to the Food Establishment permit.
4. Recommended Conditions of Approval:

~ Purauant to the Board of County Commiesioners Rseolution No. 80-0418, the use of on-
site sewer disposal systems is hereby authorized. Thie authorization is conditioned in
compliance with all rules and regulations of the Spokane County Health Dietrict and
is further conditioned and aubject to apecific application approval and issuance of
permits by the Health District.
~ The Owner(s) or 3uccessor(s) in interest agree to suthorize the County to place their
name(s) on a petition for the formation of a ULID by petition method pursuant to RCW
36.94 which the petition includea the Owner(s) property and further not to object by
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW 36.94 which includes the Owner(s) property. PROVIDED, this
condition ehall not prohibit the Owner(s) or Successor(s) from objection to any
asseasment(s) on the property as a result of improvements called for in conjunction with
the formation of a ULID by either petition or reaolution under RCW 36.94.
~ Any water service for this project shall be provided in accordance with the Coordinated
Water Syatem Plan for Spokane County, as alnended.
4.) There are no recommendations concerning the method of sewage disposal as the project
is outside of the 201 sewer study area.
5.) Water service as approved by the Spokane County Health District and/or Washington
3tate Department of 3ocial and Health Services.
~ Each unit shall be double plumbed for connection to future area-wide
collection systems.
A dry sewer connection to the future area-wide Sewerage 3ystem ie to be constructed.
Plane and speciffcations for the dry sewer connection are to be reviewed and approved
by the Utilities Department.
8.) Located within the Critical Water Supply Servfce Area but not within an,y purveyor's
distrfct. May be serviced by an individual well owned and operated by the lot owner.
9.) Any sewerage service for this project shall be provided in accordance with the
Comprehensive Wastewater Management Plan for Spokane County, as amended.
10) Sewerage facilities are not affected by this proposal therefore no recommendation.
11) Applicant will nlake connection to Public Sewer System. 3ewer Connection Permit is
required. Plans and Specifications are to be reviewed and approved by the Utilities
Department.
12) This project liea within the 3ewer Service Area. Applicant us
required to notify them of this proposal.
13) Applicant is required to sign a Developer Connection Agreement.

FINDINGS OF FACT AND CONCLUSIONS
1 The property is generally located m the Spokane Valley on the southwest corner of
th- intersection of Argonne Road and Montgomery Avenue in Section 7, Township
25 N, Range 44 EWM, Spokane County, Waslungton
2 The committee adopts the Planning Department Report as a part of this record The
Planning Department has recommended that the proposed platlrezone be approved as
conditioned
3 The existing land use(s) in the area are commercial to the east and south, while to the
north are proposed num-warehouses To the west of the site, across Hutchuison
Road, are single family residences
4 The proposed Change of Condition is compatible with exisnng uses in the area

General
The proposed development located at N 2315 Argonne Road, will be an
addition and remodel to an already existing restaurant Longhorn BBQ, wishes
to apply for a Change of Conditions that was attached to a Zone Reclassification
issued back in 1971, (ZE-91-70) and (ZE-91 a-70), see item #2 and #3
Change of CaOitiorA
The first condition was to piace a landscape screen to the south of the property
which abutted a residential zone That condition has smce changed and the
zone is now a B-3 zone, the same as the Longhorn BBQ Another condition was
to place an 85 ft strip of landscaping on the west side of the site which also
required a landscape screen The site currently has a 60 ft strip which has a
septic drain field in it The adjoining property to the south, °Super America Gas
Station°, has a 20 ft landscaping strip with screenmg vegetation along the west
property line The landscaping requirements for a B-3 zone that abuts a UR-3 5
zone is 'TYPE I 20'-0" MIN LANDSCAPING', thus the requirement for an 85 ft
strip of landscaping is no longer applicable Longhorn BBQ wishes to use the
existmg vegetation and plant new bushes and shrubs to match existing where
it's needed to fill m the screen as per'Type I LANDSCAPING' The only
exception would be to have the screen next to the property line, (the same as
Super America), instead of having it back 20'-Op as required by the 'Type I'
Landscaping
There are no requirements for landscapmg between B-3 zones
Phvsical Feotures
The totai site is 1 57 acres of which 62 65% is Parking Lot and Sidewalks
Building coverage will be 9,000 sq ft or 13 15%, and open landscaped
common areas are 26 74% The site has an existing restaurant (The Longhorn
BBQ) and will construct a new addition over part of the existmg parking The
current landscaping will be updated to satisfy the current Spokane County
Code

Longhom BARBECUE Restaurant, with the requested changes would be
complementary and compatible wnth the sunound.ing land uses by provid.ing
over twice the landscape buffer regularly requir+ed for existing B-3 zomng
2 Arterial Road Plan The proposal has frontage on Argonne Road,
which the Spokane County A,rtenal Road Plan designates as a Principal
Artenal wnth a planned nght-of-way of 100 feet The Comprehensive Plan
recommends that commercial development be located on artenal roads
The project is also bounded by the local access streets of Montgomery
Avenue (to the north) and Hutchinson Street (to the west)

the apphcant will provide more screenYng than that currendy requued witb the
3 1/2 feet lugh ornamental masonry wall m an 85 foot wide open landscaped azea
The Type I Screen will be taller (46 feet) and wider (5 feet) tha.a tfie requu-ed wall

proposed changes will have no significant effects to the existing and proposed
commercial uses The residences to the west will also actually benefit from the
proposed change to the landscaping as outluied at the end of the last sechon The
existing firewood storage area will be required to be relocatei away from the west
property hne and behind the Iandscape screen
Site Longhorn Barbecue restaurant
The proposed land use is a change of conciitions which will omit the
need for a four foot high ornamental masonry wall along the west and
south side of the property and decrease the landscaping width
requuement on the west property line from 85 feet to 55 feet
The exisdng firewood storage area on the northwest corner of the
property 2s not in compliance with the outdoor storage standards of the
Regional Business (B 3) zone The wood may not be stored wirhin
the froot (Hutchinson Road) or flanking smeet (Montgomery Avenue)
yards The front and flanking street yard setback requuement is 65
feet from the centerline of all roadwayhghts-of-ways or 35 feet from
the property line, whichever provides the greater setback from the
