The above described property is located within an area designated within the Comprehensive Wastewater Management Plan as affecting the Spokane Valley -Rathdrum Prairie sole source aquifer, and the owners of such property have made application for a permit or approval from Spokane County, which applica- tion requires the execution of this Utility Local Improvement D'+strict Real Prop- erty Covenant and Agreement. (1) OBLIGATION In accordance with the conditions of application approval in conjunction with Land Use Appfication No. set forth hereinabove, the owners hereby cove- nant and agree for themselves, their heirs, successors, assigns and personal representatives, to join in any valid petition for the formation a Utility Local tmprovement District established pursuant to Chapter 36.94 RCW, for the in- stalfation, maintenance or operation of sewer service and facilities which may be proposed to be established for the area in which the above-described property is located, and which will serve the above-described property, and said owners for themselves, their heirs, successors, assigns and personal representatives covenant and agree not to protest the establishment of such Utility Local Im- provement District as authorized under RCW 36.94.240 for such area, in serving said property, whether proposed by' petition or resolution of the appropriate governmental agency. PROVIDED, HOWEVER, this obligation shall not con- stitute a waiver of any right of said owners, their heirs, successors, assigns or personal representatives to object to or protest the U L I D assessment on the above-described property. (2) COVENANT. The obligation and agreements hereinabove contained are hereby declared to be covenants running with the above-described land, and shafl be binding upon the owners, their heirs, successors, assigns and personal representatives tor the benefit ot the above-described lands and surroundfng lands which may be included in such ULID. The County, upon approva{ of the permit or project for which the docu- ment is executed and running of the appeal time frame, shall execute the docu- ment and record the same with the Spokane County Auditor. If the permit or project is ultimately denied, the agreement will not be executed by the County and will be returned to the owner.
