Dear Commissioner Allen:
The undersigned are attorneys for Eddie K. Eng and other members
of his family who, during the past year, purchased certain
property from Lee Barton on East Sprague in the Valley. Attorney
Robert McKanna at that time processed a zone change to permit
the Engs to construct on a p4rtion of this property a restaurant
and lounqe to serve Chinese style faods. As you know, the
zoning was agproved subject to the general condition that con-
struction be commenced within a one-year period.
Beeause of problems in getting the necessary help to staff such
a business, especially in the matter of abtaining proper cooks
with sufficient skill in the art of Chinese cooking, the Engs are
not in a positidn to go ahead with their proposed constructian.
Even the issuan6e of a permit at this time would necessitate
the preparation of several thousand dollars worth of architect's drawings and plans for which the outlay is not presently warranted.
Tv make a long story short, we are at this time, on behalf of the
Engs, simply requestin+g that the construction condition be extended
for at least another twelve months. This extension would cause no
harm to anyone and would perhaps see them to the start of this new
groject of theirs6

WHEREAS, The Spokane County Planrung Commission did, after public
hearxng on February 9, 1973.. forward to the Board of County Commissioners a
recommendation that the Zoning Map not be changed from the existing Agncultural
Sunurban classif3.cation to the Commeraial classification on property dasoribed as

WHEREAS, The applicants before the Planning Commission, Barton Invest- ,
menc Company, ,did by letter dated February 13 , 1973 , request a hearing before the '
Board of County Commissioners to present evidence and testimony in favor of their
application, and ,

WHEREAS, The Board of County Commissioners did hold a public hearing on March 15 , 19 73 , to consider the recommendations of the Planning Commission and
testimony and evidence of the applicant and other interested parties, and
WHEREAS, At said hearing opportunity was afforded those favoring and
those opposing the above-described Zoning Map proposal, and the Board of
County Commissioners of Spokane County having fully considered the tesfiimony
given, the records and minutes af the Planning Commission and all other evidonce
,
presented and having personally acquainted themselves with the site and vicinrty
zn question, does hereby find: '
1) That the Comprehensive Plan Ys unreasonable and unrealistic with ~
respect to the property in question insofar as it suggests that the
property be developed to some type of residential use. The Plan
should be reevaluated.
2) That the application in question should not be considered as a spot
zone change since properties to the south across Sprague have been
approved for Commercial zoning.
3) That the particular use proposed, if developed according to the
plans submitted and without delay, would not be signzficantly
detximental to properties in the vicinity.

4) That a large major:ty of immediately adjoining owners apparently by
their petition and testimony favor the applicafiion and do not feel
zt would be detrimental to thexr properties.
NOW, THEREFORE, The Board of County Commissioners does conclude that
the above-described property should be classified Yn the Commercial classification
and does hereby order that an appropriate resolution be presented to the Board for
that purpose, and the Board does further order that said resolution incorporate the
condition that construction on the restaurant commence within ninety (90) days of
the date of the resolution, and that the property be developed in conformance with
tne site plan and artist's rendering of the restaurant strucfiure presented to the
Board at their hearing of March 15 , 1973.

COMPAnTY (Continued from the January 12th hearing. )
Planning Commission Recommendation: Deny
A. Reasons:
1, The Comprehensive Plan indicates that the frontage properties
on the north sfde of Sprague Avenue between McDonald Road
and the Vera Business district are not appropriate for
Commercial uses, The Comprehensive Plan limits commercial
development to the south side of Sprague Avenue with the
described corridor.
2. The Planning CommissYOn notes that none of the properties
on the north side of Sprague Avenue between Progress Road
and Clinton Road (approlamately 1 1/4 miles) are zoned either
Commercial or Local Business. The establishment of Commer-
cial zoning almost in the center of the 1 1/4 mile stretch
should be considered "spot°" zoning.
3. The Planning Commfssion is of the opinfon that the submitted
commercial proposal would not only be an unwarranted intrusion
into an established residential neighborhood, but would also
fail to provide sufficient protection for adjoining residential
propert3.e s. The Commis sion note s that the re sidential
neiqhborhood on the north side of Sprague Avenue is almost
exclusively developed or platted for single family home site s.
Approval of Commercial zoning for the advertised site would
set a precedent for similar applications which would cause
greater intrusions and disruptfons of the resfdential neighbor-
hood to the north.
4. In accordance with the objectives of the Comprehensive Plan
and previous actions by the Spokane County Planning Commis-
sion, the Commission is of the opinfon that the advertised
parcel is more appropriate for Resfdential Office or Multiple
Family Suburban Zoning. Such classifications would allow
uses which would have m1nimal impact on surrounding resi-
dential properties.

5. Although the Planning Commf ssfon does not attempt to
conclusively evaluate market conditions for each parcel under
consideration, the Commission notes that extensive vacant
commercial properties are available for development on the
south side of Sprague Avenue and at the Sullivan-Sprague
intersection, I n short there appears to be no demonstration
of need for additional commercial zoning in this general area.
The Commission also notes that several office projects have
been constructed on the north side of Sprague Avenue at
locations where the pressure for commercial development is
much greater than the advertised location.

2. We have a shortace of residential housing in this area. It
is sold usually before completion and moved into or rented im-
mediately. On the other hand there is a surplus of commercial
,,roperty available close by. Example- directly across the street
there is approximately three city blocks of suc!: property that
has been zoned comrnercial but at present is not in use as in-
tended. There have been mar~y comrnercial sites available near by
for years, rut rot used. `,Vhy?
3. I t is evident the main reasorl that this zone change is re-
que~ted is to make a"fast buck". To buy cheap residential land
and turn it into expensive commercial property is the name of the
game. And this is done without regard for the overall welfare of
the surrounding residents, and creates more commercial land which
is already in great abundar.ce in the immediate area..
4. The ans,;:er to all the above ;,uestions is r~roper long r~ nge
planning and this too is the reason for a Planning Commission.
Ne feel the proper decision by the Planning Commission is to reject
this zone change.
5. Attached are documents which have been signed by residents
of this immediate area, to oppose such a zone change as applied
for. These signatures represent both residents attending this
hearing and residents who are unable to attend but wish to be
