FINDINGS AND 4RDER
A. INTRODUCTIQN
This matter having come before the Zoning Hearing Examiner Committee on
September 4, 1986, and the members of the Committee present being
Phillip D. Harris, Chairman, Ron Ude11 and Jim Schurra.
B. PROPOSAL
The spansor, Kramer Enterprises, js requesting approval of a change of
conditions, File Nos. ZE-1A-73 and ZE-161A-13, Restricted Induistrial
Zone, fvr the purpase vf deleting conditian of approval of ZE-1-73 that
restri cted si gnage to anly one free-standi ng si gn; and to del ete condi ti on
of approval of ZE-161-73 which required all signs to be flat against
buildings.
C. FIMDINGS OF FACT
1. That the existing land use in the apea is a commercial center.
2. That the Comprehensave Plan designates this area as appropriate for
I ndu stri al dev►el opment.
3. That the existing zoning of the property described in the application
is Restricted Industrial,
4. This Change of Condit3ons request is exempt from the SEPA
Environmental Review process.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable far the proposed use, or
uses wi thi n the exi sti ng Zone C1 assifieati on.
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed ehange of conditions is justified.

C. FINDINGS OF FACT (continued)
8e That the propvsed use is compatible with existing uses in the
area.
9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Comm3ttee finds the proposed use to be in
harmony wi th the genera 1 purpose and wi 11 nat be otherwi se
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Heari ng Exami ner Con~ni ttee :
a) That the existing sign on-site is aesthetically pleasing, and
the requested Change of Conditions will bring the property inta
consistency with vther properties in the area.

2, A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrat4r shall be submitted with a performance bond for the
project pri or to re1 ea se of bui 1 di ng permi ts. Landscapi ng shal l
be installed and maintained such that sight distance at access
points is not obscured or impaired,
3. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Commi ttee. Vari ations when approved by the Zoni ng Admi ni strator
wi11 be permitted, including, but not 1imited to the following
changes: Building location, landscape plans, and general
allowable uses af the permitted zone. All variations must
conform to regulations set forth in the SPOKANE COUNTY ZOPJING

6. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay
Zone) of the SPOKANE COUNTY ZOPJING ORDINANCE. Accordingly, as a
condition of approval, the sponsor/applicant shall be required
to file with the Spokane County Auditor, within thirty (30) day s
of the signing of Findings and Order of the final decision in
this matter, a"Notice to the Public" which shall provide in
material as follows:
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR
CERTIFICATE QF OCCUPANCY FOR ANY BUILDING OR ANY USE
ON THE PROPERTY DESCRIBED HEREMAFTER, TME APPLICANT
SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIONS
OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4.16A
(AQUIFER SENSITIVE AREA OVERLAY ZONE). THE PROPERTY
WHICH,IS THE SUBJECT OF THIS NOTICE IS MORE PARTICULARLY

stormwater runoff and provide necessary landscaping for runoff.

A r"equest for a Change of Conditions in an existing Restricted
Industrial Zone for the purpose of deleting a condition of approval
that restricted signage to one free-standing sign and to delete a

buildings.
Location:
The site is generally located south of and adjacent to the
intersection of Montgbmery Drive and Indiana Avenue and north of and
adjacent to Interstate 90 in Section 9-25-44.
II. SITE ANALYSIS
Comprehensive Plan:
INIDUSTRIAL Category
- Inside General Sewer Service Area (GSSA) Boundary
- Inside Priority Sewer Service Area (PSSA) Boundary
- Inside Urban Impact Area (UTA) Boundary
Existing zoning is consistent with the Cornprehensive Plan. Decision
Guidelines recommend consideration of impacts to adjacent uses.

with sign limits while others have no sign controls. The Highway
Beautification Act would recommend signs be placed within 50-feet of
the structure on-site. If so placed, then there are no other State
restrictions.

Proposal: To allow~'detached sign with surface area of 467 square feet and
height of 60-feet. Condition 1 imited signs to: "The, advertised property
s ha 11 be 1 i mi ted to one (1) f ree-stand i ng s i gn not exceed i ng 25' i n he i g ht
or 120 sq.fto in area oriented to Indiana Avenue. All other advertising
structures on the property shall be placed flat against the building(s)."
III. PLANNING SUMMARY
The proposed change of conditions is consistent with some zone
changes in the area. The Corranittee should consider the size of the
sign and its impacts to the traveling public along I-90. The
applicant maintains the sign is necessary to provide direction and
exposure for his development.

IV. CONDITIONS OF APPROVAL

Recommendations are as circled:
(1) Pursuant to the Board of County Commissioners Resolution No. 80-0418, the
use of en-site sewer disposal systems is hereby authorized. This authoriza-
tion is conditioned on compliance with all rules and regulations of the
Spokane County Health District and is further conditioned and subject to
specific application approval and issuance of permits by the Health District.
(2) The Owner(s) or Successor(s) in interest agree to authorize the County to
place their name(s) on a petition for the formation of a ULID by petition
method pursuant to RCW 36.94 which the petition includes the Owner(s) prop-
erty and further not to object by the signing of a protest petition against
the formation of a ULID by resolution method pursuant to RC4I Chapter 36.9A
which includes the Owner(s) property. PROVIDED, this condition shall not
prohibit the Owner(s) or Successor(s) from objection to any assessment(s)
on the property as a result of improvements called for in conjunction with
the formation of a ULID by either petition or resolution method under RCI4
Chapter 36.94.
(3) Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
(4) There are no recommendations concerning the method of sewage disposal as
the project is outside of the 201 sewer study area.
(5) Water service as approved by the Spokane County Health District and/or the
4Jashington State Department of Social and Health Services.
(6) Each dwelling unit shall be double plumbed fo r connection to future area-
wide collection systems.
(7) A dry sewer connection to the future area-wide Sewerage System is to be con-
structed. Plans and specifications for the dry sewer connection are to be
reviewed and approved by the Utilities Department.
(8) Located within the Critical Water Supply Service Area but not within any
purveyor's district. May be serviced by an individual well owned and oper-
ated by lot owner.
(9) Any sewerage service for this project shall be provided in accordance with
the Comprehensive Wastewater Management Plan for Spokane County, as amended.
