fRestrictive covenants and easements referred to in Policy No
of the Transamerica Title Insurance Company, which are imposed by the

recorded in Volume 17 of Plats, page 19, as follows
No more than one dwelling structure shall be placed on any one lot, nor
shall any lot be further subdivided for the purpose of creating addi-
tional lots or building sites without filing a replat

A INTRODUCTION
This matter having come bef ore the Spokane County Subdivision Nearing
Examtner Committee on January 31, 1985, and the members of the Committee
present being Jane Myers, Chairperson, Lynn Tennican and Richard Skalstad
B. PROPOSAL
The sponsor, Kahuna Land Co. is requesting Change of Condition of a pre-
liminary plat of PS-1362B-79, KAHUNA NILLS 3RD ADDITION and Zone Change
ZS-262-79 from Agricultural Suburban to R-1
Proposal. The sponsor is requesting a change of condition for a redesign
of the remaining portion of the preliminary plat. The "change" involves
vacating 13th Avenue in the west portion of the preliminary plat and substi-
tuting a private road with cul-de-sac to serve the 5 westerly lots. The
sponsor desires to finalize Lots 1 and 2 of Block 1 to be served (during
the interim) by a private road that currently exists between Lots 2 and 3,
Block 1 of Final Plat KAHUNA HILLS SECOND ADDITION, until 13th Avenue and
the extended private road is developed with the finalization of the re-
maining preliminary plat.

tion is conditioned on compliance with all rules and regulations of the
Spokane County Heal th District and i s further conditi oned and subject to
specific application approval and issuance of permits by the Health District.

authorize the County to place their name(s) on a petition for the formation
of a ULID by petition method pursuant to RCW 36.94 whlch the petition includes

shall not prohibit the Owner(s) or Successor(s) from objection to any assess-

be reviewed and approved by the Utilities Department.
(8) Located within the Critical Water Supply Service Area but not within any
purveyo r's district. May be serviced by an individual well owned and oper-

The County Engineer agrees to a"change of condition" which would permit two (2)
parcels to be served by a private drive which extends from Kahuna Drive. However, no
more than two parcels will be permitted to utilize the private road as a means of ~
access. Once an alternate means of access to the two lots is developed, the private
access which connects to Kahuna Drive must be eliminated or barricaded in a manner
which would prohibit its use.
The County Engiaeer is concerned about the use of Kahuna Drive as a principal
means of access for parcels outside of the Plat of Kahuna Hills lst Additlon and Kahuna ,
Hills 2nd Addition. The intersection of Kahuna Drive at the presea[ location on the
Carnahan Hill was permitted only because of the small volume of traffic which would be
generated off of Rahuna Drive.
, The requirements for the improvement of 13th Avenue from Carnahan through the
J, ,
proposed plat were prompted for reasons of traffic safety and overall traffic circula-
~ tion.
The principal means of access (other than the easemeot from Kahuna Drive) to the
aponsor's property is the 13th Avenue alignment which extenda from Carnahan Road east-
ward. It does aot appear as if the vacation of this 13th Avenue right-of-way would be
appropriate until an alternate means of acceas is developed and it is determined by the
County that the 13th Avenue alignment is no longer needed.
Therefore, the County Engineer is reques[ing that the easement depicted on the
Revised Preliminary Plat of Record be increased to 60 ft. in wid[h and be designated as
a"Tract X" future public right-of-way. The easement shall extend from the proposed
' easterly 13th Avenue connection to the westerly property line. The "Tract X" will then
connect to the dedicated right-of-way for 13th Avenue.

tends east to west shall be designated as a"Tract X" futu e public right-of-way
and shali be a minimum of 60 ft. in width. This easement from the westerly prop-

may be bonded in accordance with the provisions of the Spokane County Subdivision
Ordinance.

History: The Hearing Examiner Conomittee approved this proposal in
January 1980. July 1980 change-of-conditions request was approved
with Hearing Examiner Committee modification. Two one-year tl.me
extensions have been granted, 1981 and 1982. The February 1981 time
extension included approval of a redesign for a cul-de-sac. Merch
1982 the first half of the preliminary plat with 14 lots was final-
ized with over $200,000 spent so far. Additionally, the sponsor
indicates that substantial progress toward finalizing this proposal
has been made; as the outer boundary has been surveyed, $50,000 has
been spent on blasting and rough grading Kahuna Drive, a sewer line
has been installed in Kahuna Drive, road plans and profiles are
completed for the remaining portion of Kahuna Drive, 13th Ave.
centerline and profiles have been surveyed and drafted, sewer plans '
' have been completed aad are being reviewed for Citq-County sewer
hook-up, commuaity sewer drainfield design has been approved, and
design and calculations are complete for the last half of this
proposal, but not yet approved by Spokane County.
Proposal: The sponsor is requestiag an "extension of time" of the
preliminary plat approval to divide the remaining 10± acres into 25 _
lots for single-family dwellings and to change the zoaing on the 10+
acres frqm Agricultural Suburban to R-1.
II. SPECIAL INFORMATION
The Planning Department is recommending tbat all preliminary plat approvals be
brought into conformance with RCW. 58.17 regarding the amount of time allowed
before a preliminary plat must be finalized. State law currently allows a
preliminary plat three (3) years (without any aew conditions) and allows one
exteasion of time for one year, if the spoasor requests the additional year;
however, this 4th year may have new coaditions added.

A. History
The Hearing Examiner Committ approved the plat ia January, 1980. The
sponsor requested a previous Change of Conditions heard on July 25, 1980 which
were approved as modified by the Committee. Now the sponsor is requestiag e
review of a revised plat.
B. Location
Kahuna Hills lst Addition is located on the south wall of the Spokane Valley
adjacent to and east of Carnahaa Road between 12th and lbth Avenues.
C. Proposal
- Project site is 16 acres subdivided into 39 lots for single family use
The sponsor indicates it is necessarq to change the road system due to top-
ography to satisfy the request of the County Engineer. The redesiga will
result in Kahuna Drive and Aloha Court having cul-de-sac's and that the lot
design will have to be chaaged accordingly. NOTE: No additional lots will be
created as a result of the redesign.

I. GENERAL INFORMATION
A. Loca ti on
Kahuna Hills lst Additlon is located on the south wall of the

February 29, 1980. The sponsor requested a Change of Condition
to be heard on June 26, 1980, however, due to improper legal
notification, it was continued to the July 25, 1980 Hearing.
C. Proposal
The sponsor is now requesting new changes of the original condition-
to provide for the redesign of the preliminary plat creating (2)
two additional lots, relaxation of setbacks from the right of
way, access to the lots, specific phasing approval and to allow
minor lot line modifications upon filing of the final plat. THe
sponsor is also requesting R.I.D. for construction of certain
roads; temporary improvements;
a change in roadvray improvements and the deletion of storm
drainage design. In addition, the sponsor has modified the
original request to reflect the redesign of the plat in regards
to the use of septic tank usage on (3) three lots (those being
Lots 9, 10 and 11, Block 1) rather than the request for septic
tank usage on (2) two lots as requested in the June Hearing.

landowners in the area. More specificaliy that the biliboard required
for adverfiiiing of the "change of conditions" indicated that the pubiic
hearing for this matter as 25-5-80 rather than the actual date of the
hearing which was26-6-80 .
D. SPECIAL CONDITIONS OR CONTIGENCIES APPLICABLE TO THIS
SU6DIVISION APPROVAL.
1. Those conditions as contained in the Findings and Order of the Hearing
Examiner Committee dated January 29th, 1980 for Kahuna Hills First

2. Amend condition #41 to include the statement except.
Individual on-site drainfield systems may be utilized on Lot 1, Block 1 and

I. GENERAL INFORMATION
.
A. Location
On the south wall of the Spokane Valley adjacent and east of Carnahan Road
bctween 12th and 16th Avenue.
B. Proposal
- 16 acres subdivided into 38 lots for single family use
- Lot frontage = 90'
- Lot size = 12,600 sq. ft.
C. Relationship to the Comprehensive Plan
The approved map of the Comprehensive Plan indicates residential usage of this
area, as well as all nearby surrounding lands, with no density desigaation.
D. Laad Use Aaalysis:
1. Existing Land Uses
The site is tree covered wlth slopes exceeding 15% and has outcroppings of
exposed bedrock. The area has experienced subdivision activity with
residential uses occurring to the south end west.
Directly south and adjacent to 16th Avenue is Riegal Heights Planned Unit
Development with single family resideaces on lots from 14,000 sq. ft. to over
h acre. Across Carnahan Road and south of 16th is the Kahuna Hills Addition
wlth single family uses oa lots of 18,000 sq. ft. and larger. Other
developments ia the area are generally along 16th Avenue to the southeast such
as Sloan's Addition and Heather Park Addition. ~
A triangular piece of property coatrolled by this applicant, located between ~
this proposal and Carnahan Road, has recently undergone a review for zone ~
change to Multi-Family Suburban with approximately 35 to 40 residential units.
This proposal was denied by the Hearing Examiner and is currently under appeal ~
to the Board o€ County Commissioaers.
Property dizectly east and north is vacant with a large gravel pit located on
the southeast corner of Eighth and Carnahaa Road.
2. Compatibility with Existing Land Uses
The area is developing for residential use, and the sponsor has proposed an
extension of that use The proposal preseats some difficulC site locatioas
due to slope and rock outcroppings, which may require some lot redesign to
facilitate individual house placement. The lots are generally smaller than
the adjacent hillside developments, but the use as proposed does appear to be
compatible to existing developments.

II. SPECIAL INFORMATION r
A. Circulation
The County Road Engineer has examined the proposed preliminary plat, providing
several conditions, including that sidewalks are required and that Rahuna
Drive be constructed as a collector arterial with a 35mrph design speed. These
conditions and the requirement for a stub road out to the northwest will
necesaitate a redesign of the plat. The sponsor has submitted a letter to the
staff objecting to the engineering conditions.
B. Sewage Disposal The Spokane County Health District has canditioned this proposal to include a
public sewer system and required that an on-site sewage management system is
required. Lots 15, 16, 17 and 18, Block 1 have been designated as a draia-
field site oa the preliminary plat map. The plat is situated peripheral to
the Spokane Valley Aquifer and the Health District has the following comments
on possible impacts:
Iropact Discussion
a. The plat sponsor has proposed 38 lots on 16 acres. Each lot is to be
served by a public water system and provlsions for a public sewer system
This raa.ses the question of significance of the impact on the groundwater
in the erea and possible alternatives for sewage disposal.
b. In the course of the conduct of the Army Corps study, Dr Todd considered
tppical soils, natural aad sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. Ia summary, he concluded that•
1. Ia normal precipitation years subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater
2. All the dissolved saits in sewage effluent will be carried to
the groundwater. However, bacteria and detergents
(phosphate portion) are mostly removed by the deep soil layer
above the groundwater aad "minor dissolved constituents such as
phosphates, which are known to react with soil particles, or
nitrates, which are taken up by the plant roots," will be less
than the total found in septic tank effluents.
3. The calculated results at the downstream end of groundwater
flow line indicate that the maximuin range of (dissolved) solids
coacentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater background
of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background
- - - The analytical results of the forecast impact of year
2020 when compared with the present impact, both measured in
terms of leachate volume and dissolved solids concentration,
indicate that the preseat impact on groundwater quality is
already a substantial proportion of the ult unate level.

c. Currently, results of chemical analysis show the total nltrogen content ~
of the groundwater as in the raage of 2.8 to 4.4 ppm. A projected ,
incremental increase using Dr. Todd's expected 8.6 percent would result ~
in a range of 3.04 to 4.78 ppm. Current Federal and State drinking water '
standards permit up to 10 ppm. '
~
d. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics:
1. Collector and central treatmeat systems discharging to surface
waters would require at least tertiary treatment and perhaps more to
obtain a permit for the discharge from the Department of Ecology.
These systems are not currently economically available for this
project.
2. rSealed systems, whether individual or community, depend on
evaporation for liquid removal. These systems require more land
area than a conventional subsurface draiafield. Some, such as
lagoons, have safety ha2ards associated with them aad relatively
' poor community acceptance. Laad, installation and operational cost
are generally more expensive than those for septic tanks and
drainfields.
C. Drainage
The County Engiueer reports that the preliminary storm drainage plan submitted
by the applicant indicates that on-site storm drainage provisions will
adequately handle surface water runoff. However, final construction plans
s6ould be reviewed and approved by both the County Engineer and Health
District prior to the final plat filing.
D. Water Sup2ly The proposal is located wlthin the recorded service area of Washington Water
~
Power Company. ~
The District advises the staff that adequate system capacity, and a desire oa
their part to serve, exists for the provisioa of water for domestic, fire and
r
irrigation uses. ;
~
E Fire Protectioa
The proposal is situated within the recorded service area of Fire District #1.
The Fire District staff tequests that the Hearing Examiner Committee require
mains and hydrants of sufficlent size for fire protection as a coadition of
final plat approval. The District also requests that they be allowed to
review aod approve final fire flows and water plans.
F. Schools
Proposal lies within the boundaries of School District #51.

III. ZONING ANALYSIS
The proposal and much of the pr4Perty between 12th and 18th Avenue is zoned Agri-
cultural Suburbaa. Kahuna Hills and Sloan's Addition ere zoned Single Family
Residential while tbe Riegal Heights PUD was left as Agricultural zoning. Given
the proposed use and lot size it appears consistent to zoae this proposal to Siagle ~
Family if approved. Some redesign of the plat will be necessary particularly Lots
10 and 11, Block 2 to allow single family frontege requirements to be met for
- cul-de-sac lots.
IV. ENVIRONMENTAL REVIEW
An Envlronmental Checklist was submitted by the spoasor and has been reviewed by
the Plaaning staff. No sigaificant adverse environmental impacts were judged to
exist.
Slight adverse environmental i.mpacts were identified on the checklist in the
following categories: earth; air; water; flora; fauna; noise; light and glare; '
iand use; population; housing; transportation/circulation; public services;
utilities; and energy. ~

The Planning Director issued a proposed Declaration of Non-Significance, and it was
circul8ted to other agencies of jurisdiction. ~

The '208' Study has forwarded the following comments under the SEPA Environmental
Review. The responses are based oa problem areas addressed in the Water Quality
Management Plaa.

2. This proposal includes too little or no open space to accownodate use of
grassed percolation areas for stormwater runoff disposal.
3. This proposal does not mention the Recoaunended Action of double plumbing and

satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproductioa.
The purveyor will also certify prior to the filing of the fiaal plat on a copy
of said water plan that appropriate contractual arrangements have been made
with the glat sponsor for construction of the water system, in accordance with
the approved plan, and in accordance with a time schedule. The time schedule
will provide, in any case, for comrpletion of the water system and inspection
by the appropriate health authorities prior to application for building
permits within the plat. The contractual arrangements will include a
provision holding Spokane County and the purveyor harmless from claims by any
lot purChaser refused a building permit due to the failure of the plat sponsor
to satisfactorily complete the approved water system.

The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities aad the local
fire district and purveyor will be installed wlthin this plat, and the
subdivider will provide for individual domestic water service as well es fire
protection to each lot prior to sale of each lot.
~ That a certificate of title be furnished the Planning Department prior to the
filing of the final plat.
8. That the prelimiaary plat be given conditional approval to Februacy 1, 1981

grades shown on the approved construction plans and that all disturbed
monuments have been replaced.
14. No construction work is to be performed within the existing or proposed
public right-of-way untll a permit has been issued by tfie County

4!e have encountered unexpected rock,,r.underground springs, incomplete engineering
data. Orainage posed a major problem, necessitating extensive testing. Two
redesigns of the plat have already taken place because of the severe steepness
and the inability of ineeting engineers requirements for road grades and inter-
sections. Seemingly insurmountable problems are about to be overcome to hook up
with the City sewer. I have changed engineers, which caused delays. Staff
cutbacks not only in County but subcontractors have caused material, labor and
time delays. My excavating subcontractor has gone bankrupt, creating additional
problems. I have run out of space, but could go on.
