IN THE MATTER CONCERNING the Spokane County Planning Commission's
recorrmendation to deny a zone change, Mining Zone, Class III, to
Restricted Industrial on property located in Section 23, Township
25 N, Range 43, E.W M- Kuney, Applicant,
The Board of Spolcane County Commissioners upheld the recommendations
of the Spokane County Planning Commission, as contained in their
minutes, dated December 8, 1972, which denied the aforementioned
zone change and found the reasons expressed by the Commisslon to
be sufficient and controlla.ng
The Board condita.oned this decision uPon receipt of a legal opinion
from the Spokane County Prosecutor stating the Notice of Hearing was
valid, said condition being made a part of this decision because
neither the applicant nor his representative were present at the
hea ring
The Board further stated that upon receint of this opinion ana
said opinion indlcating legal Notice of Hearing was given, the
Board s action would be final

Gentlemen:
Uiider date of December 18, 1972, a Notice of Appeal was given to you from
action of the Spokane P(anning Commission denying the above indicated zone
change.
I am told that a hearing was held before the Board of County Commi ssi oners on
December 18, 1972. I wish to state that I did not receive notice of that meeting.
I am leaving Spol<ane and will not retum until Monday, January 29, 1973, but
I w i I I be happy at that ti me to furn i sh to you a sworn af f idavi t stati ng that a recei pt
of Notice of Hearing was never received in this office at the above address. I am
told by Mr. Jack R. Dean, attorney, that he did not receive such a notice and that
he too would be happy to f«rnish a sworn affidavit to that effect.
I respectfully request that the matter be reopened and that we be granted tfle rigflt
to appear before the Board because of the failure of a receipt of the Notice on our
behalf.

The adverti.sed property is situated within a mining district which extends
from Havana to Stanley Streets and from 8th to 14th Avenues The applicant
proposed to mine to grade a 10 acre site west of Carnahan Road between
Tenth and Twelfth Avenues for a contractor's repair and storage yard, and
thus eliminate some of the extractive operatfons in the area Residents to
the soufih of the proposal expressed the hope that the mining activities
would be phased out, however, they were not amenable to having the area
replaced by light industrial uses

1 The Planning Commfssion is of the opinion that the reclassification
would set a precedent for Restricted Industrial zoning for the area,
thereby establishing a new industra.al district in the Spokane
Valley The Commission notes that the Comprehensive Plan does
nofi anticfpate light industrial development for the area although
the established mining activities are acknowledged
2 The Commission nct es that although the advertised area would not
significantiy contribute to traffic congestion in the area, a larger
industrial area would not have the benefit of rail or ma)or arterial
access
3 The Commission is of the opinion that the entire mining district
should be carefully considered by the Commission for alternative
land uses rather than considering individual sites which could
establish precedents for the district
